o razglasitvi zakona 6 ratifikaciji sporazuma o sodelovanju v izobraževanju, kulturi in znanosti med Vlado Republike Slovenije in Vlado Ljudske republike Kitajske
Razglašam zakon o ratifikaciji sporazuma o sodelovanju v izobraževanju, kulturi in znanosti med Vlado Republike Slovenije in Vlado Ljudske republike Kitajske, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 25. januarja 1994.

ZAKON
O RATIFIKACIJI SPORAZUMA O SODELOVANJU V IZOBRAŽEVANJU, KULTURI IN ZNANOSTI MED
VLADO REPUBLIKE SLOVENIJE IN VLADO LJUDSKE REPUBLIKE KITAJSKE
1. člen
Ratificira se sporazum o sodelovanju v izobraževanju, kulturi in znanosti med Vlado Republike Slovenije in Vlado Ljudske republike Kitajske, podpisan v Ljubljani 13. septembra 1993.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
SPORAZUM
O SODELOVANJU V IZOBRAŽEVANJU, KULTURI
IN ZNANOSTI MED VLADO REPUBLIKE
SLOVENIJE IN VLADO LJUDSKE REPUBLIKE
KITAJSKE
Vlada Republike Slovenije in Vlada Ljudske republike Kitajske (v nadaljevanju: pogodbenici) sta se, z namenom, da bi pospešili sodelovanje v izobraževanju, kulturi in znanosti in v prepričanju, da tako sodelovanje vodi k poglabljanju obojestranskega razumevanja in odnosov na različnih ravneh med državama, odločili, da skleneta ta sporazum pod naslednjimi pogoji:
1. člen
Pogodbenici se strinjata, da bosta pospeševali sodelovanje v izobraževanju, kulturi in znanosti in spodbujali neposredno sodelovanje med kulturnimi, izobraževalnimi, znanstvenimi in raziskovalnimi ustanovami.
Pogodbenici bosta spodbujali izmenjavo profesorjev, študentov, znanstvenikov, strokovnjakov in umetnikov.
2. člen
Pogodbenici se strinjata, da si bosta po svojih zmožnostih in v okviru razpoložljivih sredstev podeljevali štipendije za študij in strokovno usposabljanje.
3. člen
Pogodbenici se bosta medsebojno obveščali o možnostih za učenje jezika druge države in bosta v ta namen spodbujali svoje učitelje in študente, da bodo obiskovali poletne jezikovne tečaje v drugi državi.
4. člen
Pogodbenici soglašata, da bosta proučili možnost za sklenitev sporazuma o medsebojnem priznavanju akademskih stopenj, diplom in naslovov, ki jih je podelila druga država.
5. člen
Pogodbenici soglašata, da bosta izmenjave in sodelovanje v kulturi in umetnosti izvajali na naslednje načine:
1. izmenjava obiskov pisateljev in umetnikov
2. izmenjava gostovanj umetniških skupin
3. organizacija kulturnih in umetniških razstav v državi druge pogodbenice.
Pogodbenici soglašata, da bosta pospeševali izmenjave in sodelovanje med muzeji in knjižnicami obeh držav.
Pogodbenici soglašata, da bosta po svojih zmožnostih izmenjavali knjige, revije in drugo gradivo o kulturi in umetnosti.
6. člen
Pogodbenici bosta spodbujali sodelovanje na področju naravne in kulturne dediščine:

Pogodbenici soglašata, da bosta krepili stike in sodelovanje med športnimi organizacijami obeh držav ter da
bosta v skladu s potrebami in možnostmi spodbujali navezavo neposrednih stikov, omogočali prijateljske obiske, tekmovanja in izmenjavo športnih tehnik med atleti, trenerji in športnimi ekipami ter izmenjave na področju športa med mladimi obeh držav.
8. člen
Pogodbenici soglašata o izmenjavi in sodelovanju na področju novinarstva, založništva, radijskih in televizijskih oddaj in kinematografije.
9. člen
Vsaka od pogodbenic bo v skladu z zakoni in predpisi, ki veljajo na njenem ozemlju, drugi pogodbenici podelila vse ugodnosti za vstop, bivanje in odhod oseb ter za uvoz gradiva in opreme, potrebne za izvajanje programov izmenjave, ki bodo dogovorjeni v skladu s tem sporazumom.
10. člen
Pogodbenici bosta sestavili letne in dvoletne programe za sodelovanje v izobraževanju in kulturi z namenom uresničevanja tega sporazuma ter določili finančne načrte za te programe. Programe bodo izdelale pooblaščene ustanove obeh držav.
11. člen
Ta sporazum prične veljati potem, ko se pogodbenici medsebojno obvestita, da so zaključeni njuni ustrezni pravni postopki.
12. člen
Ta sporazum velja pet let in se samodejno obnavlja za nadaljnja petletna obdobja, če ga nobena od pogodbenic ne odpove po diplomatski poti s pisnim obvestilom drugi pogodbenici šest mesecev pred iztekom njegove veljavnosti.
13. člen
Ta sporazum je sestavljen v dveh izvodih v Ljubljani dne 13. septembra 1993 v slovenskem, kitajskem in angleškem jeziku, pri čemer so vsa tri besedila enako verodostojna. V primeru razlik v tolmačenju velja angleško besedilo.

AGREEMENT
ON COOPERATION IN EDUCATION, CULTURE
AND SCIENCE BETWEEN THE GOVERNMENT OF
THE REPUBLIC OF SLOVENIA AND THE
GOVERNMENT OF THE PEOPLE'S
REPUBLIC OF CHINA
The Government of the Republic of Slovenia and the Government of the People's Republic of China (hereinafter referred to as the two Contracting Parties), with a view to promoting cooperation in the fields of education, culture and science, and convinced that such cooperation is conducive to the deepening of mutual understanding and relations at various levels between the two countries, have decided to conclude the present Agreement under the following terms:
Article 1
The Contracting Parties agree to facilitate cooperation in the fields of education, culture and science, and shall encourage direct cooperation between the institutions in the fields of culture, education, science and research.
The contracting parties shall encourage exchanges of professors, students, scientists, specialists and artists.
Article 2
The Contracting Parties agree, each within its capability and the scope of its means, to grant scholarships to the other side for study and special training.
Article 3
The Contracting Parties shall notify each other about the possibility of learning the language of the other country, and shall, to that end, support their teachers and students to attend summer language courses held in the other country.
Article 4
The Contracting Parties agree to study the possibility for the conclusion of an agreement for mutual recognition of academic degrees, diplomas and titles granted by the other country.
Article 5
The Contracting Parties agree to have exchange and cooperation in the fields of culture and arts in the following ways:
1. Exchange visits of writers and artists.
2. Exchange performing tours of troupes of artists.
3. Hold exhibitions on culture and art in each other's country.
The Contracting Parties agree to facilitate exchanges and cooperation between museums and libraries of the two countries.
The Contracting Parties agree, each within its capability to exchange books, magazines, and other materials on culture and art.
Article 6
The Contracting Parties shall stimulate cooperation in the field of natural and cultural heritage.
Article 7
The Contracting Parties agree to strengthen contacts and cooperation between sports organisations of the two
countries, and to encourage, according to needs and possibilities, the establishment of their direct contacts and facilitate friendly visits, competitions and exchanges of sports techniques between the athletes, coaches and sport teams, as well as exchanges in sports between the youth of the two countries.
Article 8
The Contracting Parties agree to have exchanges and cooperation in the fields of journalism, publishing, radio broadcasting, television and cinema.
Article 9
Each party shall, within the terms of the laws and regulations in force in its territory, accord to the other party every reasonable facility for the entry, stay and departure of persons, and for the importation of the material and equipment necessary for carrying out the programmes of exchange which may be established in accordance with this Agreement.
Article 10
The Contracting Parties shall make annual or two-years programs for cooperation on education and culture for the purpose of implementing the present Agreement, and stipulate financial arrangements for the programs. The programs shall be worked out by the authorized organisations of the two countries.
Article 11
The present Agreement shall enter into force upon notification to each other by the contracting parties after the completion of their existing legal procedure.
Article 12
The present Agreement shall be valid for a period of five years, renewable automatically for successive periods of five years, unless either party requests the termination by sending a written notice through diplomatic channels to the other party six months prior to the date of expiration.
Article 13
This Agreement is done in duplicate in Ljubljana on 13th day of September, 1993, in the Slovene, Chinese and English languages, the three texts being equally authentic. In case of the differences in interpretation, the English text shall prevail.

3. člen
Za izvajanje tega sporazuma skrbijo ministrstva, pristojna za šolstvo in šport, za kulturo in za znanost in tehnologijo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
