O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE V IZOBRAŽEVANJU, KULTURI IN ZNANOSTI
Razglašam Zakon o ratifikaciji Sporazuma o sodelovanju med Vlado Republike Slovenije in Vlado Republike Poljske v izobraževanju, kulturi in znanosti, ki ga je sprejel Državni zbor Republike Slovenije na seji dne 20. junija 1994.

ZAKON
O RATIFIKACIJI SPORAZUMA O SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE V IZOBRAŽEVANJU, KULTURI IN ZNANOSTI
1. člen
Ratificira se Sporazum o sodelovanju med Vlado Republike Slovenije in Vlado republike Poljske v izobraževanju, kulturi in znanosti, podpisan v Varšavi 14. februarja 1994.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
SPORAZUM
O SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE POLJSKE V IZOBRAŽEVANJU, KULTURI IN ZNANOSTI
Vlada Republike Slovenije in Vlada Republike Poljske (v nadaljevanju: pogodbenici) sta:
v želji, da bi še naprej spodbujali izobraževalne, kulturne in znanstvene stike med Slovenijo in Poljsko;
prepričani, da ima sodelovanje v izobraževanju, kulturi in znanosti med dvema državama pomembno vlogo pri zbliževanju slovenskega in poljskega naroda ter da prispeva k boljšemu razumevanju;
odločeni, da bosta uresničevali načela Helsinške sklepne listine, Pariške listine za novo Evropo ter drugih dokumentov Konference o varnosti in sodelovanju v Evropi, vključno z dogovori, ki so bili sklenjeni na Krakovskem simpoziju o kulturni dediščini držav udeleženk Konference o varnosti in sodelovanju v Evropi,
sklenili:
1. člen
Pogodbenici bosta razvijali medsebojno sodelovanje v izobraževanju, kulturi in znanosti in bosta v ta namen spodbujali neposredno sodelovanje in stike med univerzami ter drugimi izobraževalnimi, kulturnimi, znanstvenimi in raziskovalnimi ustanovami kakor tudi državnimi, družbenimi in zasebnimi organizacijami, da bi dosegli cilje tega sporazuma.
2. člen
Pogodbenici bosta podpirali izmenjavo učencev, študentov, stažistov, znanstvenih in raziskovalnih delavcev kakor tudi učiteljev z namenom izobraževanja, nadaljnjega študija, stažiranja in izpopolnjevanja ter specializacij.
3. člen
Pogodbenici bosta posvetili posebno pozornost razvoju in izpopolnjevanju učenja jezika druge pogodbenice in bosta v ta namen:
– izmenjavali lektorje, učitelje jezika in književnosti, ki bi delali na univerzah in drugih visokošolskih ustanovah;
– opremili centre ter katedre za učenje jezika druge pogodbenice s programi, priročniki in drugimi učnimi pripomočki;
– sprejemali učitelje, predavatelje in študente na poletne jezikovne tečaje, ki jih organizirata obe strani.
4. člen
Pogodbenici bosta še naprej:
– podpirali izmenjavo svojih znanstvenikov in raziskovalcev, učiteljev, študentov in učencev ter
– razširili njihovo udeležbo na seminarjih, konferencah in znanstvenih kongresih, ki jih organizira druga pogodbenica.
Povabili bosta predstavnike druge pogodbenice, da bodo posredovali referate in predavanja in se udeležili drugih projektov mednarodnega značaja, ki so organizirani v obeh državah.
5. člen
Pogodbenici se strinjata, da bo pred sklenitvijo sporazuma med Vlado Republike Slovenije in Vlado Republike Poljske o medsebojnem priznavanju in enakovrednosti šolskih spričeval in diplom, univerzitetnih diplom in znanstvenih nazivov in stopenj veljal sporazum, podpisan 18. 7. 1979 med Vlado Socialistične federativne republike Jugoslavije in Vlado Ljudske republike Poljske, o medsebojnem priznavanju in enakovrednosti šolskih spričeval in univerzitetnih diplom, pridobljenih v eni ali drugi državi.
Pogodbenici si bosta prizadevali za sklenitev sporazuma o medsebojnem priznavanju enakovrednosti dokumentov, ki potrjujejo pridobitev strokovne izobrazbe.
6. člen
Pogodbenici bosta sodelovali pri analizi vsebine zgodovinskih in zemljepisnih učbenikov in bosta v ta namen ustanovili slovensko-poljski mešani odbor.
7. člen
Pogodbenici bosta podpirali razvoj neposrednega sodelovanja in izmenjave med mladinskimi organizacijami, združenji in ustanovami.
8. člen
Pogodbenici bosta podpirali razvoj sodelovanja v telesni vzgoji in športu.
9. člen
Pogodbenici bosta spodbujali zanimanje za kulturno dediščino in sodobne umetnostne dosežke druge pogodbenice.
Pogodbenici bosta pospeševali medsebojno boljše poznavanje kulture druge pogodbenice, s tem da bosta spodbujali neposredno sodelovanje posameznikov ter izmenjavo na vseh področjih kulture, zlasti s:
– prevajanjem in izdajanjem književnih del avtorjev druge pogodbenice;
– izvajanjem in širjenjem glasbenih, gledaliških in filmskih del;
– umetniškimi razstavami;
– izmenjavami umetnikov in umetniških skupin;
– udeležbo predstavnikov na festivalih, tekmovanjih, revijah, konferencah in mednarodnih srečanjih kulturne narave, ki jih organizira druga pogodbenica.
10. člen
Pogodbenici si bosta prizadevali za varovanje celovitosti narodne kulturne dediščine obeh strani in za ohranjanje ter varovanje spomenikov, ki predstavljajo kulturne vrednote ene pogodbenice na ozemlju druge pogodbenice.
Pogodbenici bosta podpirali sodelovanje v varstvu naravne in kulturne dediščine.
11. člen
Pogodbenici bosta v največji možni meri podpirali in olajševali sodelovanje med arhivi, muzeji in knjižnicami, s tem da bosta znanstvenikom in raziskovalcem druge države olajšali dostop do vseh gradiv.
Take olajšave bodo zagotovljene na skupni podlagi ter v skladu z zakoni in predpisi, ki veljajo v drugi državi in o katerih se bodo sporazumele specializirane ustanove.
12. člen
Pogodbenici si bosta prizadevali za podpis sporazuma med Vlado Republike Slovenije in Vlado Republike Poljske o sodelovanju v znanosti in tehnologiji.
13. člen
Pogodbenici si bosta prizadevali za sklenitev sporazuma o znanstvenem sodelovanju med Slovensko akademijo znanosti in umetnosti in Poljsko akademijo umetnosti ter Poljsko akademijo znanosti.
14. člen
Pogodbenici bosta sodelovali pri zdravstvenem varstvu na podlagi posebnih sporazumov.
15. člen
Pogodbenici bosta pospeševali razširitev in raznovrstnost turističnih izmenjav.
16. člen
Pogodbenici bosta zagotovili primerno in učinkovito varstvo intelektualne lastnine kot tudi primerne načine in postopke za spoštovanje pravic do intelektualne lastnine, ki ustrezajo ravni varstva, veljavnega v državah članicah Evropske gospodarske skupnosti. Posebni ukrepi in pogoji takšnega varstva bodo podrobno določeni v posebnem sporazumu med obema stranema.
17. člen
Vsaka pogodbenica bo v skladu z zakoni in predpisi, ki veljajo na njenem ozemlju, olajšala vstop, bivanje in izstop oseb ter uvoz gradiva in opreme, potrebne za programe izmenjave, o katerih se bo možno dogovoriti.
18. člen
Pogodbenici bosta podpirali dejavno sodelovanje z UNESCO in drugimi mednarodnimi organizacijami za izobraževanje, kulturo, znanost in šport.
19. člen
Pogodbenici bosta podpirali medsebojen prost pretok informacij o političnem, družbenem, kulturnem in znanstvenem delovanju druge države, z namenom, da zagotovita objektivne in obširne informacije.
S tem namenom si bosta pogodbenici prizadevali za razvoj sodelovanja med radijskimi in televizijskimi ustanovami, agencijami in časopisnimi hišami, uredništvi, združenji in novinarskimi organizacijami.
20. člen
Z namenom, da bi uresničili ta sporazum, bosta pogodbenici izdelali periodične programe sodelovanja, v katerih bosta podrobno določili posebne naloge kot tudi organizacijske in finančne pogoje.
21. člen
Pogodbenici bosta podpirali neposredno sodelovanje med vladnimi uradi, ustanovami in organizacijami obeh držav, ki pokrivajo namene in vsebino tega sporazuma.
22. člen
Ta sporazum se sprejme v skladu z zakonodajo vsake od pogodbenic in bo pričel veljati po izmenjavi not. Pričel bo veljati na dan prejema kasnejše note.
Ta sporazum se sklene za pet let in se samodejno obnavlja vsakokrat za enako obdobje, kolikor nobena od pogodbenic pisno ne obvesti druge pogodbenice o nameri odpovedi tega sporazuma vsaj šest mesecev pred potekom njegove veljavnosti.
Kljub odpovedi tega sporazuma v skladu z določbami tega člena bo vsak program izmenjave, dogovor ali projekt, ki je bil sklenjen po tem sporazumu, veljal do njegove izpolnitve.
Sestavljeno v Varšavi dne 14. februarja 1994 v dveh izvirnikih v slovenskem, poljskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna.
V primeru različnih razlag velja angleško besedilo.

AGREEMENT
ON COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF POLAND IN THE FIELDS OF EDUCATION, CULTURE AND SCIENCE
The Government of the Republic of Slovenia and the Government of the Republic of Poland (hereinafter referred to as: "The Contracting Parties"):
– desirous to promote further educational, cultural and scientific relations between Slovenia and Poland;
– convinced that the educational, cultural and scientific cooperation between the two countries plays an important role in the rapprochement between the Slovenian and the Polish nations, and that it contributes to better mutual understanding;
– determined to implement the principles of the Helsinki Final Act, Charter of Paris for a New Europe and other documents of the Conference on Security and Cooperation in Europe, including the agreements reached during the Cracow Symposium on Cultural Heritage of the Participating States in the Conference on Security and Cooperation in Europe,
have agreed on the following:
Article 1
The Contracting Parties shall develop mutual cooperation in the fields of education, culture and science, and shall, for this purpose, promote direct cooperation and contracts between universities, other educational, cultural, scientific and research institutions as well as state, social and private organizations – aiming at achieving the purposes of this Agreement.
Article 2
The Contracting Parties shall support the exchange of pupils, students, interns, scientific and research workers as well as teachers in the aim of education, the pursuing of studies, internships and the improving of qualifications and specializations.
Article 3
The Contracting Parties shall pay special attention to the development and improvement of teaching of the language of the other Party, and with this aim they shall:
– exchange lecturers, language and literature teachers who would work in universities and other institutions of higher education;
– equip centres and chairs for teaching the other Party's language with programmes, manuals and other means of instruction;
– accept teachers, lecturers and students for summer language courses organized by both Sides.
Article 4
The Contracting Parties shall proceed:
– to support the exchange of their scientific and research workers, teachers, students and pupils and
– to widen their participation in seminars, conferences and scientific congresses organized by the other Party.
They will invite representatives of their other Party to deliver papers and lectures and to participate in other undertakings of international character organized in both countries.
Article 5
The Contracting Parties have agreed that before concluding an agreement between the Government of the Republic of Slovenia and the Government of the Republic of Poland on the mutual recognition and equal validity of school certificates and diplomas, university diplomas, scientific titles and degrees the Agreement signed on the 18th July 1979 between the Government of the Socialist Federative Republic of Yugoslavia and the Government of the Polish People's Republic on the mutual recognition of the equal validity of school certificates and university diplomas obtained in either country will remain in force.
The Contracting Parties shall work towards the securing of an agreement on the mutual recognition of equal validity of documents certifying the obtaining of professional qualifications.
Article 6
The Contracting Parties shall cooperate in the field of analysing the content of history and geography handbooks, and to this effect shall establish a Slovenian -Polish Mixed Committee.
Article 7
The Contracting Parties shall support the development of direct cooperation and exchange between youth organizations, associations and institutions.
Article 8
The Contracting Parties shall support the development of cooperation in the field of physical education and sports.
Article 9
The Contracting Parties shall promote the interest in cultural heritage and in the modern cultural achievements of the other Party.
The Contracting Parties shall promote mutual acquiring of better knowledge of the other Party's culture by stimulating direct and individual cooperation and exchange in all fields of culture, especially through:
– translating and publishing of literary works by the authors of the other Party;
– performing and disseminating works of music, theatre and film;
– art exhibitions;
– exchange of artists and artistic groups;
– participation of representatives in festivals, competitions, reviews, conferences and international meetings of cultural character organized by the other Party.
Article 10
The Contracting Parties shall make efforts to protect the integrality of the national cultural heritage of the two Parties, and to conserve and preserve on their territories objects which are monuments and which constitute cultural values of the other Party.
The Contracting Parties shall stimulate cooperation in protection of natural and cultural heritage.
Article 11
The Contracting Parties shall support and facilitate the widest possible cooperation between their archives, museums and libraries, by facilitating the access of scientists and researchers of the other country to the funds of the respective institutions.
Such facilities shall be granted on a mutual basis and in accordance with the laws and regulations in force in the other country, and shall be agreed upon between the specialized institutions.
Article 12
The Contracting Parties shall undertake activities aiming at the signing of an Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Poland on cooperation in the field of science and technology.
Article 13
The Contracting Parties shall favour the reaching of an agreement on scientific cooperation between the Slovenian Academy of Sciences and Arts and the Polish Academy of Sciences and the Polish Academy of Abilities.
Article 14
The Contracting Parties shall cooperate in the field of health protection on the basis of separate direct agreements.
Article 15
The Contracting Parties shall promote the extension and diversification of tourist exchange.
Article 16
The Contracting Parties shall ensure the appropriate and effective protection in the field of intellectual property as well as the appropriate means and procedures for the respecting of the rights of intellectual property which correspond to the level of protection in force in the Member States of the European Economic Community. Specific measures and conditions of such protection will be detailed in a separate agreement between both Parties.
Article 17
Each Party shall, within the terms of laws and regulations in force in its territory, accord to the other Party every reasonable facility for the entry, stay and departure of persons, and for the importation of the material and equipment for carrying out the programmes of exchange which may be established in accordance with this Agreement.
Article 18
The Contracting Parties shall promote active cooperation within UNESCO and other international organizations in the fields of education, culture, science and sports.
Article 19
The Contracting Parties shall support the mutual, free flow of information on political, social, cultural and scientific life of the other country, with the aim of providing objective and comprehensive information.
With this aim the Contracting Parties shall act jointly for the development of cooperation between radio and television institutions, agencies and press publishers, editors' offices, associations and journalist organizations.
Article 20
With the aim of implementation of this Agreement the Contracting Parties shall work out periodic executive programmes detailing specific undertakings as well as their organizational and financial conditions.
Article 21
The Contracting Parties shall support direct cooperation between governmental offices, institutions and organizations of the two countries covering the aims and contents of this Agreement.
Article 22
This Agreement shall be accepted according to the law of each of the Contracting Parties and shall enter into force upon the exchange of notes.
It shall take effect on the day of receiving the posterior note.
This Agreement shall remain in force for the period of five years and shall be automatically renewed for the same period each time, unless either Contracting Party notifies the other Contracting Party in writing of its intention to terminate the present Agreement at least six months prior to its expiry.
Notwithstanding the termination of the present Agreement in accordance with the above provisions of this Article, any programme of exchange, arrangement or project which has been concluded under it, but which has not been completed shall remain valid until its completion.
Done at Warsaw, on the 14th of February 1994 in two original copies, in the Slovene, Polish and English languages, all texts being equally authentic.
In case of differences in interpretation, the English text will be authoritative.

3. člen
Za izvajanje sporazuma skrbijo ministrstvo, pristojno za zunanje zadeve, ministrstvo, pristojno za šolstvo in šport, ministrstvo, pristojno za kulturo, ter ministrstvo, pristojno za znanost in tehnologijo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
