Na podlagi tretjega odstavka 63. člena Zakona o zunanjih zadevah (Uradni list RS, št. 1/91-I) izdaja Vlada Republike Slovenije
UREDBO
O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO LJUDSKE REPUBLIKE KITAJSKE O UKINITVI VIZUMOV ZA DIPLOMATSKE IN SLUŽBENE POTNE LISTE
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Ljudske republike Kitajske o ukinitvi vizumov za diplomatske in službene potne liste, podpisan v Pekingu 1. junija 1994.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku* glasi:
SPORAZUM
MED VLADO REPUBLIKE SLOVENIJE IN VLADO LJUDSKE REPUBLIKE KITAJSKE O UKINITVI VIZUMOV ZA DIPLOMATSKE IN SLUŽBENE POTNE LISTE
Da bi nadalje razvijali prijateljske odnose med Republiko Slovenijo in Ljudsko republiko Kitajsko ter omogočili lažje stike med državljani obeh držav, sta se Vladi Republike Slovenije in Ljudske republike Kitajske (v nadaljevanju imenovani »pogodbenici) dogovorili naslednje:
1. člen
Državljani Republike Slovenije, ki imajo veljavne diplomatske ali službene potne liste Republike Slovenije, ter državljani Ljudske republike Kitajske, ki imajo veljavne diplomatske ali službene potne liste Ljudske republike Kitajske, in njihovi mladoletni otroci, ki so vpisani v njihove potne liste, so oproščeni pridobitve vizuma za vstop na ozemlje druge pogodbenice, prehod preko njenega ozemlja in bivanje na njem za obdobje, ki ni daljše od 90 dni.
2. člen
1. Državljani ene ali druge pogodbenice, ki imajo veljavne diplomatske ali službene potne liste in ki opravljajo uradne dolžnosti na ozemlju druge pogodbenice kot člani diplomatske misije, konzularnega predstavništva ali mednarodnih organizacij, so v času opravljanja svojih dolžnosti oproščeni pridobitve vizuma za vstop ali odhod z ozemlja druge pogodbenice.
2. Določila prvega odstavka tega člena veljajo tudi za zakonce in mladoletne otroke zgoraj omenjenih oseb.
3. člen
Državljani ene ali druge pogodbenice, omenjeni v 1. in 2. členu tega sporazuma, ki nameravajo bivati na ozemlju druge pogodbenice več kot 30 dni, morajo prositi pristojne organe druge pogodbenice po prihodu na njeno ozemlje za dovoljenje za bivanje v skladu z njenimi predpisi.
4. člen
Državljani ene ali druge pogodbenice iz 1. in 2. člena tega sporazuma morajo vstopiti na ozemlje druge pogodbenice, potovati preko tega ozemlja ali ga zapustiti skozi pristanišča, ki so odprta za mednarodne potnike, ter izpolniti potrebne formalnosti v skladu z ustreznimi predpisi pristojnih organov zadevne države.
5. člen
Ta sporazum ne omejuje pravice ene ali druge pogodbenice, da nezaželenim osebam ali nesprejemljivim državljanom druge pogodbenice prepovedo vstop na svoje ozemlje ali prekinejo njihovo bivanje na svojem ozemlju brez navedbe razlogov za tako ravnanje.
6. člen
Vsaka od pogodbenic lahko deloma ali v celoti začasno razveljavi ta sporazum iz razlogov javnega reda, državne varnosti in ljudskega zdravja. Vendar pa je treba drugo pogodbenico po diplomatski poti ustrezno obvestiti o taki odločitvi, še preden začne izvajati to začasno razveljavitev ali jo ukine.
Dodatne določbe ali dopolnitve tega sporazuma so možne z izmenjavo not obeh pogodbenic po opravljenih posvetovanjih.
7. člen
Pogodbenici bosta pravočasno po diplomatski poti izmenjali vzorce svojih potnih listov iz 1. člena, še preden bo ta sporazum začel veljati. Vsaka od pogodbenic bo v primeru kakršne koli spremembe v obliki svojih potnih listov o tem po diplomatski poti obvestila drugo pogodbenico 30 dni pred njihovo uvedbo in ji poslala vzorce novih potnih listov.
8. člen
Ta sporazum ostane v veljavi za nedoločen čas. Če ena od pogodbenic želi ukiniti ta sporazum, mora o tem obvestiti drugo stran v pisni obliki po diplomatski poti, in ta sporazum bo prenehal veljati na 90. dan po datumu takega obvestila.
9. člen
Sporazum o medsebojni oprostitvi vizumov in pristojbin za vizume med Vlado bivše Socialistične federativne republike Jugoslavije in Vlado Ljudske republike Kitajske z dne 19. aprila 1979 bo nehal veljati med Vladama Republike Slovenije in Ljudske republike Kitajske z dnem, ko bo začel veljati ta sporazum.
10. člen
Ta sporazum bo začel veljati 30 dni po datumu njegovega podpisa.
Sestavljeno v Pekingu dne 1. junija 1994 v dveh izvodih v slovenskem, kitajskem in angleškem jeziku, pri čemer so vsa tri besedila enako verodostojna. V primeru različnih interpretacij velja angleški jezik.

AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE PEOPLE'S REPUBLIC OF CHINA ON MUTUAL EXEMPTION OF VISAS FOR DIPLOMATIC AND SERVICE PASSPORTS
In order to further develop the friendly relations between the Republic of Slovenia and the People's Republic of China, and facilitate the intercourse of the citizens of both countries, the Government of the Republic of Slovenia and the Government of the People's Republic of China (hereinafter referred to as the Contracting Parties), have reached agreement on the following points:
Article 1
Citizens of the Republic of Slovenia, who are holders of a valid diplomatic or service passport of the Republic of Slovenia, and citizens of the People's Republic of China, who are holders of a valid diplomatic or service passport of the People's Republic of China, and their minor children who share the same passport with them, shall be exempted from visa requirements for entry into, transit through and stay in the territory of the other Contracting Party for a period not exceeding 90 days.
Article 2
1. Citizens of either Contracting Party, who are holders of a valid diplomatic or service passport exercising official functions in the territory of the other as members of a diplomatic mission, consular office or international organization shall, during their tenure of office be exempted from visa requirements for entry into or exit from the territory of the other Contracting Party.
2. The provisions of paragraph 1 of this article shall be applicable to the spouses and minor children of the above-mentioned personnel.
Article 3
Citizens of either Contracting Party referred to in Articles 1 and 2 of this Agreement, who plan to stay in the territory of the other Contracting Party for more than 30 days, shall apply to the competent authorities of the other Contracting party for a resident permit upon entry into the latter's territory in accordance with the relevant regulations of the latter.
Article 4
Citizens of either Contracting Party referred to in Articles 1 and 2 of this Agreement shall enter into, exit from or transit through the territory of the other Contracting Party through ports open to international travellers and complete necessary formalities in accordance with the relevant regulations of the competent authorities of the receiving country.
Article 5
This Agreement does not restrict the right of either Contracting Party to prohibit personae non grata or unacceptable citizens of the other Contracting Party from entering its territory or to terminate their stay in its territory without citing reasons therefor.
Article 6
Either Contracting Party may temporarily suspend this Agreement partly or wholly on grounds of public order, state security and public health. However, the other party shall be duly notified of such a decision through diplomatic channels, before the suspension is implemented or released.
Additional clauses or amendments to this Agreement may be made by the Contracting Parties after consultation through an exchange of notes.
Article 7
The Contracting Parties shall exchange, in a timely fashion, through diplomatic channels, samples of their passports referred to in Article 1 before this Agreement enters into force. Either Contracting Party shall inform the other Contracting Party of any change to the form of its passports through diplomatic channels 30 days before its introduction and furnish it with samples of new passports.
Article 8
This Agreement shall remain valid for an indefinite period of time. If either Contracting Party wishes to terminate this Agreement, it shall notify the other party in writing through diplomatic channels, and this Agreement shall cease to be effective on the 90th day after the date of that notice.
Article 9
The Agreement on mutual exemption of visas and visa fees between the Government of the former Socialist Federal Republic of Yugoslavia and the Government of the People's Republic of China of 19 April 1979 shall cease to be effective between the Government of the Republic of Slovenia and the Government of the People's Republic of China as of the date of entering into force of this Agreement.
Article 10
The present Agreement shall enter into force on the 30th day after the date of its signature.
Done at Beijing on June 1, 1994 in duplicate, in the Slovene, Chinese and English language, all the three texts being equally authentic. In case of discrepancy in its interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
