O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O ZRAČNEM PROMETU MED REPUBLIKO SLOVENIJO IN DRŽAVO IZRAEL
Razglašam Zakon o ratifikaciji Sporazuma o zračnem prometu med Republiko Slovenijo in Državo Izrael, ki ga je sprejel Državni zbor Republike Slovenije ha seji dne 24. novembra 1994.

O RATIFIKACIJI SPORAZUMA O ZRAČNEM PROMETU MED REPUBLIKO SLOVENIJO IN DRŽAVO IZRAEL
1. člen
Ratificira se Sporazum o zračnem prometu med Republiko Slovenijo in Državo Izrael, podpisan 16. junija 1993 v Ljubljani.
2. člen
Sporazum se v slovenskem in angleškem jeziku glasi:
SPORAZUM
O ZRAČNEM PROMETU MED REPUBLIKO SLOVENIJO IN DRŽAVO IZRAEL
Vlada Republike Slovenije in Vlada Države Izrael, v nadaljnjem besedilu "pogodbenici",
kot pogodbenici Konvencije o mednarodnem civilnem letalstvu, ki je bila odprta za podpis v Chicagu 7. decembra 1944, in
ker priznavata pomembnost zračnega prometa kot sredstva za ustvarjanje in ohranjanje prijateljstva, razumevanja in sodelovanja med narodi obeh držav,
v želji, da pospešita razvoj zračnega prometa med Slovenijo in Izraelom, da bi v največji možni meri nadaljevali mednarodno sodelovanje na tem področju, in v želji, da skleneta sporazum o opravljanju rednega zračnega prometa med svojima ozemljema, temelječ na načelu recipročnosti,
sta se dogovorili o naslednjem:
1. člen
Definicije
Posamezni izrazi imajo za razlago in uporabo tega Sporazuma, razen če ni v nadaljevanju drugače določeno, naslednji pomen:
a) "konvencija" pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila odprta za podpis v Chicagu 7. decembra 1944, ter vključuje vsako prilogo, sprejeto na podlagi 90. člena omenjene konvencije, in vsako spremembo prilog ali konvencije v skladu z njenim 90. in 94. členom, če te priloge in spremembe veljajo za obe pogodbenici ali sta jih ratificirali;
b) "pristojni organi" pomeni za Republiko Slovenijo Ministrstvo za promet in zveze, Republiško upravo za zračno plovbo in za Državo Izrael Ministrstvo za promet in zveze, Upravo za civilno letalstvo ali v obeh primerih katerokoli drugo osebo" ali telo, pooblaščeno za opravljanje nalog, ki jih opravljata omenjena organa;
c) "določeni prevoznik" pomeni prevoznika v zračnem prometu, ki ga je v skladu s 3. členom tega sporazuma določila posamezna pogodbenica za opravljanje dogovorjenega prometa, določenega v prilogi tega sporazuma;
d) "ozemlje", "zračni promet", "mednarodni zračni promet", "prevoznik", "pristanek v nekomercialne namene" imajo pomen, določen v 2. in 96. členu konvencije;
e) "sporazum" pomeni ta sporazum, njegove priloge in vse spremembe;
f) "določene proge" pomeni proge, ki so ali bodo dogovorjene v prilogi tega sporazuma;
g) "dogovorjeni promet" pomeni mednarodni zračni promet, ki ga opravljajo zrakoplovi za javni prevoz potnikov, prtljage in pošte, ki se lahko v skladu z določili tega sporazuma opravlja na določenih progah;
h) "tarifa" pomeni cene za prevoz potnikov, prtljage in tovora ter pogoje, na podlagi katerih se te cene uporabljajo, vključno s provizijo in drugimi dodatnimi plačili za agencijo ali za pomožne storitve, izvzeta pa so nadomestila in pogoji za prevoz pošte;
i) "kapaciteta" v zvezi z "dogovorjenim prometom" pomeni kapaciteto zrakoplova, ki se uporablja v tem prometu, pomnoženo s frekvenco operacij takega zrakoplova v določenem časovnem obdobju na progi ali delu proge.
2. člen
Prometne pravice
1. Vsaka pogodbenica daje drugi pogodbenici v tem sporazumu določene pravice, da vzpostavi in opravlja dogovorjeni mednarodni zračni promet na progah, ki so določene v prilogi.
2. Če ni drugače določeno v tem sporazumu ali njegovi prilogi, imata določena prevoznika obeh pogodbenic pri opravljanju dogovorjenega prometa na določenih progah naslednje pravice:
a) pravico do preleta ozemlja druge pogodbenice brez pristanka;
b) pravico do pristanka na ozemlju druge pogodbenice v nekomercialne namene;
c) pravico na ozemlju druge pogodbenice v krajih, določenih v prilogi tega sporazuma, vkrcati in izkrcati potnike, prtljago, blago in pošto, ki so namenjeni v ali prihajajo iz ozemlja pogodbenice, ki je prevoznika določila.
3. Nobeno določilo tega sporazuma ne daje določenemu prevozniku ene pogodbenice pravice, da na ozemlju druge pogodbenice za najem ali nagrado vkrca potnike, prtljago, tovor ali pošto, namenjeno v kakšen drug kraj na njenem ozemlju.
3. člen
Določitev prevoznikov in dovoljenje za opravljanje prometa
1. Vsaka pogodbenica ima pravico določiti enega prevoznika za opravljanje dogovorjenega prometa na določenih progah med ozemljema obeh držav in to pisno sporočiti drugi pogodbenici.
2. Po prejemu take določitve bo druga pogodbenica brez odlašanja, v skladu z določili 3. in 4. odstavka tega člena izdala ustrezno operativno dovoljenje.
3. Pristojni organ ene pogodbenice lahko od določenega prevoznika, ki ga je določila druga pogodbenica, zahteva, naj dokaže, da izpolnjuje pogoje, določene v zakonih in predpisih, ki jih običajno in razumno uporabljajo omenjeni organi glede opravljanja mednarodnega zračnega prometa v skladu s konvencijo.
4. Vsaka pogodbenica ima pravico odkloniti izdajo dovoljenja za opravljanje prometa iz drugega odstavka tega člena ali naložiti pogoje, ki so po njenem mnenju potrebni za to, da določeni prevoznik izvršuje pravice, določene v 2. členu tega sporazuma, v vseh primerih, ko ni prejela zadovoljivih dokazov, da so druga pogodbenica ali njeni državljani lastniki bistvenega deleža in imajo dejanski nadzor nad določenim prevoznikom, ki ga je druga pogodbenica določila za opravljanje dogovorjenega prometa.
5. Ko je prevoznik tako določen in dobi dovoljenje za opravljanje prometa, sme kadarkoli začeti opravljati dogovorjeni promet pod pogojem, da so tarife, določene v skladu s 6. členom tega sporazuma, veljavne za ta promet.
4. člen
Preklic ali začasna ustavitev pravic
1. Vsaka pogodbenica ima pravico preklicati dovoljenje za opravljanje prometa ali ustaviti uresničevanje v drugem členu tega sporazuma določenih pravic določenemu prevozniku druge pogodbenice ali določiti take pogoje, ki se ji zdijo potrebni za izvrševanje teh pravic, če:
a) ni zadostnih dokazov, da so druga pogodbenica ali. njeni državljani lastniki bistvenega deleža in imajo dejanski nadzor nad določenim prevoznikom;
b) zadevni prevoznik ne spoštuje zakonov in predpisov pogodbenice, ki daje te pravice; ali
c) zadevni prevoznik ne opravlja dogovorjenega prometa pod pogoji, ki so določeni v tem sporazumu.
2. Ta pravica bo uporabljena le po posvetovanju z drugo pogodbenico, razen če je takojšen preklic ali ustavitev izvrševanja ali uveljavitev pogojev po prvem odstavku tega člena nujna za preprečitev nadaljnjega kršenja zakonov in predpisov.
5. člen
Oprostitev carin, davščin in taks
1. Na podlagi recipročnosti bo vsaka pogodbenica, v največjem možnem obsegu, ki ga dovoljujejo njeni zakoni, oprostila določenega prevoznika druge pogodbenice uvoznih omejitev, carin, davkov, inšpekcijskih taks in drugih domačih davščin in taks na dobavo rezervnih delov vključno z motorji, redno opremo letal, zalog in hrane (vključno s tobakom, alkoholnimi in drugimi pijačami in drugimi proizvodi, ki so med poletom v omejenih količinah namenjeni prodaji potnikom). Isto velja za druge predmete, ki se uporabljajo zgolj v zvezi z letenjem ali servisiranjem letal določenega prevoznika druge pogodbenice, ki opravlja dogovorjeni promet, kot tudi za tiskano zalogo vozovnic, letalskih tovornih listov, katerokoli tiskano gradivo z oznako prevoznika in vse reklamno gradivo, ki ga določeni prevoznik brezplačno distribuira.
2. Oprostitve za predmete iz 1. odstavka tega člena se bodo uporabljale za vse predmete:
a) ki jih na ozemlje ene pogodbenice prinese ali so bili prineseni za račun določenega prevoznika druge pogodbenice;
b) ki so ostali na letalu določenega prevoznika ene pogodbenice ob prihodu-in odhodu iz ozemlja druge pogodbenice;
c) ki so vkrcani na letalo določenega prevoznika ene pogodbenice na ozemlju druge pogodbenice in so namenjeni uporabi med opravljanjem dogovorjenega prometa.
Oprostitve veljajo ne glede na to, ali se ti predmeti v celoti ali delno porabijo na ozemlju pogodbenice, ki daje oprostitev, pod pogojem, da ti predmeti niso odtujeni na ozemlju te pogodbenice.
Predmeti, o katerih govore točke a), b), in c), bodo pod carinskim varstvom ali nadzorom.
3. Redna oprema letala, kakor tudi ves material in zaloge, ki so običajno na letalu določenega prevoznika ene ali druge pogodbenice, se lahko raztovarja na ozemlju druge pogodbenice samo s soglasjem carinskih oblasti tega ozemlja. V takem primeru so lahko pod carinskim nadzorom omenjenih oblasti, dokler niso odpeljani ali drugače porabljeni v skladu s carinskimi predpisi.
4. Oprostitve, predvidene v 1. odstavku tega člena, bodo veljale tudi, kadar prevoznik ene pogodbenice sklene pogodbo z drugim letalskim prevoznikom, ki tudi uživa podobne oprostitve s strani druge pogodbenice, da mu da na posodo ali pripelje na ozemlje druge pogodbenice predmete, specificirane v 1. odstavku tega člena.
6. člen
Tarife
1. Tarife, ki jih bo določeni prevoznik ene pogodbenice zaračunaval za prevoz na ozemlje ali z ozemlja druge pogodbenice, morajo biti določene v primernih zneskih; pri tem naj se upoštevajo vsi ustrezni dejavniki, kot so poslovni stroški, primeren dobiček, kot tudi tarife, ki jih zaračunavajo drugi prevozniki v zračnem prometu. Pogodbenici bosta imeli za nesprejemljive tarife, ki so izkoriščevalske ali diskriminacijske, neupravičeno visoke ali restriktivne zaradi zlorabe dominantnega položaja ali umetno nizke zaradi direktne ali indirektne državne subvencije ali podpore.
2. O tarifah iz 1. točke tega člena se, če je mogoče, dogovorita določena prevoznika obeh pogodbenic po posvetovanju z drugimi prevozniki, ki opravljajo zračni promet na isti progi ali na delu te proge. Določena prevoznika bosta, kadarkoli bo to mogoče, sklenila tak dogovor po postopkih, ki jih določa Mednarodno združenje zračnih prevoznikov (IATA) ali kakšen drug ustrezen mednarodni mehanizem za določanje tarif.
3. Tako določene tarife je treba predložiti v odobritev pristojnim organom obeh pogodbenic najmanj šestdeset (60) dni pred dnem, ki je predlagan za njihovo uveljavitev. V posebnih primerih se lahko omenjeni organi dogovorijo za krajši rok.
4. Odobritev je lahko dana izrecno. Če pristojni organi nobene od pogodbenic niso izrazili svojega nestrinjanja v tridesetih (30) dneh od predložitve zahtevka po 3. odstavku tega člena, se te tarife štejejo za potrjene. V primerih, ko se pristojni organi v skladu s 3. odstavkom tega člena dogovorijo za krajši rok, se lahko dogovorijo tudi, da je rok, v katerem morajo izraziti svoje nestrinjanje, krajši kot trideset (30) dni.
5. Če tarifa ne more biti dogovorjena v skladu z določili 2. odstavka tega člena ali če je v roku, predvidenem v 4. odstavku tega člena, en pristojni organ sporočil drugemu pristojnemu organu svoje nestrinjanje s katerokoli tarifo, dogovorjeno v skladu z določili 2. odstavka, si bosta pristojna organa obeh pogodbenic, po posvetovanju z organi, pristojnimi za zračno plovbo katerekoli države, katere nasvet ocenita kot koristen, prizadevala sporazumno določiti tarifo.
6. Če se pristojna organa ne moreta dogovoriti o katerikoli tarifi, ki jima je bila predložena v skladu z določili 3. odstavka tega člena, ali določiti tarife v skladu z določili 5. odstavka tega člena, se bo spor reševal v skladu z določili 18. člena tega sporazuma.
7. Tarifa, uveljavljena v skladu z določili tega člena, ostane veljavna, dokler se ne uveljavi nova tarifa, vendar se tarifa ne bo podaljševala s pomočjo tega odstavka več kot dvanajst (12) mesecev po datumu, ko bi drugače prenehala veljati.
8. Pristojni organi obeh pogodbenic si bodo prizadevali, da bi zagotovili, da bodo določeni prevozniki spoštovali dogovorjene tarife, ki bodo deponirane pri njih, in da noben letalski prevoznik ne bo na noben način neposredno ali posredno zmanjševal nobenega deleža teh tarif.
7. člen
Predstavništvo in komercialne dejavnosti
1. Določeni prevoznik ene pogodbenice ima lahko, na podlagi recipročnosti, ustrezna predstavništva na ozemlju druge pogodbenice. Ta predstavništva lahko imajo komercialno, operativno in tehnično osebje, ki je primerno za opravljanje dogovorjenega prometa. To osebje se lahko izbere med državljani vsake ali obeh pogodbenic.
2. Potrebno osebje lahko določeni prevoznik po lastni presoji zagotovi izmed svojih uslužbencev ali uporabi storitve druge organizacije, podjetja ali letalske družbe, ki deluje na ozemlju druge pogodbenice in je pooblaščena za opravljanje takih storitev na ozemlju te pogodbenice.
3. Predstavniki in osebje morajo ravnati v skladu z veljavnimi zakoni in predpisi druge pogodbenice. Obe pogodbenici bosta v skladu s svojimi zakoni in predpisi in na podlagi recipročnosti v najkrajšem možnem času izdali potrebna dovoljenja za delo, delovne vize ali druge podobne dokumente predstavnikom in osebju iz prvega odstavka tega člena.
8. člen
Uporaba: zakonov in predpisov
1. Zakoni in predpisi vsake od pogodbenic, s katerimi so urejeni prihod in odhod z njenega ozemlja letal, ki opravljajo mednarodni promet ali se nanašajo, na operacije takih letal medtem, ko so na njenem ozemlju, se bodo uporabljali za letala določenega prevoznika druge pogodbenice pri vstopu v, odhodu iz in medtem, ko so na njenem ozemlju.
2. Zakoni in predpisi vsake od pogodbenic, ki urejajo prihod, zadrževanje, tranzit in odhod z njenega ozemlja potnikov, posadke, prtljage, tovora in pošte, na letalih, vključno s predpisi, ki se nanašajo na vstop in odhod, izseljevanje in priseljevanje, potne liste, carinske, valutne in sanitarne ukrepe, bodo spoštovani s strani določenih prevoznikov vsake pogodbenice pri vstopu na, odhodu iz in medtem, ko bodo na ozemlju druge pogodbenice.
9. člen
Priznavanje potrdil in dovoljenj
1. Spričevala o plovnosti, spričevala o sposobnosti in dovoljenja, ki jih izda ali potrdi ena pogodbenica, bo, dokler so veljavna, priznavala tudi druga pogodbenica za opravljanje dogovorjenega prometa. Pogoj za to je, da so pogoji, pod katerimi so bila taka spričevala ali dovoljenja izdana ali podaljšana, enaki ali strožji od minimalnih standardov, ki bi bili določeni v skladu s konvencijo.
2. Vsaka pogodbenica pa si pridržuje pravico, da za preletanje nad svojim ozemljem ne prizna veljavnosti tistim spričevalom o sposobnosti in dovoljenjem, ki jih je njenim državljanom izdala ali potrdila druga pogodbenica.
10. člen
Varnost
1. Pogodbenici ponovno potrjujeta medsebojno obveznost varovanja civilnega zračnega prometa pred dejanji nezakonitega vmešavanja. Pogodbenici bosta še posebej ravnali v skladu z določili Konvencije o kaznivih dejanjih in nekih drugih aktih, storjenih na letalih, podpisane v Tokyu 14. septembra 1963, Konvencije o zatiranju nezakonite ugrabitve zrakoplovov, podpisane v Haagu 16. decembra 1970, Konvencije o zatiranju nezakonitih aktov zoper varnost civilnega letalstva, podpisane v Montrealu 23. septembra 1971, in Protokola o zatiranju nezakonitih nasilnih dejanj na letališčih za mednarodno civilno zrakoplovstvo, podpisanega v Montrealu 24. februarja 1988, ko bo ta protokol stopil v veljavo za obe pogodbenici.
2. Pogodbenici si bosta na zahtevo medsebojno pomagali, da bi preprečili nezakonite ugrabitve civilnih letal in druga nezakonita dejanja proti varnosti takih letal, njihovih potnikov in posadk, letališč in navigacijskih naprav ter vsako drugo ogrožanje varnosti civilne zračne plovbe.
3. Pogodbenici bosta v medsebojnih odnosih ravnali v skladu z določili Mednarodne organizacije civilnega letalstva o varnosti civilne zračne plovbe, ki so opredeljena v aneksih konvencije, v taki meri, kot ta določila veljajo za obe pogodbenici. Pogodbenici bosta zahtevali od letalskih družb, ki so vpisane v njunih registrih ali ki opravljajo pretežni del svojih dejavnosti ali imajo sedež na njunem ozemlju, ter od letaliških podjetij na njunem ozemlju, da delujejo v skladu s takimi varnostnimi predpisi.
4. Pogodbenici se strinjata, da od navedenih družb lahko zahtevata, da spoštujeta letalske varnostne predpise, navedene v 3. odstavku tega člena, ki jih zahteva druga pogodbenica za vstop, odhod, oziroma dokler so letala na ozemlju te druge pogodbenice. Vsaka pogodbenica zagotavlja, da se bodo na njenem ozemlju učinkovito izvajali primerni ukrepi za zavarovanje letal in za pregled potnikov, posadke, ročne prtljage, prtljage, tovora in potrošnega blaga, hrane, pijače ipd. pred in med vkrcava-. njem in natovarjanjem. Pogodbenici bosta z naklonjenostjo obravnavali vsako drugo zahtevo druge pogodbenice za uvedbo razumnih dodatnih varnostnih ukrepov zaradi neposredne grožnje.
5. Ob nezakoniti ugrabitvi ali grožnji z ugrabitvijo oziroma drugih nezakonitih dejanjih proti varnosti letal, potnikov in posadk, letališč ali navigacijskih naprav bosta pogodbenici, pomagali druga drugi, s tem da bosta poskrbeli za komunikacije in druge ustrezne ukrepe, da bi se čim hitreje in varno končal tak incident ali grožnja.
6. Kadar ena pogodbenica upravičeno meni, da druga pogodbenica ne ravna v skladu s predpisi o varnosti zračne plovbe iz tega člena, lahko pristojni organ za zračno plovbo ene pogodbenice zahteva takojšnje posvetovanje s pristojnim organom za zračno plovbo druge pogodbenice.
11. člen
Transfer presežka prihodkov
1. Na podlagi recipročnosti bo imel določeni prevoznik ene pogodbenice pravico prodajati storitve v zračnem prometu na ozemlju druge pogodbenice za lokalno valuto ali katerokoli prosto konvertibilno valuto, direktno ali preko agentov, v skladu z domačimi zakoni in predpisi.
2. Na podlagi recipročnosti bo imel določeni prevoznik ene pogodbenice pravico zamenjati v prosto konvertibilno valuto presežek prihodkov nad stroški in bo ta presežek lahko prosto transferiral iz države prodaje v domačo državo. V tem neto transferu bodo vključeni dohodki od prodaje prevoznih storitev direktno in preko agentov in od pomožnih dopolnilnih storitev. Če je med državama v veljavi plačilni sporazum, se transferi opravljajo v skladu z določili tega sporazuma in veljavnimi deviznimi predpisi.
3. Določeni prevoznik posamezne pogodbenice bo dobil dovoljenje za tak transfer najkasneje v tridesetih (30) dneh od vložitve zahtevka. Postopek za tak transfer bo v skladu z deviznimi predpisi države, v kateri je zaslužek nastal.
4. Vsaka pogodbenica bo jamčila določenemu prevozniku druge pogodbenice na podlagi recipročnosti oprostitev od taks in davkov na dobiček ali dohodek, ki bo izviral iz opravljanja zračnega prometa.
12. člen
Uresničevanje pravic in kapaciteta
1. Oba določena prevoznika bosta imela primerne in enake, možnosti za opravljanje dogovorjenega prometa, ki je specificiran v prilogi k temu sporazumu.
2. Določena prevoznika obeh pogodbenic bosta opravljala dogovorjeni zračni promet v skladu z veljavnim medsebojnim komercialnim sporazumom: Če takega sporazuma ne moreta doseči, bodo sporna vprašanja predložena organom, pristojnim za zračno plovbo obeh pogodbenic v odločanje.
3. Pri opravljanju teh storitev v zračnem prometu mora določeni prevoznik ene pogodbenice upoštevati interese prevoznika, ki ga je določila druga pogodbenica, tako da ne bo neupravičeno ogrožal prometa, ki ga ta opravlja na delu ali celotni progi ali na drugih progah svoje mreže.
4. Kapacitete, ki se bodo zagotavljale v dogovorjenem prometu, bodo povezane s predvidenimi potrebami po zračnem prometu potnikov med ozemljema obeh pogodbenic.
5. Frekvence in rede letenja za opravljanje dogovorjenega prometa bosta sporazumno določila določena prevoznika in jih predložila pristojnim organom za zračno plovbo v potrditev pred pričetkom opravljanja dogovorjenega prometa in najmanj trideset (30) dni, preden stopijo v veljavo.
6. Za dodatne lete, ki jih želi določeni prevoznik ene pogodbenice opravljati v dogovorjenem prometu izven odobrenega reda letenja, mora zahtevati predhodno odobritev od pristojnih organov druge pogodbenice. Taka zahteva bo običajno vložena najmanj 3 delovne dni pred opravljanjem takih poletov.
13. člen
Takse uporabnikov in olajšave
1. Vsaka pogodbenica lahko uvede ali dovoli, da se uvedejo upravičene in razumne takse za določenega prevoznika druge pogodbenice. Te takse bodo ekonomsko utemeljene.
2. Za uporabo letališč ter drugih služb in naprav, ki jih da na razpolago ena pogodbenica, ne bo določeni prevoznik druge pogodbenice plačal več, kot je treba plačati za domača letala, ki se uporabljajo v rednem mednarodnem zračnem prometu.
3. Nobena pogodbenica ne bo dajala prednosti svoji ali katerikoli drugi letalski družbi pred letalsko družbo druge pogodbenice, ki opravlja podoben mednarodni zračni promet, glede postopkov carine, vseljevanja, karantene in podobnih predpisov ali glede uporabe letališč, zračnih poti, storitev zračnega prometa in dodatnih naprav, nad katerimi ima nadzor.
14. člen
Izmenjava informacij in statističnih podatkov
Pristojni organi ene pogodbenice bodo na zahtevo pošiljali pristojnim organom druge pogodbenice take statistične podatke, ki bodo lahko potrebni za določitev kapacitete, ki naj jo zagotavlja določeni prevoznik, obseg prometa, opravljenega na dogovorjenih progah, kot tudi odhodne in namembne kraje, če se izjemoma opravlja promet v in iz tretjih držav.
15. člen
Direktni tranzit
Potniki v direktnem tranzitu preko ozemlja pogodbenice in ki ne zapuste območja, ki je na letališču za to rezervirano, bodo podvrženi enostavnejšemu pregledu. Prtljaga in tovor v direktnem tranzitu bo oproščen carinskih prispevkov in drugih taks.
16. člen
Posvetovanja
1. V duhu tesnega sodelovanja se bosta pristojna organa pogodbenic občasno posvetovala, da bi zagotavljala uveljavitev in izvrševanje določil tega sporazuma in njegove priloge.
2. Taka posvetovanja se bodo pričela v šestdesetih (60) dneh od prejema zahteve za posvetovanja, če se pogodbenici ne dogovorita drugače.
17. člen
Spremembe
1. Če ena pogodbenica meni, da bi bilo zaželeno spremeniti katerokoli določilo tega sporazuma, lahko zahteva posvetovanje z drugo pogodbenico. Taka posvetovanja med pristojnima organoma so lahko ustna ali pisna in se bodo začela v šestdesetih (60) dneh od dneva zahteve. Kakršnakoli tako dogovorjena sprememba bo pričela veljati v skladu s postopkom, opisanim v 21. členu.
2. Spremembe priloge tega sporazuma se lahko dogovorijo z neposrednim sporazumom med pristojnima organoma pogodbenic.
3. Ta sporazum bo spremenjen tako, da bo v skladu s katerokoli multilateralno konvencijo, ki bi lahko postala obvezujoča za obe pogodbenici.
18. člen
Reševanje sporov
1. Če pride med pogodbenicama do spora glede razlage ali izvajanja tega sporazuma, si bosta pogodbenici najprej prizadevali, da bi ga rešili s pogajanji.
2. Če pogodbenici spora ne moreta rešiti s pogajanji, se lahko dogovorita, da bo o sporu odločala arbitraža treh razsodnikov, od katerih vsaka pogodbenica imenuje po enega, ta dva pa skupaj določita tretjega. Vsaka pogodbenica bo imenovala svojega razsodnika v šestdesetih (60) dneh od dneva, ko je po diplomatski poti prejela zahtevo druge pogodbenice o razrešitvi spora na arbitraži. Tretji razsodnik bo določen v nadaljnjih šestdesetih (60) dneh. Če katerakoli pogodbenica ne imenuje razsodnika v predvidenem času ali če tretji razsodnik ni določen v predvidenem času, lahko vsaka od pogodbenic zahteva, da predsednik Sveta Mednarodne organizacije civilnega letalstva določi razsodnika ali razsodnike, ki so v posameznem primeru potrebni. V vseh primerih mora biti tretji razsodnik državljan tretje države in bo deloval kot predsednik arbitraže ter določil kraj, kjer bo arbitraža zasedala. Arbitraža bo sama določila svoje postopke in če bo potrebno zakone, ki jih bo uporabljala.
3. Katerakoli odločitev arbitražnega razsodišča bo obvezujoča za obe pogodbenici, razen če se, ko spor predložita arbitražnemu razsodišču, odločita drugače.
4. Vsaka pogodbenica plača stroške svojega razsodnika. Preostali stroški arbitražnega razsodišča pa se v enakih delih razdelijo med pogodbenicama.
5. Če in dokler katerakoli pogodbenica ne izpolnjuje odločitev arbitraže v skladu s 3. odstavkom tega člena, lahko druga pogodbenica omeji, zadrži ali prekliče katerokoli pravico ali olajšavo, ki jo je odobrila s tem sporazumom pogodbenici ali določenemu prevozniku, ki teh sklepov ne spoštuje.
19. člen
Registracija
Ta sporazum in vse njegove poznejše spremembe bodo registrirane pri Mednarodni organizaciji civilnega letalstva.
20. člen
Prenehanje
1. Ta sporazum bo veljal nedoločen čas.
2. Vsaka pogodbenica lahko kadarkoli pisno sporoči drugi pogodbenici, da se je odločila, da odpove ta sporazum. Tako sporočilo bo istočasno poslano Mednarodni organizaciji civilnega letalstva. V takem primeru bo sporazum prenehal veljati ob koncu IATA sezone, vendar ne prej kot dvanajst (12) mesecev po prejemu sporočila, razen če je odpoved sporazumno umaknjena pred potekom tega časa. Če druga pogodbenica ne potrdi prejema sporočila o odpovedi, se šteje, da ga je prejela štirinajst (14) dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
21. člen
Uveljavitev
Ta sporazum stopi v veljavo tistega dne, ko bosta obe pogodbenici druga drugo ž izmenjavo diplomatskih not pisno obvestili, da so izpolnjene njune notranjepravne formalnosti za uveljavitev.
V potrditev tega sta podpisana, ki sta pravilno pooblaščena s strani svojih vlad, podpisala ta sporazum.
Sestavljeno v Ljubljani dne 16. junija 1993, kar ustreza 27. sivanu 5753, v dveh izvirnikih v slovenskem, hebrejskem in angleškem jeziku, pri čemer so vsa tri besedila enako avtentična. Ob morebitnem neskladju glede razlage je merodajno besedilo v angleškem jeziku.

4. Katerikoli ali vsi kraji vmesnega pristajanja ali naslednji kraji so lahko po odločitvi določenega prevoznika izpuščeni na kateremkoli ali vseh letih, pod pogojem da se je polet začel ali končal na ozemlju države, ki je prevoznika določila.
AIR TRANSPORT AGREEMENT
BETWEEN THE REPUBLIC OF SLOVENIA AND THE STATE OF ISRAEL
The Government of the State of Israel, and The Government of the Republic of Slovenia, hereinafter referred to as the "Contracting Parties",
Being parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1994; and
Acknowledging the importance of air transport as means of creating and preserving friendship, understanding and cooperation between peoples of the two countries; and
Desiring to promote the development of air transport between Israel and Slovenia, to continue to the fullest extent the international cooperation in this field; and
Desiring to conclude an Agreement, based on the principle of reciprocity, for the operation of scheduled air services between their territories;
Have agreed as follows:
Article I
Definitions
For the purpose of the interpretation and application of the Agreement, except as otherwise provided herein:
a) the term "Convention" means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944, and includes any Annex adopted under Article 90 of that Convention, any amendment of the Annexes or Convention under Articles 90 and 94 thereof so far as those Annexes and amendments have become effective for or have been ratified by both Contracting Parties;
b) the term "aeronautical authorities" means in the case of the State of Israel, The Ministry of Transport, Civil Aviation Administration, and in the case of the Republic of Slovenia, the Ministry of Transport and Communication, Civil Aviation Authority, or in both cases any person or body duly authorised to perform any functions exercised by the said authorities;
c) the term "designated airline" means the airline that each Contracting Party has designated to operate the agreed services as specified in the Annex of this Agreement and in accordance with Article III of this Agreement;
d) 'the term "territory", "air services", "international air services", "airline" and "stop for non-traffic purposes" have the meaning specified in Articles 2 and 96 of the Convention;
e) the term "Agreement" means this Agreement, its Annexes and any amendments thereto;
f) the term "specified routes" means the routes established or to be established in the Annex to the Agreement;
g) the term "agreed services" means the international air services performed by aircraft for public transport of passengers, cargo and mail which can be operated, according to the provisions of the Agreement, on the specified routes;
h) the term "tariff' means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which those prices apply, including prices and conditions for agency and other auxiliary services, but excluding remuneration or conditions for the carriage of mail.
i) The term "capacity" in relation to "agreed services" means the capacity of the aircraft used on such services, multiplied by the frequency operated by such aircraft over a given period of time and route or section of a route.
Article II
Grant of Rights
1. Each Contracting Party grants to the other Contracting Party the rights specified in the Agreement, for the purpose of establishing and operating scheduled international air services on the routes specified in the Annex hereto.
2. Unless otherwise specified in this Agreement or in its Annex, the airline designated by each Contracting Party shall enjoy, while operating an agreed service on a specified route, the following rights:
a) to fly without landing across the territory of the other Contracting Party;
b) to make stops in the said territory for non-traffic purposes;
c) to embark and disembark in the other Contracting Party's territory, at the points specified in the Annex of this Agreement, passengers, cargo and mail coming from or destined to the territory of the Contracting Party designating the airline.
3. Nothing in this Agreement shall be deemed to confer on the designated airline of one Contracting Party the privilege of taking on board in the territory of the other Contracting Party passengers, cargo or mail, carried for hire or reward and destined for another point in the territory of the other Contracting Party.
Article III
Designation of Airlines and Operating Authorization
1. Each Contracting Party shall have the right to designate in writing to the other Contracting Party one airline for the purpose of operating, between the territories of the two countries, the agreed services on the specified routes.
2. On receipt of such designation, the other Contracting Party shall grant without delay, subject to the provisions of paragraphs 3 and 4 of this Article, to the designated airline the appropriate operating authorization.
3. The aeronautical authorities of one Contracting Party may require the airline designated by the other Contracting Party to satisfy them that it fulfils the conditions prescribed under the laws and regulations normally and reasonably applied to the operation of international air services by such authorites in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article or to impose such conditions, as it may deem necessary, on the exercise by the designated, airline of the rights specified in Article II of this Agreement in any case when the said Contracting Party is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals.
5. When an airline has been so designated and authorised, it may begin at any time to operate the agreed services, provided that tariffs established in accordance with the provisions of Article VI of this Agreement are in force in respect of those services.
Article IV
Revocation or Suspension of Rights
1. Each Contracting Party shall have the right to revoke an operating authorization or to suspend the exercise of the rights specified in Article II of this Agreement given to the airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary for the exercise of these rights:
a) in case where it is not satisfied that substanstial ownership and effective control of the airline are vested in the Contracting Party designating the airline or in nationals of such Contracting Party; or
b) in case of failure by that airline to comply with the laws and regulations of the Contracting Party granting these rights; or
c) in any case in which the airline otherwise fails to operate the agreed services in accordance with the conditions prescribed under the Agreement.
2. Unless immediate revocation, suspension or imposition of the conditions mentioned in paragraph 1 of this Article are essential to prevent further infringement of laws or regulations, such right shall be exercised only after consultation with the other Contracting Party.
Article V
Exemptions from Duties and Taxes
1. Each Contracting Party shall on a basis of reciprocity exempt the designated airline of the other Contracting Party to the fullest possible extent under its national law from import restrictions, customs duties excise taxes, inspection fees and other national duties and Charges on supplies, spare parts including engines, regular aircraft equipment, aircraft stores and food (including tobacco, liquor, beverages and other products destined for sale to passengers in limited quantities during the flight) and other items intended for use solely in connection with the operation or servicing of aircraft of the designated airline of such Contracting Party operating the agreed services, as well as printed tickets stock, airway bills, any printed material which bears the insignia of the company printed thereon and usual publicity material distributed without charge by that designated airline.
2. The exemption granted by this Article shall apply to the items referred to in paragraph 1 of this Article:
a) introduced in the territory of one Contracting Party by or on behalf of the designated airline of the other Contracting Party;
b) retained on board aircraft of the designated airline of one Contracting Party upon arriving to or departing from the territory of the other Contracting Party;
c) taken on board aircraft of the designated airline of one Contracting Party in the territory of the other Contracting Party and intended for use in operating the agreed services;
whether or not such items are used or consumed wholly or partly within the territory of the Contracting Party granting the exemption, provided such items are not alienated in the territory of the said Contracting Party.
The material referred to in a), b) and c) above shall be kept under customs supervision or control.
3. The regular airborne equipment, as well as the materials and supplies normally retained on board the aircraft of the designated airline of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that territory. In such case, they may be placed under the supervision of the said authorities up to such time as they are taken out or otherwise disposed of in accordance with Customs regulations.
4. The exemptions provided by paragraph 1 of this Article shall also be available where the airline of one Contracting Party have contracted with another airline, which similarly enjoys such exemptions from the other Contracting Party, for loan or transfer in the territory of the other Contracting Party of the items specified in paragraph 1 of this Article.
Article VI
Tariffs
1. The tariffs to be charged by the designated airline of one Contracting Party for carriage to or from the territory of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit and tariffs of other airlines. The Contracting Parties shall consider unacceptable tariffs that are predatory or discriminatory, unduly high or restrictive because of the abuse of a dominant position, or artificially low because of direct or indirect government subsidy or support.
2. The tariffs referred to in paragraph 1 of this Article, shall be agreed between the designated airlines of both Contracting Parties, after consultation with other airlines operating over the whole or part of the route, and such agreement shall, whenever possible, be reached by the use of the procedures of the International Air Transport Association or any other appropriate international rate fixing mechanism for the working out of tariffs.
3. The tariffs so agreed shall be sumbitted for the approval of the aeronautical authorities of both Contracting Parties at least (60) days before the proposed date of their introduction. In special cases, this period may be reduced, subject to the agreement of the said authorities.
4. This approval may be given expressly. If neither of the aeronautical authorities has expressed disapproval within (30) days from the date of submission, in accordance with paragraph 3 of this Article, these tariffs shall be considered approved. In the event of the period for submission being reduced, as provided for in paragraph 3, the aeronautical authorities may agree that the period within which any disapproval must be notified shall be less than (30) days.
5. If a tariff cannot be agreed in accordance with the provisions of paragraph 2 of this Article, or if during the period applicable in accordance with paragraph 4 of this Article, one aeronautical authority gives the other aeronautical authority notice of its disapproval of any tariff agreed upon in accordance with the provisions of paragraph 2, the aeronautical authorities of the two Contracting Parties shall, after consultation with the aeronautical authorities of any state whose advice they may consider useful, endeavor to determine the tariff by mutual agreement.
6. If the aeronautical authorities cannot agree on any tariff submitted to them in accordance with paragraph 3 of this Article, or on the determination of any tariff as specified in paragraph 5 of this Article, the dispute shall be settled in accordance with the provisions of Article XVIII of this Agreement.
7. A tariff established in accordance with the provisions of this Article shall remain in force until a new tariff has been established. Nevertheless, a tariff shall not be prolonged by virtue of this paragraph for more than (12) months after the date on which it otherwise would have expired.
8: The aeronautical authorities of each Contracting Party shall exercise their best efforts to ensure that the designated airlines conform to the agreed-tariffs filed with the aeronautical authorities of the Contracting Parties and that no airline rebates any portion of such tariffs by any means, directly or indirectly.
Article VII
Representation and Commercial Activities
1. The designated airline of the Contracting Party shall be allowed, on the basis of reciprocity, to maintain in the territory of the other Contracting Party their representatives and commercial, operational and technical staff as required in connection with the operation of the agreed services. These staff may be chosen among nationals of either or both Parties.
2. These staff requirements may, at the opinion of the designated airline, be satisfied by its own personnel or by using the services of other organisation, company or airline operating in the territory of the other Contracting Party, and authorized to perform such services in the territory of that Contracting Party.
3. The representatives and staff shall be subject to the laws and regulations in force of the other Contracting Party,' and, consistent with such laws and regulations, each Contracting Party shall, on the basis of reciprocity and with the minimum of delay, grant the necessary work permits, employment visas or other similar documents to the representatives and staff referred to in paragraph 1 of this Article.
Article VIII
Application of Laws and Regulations
1. The laws and regulations of each Contracting Party governing the admission to or departure from its own territory of aircraft engaged in international navigation, or related to the operation of such aircraft while within its territory, will be applied to the aircraft of the designated airline of the other Contracting Party upon entrance into, departure from and while within the said territory.
2. The laws and regulations of each Contracting Party related to the adminission to, stay in, transit through and departure from its territory of passengers, crew, baggage, cargo and mail on aircraft, including regulations relating to entry and departure, immigration, and emigration, passports, customs, currency and sanitary measures, shall be complied with by the airline of each Contracting Party upon entrance into or departure from and while within the territory of the other Contracting Party.
Article IX
Recognition of Certificates and Licences
1. Certificates of airworthiness, certificates of competency and licences issued or rendered valid by one Contracting Party and still in force shall be recognized as valid by the other Contracting Party for the purpose of operating the agreed services provided that the requirements under which such certificates and licences were issued or rendered valid are equal to or above the minimum standards which may be established pursuant to the Convention.
2. Each Contracting Party reserves the right, however, of refusing to recognize the validity of the certificates of competency and the licences granted to its own nationals by the other Contracting Party for the purpose of overflying its own territory.
Article X
Security
1. The contracting Parties reaffirm their obligation to each other to protect the security of civil aviation against acts of unlawful interference. The Contracting Parties shall in particular act in conformity with the provisions of the Convention of Offences and Certain Other Acts Committed on Board Aircraft, signed in Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971,and the Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988, when the latter Protocol enters in force for the two Contracting Parties.
2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as Annexes to the Convention to the extent that such security provisions are applicable to the Parties; they shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in. their territory and the operators of airports in their territory act in conformity with such aviation security provisions.
4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 above required by the other Contracting Party for entry into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to inspect passengers, crew, carry-on items, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give sympathetic consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.
6. When a Contracting Party has reasonable ground to believe that the other Contracting Party has departed from the aviation security provisions of this Article, the. aeronautical authorities of that Contracting Party may request immediate consultations with the aeronautical authorities of the other Contracting Party.
Article XI
Transfer of Excess Receipts
1. Based on the principle of reciprocity, the designated airline of one Contracting Party shall be free, to sell air transport services in the territory of the other Contracting Party, in local currency or in any freely convertible currency, either directly or through agents, in accordance with the respective applicable national laws and regulations.
2. Based on the principle of reciprocity, the designated airlines of the Contracting Parties shall be free to convert to freely convertible currency the excess of receipts over expenditure and shall be free to transfer from the territory of sale to their home territory this excess of receipts. Included in such net transfers shall be revenues from sales made directly or through an agent of air transport services, and ancillary supplementary services, and the payments shall be settled in conformity with the provisions of the payment agreement in force between the two countries, if such an agreement has been reached, and with the applicable currency regulations.
3. The designated airlines of the Contracting Parties shall receive approval for such transfers within at most (30) days of application. The procedure for such transfers shall be in accordance with the foreign exchange regulations of the country in which the revenue accrues.
4. Each Contracting Party shall grant to the designated airline of the other Contracting Party, on a reciprocal basis, the exemption of all taxes and duties on the profit or incomes derived from the operation of the air services.
Article XII
Exercise of Rights and Capacity
1. There shall be fair and equal opportunity for both designated airlines to operate the agreed services as specified in the Annex to this Agreement.
2. The designated airlines of both Contracting Parties shall operate the agreed air services in accordance with a valid Commercial Agreement between them. In case such an agreement cannot be reached between them, the issues in dispute shall be referred to the aeronautical authorities of the Contracting Parties.
3. While operating these air services, each designated airline shall take into account the interest of the other designated airline so as not to affect unduly the services which the latter provides on the whole or part of the same route, or on other routes of its network.
4. The capacity to be provided on the agreed services by the designated airlines shall bear a close relationship to the estimated air transport requirements of the travelling public of the territories of the Contracting Parties.
5. The frequencies and the schedules for the operation of the agreed services shall be established by mutual agreement between the two designated airlines and submitted to the aeronautical authorities for approval prior to the operation of the said agreed services and at least (30) days prior to their entry into force.
6. For supplementary flights which the designated airlines of one Contracting Party wishes to operate on the agreed, services, outside the approved time-table, it has to request prior permission from the aeronautical authorities of the other Contracting Party. Such request shall usually be sumitted at least (3) working-days before operating such flights.
Article XIII
Users Charges and Facilitation
1. Each Contracting Party may impose or permit to be imposed just and reasonable charges on the designated airline of the other Contracting Party. These charges shall be based on sound economic principles.
2. Charges for the use of airport and air navigation facilities and services offered by one Contracting Party to the designated airline of the other Contracting Party shall not be higher than those which have to be paid by national aircraft, operating on scheduled international services.
3. Neither of the Contracting Parties shall give preference to its own or any other airline over an airline engaged in similar international air services of the other
Contracting Party in the application of its customs, immigration, quarantine and similar regulations or in the use of airports, airways, air traffic services and associated facilities under its control.
Article XIV
Exchange of Information and Statistics
The aeronautical authorities of either Contracting Party shall supply to the aeronautical authorities of the other Contracting Party, at their request, such statistical information as may be reasonably required for the purpose of determining, the capacity to be provided by the designated airline, the amount of traffic carried on the agreed services as well as the origin and destination of no-stopover traffic, when exceptionally carried to/from third countries.
Article XV
Direct Transit Passengers in direct transit across the territory of a Contracting Party, not leaving the area of the airport reserved for such purposes, shall be subject to a simplified control. Baggage and freight in direct transit shall be exempt from customs duties and other charges.
Article XVI
Consultations
1. In the spirit of close cooperation, the aeronautical authorities of the Contracting Parties shall consult each other from time to time with a view to ensuring the implementation of, and satisfactory compliance with, the provisions of this Agreement and of its Annex.
2. Such consultations shall begin within a period of-(60) days of the date of receipt of such a request, unless otherwise agreed by the Contracting Parties.
Article XVII
Modifications
1. If either Contracting Party considers it desirable to modify any provisions of the Agreement, it may request consultations with the other Contracting Party. Such consultations between aeronautical authorities may be through discussions or by correspondance and shall begin within a period of (60) days from the date of request. Any modifications so agreed shall come into force in accordance with the procedure outline in Article XXI.
2. Modifications of the Annex to this Agreement may be made by direct agreement between the competent aeronautical authorities of the Contracting Parties.
3. The Agreement will be amended so as to conform with any multilateral convention which may become binding on both Contracting Parties.
Article XVIII
Settlement of Disputes
1. If any dispute arises between the Contracting Parties relating to the interpretation or application of this Agreement, the Contracting Parties shall in the first place -endeavor to settle it by negotiations.
2. If the Contracting Parties fail to reach a settlement by negotiations, they may agree to refer the dispute to a Tribunal of three arbitrators, one to be nominated by each Contracting Party and the third to be appointed by the two arbitrators. Each of the Contracting Parties shall nominate an arbitrator within a period of (60) days from the date of receipt by either Contracting Party of a notice through diplomatic channels requesting arbitration of the dispute and the third arbitrator shall be appointed within a further period of (60) days. If either of the Contracting Parties fails to nominate an arbitrator within the period specified, or if the third arbitrator is not appointed within the period specified, the President of the Council of the International Civil Aviation Organization may be requested by either Contracting Party to appoint an arbitrator or arbitrators as the case requires. In all cases the third arbitrator shall be a national of a third State, shall act as Chairman of the Tribunal and shall determine the place where arbitration will be held. The arbitral Tribunal shall settle its own procedure and if necessary shall decide the law to be applicable.
3. Any decision given by the arbitral Tribunal shall be binding on both Contracting Parties, unless they decide otherwise at the time of referring the dispute to an arbitral Tribunal.
4. Each Contracting Party shall bear the expenses of its arbitrator. The remaining expenses of the arbitral Tribunal shall be shared equally between the Contracting Parties.
5. If and so long as either Contracting Party fails to comply with any decision, given under paragraph 3 of this Article, the other Contracting Party may limit, withhold or revoke any rights or privileges which it has granted by virtue of this Agreement to the Contracting Party in default or to the designated airline in default.
Article XIX
Registration
This agreement and all modifications thereto shall be registered with the International Civil Aviation Organization.
Article XX
Termination
1. This Agreement shall be valid for indefinite period of time.
2. Either Contracting Party may at any time give notice, in writing to the other Contracting Party of its decision to terminate the Agreement. Such notice shall be simultaneously communicated to the International Civil Aviation Organization. In such case the Agreement shall terminate at the end of an IATA seasonal period but not less than (12) months after the date of receipt of the notice by the other Contracting Party, unless the notice of termination is withdrawn by mutual agreement before "the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received (14) days after the receipt of the notice by the International Civil Aviation Organization.
Article XXI
Entry into Force
This Agreement shall enter into force at the date on which both Contracting Parties give written notifications to each other by exchange of Diplomatic Notes that their respective internal requirements for entry into force have been fulfilled.
In witness whereof, the undersigned, being duly authorized thereto by their respective Government have signed the present Agreement.
Done in Ljubljana this 16th day of June 1993 which corresponds to the 27th of Sivan 5753, in two original copies in the English, Slovene and Hebrew languages, all the texts being equally authentic. In case of divergence of interpretation, the English text shall prevail.

to the Air Transport Agreement between the Government of Israel and the Government of the Republic of Slovenia on scheduled air Transport between their territories
1. Routes on which air services may be operated by the designated airline of the State of Israel:

Intermediate Points: Any point
Point of destination: Ljubljana
Points Beyond: Any point
2. Routes on which air services may be operated by the designated airline of the Republic of Slovenia:
Point of origin: Ljubljana

Point of destination: Tel-Aviv
Points Beyond: Any point
3. The designated airlines of the Contracting Parties shall not exercise 5th freedom traffic rights to/from third countries unless they mutually agree otherwise. Such agreements have to be approved by both aeronautical authorities before their implementation.
4. Any or all of the intermediate or beyond points may, at the opinion of the designated airline, be omitted on any or all flights provided that the services begin or terminate in the territory of the party designating the airline.
