Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Litve o ponovnem sprejemu oseb, katerih vstop v državo ali bivanje v njej sta v nasprotju z veljavnimi predpisi države (BLIPSO), ki ga je sprejel Državni zbor Republike Slovenije na seji dne 19. februarja 1997.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE LITVE O PONOVNEM SPREJEMU OSEB, KATERIH VSTOP V DRŽAVO ALI BIVANJE V NJEJ STA V NASPROTJU Z VELJAVNIMI PREDPISI DRŽAVE (BLIPSO)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Litve o ponovnem sprejemu oseb, katerih vstop v državo ali bivanje v njej sta v nasprotju z veljavnimi predpisi države, podpisan v Ljubljani dne 6. maja 1996.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE LITVE O PONOVNEM SPREJEMU OSEB, KATERIH VSTOP V DRŽAVO ALI BIVANJE V NJEJ STA V NASPROTJU S PREDPISI DRŽAVE
Vlada Republike Slovenije in Vlada Republike Litve sta se
upoštevaje svoj skupni cilj, da olajšata težave, ki bi utegnile nastati zaradi obojestranske odprave vizumov za kratko turistično bivanje njunih državljanov
in z željo, da v duhu dobrega sodelovanja na bazi vzajemnosti olajšata ponoven sprejem oseb, katerih vstop v državo ali bivanje v njej sta v nasprotju s predpisi države,
dogovorili naslednje:
I. PONOVEN SPREJEM DRŽAVLJANOV DRŽAV POGODBENIC
1. člen
(1) Vsaka država pogodbenica je dolžna na zahtevo druge države pogodbenice in brez formalnosti ponovno sprejeti na svoje ozemlje vsako osebo, ki ne izpolnjuje ali ne izpolnjuje več pogojev za vstop ali bivanje, ki veljajo na ozemlju države prosilke, če je bilo ugotovljeno ali se domneva, da ima ta oseba državljanstvo zaprošene države.
(2) Državljanstvo se lahko ugotavlja ali domneva na podlagi potrdila o državljanstvu, potnega lista ali osebne izkaznice, tudi če so bili ti dokumenti izdani nepravilno ali če je njihova veljavnost potekla pred manj kot tremi leti. Državljanstvo se lahko domneva tudi na podlagi drugih podatkov.
(3) Država prosilka je dolžna osebo pod istimi pogoji ponovno sprejeti, tudi če se z nadaljnjim preverjanjem ugotovi, da oseba v trenutku, ko je zapustila ozemlje države prosilke, ni imela državljanstva zaprošene države.
II. PONOVEN SPREJEM DRŽAVLJANOV TRETJIH DRŽAV IN OSEB BREZ DRŽAVLJANSTVA
2. člen
(1) Vsaka država pogodbenica je dolžna na zahtevo druge države pogodbenice in brez formalnosti ponovno sprejeti državljana tretje države ali osebo brez državljanstva, ki ne izpolnjuje ali ne izpolnjuje več pogojev za vstop ali bivanje, ki veljajo na ozemlju države prosilke, če se ugotovi, da je taka oseba stopila na ozemlje pogodbenice po bivanju na ozemlju zaprošene države ali potovanju skozenj.
(2) Vsaka država pogodbenica je dolžna na zahtevo druge države pogodbenice in brez formalnosti ponovno sprejeti državljana tretje države ali osebo brez državljanstva, ki ne izpolnjuje ali ne izpolnjuje več pogojev za bivanje ali vstop, ki veljajo na ozemlju države prosilke, če ima taka oseba veljaven vizum ali kako drugo veljavno dovoljenje za bivanje, ki ga je izdala zaprošena država.
3. člen
(1) Obveznost ponovnega sprejema, predpisana v 2. členu, ne velja, kadar gre za:
a) državljane tretjih držav, ki imajo skupno mejo z državo prosilko;
b) državljane tretjih držav ali osebe brez državljanstva, ki so po zapustitvi ozemlja zaprošene države ali po vstopu na ozemlje države prosilke od slednje dobili vizum ali dovoljenje za bivanje;
c) državljane tretjih držav ali osebe brez državljanstva, ki so zadnjih šest mesecev bivali na ozemlju države prosilke;
d) državljane tretjih držav ali osebe brez državljanstva, ki jim je zaprošena država priznala bodisi status begunca na podlagi določil Ženevske konvencije o statusu beguncev z dne 28. julija 1951, dopolnjene z Newyorškim protokolom z dne 31. januarja 1967, ali status osebe brez državljanstva na podlagi Newyorške konvencije o statusu oseb brez državljanstva z dne 28. septembra 1954;
e) državljane tretjih držav ali osebe brez državljanstva, ki jih je zaprošena država dejansko vrnila v njihovo matično državo ali v kako tretjo državo.
4. člen
Država prosilka se obvezuje, da bo ponovno sprejela na svoje lastno ozemlje državljane tretjih držav ali osebe brez državljanstva, za katere bi se po ustreznih preverbah zaprošene države ugotovilo, da v času njihovega odhoda z ozemlja države prosilke ne ustrezajo določilom 2. in 3. člena tega sporazuma.
III. POSTOPEK PONOVNEGA SPREJEMA
5. člen
(1) Zaprošena država je dolžna v osmih dneh pisno odgovoriti na prošnjo za ponoven sprejem. Zavrnitev ponovnega sprejema je treba utemeljiti.
(2) Zaprošena država je dolžna najpozneje v enem mesecu ponovno sprejeti osebo, za katero je bil potrjen ponoven sprejem. Ta rok se lahko podaljša na zahtevo države prosilke.
6. člen
Zaprošena država je dolžna državi prosilki izdati potrditev ponovnega sprejema, z identifikacijskimi podatki osebe, za katero se zahteva ponoven sprejem, in z morebitnimi dokumenti take osebe.
7. člen
Država prosilka je dolžna kriti stroške prevoza oseb, ki naj bi jih ponovno sprejeli na meji zaprošene države. Država prosilka nosi tudi vse stroške v primeru ponovnega sprejema oseb, če bi bil potreben.
IV. TRANZIT V PRIMERU ZAVRNITVE
8. člen
(1) Vsaka država pogodbenica bo na zahtevo druge države pogodbenice dovolila vstop na svoje ozemlje ali tranzit čezenj državljanom tretjih držav ali osebam brez državljanstva, ki jih je država prosilka zavrnila na meji. Tranzit se lahko opravi po cesti, železnici ali z letalom.
(2) Država prosilka prevzame polno odgovornost za nadaljevanje potovanja take osebe v namembno državo in bo tako osebo ponovno sprejela, če se ukrep zavrnitve iz kakršnegakoli razloga ne bi mogel izvršiti.
(3) Država prosilka bo zaprošeni državi potrdila, da ima oseba, za katero je bil odobren tranzit, dokument za prevoz v namembno državo.
9. člen
(1) Država pogodbenica, ki je uporabila ukrep izgona, je dolžna obvestiti zaprošeno državo, ali zavrnjena oseba potrebuje spremstvo. Zaprošena država se v zvezi s tranzitom lahko:
– odloči, da bo sama določila spremstvo;
– odloči, da bo določila spremstvo skupaj s pogodbenico, ki je uporabila ukrep izgona.
(2) Če se tranzit opravi z letalsko družbo pogodbenice, ki je uporabila ukrep izgona, in s policijskim spremstvom, to lahko opravi država pogodbenica sama, pod pogojem da ne zapustijo mednarodnega pasu na letališču zaprošene države.
(3) Če se tranzit opravi z letalsko družbo zaprošene države in s policijskim spremstvom, tedaj to opravi zaprošena država, pog pogojem, da država, ki je uporabila ukrep izgona, krije vse nastale stroške.
(4) Če se mora tranzit izjemoma opraviti po cesti ali železnici, se državi pogodbenici dogovorita o nujnosti in izvedbi spremstva.
10. člen
Zahtevo za tranzit si neposredno izmenjata ustrezna organa držav pogodbenic. Zahteva mora vsebovati vse podatke o istovetnosti in državljanstvu osebe, datum potovanja, čas in kraj prihoda v tranzitno državo ter čas in kraj odhoda iz nje v namembno državo, vključno z vsemi podatki uradnih oseb, ki bi spremljale tako osebo.
11. člen
Tranzit se lahko zavrne:
– če se oseba v njeni namembni državi kazensko preganja zaradi rase, veroizpovedi, narodnosti ali pripadnosti določeni družbeni skupini ali zaradi njenega političnega prepričanja;
– če osebi grozi, da bo v namembni državi preganjana ali kaznovana za kazniva dejanja, storjena pred tranzitom.
12. člen
Država prosilka je dolžna kriti vse stroške tranzita do meje namembne države kot tudi vse stroške, ki bi nastali v primeru vračanja.
V. SPLOŠNE DOLOČBE
13. člen
Državi pogodbenici bosta z izmenjavo not med ministroma, odgovornima za nadzor državne meje, določili
– letališča, ki se bodo uporabljala za ponoven sprejem ali za vstop oseb, ki so v tranzitu;
– državne in lokalne organe, katerih naloga je obravnavati zahteve za ponoven sprejem ali tranzit.
14. člen
(1) Določila tega sporazuma ne posegajo v obveznosti ponovnega sprejemanja ali vračanja tujih državljanov, ki izhajajo iz drugih mednarodnih pogodb, katerih podpisnici sta državi pogodbenici.
(2) Določila tega sporazuma niso ovira za uporabo določil Ženevske konvencije o statusu beguncev z dne 28. julija 1951 in določil Newyorškega protokola z dne 31. januarja 1967.
(3) Določila tega sporazuma niso ovira za uporabo določil Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin z dne 4. novembra 1950.
15. člen
(1) Vsaka država pogodbenica je drugo dolžna obvestiti o končanju vseh potrebnih ustavnih postopkov za ratifikacijo tega sporazuma, ki začne veljati trideset dni po prejemu zadnjega obvestila.
(2) Ta sporazum se začasno uporablja od dneva podpisa.
(3) Ta sporazum je sklenjen za nedoločen čas. Lahko se ga odpove po diplomatski poti s trimesečnim odpovednim rokom.
V potrditev zgornjega so ta sporazum podpisali predstavniki obeh držav pogodbenic, pravilno pooblaščeni za ta namen.
Sestavljeno v Ljubljani dne 6. maja 1996 v dveh izvodih v slovenskem, litvanskem in angleškem jeziku, pri čemer so vsa tri besedila enako verodostojna. V primeru spora ali razlike pri razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF LITHUANIA ON READMISSION OF THOSE PERSONS WHOSE ENTRY INTO OR RESIDENCE IN A COUNTRY ARE CONTRARY TO THE NATIONAL LAW
The Government of the Republic of Slovenia and the Government of the Republic of Lithuania
considering their common aim to facilitate the difficulties, which might appear because of the mutual abolishment of visas for short sojourn of their citizens during their travels;
with a desire to facilitate, in the spirit of good co-operation and on the mutual basis, the readmission of persons, whose entry into or residence in a country are contrary to the national law;
have agreed as follows:
I. READMISSION OF THE CITIZENS OF THE CONTRACTING STATES
Article 1
(1) Each Contracting State shall, upon request of the other Contracting State and without any formalities, readmit to its territory any person, which does not, or does not any more, comply with the conditions for entry or stay, applicable in the territory of the requesting Contracting State, if it is ascertained or presumed, that such person has the citizenship of the requested Contracting State.
(2) The citizenship may be ascertained or presumed on the basis of a citizenship certificate, a passport or an identity card, even if such documents were issued incorrectly or if they expired not more than three years ago. The citizenship may be presumed also on the basis of other data.
(3) The requesting Contracting State shall, under the same conditions, readmit a person, even if it has been ascertained through further verifications that at the moment of leaving the territory of the requesting Contracting State, the person did not have the citizenship of the requested Contracting State.
II. READMISSION OF CITIZENS OF THIRD STATES AND STATELESS PERSONS
Article 2
(1) Either Contracting State shall readmit to its territory, upon a request of the other Contracting State and without any formalities, a citizen of a third state or a stateless person who does not, or does not any more comply with the conditions for entry or residence applicable in the territory of the requesting Contracting State, if it was ascertained that such person had entered the territory of the Contracting State after having sojourned in or travelled through the territory of the requested Contracting State.
(2) Either Contracting State shall, upon a request of the other Contracting State and without any formalities, readmit a citizen of a third state or a stateless person who does not, or does not any more, comply with the conditions for residence or entry applicable in the territory of the requesting Contracting State, if such person has a valid visa or any other valid residential permit, issued by the requested Contracting State.
Article 3
(1) The obligation of readmission as provided in Article 2, shall not exist in case of:
a) citizens of third states, that have a common state border with the requesting Contracting State;
b) citizens of third states or stateless persons, who obtained, after they left the territory of the requested Contracting State or after they entered the territory of the requesting Contracting State, a visa or residential permit from the latter;
c) citizens of third states or stateless persons, who have resided in the territory of the requesting Contracting State for the last six months;
d) citizens of third states or stateless persons, who were recognised by the requested Contracting State either the status of refugee on the basis of the provisions of the Geneva Convention of July 28, 1951 on the Status of the Refugees, complemented by the New York Protocol of January 31, 1967, or the status of stateless Persons on the basis of the New York Convention on the Status of Stateless Persons of September 28, 1954;
e) citizens of third states or stateless persons, actually returned by the requested Contracting State to their state of origin or to any other third state.
Article 4
The requesting Contracting State agrees to readmit to its own territory those citizens of third states or stateless persons for whom it would be ascertained, after adequate verifications made by the requested Contracting State, that they do not comply with the clauses under Articles 2 and 3 of the present Agreement at the time of their departure from the territory of the requesting Contracting State.
III. READMISSION PROCEDURE
Article 5
(1) The requested Contracting State is obliged to answer the request for readmission in writing within eight days. Any refusal of the readmission shall be founded.
(2) The requested Contracting State shall, within one month at the latest, readmit a person whose readmission was confirmed. This period may be extended upon request by the requesting Contracting State.
Article 6
The requested Contracting State shall issue a confirmation of readmission to the requesting Contracting State, including the identity data of the person whose readmission was requested, and any possible documents of such person.
Article 7
The requesting Contracting State shall cover the expenses of transportation of persons to be readmitted to the border of the requested Contracting State. The requesting Contracting State shall bear also all the expenses in case of readmission of persons, if necessary.
IV. TRANSIT IN CASE OF REJECTION
Article 8
(1) Either Contracting State will allow, upon request from the other Contracting State, entry into, and transit through, its territory to citizens of third states or stateless persons who were rejected by the requesting Contracting State at the border. The transit may be made by road, railway or air transport.
(2) The requesting Contracting State shall take full responsibility for the continuation of the travel of such person to the country of destination and will readmit such person, if the measure of rejection cannot be carried out for any reason.
(3) The requesting Contracting State will confirm to the requested Contracting State, that the person for whom the transit was approved, has a document for the transportation to the State of destination.
Article 9
(1) The Contracting State that implemented the measure of expulsion, shall inform the requested Contracting State in case the rejected person needs an escort. The requested Contracting State may, in connection with the transit:
– decide to appoint its own escort;
– decide to appoint escort in coordination with the Contracting State that implemented the measure of expulsion.
(2) If the transit is performed by an airline company of the Contracting State that applied the measure of expulsion, and with a police escort, this can be done by the Contracting State alone, under the condition that they do not leave the international zone at the airport of the requested Contracting State.
(3) If the transit is performed by an airline company of the requested Contracting State and with a police escort, this will be provided for by the requested State under the condition, that the Contracting State that applied the measure of expulsion covers all the expenses that may occur.
(4) If a transit must be, exceptionally, done by road or railway, the Contracting States shall agree about the necessity and modality of the escort.
Article 10
The request for the transit shall be exchanged directly between the adequate authorities of the Contracting States. The request should contain all data pertaining to the identity and citizenship of the person, the date of travel, the time and place of the arrival to the transit state as well as the time and place of the departure from it to the state of destination and including all data of the officials, if they accompany such a person.
Article 11
The transit may be rejected:
– if the person is prosecuted in his/her destination state because of his/her race, religion, ethnicity or membership of a certain social group or because of his/her political opinion;
– if the person is threatened to be prosecuted or sentenced in the state of destination for criminal offences, committed before the transit.
Article 12
The requesting Contracting State shall cover all the expenses of the transit to the border of the state of destination, as well as any expenses which may occur in case of return.
V. GENERAL CLAUSES
Article 13
The Contracting States shall define, with an exchange of notes between the ministers responsible for the border control:
– the airports, that may be used for the readmission or for entry of persons in transit;
– the state and local authorities responsible for dealing with applications for readmission or transit.
Article 14
(1) The provisions of the present Agreement shall not interfere with any obligations of readmission or return of foreign citizens which derive from other international agreements signed by the Contracting States.
(2) The provisions of the present Agreement shall not prevent the application of the provisions of the Geneva Convention of July 28, 1951 concerning the refugee status and the provisions of the New York Protocol of January 31, 1967.
(3) The provisions of the present Agreement shall not prevent the application of the provisions of the European Convention on the Protection of Human Rights and Fundamental Freedoms of November 4, 1950.
Article 15
(1) Either Contracting State shall notify the other of the completion of all necessary constitutional procedures for the ratification of the present Agreement which shall become effective thirty days after the receipt of the last notice.
(2) This Agreement shall be temporarily in use from the day of its signature.
(3) This Agreement is signed for an indefinite period. It may be terminated with a three months notice through diplomatic channels.
In confirmation of the above the representatives of both Contracting States, duly authorised for this purpose, signed the present Agreement.
Done at Ljubljana on the 6th day of May 1996 in two copies in Slovene, Lithuanian and English languages, all three texts being equally authentic. In case of any dispute or difference in the interpretation of the present Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
