Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Kraljevine Danske o ponovnem sprejemu državljanov ene od obeh držav in tujcev, ki nezakonito bivajo na ozemlju druge države (BDKPSD), ki ga je sprejel Državni zbor Republike Slovenije na seji 29. julija 1997.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE DANSKE O PONOVNEM SPREJEMU DRŽAVLJANOV ENE OD OBEH DRŽAV IN TUJCEV, KI NEZAKONITO BIVAJO NA OZEMLJU DRUGE DRŽAVE (BDKPSD)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Kraljevine Danske o ponovnem sprejemu državljanov ene od obeh držav in tujcev, ki nezakonito bivajo na ozemlju druge države, podpisan v Kopenhagnu dne 7. maja 1997.
2. člen
Sporazum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
A G R E E M E N T
between the Government of the Republic of Slovenia and the Government of the Kingdom of Denmark regarding readmission of citizens of one of the two states and aliens, who are staying illegally in the territory of the other State
The Government of the Republic of Slovenia and the Government of the Kingdom of Denmark (hereinafter referred to as the Contracting Parties),
in order to further improve the connections between the two states and their citizens, in accordance with the two states’ existing legislation in force,
in the light of the international practice in this area and with respect for the international obligations entered upon,
have agreed as follows:
Article 1
Concepts
In this Agreement the following concepts have the following meaning:
1. an alien – a person who is neither Slovenian nor Danish citizen;
2. a visa – a valid permission issued by a competent authority of the Contracting Party, entitling the alien to enter the country and to reside there without interruption for a period not exceeding three months;
3. a residence permit – a valid permission issued by a competent authority of the Contracting Party, entitling the person to enter the country repeatedly and to reside in the country. Residence permit does not mean a visa nor a possibility to stay in the territory of a Contracting Party during the consideration of an application for asylum or during an expulsion procedure.
Article 2
Proof of Citizenship
1. Proof of citizenship is a valid passport or identity documents, issued by the competent authorities in the country of origin of the readmitted persons or by a diplomatic or consular mission in the requested state.
2. Citizenship is considered probable, if the person is in possession of the documents under Article 2, section 1, even if expired or a seaman‘s book, a driving licence or a similar document, even if this has expired.
3. Citizenship is also assumed to exist, if this, after an investigation, is rendered probable in any other way.
Article 3
Readmission of own citizens
1. Each Contracting Party shall readmit at the request of the other Contracting Party and without any formality persons who do not, or who no longer, fulfil the conditions in force for entry or residence on the territory of the requesting Contracting Party provided that it is proved or may be validly assumed that they possess the citizenship of the requested Contracted Party. The same shall apply to persons who have been deprived of the citizenship of the requested Contracting Party since entering the territory of the requesting Contracting Party without at least having been promised naturalization by the requesting Contracting Party.
2. Upon application by a Contracting Party, the requested Contracting Party shall without delay provide the persons to be readmitted with the travel documents required for their repatriation.
3. A requesting Contracting Party shall readmit such persons again under the same conditions if checks reveal that they were not in possession of the citizenship of the requested Contracting Party when they departed from the territory of the requesting Contracting Party. This shall not apply if the readmission obligation is based on the fact that the requested Contracting Party deprived the person in question of its citizenship after that person had entered the territory of the requesting Contracting Party without that person at least having been promised naturalization by the requesting Contracting Party.
Article 4
Readmission of an alien on the basis of an advance notification
A Contracting Party shall readmit without any formality an alien who has entered the territory of the other Contracting Party directly from its territory, on the basis of an advance notification by the competent authority of the other Contracting Party, if no more than 7 days have passed since entry.
Article 5
Readmission in the case of third–country nationals who entered via the external frontier
1. A Contracting Party shall, at the request of the other Contracting Party, readmit an alien who has arrived in the territory of the requesting Contracting Party directly from the territory of the requested Contracting Party and the entry or residence of whom does not fulfil the provisions in the legislation of the requesting Contracting Party.
2. A residence permit obtained by fraud or on grounds that were not correct is exempt from section 1.
3. A Contracting Party shall also, at the request of the other Contracting Party, readmit an alien who resides illegally in the territory of the requesting Contracting Party and who is in possession of a valid residence permit, a visa other than a transit visa issued by the requested Contracting Party, or who has previously stayed for a period exceeding 3 years in the territory of the requested Contracting Party, or who has had a citizenship in the requested Contracting Party.
4. Section 1 and 2 shall not apply where a transit visa was issued.
Article 6
Time limits
1. A Contracting Party shall reply to the readmission requests addressed to it without delay and, in any event, at the latest within twenty days from the presentation of the request. It is possible to make the readmission request by mail, by handing the request directly to the competent authority of the other Contracting Party or through electronic means of communication.
2. The requested Contracting Party shall take charge of persons immediately after the request has been approved and, in any event, at the latest within 3 months from the approval. Upon notification by the requesting Contracting Party this time limit shall be extended by the time necessary for the clearing of legal or practical obstacles.
Article 7
Transit
1. Without prejudice to Article 11, the Contracting Parties shall allow aliens to pass through their territory in transit if the other Contracting Party requests and if admission to other possible States of transit and to the State of destination is assured.
2. It shall not be essential for the requested Contracting Party to issue a transit visa.
3. Notwithstanding any authorization issued, persons taken in charge for transit purposes may be returned to the other Contracting Party if circumstances within the meaning of Article 11 subsequently arise or come to light which stand in the way of a transit operation or if the onward journey or admission by the State of destination is no longer assured.
4. The Contracting Parties shall endeavour to restrict transit operations to aliens who cannot be returned to their States of origin directly.
Article 8
Providing information
Insofar as information on individual cases has to be provided to the other Contracting Party in order to implement this Agreement, such information may concern the following:
a) the particulars of the person and where necessary, of the members of the person´s family (surname, given name, any previous names, nicknames or pseudonyms, aliases, date and place of birth, sex, current and any previous nationality/citizenship);
b) passport, identity card or other travel documents (number, date of issue, issuing authority, place of issue, period of validity, territory of validity);
c) other details needed to identify the persons;
d) residence permits and visas issued by the Contracting Parties or by third states, itinerary, stopping places, travel tickets and other possible travel arrangements;
e) any information which can prove or make it sufficiently probable that the person has stayed in the territory of the Contracting Parties;
f) if necessary, the need for special assistance to elderly or sick persons should be notified.
Article 9
Implementing provisions
1. Upon signature of this Agreement the Contracting Parties shall inform each other through diplomatic channels of the competent authorities responsible for the implementation of this Agreement and of their addresses and other information facilitating communication. The Contracting Parties shall also inform each other of changes with respect to these authorities.
2. The competent authorities shall meet as the need arises and they shall decide on practical arrangements required for the implementation of this Agreement.
Article 10
Costs
The Contracting Party which requests a readmission, defrays the transport expenses to the country of destination for the returned person and accompanying persons.
Article 11
International agreements which are not affected by this Agreement
1. The Convention of 28 July 1951 on the Status of Refugees as amended by the Protocol of 31 January 1967 on the Status of Refugees;
2. International conventions on extradition and transit;
3. The Convention of 4 November 1950 for the Protection of Human Rights and Fundamental Freedoms;
4. International conventions on asylum, in particular the Dublin Convention of 15 June 1990 determining the State responsible for examining applications for asylum lodged in a Member State of the European Community;
5. The Treaties of the European Community;
6. The Schengen Convention of 19 June 1990;
7. International conventions and agreements on the readmission of foreign nationals.
Article 12
Final provisions
1. This Agreement shall enter into force on 1 September 1997.
2. Each Contracting Party may temporarily suspend this Agreement on the grounds of the protection of State security, public order or public health, by notifying the other Contracting Party in writing. The suspension shall become effective immediately.
3. This Agreement shall remain in force until further notice. Each Contracting Party may denounce this Agreement by notifying the other Contracting Party in writing. The denunciation shall become effective on the first day of the month following the month in which the notification thereof was received by the other Contracting Party.
4. This Agreement shall apply to all persons who are staying in the territory of the Contracting Parties at the time of the entry into force of this Agreement or after.

S P O R A Z U M
med Vlado Republike Slovenije in Vlado Kraljevine Danske o ponovnem sprejemu državljanov ene od obeh držav in tujcev, ki nezakonito bivajo na ozemlju druge države
Vlada Republike Slovenije in Vlada Kraljevine Danske (v nadaljevanju pogodbenici) sta se,
da bi še izboljšali povezave med državama in njunimi državljani v skladu z obstoječo veljavno zakonodajo obeh držav,
v smislu mednarodne prakse na tem področju in glede na mednarodne obveznosti, ki sta jih sprejeli,
dogovorili kot sledi:
1. člen
Pojmi
V tem sporazumu imajo naslednji pojmi tale pomen:
1. tujec – oseba, ki ni državljan Slovenije ali Danske;
2. vizum – veljavno dovoljenje, ki ga izda pristojni organ pogodbenice, in omogoča tujcu, da vstopi v državo in v njej neprekinjeno biva največ tri mesece;
3. dovoljenje za bivanje – veljavno dovoljenje, ki ga izda pristojni organ pogodbenice in daje osebi možnost, da večkrat vstopi v državo in biva v njej. Dovoljenje za bivanje ni enako vizumu in ne daje možnosti bivanja na ozemlju pogodbenice v času obravnave prošnje za azil ali med postopkom izgona.
2. člen
Dokazilo o državljanstvu
1. Dokazilo o državljanstvu je veljaven potni list, ali dokumenti, ki dokazujejo istovetnost, ki jih izdajo pristojni organi v matični državi ponovno sprejetih oseb, ali diplomatsko ali konzularno predstavništvo v zaprošeni državi.
2. Državljanstvo se šteje za verjetno, če ima oseba dokumente navedene v 1. delu 2. člena, tudi če so že potekli, ali če ima pomorsko knjižico, vozniško dovoljenje ali podoben dokument, tudi če je že potekel.
3. Sklepa se, da državljanstvo obstaja tudi, če se po preverjanju na kakršen koli drug način izkaže za verjetno.
3. člen
Ponovni sprejem lastnih državljanov
1. Vsaka pogodbenica na prošnjo druge pogodbenice in brez vseh formalnosti ponovno sprejme osebe, ki ne izpolnjujejo pogojev, ki veljajo za vstop na ozemlje pogodbenice prosilke ali za bivanje na tem ozemlju, oziroma ki teh pogojev ne izpolnjujejo več, če je dokazano, ali se lahko veljavno sklepa, da imajo te osebe državljanstvo zaprošene pogodbenice. Isto velja za osebe, ki se jim je ob vstopu na ozemlje pogodbenice prosilke odvzelo državljanstvo zaprošene pogodbenice, ne da bi jim pogodbenica prosilka vsaj obljubila svoje državljanstvo.
2. Na podlagi vloge pogodbenice zaprošena pogodbenica osebam, ki naj bi jih ponovno sprejela, brez odloga priskrbi potne listine, potrebne za njihovo repatriacijo.
3. Pogodbenica prosilka ponovno sprejme takšne osebe pod enakimi pogoji, če preiskava razkrije, da v času odhoda z ozemlja pogodbenice prosilke te osebe niso imele državljanstva zaprošene pogodbenice. To ne velja, če obveznost ponovnega sprejema temelji na dejstvu, da je zaprošena pogodbenica odvzela zadevni osebi svoje državljanstvo potem, ko je ta oseba vstopila na ozemlje pogodbenice prosilke, ne da bi ji ta vsaj obljubila svoje državljanstvo.
4. člen
Ponovni sprejem tujca na podlagi vnaprejšnjega uradnega obvestila
Pogodbenica brez formalnosti ponovno sprejme tujca, ki je vstopil na ozemlje druge pogodbenice neposredno z njenega ozemlja, na podlagi vnaprejšnjega uradnega obvestila pristojnega organa druge pogodbenice, če ni od vstopa preteklo več kot 7 dni.
5. člen
Ponovni sprejem v primeru državljanov tretje države, ki so vstopili preko zunanje meje
1. Pogodbenica na prošnjo druge pogodbenice ponovno sprejme tujca, ki je prispel na ozemlje pogodbenice prosilke neposredno z ozemlja zaprošene pogodbenice in katerega vstop ali bivanje nista v skladu z določbami zakonodaje pogodbenice prosilke.
2. Dovoljenje za bivanje, ki se pridobi z goljufijo ali na nepravilen način, je izključeno iz 1. dela.
3. Pogodbenica na prošnjo druge pogodbenice ponovno sprejme tudi tujca, ki nezakonito biva na ozemlju pogodbenice prosilke in ima veljavno dovoljenje za bivanje, vizum, ki ni tranzitni vizum, ki ga je izdala zaprošena pogodbenica, ali ki je pred tem več kot tri leta bival na ozemlju zaprošene pogodbenice, ali imel državljanstvo v zaprošeni pogodbenici.
4. 1. in 2. del se ne uporabljata v primeru, ko je bil izdan tranzitni vizum.
6. člen
Roki
1. Pogodbenica na prošnje za ponovni sprejem, ki so nanjo naslovljene, odgovori brez odloga in v vsakem primeru najkasneje dvajset dni po predložitvi prošnje. Prošnja za ponovni sprejem se lahko pošlje po pošti, neposredno izroči pristojnemu organu druge pogodbenice ali posreduje preko elektronskih sredstev komunikacije.
2. Zaprošena pogodbenica prevzame skrb nad osebami takoj po odobritvi prošnje in v vsakem primeru najkasneje v treh mesecih po odobritvi. V primeru obvestila pogodbenice prosilke se ta rok podaljša za čas, potreben za odstranitev zakonskih ali praktičnih ovir.
7. člen
Tranzit
1. Brez poseganja v 11. člen pogodbenici dovolita tujcem, da v tranzitu prečkajo njuno ozemlje, če to zaprosi druga pogodbenica in če je zagotovljen sprejem drugih možnih tranzitnih držav in namembne države.
2. Za zaprošeno pogodbenico ni bistveno, da izda tranzitni vizum.
3. Ne glede na katero koli izdano pooblastilo, se lahko osebe, ki se prevzamejo za tranzit, vrnejo drugi pogodbenici, če se kasneje pojavijo ali razkrijejo okoliščine, navedene v 11. členu, ki preprečujejo izvajanje tranzita, ali če ni več zagotovljeno nadaljnje potovanje v namembno državo ali sprejem v njej.
4. Pogodbenici si prizadevata omejiti izvajanje tranzita na tujce, ki jih ni mogoče neposredno vrniti v njihove matične države.
8. člen
Zagotavljanje podatkov
Če je treba za izvajanje tega sporazuma drugi pogodbenici zagotoviti podatke o posameznih primerih, lahko ti podatki zadevajo:
a) podatke o osebi in, če je potrebno, o članih družine osebe (priimek, ime, vsa prejšnja imena, vzdevki ali psevdonimi, privzeta imena, datum in kraj rojstva, spol, sedanja in vse prejšnje narodnosti/državljanstva);
b) potni list, osebno izkaznico ali druge potne listine (številko, datum izdaje, organ, ki jih je izdal, kraj izdaje, obdobje veljavnosti, ozemlje, kjer veljajo);
c) druge podrobnosti, potrebne za ugotavljanje identitete oseb;
d) dovoljenja za bivanje in vizumi, ki sta jih izdali pogodbenici ali so jih izdale tretje države, načrt potovanja, mesta postankov, vozovnice in druge možne dogovore v zvezi s potovanjem;
e) kakršne koli podatke, ki lahko dokažejo ali kažejo na verjetnost, da je oseba bivala na ozemlju pogodbenic;
f) po potrebi je treba sporočiti nujnost posebne pomoči ostarelim ali bolnim osebam.
9. člen
Izvajanje določb
1. Ob podpisu tega sporazuma pogodbenici po diplomatski poti obvestita druga drugo o pristojnih organih, odgovornih za izvjanje tega sporazuma, in posredujeta njihove naslove ter druge podatke, ki olajšajo komunikacije. Pogodbenici druga drugo obvestita tudi o spremembah v zvezi s temi organi.
2. Pristojni organi se sestajajo po potrebi in odločajo o praktičnih dogovorih, potrebnih za izvajanje tega sporazuma.
10. člen
Stroški
Pogodbenica, ki zaprosi za ponovni sprejem, poravna stroške prevoza v namembno državo za vrnjeno osebo in osebo, ki jo spremlja.
11. člen
Mednarodni sporazumi, na katere ta sporazum ne vpliva
1. Konvencija o statusu beguncev z dne 28. julija 1951 kot je bila spremenjena oziroma dopolnjena s Protokolom o statusu beguncev z dne 31. januarja 1967;
2. Mednarodne konvencije o izročitvi in tranzitu;
3. Konvencija o varstvu človekovih pravic in temeljnih svoboščin z dne 4. novembra 1950;
4. Mednarodne konvencije o azilu, še posebej Dublinska konvencija z dne 15. junija 1990, ki določa državo, odgovorno za pregled prošenj za azil, vloženih v državi članici Evropske skupnosti;
5. Pogodbe Evropske skupnosti;
6. Schengenska konvencija z dne 19. junija 1990;
7. Mednarodne konvencije in sporazumi o ponovnem sprejemu tujih državljanov.
12. člen
Končne določbe
1. Ta sporazum začne veljati 1. septembra 1997.
2. Vsaka pogodbenica lahko s pisnim obvestilom drugi pogodbenici začasno prekine izvajanje tega sporazuma zaradi varovanja državne varnosti, javnega reda ali javnega zdravja. Prekinitev izvajanja začne veljati takoj.
3. Ta sprazum je veljaven do nadaljnjega obvestila. Vsaka pogodbenica lahko odpove ta sporazum s pisnim obvestilom drugi pogodbenici. Odpoved začne veljati na prvi dan v mesecu, ki sledi mesecu, v katerem je druga pogodbenica prejela to obvestilo.
4. Ta sporazum se uporablja za vse osebe, ki so na ozemlju pogodbenic v času, ko začne ta sporazum veljati, ali kasneje.
Sestavljeno v Kopenhagnu dne 7. maja 1997 v dveh izvodih, v angleškem jeziku.

3. člen
Za izvajanje sporazuma skrbita Ministrstvo za notranje zadeve in Ministrstvo za zunanje zadeve.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
