Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Malezije o zračnem prometu med njunima ozemljema in zunaj njunih ozemelj (BMAZP), ki ga je sprejel Državni zbor Republike Slovenije na seji 26. maja 1998.

1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Malezije o zračnem prometu med njunima ozemljema in zunaj njunih ozemelj, podpisan v Ljubljani 28. oktobra 1997.
2. člen
Sporazum se v izvirnikih v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO MALEZIJE O ZRAČNEM PROMETU MED NJUNIMA OZEMLJEMA IN ZUNAJ NJUNIH OZEMELJ
Vlada Republike Slovenije in Vlada Malezije sta se kot
pogodbenici Konvencije o mednarodnem civilnem letalstvu in
v želji, da bi sklenili sporazum o ustanovitvi zračnega prometa med njunima ozemljema in zunaj njunih ozemelj,
sporazumeli o naslednjem:
1. člen
Definicije
Za namen tega sporazuma, razen če besedilo ne zahteva drugače:
(a) pojem “konvencija” pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila na voljo za podpis v Chicagu 7. decembra 1944, in vključuje vsako prilogo, sprejeto na podlagi 90. člena omenjene konvencije, ter vsako spremembo prilog ali konvencije v skladu z njenim 90. in 94. členom, kolikor veljajo za obe pogodbenici;
(b) pojem “pristojna organa” pomeni za Republiko Slovenijo Ministrstvo za promet in zveze oziroma katero koli osebo ali organ, pooblaščen za opravljanje nalog, ki jih zdaj opravlja omenjeno ministrstvo, ali podobnih nalog, in za Malezijo ministra za promet in katero koli osebo ali organ, pooblaščen za opravljanje nalog, ki jih zdaj opravlja omenjeni minister, ali podobnih nalog;
(c) pojem “določeni prevoznik” pomeni letalskega prevoznika oziroma letalske prevoznike, ki jih določi ena pogodbenica, o čemer pisno obvesti drugo pogodbenico v skladu s 3. členom tega sporazuma, za opravljanje dogovorjenega prometa na progah, ki so navedene v takem obvestilu;
(d) pojmi “ozemlje” in “zračni promet”, “mednarodni zračni promet”, “prevoznik” in “pristanek v nekomercialne namene” imajo pomen, ki ga določata 2. in 96. člen konvencije;
(e) pojem “tarifa” pomeni cene, ki jih je treba plačati za prevoz potnikov, prtljage in tovora, ter pogoje, ki veljajo za te cene, vključno s provizijo in drugimi dodatnimi plačili za agencijo ali za prodajo prevoznih listin, razen nadomestil in pogojev za prevoz pošte;
(f) pojem “priloga k temu sporazumu” pomeni pregled prog tega sporazuma oziroma spremembe in dopolnila v skladu z določbami 15. člena tega sporazuma. “Priloga k temu sporazumu” je sestavni del tega sporazuma in vsako sklicevanje na sporazum pomeni tudi sklicevanje na prilogo, razen kadar je to drugače določeno.
2. člen
Prometne pravice
(1) Vsaka pogodbenica prizna drugi pogodbenici v tem sporazumu določene pravice, da opravlja zračni promet na progah, določenih v prilogi tega sporazuma (v nadaljnjem besedilu “dogovorjeni promet” in “določene proge”).
(2) V skladu z določbami tega sporazuma ima določeni prevoznik pogodbenice naslednje pravice:
(a) pravico do preleta ozemlja druge pogodbenice brez pristanka;
(b) pravico do pristanka na ozemlju druge pogodbenice v nekomercialne namene in
(c) pravico, da med opravljanjem dogovorjenega prometa na določeni progi opravlja pristanke na omenjenem ozemlju na kraju ali krajih, določenih v prilogi tega sporazuma, zato da vkrca in izkrca potnike, tovor in pošto.
(3) Nobene določbe drugega odstavka tega člena ni možno razumeti tako, da ima določeni prevoznik ene pogodbenice na ozemlju druge pogodbenice pravico za plačilo ali najemnino vkrcati potnike, prtljago, tovor ali pošto, namenjene v kakšen drug kraj na njenem ozemlju.
3. člen
Dovoljenje za opravljanje prometa
(1) Vsaka pogodbenica ima pravico, da drugi pogodbenici pisno sporoči prevoznika oziroma prevoznike, ki bodo opravljali dogovorjeni promet na določenih progah.
(2) Po prejemu obvestila o določitvi druga pogodbenica, če ni zadržkov iz tretjega in četrtega odstavka tega člena, nemudoma izda določenemu prevozniku oziroma prevoznikom ustrezno dovoljenje za opravljanje prometa.
(3) Pristojni organ ene pogodbenice lahko zahteva, da določeni prevoznik druge pogodbenice dokaže, da izpolnjuje pogoje, določene v zakonih in predpisih, ki jih ta organ v skladu z določbami konvencije normalno in v razumni meji uporablja za opravljanje mednarodnega komercialnega zračnega prometa.
(4) Vsaka pogodbenica ima pravico odkloniti določenega prevoznika in zadržati oziroma preklicati pravice iz drugega odstavka 2. člena tega sporazuma ali postaviti take pogoje, ki so po njenem mnenju potrebni za uresničevanje teh pravic v vsakem primeru, kjer se ji zdi, da pogodbenica, ki določi prevoznika, ali njeni državljani niso odločujoči lastnik in nimajo dejanskega nadzora nad določenim prevoznikom.
(5) Ko so izpolnjene določbe iz prvega in drugega odstavka tega člena, lahko tako določeni prevoznik, ki ima za to dovoljenje, prične opravljati dogovorjeni promet, če zanj veljajo tarife, določene v skladu z 8. členom tega sporazuma.
(6) Vsaka pogodbenica ima pravico začasno prepovedati določenemu prevozniku uresničevanje pravic, določenih v drugem odstavku 2. člena tega sporazuma, ali določiti take pogoje, ki so po njenem mnenju potrebni za uresničevanje teh pravic, kadar koli prevoznik ne spoštuje zakonov in predpisov pogodbenice, ki daje te pravice, ali pa kako drugače ne upošteva določb tega sporazuma. Če takojšnja začasna prepoved uresničevanja ali uveljavitev pogojev ni bistvena za preprečitev nadaljnjega kršenja zakonov in predpisov, se ta pravica uporabi le po posvetovanju z drugo pogodbenico.
4. člen
Oprostitev carin za gorivo, maziva in rezervne dele
(1) Letala, ki jih uporablja v mednarodnem zračnem prometu določeni prevoznik katere koli pogodbenice, kot tudi njihova običajna oprema, rezervni deli, zaloge goriva in maziv ter zaloge (vključno s hrano, pijačo in tobakom), ki so na takem letalu, so po prihodu na ozemlje druge pogodbenice oproščeni vseh carin, inšpekcijskih taks in drugih davščin ali taks, če ostanejo na letalih, dokler se ponovno ne izvozijo.
(2) Zaloge goriva, maziv, rezervnih delov, običajne opreme in zaloge na letalu, ki jih na ozemlje ene pogodbenice pripelje določeni prevoznik druge pogodbenice ali so pripeljane v njegovem imenu ali so v letalu, ki ga upravlja določeni prevoznik in so izključno namenjene uporabi med opravljanjem mednarodnega prometa, so oproščene vseh državnih davščin in taks, vključno s carinami in inšpekcijskimi taksami, ki veljajo na ozemlju prve pogodbenice, tudi kadar so porabljene na delu poleta nad ozemljem pogodbenice, na katerem so bile natovorjene. Lahko se zahteva, da so zgoraj omenjeni predmeti pod carinskim nadzorom.
(3) Običajna oprema v letalu, rezervni deli, zaloge na letalu in zaloge goriva in maziv, ki so v letalih prevoznika katere koli pogodbenice, so lahko raztovorjeni na ozemlju druge pogodbenice le z odobritvijo carinskih organov te pogodbenice, ki lahko zahteva, da se ti predmeti dajo pod njihov nadzor, dokler niso ponovno izvoženi ali drugače porabljeni v skladu s carinskimi predpisi.
(4) Gorivo, maziva, rezervni deli, običajna oprema na letalu in zaloge na letalu, ki so vkrcani na letalo ene pogodbenice na ozemlju druge pogodbenice in ki se izključno uporabljajo na poletih med dvema krajema na ozemlju druge pogodbenice, se glede carin, inšpekcijskih taks in drugih podobnih državnih ali lokalnih dajatev in taks ne obravnavajo nič manj ugodno kot nacionalni prevoznik tiste pogodbenice.
5. člen
Poslovne dejavnosti
(1) Ob upoštevanju določb zakonov in predpisov, ki veljajo na ozemlju vsake pogodbenice, je prevoznik, ki ga določi ena pogodbenica v skladu s 3. členom upravičen, da ima na ozemlju druge pogodbenice tehnično, administrativno in poslovno osebje, ki ga potrebuje za opravljanje zračnega prometa v skladu s prilogo k temu sporazumu, in da odpre in vodi svoja predstavništva.
(2) Za poslovne dejavnosti velja načelo vzajemnosti. Pristojne oblasti vsake pogodbenice storijo vse, da predstavništva določenega prevoznika druge pogodbenice lahko nemoteno opravljajo svoje dejavnosti na ozemlju druge pogodbenice.
(3) Vsaka pogodbenica dovoljuje določenemu prevozniku druge pogodbenice, da na njenem ozemlju prodaja svoje prevozne zmogljivosti neposredno in po lastni presoji po agentih. Vsak prevoznik ima pravico prodajati take prevozne zmogljivosti in vsak jih lahko prosto kupuje v lokalni valuti ali v prosto konvertibilni valuti drugih držav v skladu z veljavno notranjo zakonodajo in predpisi.
6. člen
Zakoni in predpisi o prihodu in odhodu
(1) Zakoni in predpisi ene pogodbenice, s katerimi so urejeni prihod in odhod letal v mednarodnem prometu, kot tudi poleti čez njeno ozemlje, se uporabljajo tudi za letala določenega prevoznika druge pogodbenice.
(2) Zakoni in predpisi ene pogodbenice o prihodu, začasnem bivanju in odhodu s tega ozemlja potnikov, posadke, tovora ali pošte kot tudi formalnosti glede prihoda, odhoda, priseljevanja in izseljevanja ter carinski in sanitarni ukrepi veljajo za potnike, posadko, tovor ali pošto, ki jih prevaža letalo določenega prevoznika druge pogodbenice, medtem ko je znotraj omenjenega ozemlja.
(3) Nobena pogodbenica nima pravice svojemu prevozniku v primerjavi z določenim prevoznikom druge pogodbenice dajati kakršne koli prednosti pri uporabi zakonov in predpisov, omenjenih v prvem in drugem odstavku tega člena.
7. člen
Določbe o zmogljivosti
(1) Določena prevoznika obeh pogodbenic imata primerne in enake možnosti za opravljanje dogovorjenega prometa na določenih progah med njunima ozemljema.
(2) Pri izvajanju dogovorjenega prometa vsak določeni prevoznik vsake pogodbenice upošteva interese določenega prevoznika druge pogodbenice tako, da ne škodi prometu, ki ga prevoznik druge pogodbenice opravlja na isti progi ali delu iste proge.
(3) Dogovorjeni promet, ki ga opravljajo določeni prevozniki pogodbenic, bo v tesni povezavi z javnimi potrebami po prevozu na določenih progah, njegov glavni namen bo ob primerni zasedenosti zagotavljanje zmogljivosti, ki bo ustrezala tekočim in normalno predvidenim potrebam po prevozu potnikov, tovora in pošte, ki izhajajo ali so namenjeni na ozemlje pogodbenice, ki je določila prevoznika. Prevoz potnikov, tovora in pošte, vkrcanih in izkrcanih v krajih na določenih progah, ki niso na ozemlju držav, ki so določile prevoznika, bo v skladu s splošnimi načeli o zmogljivosti, ki naj ustreza:
(a) prometnim potrebam z ozemlja in na ozemlje pogodbenice, ki je določila prevoznika;
(b) prometnim potrebam na območju, čez katero prevoznik leti, ob upoštevanju drugih prometnih povezav prevoznikov držav, ki so na tem območju, in
(c) potrebam celotne operacije prevoznika.
(4) Pristojni organi pogodbenic občasno skupno presodijo, kako določeni prevozniki pri opravljanju dogovorjenega prometa v praksi izvajajo načela, ki jih navajajo zgornji odstavki tega člena.
(5) Nobena pogodbenica ne sme enostransko omejiti delovanja določenega prevoznika druge pogodbenice, razen v skladu s tem sporazumom ali v skladu z enotnimi pogoji, kot jih predvideva konvencija.
8. člen
Tarife
(1) Tarife, ki jih zaračunavajo določeni prevozniki pogodbenic za prevoz med Republiko Slovenijo in Malezijo, odobrita oba pristojna organa. Določene bodo na razumni ravni ob upoštevanju vseh bistvenih dejavnikov, vključno s stroški dogovorjenega prometa, interesi uporabnikov, primernim dobičkom in tarifami drugih prevoznikov, ki delujejo na celotni progi ali njenem delu.
(2) Kateri koli določeni prevoznik se lahko posvetuje o tarifnih predlogih, vendar se ne zahteva, da to stori preden vloži prošnjo za predlagano tarifo. Pristojni organ vsake pogodbenice prošnjo sprejme le, če določeni prevoznik, ki vloži prošnjo, potrdi, da je drugega določenega prevoznika obvestil o predlaganih tarifah.
(3) Kateri koli predlog za tarifo za prevoz med Republiko Slovenijo in Malezijo se vloži pri pristojnih organih obeh pogodbenic na način, ki ga zahtevata pristojna organa. Predlog ne sme biti vložen manj kot 60 dni (razen če ustrezna pristojna organa predhodno odobrita krajši rok za vložitev vloge) pred dnem, ki je predlagan za njihovo uveljavitev. Predlog za tarifo se šteje, da je bil vložen pri pogodbenici na dan, ko ga prejme pristojni organ te pogodbenice. Vsak določen prevoznik mora le pred svojim pristojnim organom utemeljiti svoj predlog za tarife in ne pred drugim organom, razen če je tarifa registrirana enostransko.
(4) Vsako predlagano tarifo lahko kadar koli odobri pristojni organ katere koli pogodbenice pod pogojem, da je bila registrirana v skladu s tretjim odstavkom tega člena.
(5) Če se tarifa ne odobri v skladu z določbami četrtega odstavka tega člena, lahko pristojni organ katere koli pogodbenice zahteva posvetovanje, ki se mora izvesti v 30 dneh po vložitvi zahtevka, če se pristojna organa ne dogovorita drugače.
(6) Če en pristojni organ tarife ne odobri v skladu s četrtim odstavkom tega člena in pristojnima organoma ni uspelo doseči soglasja po posvetovanjih v skladu s petim odstavkom tega člena, se spor poskuša rešiti v skladu z določbami 14. člena tega sporazuma. Vendar v nobenem primeru pogodbenica ne sme zahtevati tarife, ki je drugačna od tarife prevoznika, ki ga je sama določila, za primerljive storitve med istimi kraji.
(7) Tarifa, ki je uvedena v skladu z določbami tega člena, velja, dokler se ne uvede nadomestna tarifa.
(8) Tarife, ki jih zaračunava določeni prevoznik ene pogodbenice za prevoz med območjem druge pogodbenice in ozemljem države, ki ni pogodbenica, so predložene v odobritev drugi pogodbenici in državi, ki ni pogodbenica, vendar pod pogojem, da pogodbenica ne zahteva tarife, ki je drugačna od tarife njenega lastnega prevoznika za primerljive storitve med istima krajema. Določeni prevoznik vsake pogodbenice registrira take tarife pri drugi pogodbenici v skladu z njenimi zahtevami. Odobritev teh tarif se lahko prekliče, vendar ne prej kot po 30 dnevnem odpovednem roku, pri čemer mora pogodbenica, ki odobritev prekliče, določenemu prevozniku dovoliti, da uporablja iste tarife kot njen lastni prevoznik za primerljive storitve med istimi kraji.
9. člen
Takse za uporabnike
Nobena pogodbenica ne uvede oziroma ne dovoli, da se za določenega prevoznika druge pogodbenice uvedejo takse za uporabnike, ki so višje od tistih, ki veljajo za njenega določenega prevoznika, ki opravlja podoben mednarodni zračni promet.
10. člen
Varnost zračne plovbe
(1) V skladu s pravicami in obveznostmi mednarodnega prava pogodbenici ponovno potrjujeta kot sestavni del tega sporazuma medsebojno dolžnost, da varujeta civilno letalstvo pred dejanji nezakonitega vmešavanja. Ne da bi omejevali svoje pravice in obveznosti po mednarodnem pravu, pogodbenici še prav posebno upoštevata določbe Konvencije o kaznivih dejanjih in nekih drugih dejanjih, storjenih na letalih, sprejete v Tokiu 14. septembra 1963, Konvencije o zatiranju nezakonite ugrabitve zrakoplovov, sprejete v Haagu 16. decembra 1970, Konvencije o zatiranju nezakonitih dejanj zoper varnost civilnega letalstva, sprejete v Montrealu 23. septembra 1971, in katere koli druge konvencije, ki se nanaša na varnost civilnega letalstva in ki jo podpišeta obe pogodbenici.
(2) Pogodbenici na zahtevo druga drugi dajeta vso potrebno pomoč, da bi preprečili nezakonite ugrabitve civilnih letal in druga nezakonita dejanja proti varnosti takih letal, njihovih potnikov in posadk, letališč in letalskih navigacijskih naprav ter vsako drugo grožnjo varnosti civilnega letalstva.
(3) Pogodbenici v medsebojnih odnosih ravnata v skladu z določbami Mednarodne organizacije civilnega letalstva o varnosti civilne zračne plovbe, ki so opredeljene v prilogah konvencije, v tisti meri, v kateri te določbe veljajo za obe pogodbenici; od letalskih družb, ki so vpisane v njunih registrih ali opravljajo pretežni del svojih dejavnosti ali imajo sedež na njunih ozemljih, ter od letaliških podjetij na svojih ozemljih zahtevata, da delujejo v skladu s takimi varnostnimi predpisi. V skladu s tem vsaka pogodbenica drugo obvesti o kakršnem koli neskladju med notranjepravnimi predpisi in postopki in prej omenjenimi določbami o varnosti zračne plovbe. Katera koli pogodbenica lahko kadar koli zahteva takojšen posvet z drugo pogodbenico, da se pogovorita o takšnih razhajanjih.
(4) Vsaka pogodbenica se strinja, da bo upoštevala določbe o varnosti, ki jih zahteva druga pogodbenica za prihod na ozemlje druge pogodbenice, in da bo uvedla primerne ukrepe za zaščito letala ter da bo pregledala potnike, posadko, ročno prtljago kot tudi tovor in zaloge na letalu pred in med vkrcavanjem ali natovarjanjem. Vsaka pogodbenica z naklonjenostjo obravnava vsako zahtevo druge pogodbenice za uvedbo posebnih varnostnih ukrepov zaradi določene grožnje za civilno zračno plovbo.
(5) Kadar se zgodi incident ali obstaja nevarnost za nezakonito ugrabitev letala ali za kakšno drugo nezakonito dejanje proti varnosti, potnikov, posadke, letal, letališč in letalskih navigacijskih naprav, pogodbenici pomagata druga drugi, s tem da poskrbita za komunikacije in druge ustrezne ukrepe, da bi se tak incident ali grožnja končal čim hitreje in z najmanjšim tveganjem za človeška življenja.
11. člen
Prenos sredstev
Vsaka pogodbenica prizna določenemu prevozniku druge pogodbenice pravico, da svoji upravi nakaže presežek prejemkov nad izdatki, ki jih zasluži na ozemlju prve pogodbenice. Postopek za tako nakazilo je v skladu z deviznimi predpisi pogodbenice na ozemlju, kjer je prihodek nastal. Če so plačila med pogodbenicama naknadno urejena s posebnim sporazumom, velja tak sporazum.
12. člen
Informacije in statistični podatki
Pristojna organa obeh pogodbenic morata na zahtevo pristojnega organa druge pogodbenice pripraviti periodične statistične podatke in druge statistične izkaze v skladu s potrebami, da se preveri zmogljivost dogovorjenega prometa določenega prevoznika prve pogodbenice. Taki izkazi morajo vsebovati vse potrebne informacije za določitev obsega prometa, ki ga opravlja določeni prevoznik v dogovorjenem prometu.
13. člen
Posvetovanja
Vsaka pogodbenica lahko kadar koli zahteva posvetovanja o kateri koli zadevi v zvezi s tem sporazumom. Taka posvetovanja se začno v šestdesetih dneh po prejemu pisne zahteve druge pogodbenice, razen če se pogodbenici dogovorita drugače.
14. člen
Reševanje sporov
(1) Vsakršen spor, ki nastane med pogodbenicama in ki se nanaša na razlago ali izvajanje tega sporazuma, se reši z neposrednimi pogajanji med pristojnima organoma pogodbenic.
(2) Če pogodbenici spora ne rešita s pogajanji, kot določa prvi odstavek tega člena, se spor reši po diplomatski poti.
15. člen
Spremembe
(1) Če katera od pogodbenic želi spremeniti določbe tega sporazuma, lahko kadar koli zaprosi za posvet drugo pogodbenico. Tak posvet se začne v šestdesetih dneh od dneva prejema takega zahtevka.
(2) Kakršna koli sprememba tega sporazuma, dogovorjena med pogodbenicama, začne veljati po tem ko je potrjena z izmenjavo diplomatskih not.
(3) O spremembah priloge tega sporazuma se lahko neposredno dogovorita pristojna organa pogodbenic.
16. člen
Večstranski sporazumi
Če se sklene kakršna koli splošna večstranska konvencija o letalskem prometu, ki zavezuje obe pogodbenici, se bo ta sporazum spremenil tako, da ustreza določbam take konvencije.
17. člen
Prenehanje sporazuma
Vsaka od pogodbenic lahko kadar koli obvesti drugo pogodbenico, da želi odstopiti od tega sporazuma. Tako obvestilo se istočasno pošlje Mednarodni organizaciji civilnega letalstva. Če se vroči tako obvestilo, sporazum preneha veljati dvanajst mesecev po dnevu prejema obvestila druge pogodbenice, razen če je obvestilo sporazumno umaknjeno pred iztekom tega roka. Če druga pogodbenica ne potrdi prejema tega obvestila, se šteje, da ga je prejela štirinajst dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
18. člen
Registracija
Ta sporazum in vsakršno izmenjavo obvestil v skladu s 15. in 16. členom je treba registrirati pri Mednarodni organizaciji civilnega letalstva.
19. člen
Naslovi
Naslovi na začetku vsakega člena tega sporazuma so samo zaradi večje preglednosti in lažje uporabnosti in nikakor ne definirajo, omejujejo ali opisujejo obsega oziroma namena tega sporazuma.
20. člen
Veljavnost
Ta sporazum se začasno uporablja od dneva podpisa in začne veljati po izpolnitvi ustavnopravnih zahtev pogodbenic na dan izmenjave diplomatskih not.
V potrditev tega sta podpisana pooblaščenca, ki sta ju pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v dveh izvirnikih 28. dne oktobra 1997 v Ljubljani v slovenskem, malezijskem in angleškem jeziku. Vsa besedila so enako verodostojna. Ob neskladju velja angleško besedilo.

OPOMBE
(i) Določeni prevoznik oziroma prevozniki obeh pogodbenic lahko na katerem koli ali na vseh poletih izpustijo pristanek v katerem koli od zgoraj omenjenih krajev.
(ii) Dejanske operacije, frekvence in izvrševanje prometnih pravic, ki so dodeljene določenemu prevozniku oziroma prevoznikom obeh pogodbenic, sporazumno določita pristojna organa obeh pogodbenic.
(iii) Pravico pete svobode lahko določeni prevoznik uresničuje na podlagi komercialnega dogovora med določenima prevoznikoma obeh pogodbenic.
AGREEMENT
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF MALAYSIA FOR AIR SERVICES BETWEEN AND BEYOND THEIR RESPECTIVE TERRITORIES
The Government of the Republic of Slovenia and the Government of Malaysia being parties to
the Convention on International Civil Aviation and
desiring to conclude an Agreement for the purpose of establishing air services between and beyond their respective territories,
have agreed as follows :
Article 1
Definitions
For the purpose of this Agreement, unless the context otherwise requires :
(a) the term “the Convention” means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December 1944 and includes any Annex adopted under Article 90 of that Convention and any amendment of the Annexes or Convention under Articles 90 and 94 thereof, insofar as these have become effective for both Contracting Parties;
(b) the term “aeronautical authorities” means, in the case of the Republic of Slovenia, the Ministry of Transport and Communications or any person or body authorized to perform any functions at present exercised by the said Ministry or similar functions, and in the case of Malaysia, the Minister of Transport and any person or body authorized to perform any functions at present exercised by the said Minister or similar functions,
(c) the term “designated airline” means an airline or airlines which one Contracting Party shall have designated, by written notification to the other Contracting Party, in accordance with Article 3 of this Agreement, for the operation of air services on the routes specified in such notification;
(d) the terms “territory” and “air service”, “international air service”, “airline” and “stop for non-traffic purposes” have the meanings respectively assigned to them in Articles 2 and 96 of the Convention;
(e) the term “tariff” means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which these prices apply, including commission charges and other additional remuneration for agency or sale of transportation documents but excluding remuneration and conditions for the carriage of mail;
(f) the term “Annex to this Agreement” means the Route Schedules to this Agreement or as amended in accordance with the provisions of Article 15 of this Agreement. The “Annex to this Agreement” shall form an integral part of this Agreement and all references to the Agreement shall include references to the Annex except where otherwise provided.
Article 2
Traffic rights
(1) Each Contracting Party grants to the other Contracting Party the rights specified in this Agreement for the purpose of operating air services on the routes specified in the Schedules of the Annex to this Agreement (hereinafter called “the agreed services” and “the specified routes”).
(2) Subject to the provisions of this Agreement, an airline designated by each Contracting Party shall enjoy the following rights :
(a) to fly without landing across the territory of the other Contracting Party;
(b) to make stops in the said territory for non traffic purposes; and
(c) while operating an agreed service on a specified route, to make stops in the said territory at the point or points specified for that route in the Schedule of the Annex to this Agreement for the purpose of putting down and taking on international traffic in passengers, cargo and mail.
(3) Nothing in paragraph (2) of this Article shall be deemed to confer on the designated airline of one Contracting Party the right of taking up, in the territory of the other Contracting Party, passengers, cargo or mail carried for remuneration or hire and destined for another point in the territory of that other Contracting Party.
Article 3
Operating authorization
(1) Each Contracting Party shall have the right to designate in writing to the other Contracting Party an airline or airlines for the purpose of operating the agreed services on the specified routes.
(2) On receipt of the designation, the other Contracting Party shall, subject to the provisions of paragraphs (3) and (4) of this Article, without delay grant to the airline or airlines designated the appropriate operating authorization.
(3) The aeronautical authorities of one Contracting Party may require an airline designated by the other Contracting Party to satisfy them that it is qualified to fulfill the conditions prescribed under the laws and regulations normally and reasonably applied by them in conformity with the provisions of the Convention to the operation of international commercial air services.
(4) Each Contracting Party shall have the right to refuse to accept the designation of an airline and to withhold or revoke the grant to an airline of the rights specified in paragraph (2) of Article 2 of this Agreement or to impose such conditions as it may deem necessary on the exercise by an airline of those rights in any case where it is not satisfied that substantial ownership and effective control of that airline are vested in the Contracting Party designating the airline or in nationals of the Contracting Party designating the airline.
(5) At any time after the provisions of paragraphs (1) and (2) of this Article have been complied with, an airline so designated and authorized may begin to operate the agreed services provided that such services shall not be operated unless a tariff established in accordance with the provisions of Article 8 of this Agreement is in force in respect of that service.
(6) Each Contracting Party shall have the right to suspend the exercise by an airline of the rights specified in paragraph (2) of Article 2 of this Agreement or to impose such conditions as it may deem necessary on the exercise by an airline of those rights in any case where an airline fails to comply with the laws or regulations of the Contracting Party granting those rights or otherwise fails to operate in accordance with the conditions prescribed in this Agreement provided that, unless immediate suspension or imposition of conditions is essential to prevent further infringements of laws or regulations, this right shall be exercised only after consultation with the other Contracting Party.
Article 4
Exemption of duties on fuel, lubrication and spare parts
(1) Aircraft operating on international services by the designated airline of either Contracting Party, as well as their regular equipment, spare parts, supplies of fuels and lubricants and aircraft stores (including food, beverages and tobacco) on board such aircraft shall be exempt from all customs duties, inspection fees and other duties or taxes on arriving in the territory of the other Contracting Party, provided such equipment and supplies remain on board the aircraft up to such time as they are re-exported.
(2) Supplies of fuels, lubricants, spare parts, regular equipment and aircraft stores introduced into the territory of one Contracting Party by or on behalf of the designated airline of the other Contracting Party or taken on board the aircraft operated by such designated airline and intended solely for use in the operation of international services shall be exempt from all national duties and charges, including customs duties and inspection fees imposed in the territory of the first Contracting Party, even when these supplies are to be used on the parts of the journey performed over the territory of the Contracting Party in which they are taken on board. The materials referred to above may be required to be kept under customs supervision or control.
(3) The regular airborne equipment, spare parts, aircraft stores and supplies of fuels and lubricants retained on board the aircraft of either Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that Party, who may require that these materials be placed under their supervision up to such time as they are re-exported or otherwise disposed of in accordance with customs regulations.
(4) Fuel, lubricants, spare parts, regular aircraft equipment and aircraft stores taken on board the aircraft of one Contracting Party in the territory of the other Contracting Party and used solely on flights between two points in the territory of the latter Contracting Party shall be accorded with respect to customs duties, inspection fees and other similar national or local duties and charges, treatment not less favorable than that granted to the national airline of that Contracting Party.
Article 5
Commercial activities
(1) Subject to the provisions of laws and regulations in force in the territory of each Contracting Party, an airline designated by one Contracting Party in accordance with Article 3, is entitled to maintain the technical, administrative and commercial personnel required for the operation of air services in accordance with the Annex to this Agreement and to establish and operate offices in the territory of the other Contracting Party.
(2) For the commercial activities the principle of reciprocity shall apply. The competent authorities of each Contracting Party will take all necessary steps to facilitate that the representations of the airline designated by the other Contracting Party may exercise its activities in the territory of the other Contracting Party.
(3) Each Contracting Party grants to the designated airline of the other Contracting Party the right to engage in the sale of air transportation in its territory directly and, at the airline’s discretion, through its agents. Each airline shall have the right to sell such transportation, and any person shall be free to purchase such transportation in the currency of that territory or, subject to the national laws and regulations, in freely convertible currencies of other countries.
Article 6
Laws and regulations on entry and departure
(1) The laws and regulations of one Contracting Party governing entry into and departure from its territory of aircraft engaged in international air navigation or flights of such aircraft over that territory shall apply to the designated airline of the other Contracting Party.
(2) The laws and regulations of one Contracting Party governing entry into, sojourn in, and departure from its territory of passengers, crew, cargo or mail, such as formalities regarding entry, exit, emigration and immigration, as well as customs and sanitary measures shall apply to passengers, crew, cargo or mail carried by the aircraft of the designated airline of the other Contracting Party while they are within the said territory.
(3) Neither Contracting Party may grant any preference to its own airline in relation to the designated airline of the other Contracting Party in the application of the laws and regulations referred to in paragraphs (1) and (2) of this Article.
Article 7
Capacity provisions
(1) There shall be fair end equal opportunity for the designated airlines of both Contracting Parties to operate the agreed services on the specified routes between their respective territories.
(2) In operating the agreed services, the designated airline of each Contracting Party shall take into account the interests of the designated airline of the other Contracting Party so as not to affect unduly the services which the latter provides on the whole or part of the same routes.
(3) The agreed services provided by the designated airlines of the Contracting Parties shall bear close relationship to the requirements of the public for transportation on the specified routes and shall have as their primary objective the provision, at a reasonable load factor, of capacity adequate to carry the current and reasonably anticipated requirements for the carriage of passengers, cargo and mail originating from or destined for the territory of the Contracting Party which has designated the airline. Provision for the carriage of passengers, cargo and mail both taken up and put down at points on specified routes in the territories of States other than that designating the airline shall be made in accordance with the general principles that capacity shall be related to :
(a) traffic requirements to and from the territory of the Contracting Party which has designated the airline;
(b) traffic requirements of the area through which the airline passes after taking account of other transport services established by airlines of the States comprising the area; and
(c) the requirements of through airline operations.
(4) The aeronautical authorities of the Contracting Parties shall from time to time jointly determine the practical application of the principles contained in the foregoing paragraphs of this Article for the operation of the agreed services by the designated airlines.
(5) Neither Contracting Party shall unilaterally restrict the operations of the designated airline of the other Contracting Party, except according to the terms of the present Agreement or by such uniform conditions as may be contemplated by the Convention.
Article 8
Tariffs
(1) The tariffs to be charged by the designated airlines of the Contracting Parties for carriage between the Republic of Slovenia and Malaysia shall be those approved by both aeronautical authorities and shall be established at reasonable levels, due regard being paid to all relevant factors, including the cost of operating the agreed services, the interests of users, reasonable profit and the tariffs of other airlines operating over the whole or part of the same route.
(2) Any of the designated airlines may consult together about tariff proposals, but shall not be required to do so before filing a proposed tariff. The aeronautical authorities of each Contracting Party shall not accept a filing unless the designated airline making such filing gives an assurance that it has informed the other designated airline of the proposed tariffs.
(3) Any proposed tariff for carriage between the Republic of Slovenia and Malaysia shall be filed with the aeronautical authorities of both Contracting Parties in such manner as the aeronautical authorities may require. It shall be filed not less than 60 days (unless prior approval is obtained from the respective aeronautical authorities for a shorter filing period) before the proposed effective date. The proposed tariff shall be treated as having been filed with a Contracting Party on the date on which it is received by the aeronautical authorities of that Contracting Party. Each designated airline shall not be responsible to any aeronautical authorities other than its own for the justification of the tariffs so proposed except where a tariff has been unilaterally filed.
(4) Any proposed tariff may be approved by the aeronautical authorities of either Contracting Party at any time provided it has been filed in accordance with paragraph (3) of this Article.
(5) If a tariff is not approved in accordance with the provisions of paragraph (4) of this Article, the aeronautical authorities of either Contracting Party may request consultations which shall be held within 30 days of the request, or as otherwise agreed by both aeronautical authorities.
(6) If a tariff has not been approved by one of the aeronautical authorities in accordance with paragraph (4) of this Article, and the aeronautical authorities have been unable to agree following consultations held in accordance with paragraph (5) of this Article, the dispute may be settled in accordance with the provisions of Article 14 of this Agreement. In no circumstances, however, shall a Contracting Party require a different tariff from the tariff of its own designated airline for comparable services between the same points.
(7) A tariff established in accordance with the provisions of this Article shall remain in force until a replacement tariff has been established.
(8) The tariffs charged by the designated airline of one Contracting Party for carriage between the area of the other Contracting Party and the territory of a State which is not a Contracting Party shall be subject to the approval of the other Contracting Party and such non-contracting State; provided, however, that a Contracting Party shall not require a different tariff from the tariff of its own airline for comparable services between the same points. The designated airline of each Contracting Party shall file such tariffs with the other Contracting Party, in accordance with its requirements. Approval of such tariffs may be withdrawn on no less than 30 days notice provided, however, that a Contracting Party withdrawing such approval shall permit the designated airline concerned to apply the same tariffs as its own airline for comparable services between the same points.
Article 9
User charges
Neither Contracting Party shall impose or permit to be imposed on a designated airline of the other Contracting Party user charges higher than those imposed on its own designated airline operating similar international air services.
Article 10
Aviation security
(1) Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of this Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at The Hague on 16 December 1970 and the Convention for the Suppression of Unlawful Acts Against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and any other convention relating to the security of civil aviation to which both Contracting Parties are party.
(2) The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
(3) The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organization and designated as Annexes to the Convention to the extent that such security provisions are applicable to the Contracting Parties; each Contracting Party shall require that operators of aircraft of their registry or operators who have their principal place of business or permanent residence in their territory and the operators of airports in their territory act in conformity with such aviation security provisions. Accordingly each Contracting Party shall advise the other Contracting Party of any difference between its national regulations and practices and the aforementioned aviation security provisions. Either Contracting Party may request immediate consultations with the other Contracting Party at any time to discuss any such difference.
(4) Each Contracting Party agrees to observe the security provisions required by the other Contracting Party for entry into the territory of that other Contracting Party and to take adequate measures to protect aircraft and to inspect passengers, crew, their carry-on items as well as cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give positive consideration to any request from the other Contracting Party for special security measures to meet a particular threat to civil aviation.
(5) When an incident or threat of an incident of unlawful seizure of aircraft or other unlawful acts against the safety of passengers, crew, aircraft, airports and air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and with minimum risk to life such incident or threat thereof.
Article 11
Transfer of funds
Each Contracting Party shall grant to the designated airline of the other Contracting Party the right to remit to its head office the excess over expenditure of receipts earned in the territory of the first Contracting Party. The procedure for such remittance, however, shall be in accordance with the foreign exchange regulations of the Contracting Party in the territory of which the revenue accrued. If payments between the Contracting Parties are regulated by a subsequent special agreement, this special agreement shall apply.
Article 12
Information and statistics
The aeronautical authorities of either Contracting Party shall supply to the aeronautical authorities of the other Contracting Party at their request such periodic or other statements of statistics as may be reasonably required for the purpose of reviewing the capacity on the agreed services by the designated airline of the first Contracting Party. Such statements shall include all information required to determine the amount of traffic carried by that designated airline on the agreed services.
Article 13
Consultation
Either Contracting Party may at any time request consultations on any matter related to this Agreement. Such consultations shall begin within a period of sixty days from the date the other Contracting Party receives the request, unless otherwise agreed by the Contracting Parties.
Article 14
Settlement of disputes
(1) Any dispute arising between the Contracting Parties relating to the interpretation or application of this Agreement, shall be settled by direct negotiations between the aeronautical authorities of the Contracting Parties.
(2) If the Contracting Parties fail to reach a settlement by negotiation under the provision of paragraph (1) of this Article, the dispute shall be settled through diplomatic channels.
Article 15
Modifications
(1) If either of the Contracting Parties considers it desirable to modify any provisions of this Agreement; it may at any time request consultation with the other Contracting Party. Such consultation shall begin within a period of sixty days from the date of receipt of such request.
(2) Any modification to this Agreement if agreed between the Contracting Parties shall enter into force after they have been confirmed by an exchange of notes through diplomatic channels.
(3) Modification to the Annex of this Agreement may be agreed directly between the aeronautical authorities of the Contracting Parties
Article 16
Multilateral agreements
In the event of the conclusion of any general multilateral convention concerning air transport by which both Contracting Parties become bound, this Agreement shall be amended so as to conform with the provisions of such convention.
Article 17
Termination
Either Contracting Party may at any time give notice to the other if it desires to terminate this Agreement. Such notice shall be simultaneously communicated to the International Civil Aviation Organization. If such notice is given, this Agreement shall terminate twelve months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by agreement before the expiry of this period. In the absence of acknowledgement of receipt by the other Contracting Party, notice shall be deemed to have been received fourteen days after the receipt of the notice by the International Civil Aviation Organization.
Article 18
Registration
This Agreement and any exchange of notes in accordance with Articles 15 and 16 shall be registered with the International Civil Aviation Organization.
Article 19
Titles
Titles are inserted in this Agreement at the head of each article for the purpose of reference and convenience and in no way define, limit or describe the scope or intent of this Agreement.
Article 20
Entry into force
This Agreement shall be applied provisionally from the date of its signature and shall enter into force after fulfillment of the constitutional requirements by each Contracting Party, on the date of exchange of diplomatic notes to this effect.
In witness whereof, the undersigned plenipotentiaries, being duly authorized thereto by their respective Governments, have signed this Agreement.
Done this 28th day of October 1997 at Ljubljana in duplicate in the Slovenian, Malay, and English languages, all texts being equally authentic. In case of any inconsistency the English text shall prevail.

NOTES
(i) The designated airline or airlines of both Contracting Parties may on any or all flights omit calling at any of the points mentioned above.
(ii) The effective operations, frequencies and the exercise of traffic rights granted for the designated airline or airlines of both Contracting Parties shall be agreed upon between the aeronautical authorities of the two Contracting Parties.
(iii) The exercise of the fifth freedom traffic rights by a designated airline shall be subject to a commercial arrangement between the designated airlines of both Contracting Parties.
