Razglašam Zakon o ratifikaciji Sporazuma med Republiko Slovenijo in Portugalsko republiko o sodelovanju v kulturi, izobraževanju in znanosti (BPOKIZ), ki ga je sprejel Državni zbor Republike Slovenije na seji 23. marca 1999.

O RATIFIKACIJI SPORAZUMA MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO O SODELOVANJU V KULTURI, IZOBRAŽEVANJU IN ZNANOSTI (BPOKIZ)
1. člen
Ratificira se Sporazum med Republiko Slovenijo in Portugalsko republiko o sodelovanju v kulturi, izobraževanju in znanosti, podpisan v Lizboni 6. aprila 1998.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi*:
S P O R A Z U M
MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO O SODELOVANJU V KULTURI, IZOBRAŽEVANJU IN ZNANOSTI
Republika Slovenija in Portugalska republika (v nadaljnjem besedilu “pogodbenici”) sta se
v želji, da bi spodbujali in razvijali sodelovanje med državama v kulturi, izobraževanju in znanosti,
v prepričanju, da bo takšno sodelovanje prispevalo k medsebojnemu razumevanju in krepitvi odnosov med državama,
odločeni upoštevati načela helsinške Sklepne listine Konference o varnosti in sodelovanju v Evropi, Pariške listine za novo Evropo in Dunajske deklaracije Sveta Evrope,
dogovorili o naslednjem:
1. člen
Pogodbenici spodbujata in omogočata sodelovanje med kulturnimi, izobraževalnimi in znanstvenimi inštitucijami obeh držav. Prav tako pospešujeta in spodbujata razširjanje svojih jezikov in kultur.
2. člen
Pogodbenici podpirata izmenjavo umetnikov in strokovnjakov s področja likovne umetnosti, gledališča, glasbe, filma, radia in televizije, književnosti, knjižnic, muzejev in arhivov.
3. člen
Pogodbenici spodbujata sodelovanje pri ohranjanju svoje kulturne dediščine.
4. člen
Pogodbenici v skladu s svojima zakonodajama sodelujeta pri preprečevanju nezakonitega trgovanja s kulturnimi dobrinami.
5. člen
Pogodbenici podpirata izmenjavo univerzitetnih učiteljev, študentov, znanstvenikov in strokovnjakov. Prav tako v skladu s svojimi možnostmi podeljujeta štipendije za študij in specializacije študentom in raziskovalcem druge pogodbenice.
6. člen
Pogodbenici v skladu s svojima notranjima zakonodajama proučita potrebne pogoje za medsebojno priznavanje akademskih naslovov.
7. člen
Sodelovanje v znanosti, raziskavah in tehnologiji ureja posebni sporazum, če se pogodbenici tako dogovorita.
8. člen
V ta namen pogodbenici na podlagi obojestranske koristi spodbujata in olajšujeta izmenjavo in sodelovanje v teoretičnih in uporabnih znanostih ter zagotavljata ustrezne možnosti za stike med znanstvenimi inštitucijami in organizacijami, raziskovalnimi inštituti, univerzami in drugimi visokošolskimi inštitucijami, znanstveniki, raziskovalci in strokovnjaki obeh držav; tudi spodbujata skupne dejavnosti na specializiranih področjih in v zvezi s temami v skupnem interesu.
Da bi razvijali in razširili znanstveno sodelovanje, pogodbenici med drugim olajšujeta:
1. obiske, študijske ekskurzije in posvete raziskovalcev, znanstvenikov in drugih strokovnjakov;
2. skupno pripravo in izvajanje raziskovalnih programov in projektov ter izmenjavo njihovih rezultatov;
3. organizacijo skupnih tečajev, konferenc in simpozijev;
4. izmenjavo avdiovizualnega znanstvenega gradiva;
5. organizacijo znanstvenih razstav in prikazov;
6. izmenjavo znanstvene literature, dokumentacije in podatkov.
9. člen
Pogodbenici podpirata sodelovanje med športnimi organizacijami in udeležbo na športnih prireditvah v obeh državah.
10. člen
Pogodbenici spodbujata sodelovanje in izmenjavo med mladimi in med mladinskimi organizacijami obeh držav.
11. člen
Pogodbenici podpirata sodelovanje med javnimi občili obeh držav.
12. člen
Pogodbenici v skladu s predpisi in zakoni, ki veljajo na ozemlju vsake od njiju, omogočata vse možne olajšave za vstop, odhod in bivanje oseb ter za uvoz gradiva in opreme, potrebne za izvajanje programov ali izmenjav, dogovorjenih v skladu s tem sporazumom.
13. člen
1. Za izvajanje tega sporazuma pogodbenici ustanovita paritetno sestavljeno stalno mešano komisijo za proučevanje vseh vprašanj, ki bi lahko nastala med pogodbenicama pri sodelovanju v kulturi, izobraževanju in znanosti.
2. Mešana komisija se sestaja po potrebi, sicer pa najmanj enkrat na pet let, izmenično v eni in drugi državi. Datum in kraj posameznega zasedanja se določata po diplomatski poti.
14. člen
Ta sporazum na noben način ne omejuje pravic in obveznosti iz obstoječih ali prihodnjih dvostranskih ali večstranskih sporazumov in ne vpliva na pravice in obveznosti pogodbenic, ki izhajajo iz takšnih sporazumov ali drugih mednarodnih sporazumov, katerih pogodbenici sta ali bosta.
15. člen
1. Ta sporazum začne veljati na dan izmenjave not, ki navajata, da so izpolnjeni vsi potrebni notranji pravni postopki.
2. Ta sporazum velja pet let. Potem se samodejno obnavlja za nadaljnja petletna obdobja, razen če ga katera od pogodbenic šest mesecev pred iztekom takšnega obdobja pisno ne odpove po diplomatski poti.
3. Če ta sporazum preneha veljati, ostane vsak program izmenjave ali projekt, začet na podlagi tega sporazuma, ki še vedno traja, veljaven, dokler se ne dokonča.
V POTRDITEV TEGA sta podpisana, ki sta pravilno pooblaščena, podpisala ta sporazum.
Sestavljeno v Lizboni dne 6. aprila 1998 v dveh izvirnikih v slovenskem, portugalskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna.
V primeru različne razlage prevlada besedilo v angleškem besedilu.

A G R E E M E N T
BETWEEN THE REPUBLIC OF SLOVENIA AND THE PORTUGUESE REPUBLIC ON COOPERATION IN THE FIELDS OF EDUCATION, CULTURE AND SCIENCE
The Republic of Slovenia and the Portuguese Republic (hereinafter referred to as “the Parties”);
Desirous of encouraging and developing cooperation between the two countries in the fields of culture, education and science;
Convinced that such cooperation will contribute to mutual understanding and enhancement of relations between the two countries;
Resolved to respect the principles of the Helsinki Final Act of the Conference on Security and Cooperation in Europe, Paris Charter for a New Europe and the Vienna Declaration of the Council of Europe;
Have agreed as follows:
Article 1
The Parties shall encourage and make possible cooperation between cultural, educational and scientific institutions of both countries. They shall also encourage and promote the spread of their respective languages and cultures.
Article 2
The Parties shall support exchanges of artists and experts in the fields of fine arts, theatre, music, film, radio and television, literature, libraries, museums and archives.
Article 3
The Parties shall encourage cooperation in preserving their cultural heritage.
Article 4
The Parties shall, in accordance with respective legislations, cooperate in preventing illicit trafficking of cultural properties.
Article 5
The Parties shall support exchange of university teachers, students, scientists and experts. They shall also, in the scope of their means, grant scholarships for study and specialized training to students and researchers of the other Party.
Article 6
The Parties shall, in accordance with their respective internal legislations, examine necessary conditions for the mutual recognition of academic titles.
Article 7
Cooperation in the fields of science, research and technology shall be regulated by a special agreement, should the Parties agree so.
Article 8
To this end the Parties shall encourage and facilitate, on the basis of mutual benefit, exchanges and cooperation in the fields of theoretical and applied sciences and provide appropriate opportunities for contacts between scientific institutions and organizations, research institutes, universities as well as other institutions of higher education, scholars, researchers and experts of the two countries; they shall also encourage joint activities in specialized areas and topics of common interest.
In order to develop and expand scientific cooperation, the Parties shall facilitate, inter alia:
1. Visits, study trips and consultations of researchers, scientists and other experts.
2. Joint elaboration and implementation of research programmes and projects and exchange of the results thereof.
3. Organization of joint courses, conferences and symposia.
4. Exchange of audiovisual material of scientific nature.
5. Organization of scientific exhibitions and displays.
6. Exchange of scientific literature, documentation and information.
Article 9
The Parties shall support cooperation between sports organizations and participation in sporting events in both countries.
Article 10
The Parties shall encourage cooperation and exchanges between the young and between youth organizations of the two countries.
Article 11
The Parties shall support cooperation in the field of mass media of the two countries.
Article 12
The Parties shall, in accordance with regulations and laws in force in their respective territories, grant all conceivable concessions for the entry, departure and stay of persons and for the import of materials and equipment necessary for the implementation of programmes or exchanges agreed in accordance with the present Agreement.
Article 13
1. For the purpose of implementation of the present Agreement, the Parties shall establish a Joint Commission formed on a parity basis which will examine all issues which may arise in the field of cultural, educational and scientific cooperation between the Parties.
2. The Joint Commission shall meet whenever deemed necessary, but not less than once in five years, alternatively in one and the other country. The date and place of an individual session shall be determined through diplomatic channels.
Article 14
This Agreement shall not in any way prejudice the rights and obligations of existing and future bilateral or multilateral agreements and shall have no effect on the rights and obligations of the Parties derived from such agreements or other international agreements to which they may or will be a party.
Article 15
1. This Agreement shall enter into force on the day of the exchange of notes to the effect that all necessary internal legal procedures have been fulfilled.
2. This Agreement shall remain in force for a period of five years. It shall thereafter be automatically renewed for a successive period of five years unless denounced in writing through diplomatic channels by either Party six months prior to the expiry of any one period.
3. In case of termination of the present Agreement, any programme of exchange and project initiated on the basis of this Agreement, and still in progress, will remain valid until its completion.
IN WITNESS WHEREOF, the undersigned, being duly authorized, have signed this Agreement.
Done at Lisbon this 6th day of April 1998 in two originals in the Slovene, Portuguese and English languages, all texts being equally authentic.
In case of different interpretation, the text in English language shall prevail.

3. člen
Za izvajanje sporazuma skrbijo Ministrstvo za zunanje zadeve, Ministrstvo za kulturo, Ministrstvo za šolstvo in šport ter Ministrstvo za znanost in tehnologijo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije - Mednarodne pogodbe.
