Na podlagi druge alinee prvega odstavka 107. člena in prvega odstavka 91. člena Ustave Republike Slovenije izdajam

Razglašam Zakon o ratifikaciji Spremembe Kreditne pogodbe (Projekt slovenskih avtocest vzhod–zahod) med Republiko Slovenijo in Evropsko banko za obnovo in razvoj z dne 10. junija 1994 (MPAEB-A), ki ga je sprejel Državni zbor Republike Slovenije na seji 19. novembra 1999.

Ratificira se Sprememba Kreditne pogodbe (Projekt slovenskih avtocest vzhod–zahod) med Republiko Slovenijo in Evropsko banko za obnovo in razvoj z dne 10. junija 1994, podpisana 11. septembra 1998 v Ljubljani.

Sprememba se v angleškem izvirniku in slovenskem prevodu glasi:
AMENDMENT dated 11. September 1998 (the “Amendment“) to the LOAN AGREEMENT, dated 10 June 1994, between the EUROPEAN BANK FOR RECONSTRUCTION AND DEVELOPMENT (the “Bank“) and Republic of Slovenia (the “ Borrower“).
WHEREAS, the Bank and the Borrower entered into a Loan Agreement, dated 10 June 1994 (the “Loan Agreement“);
NOW THEREFORE, the parties hereto hereby agree to amend the Loan Agreement as follows:
1. Part A of Schedule 1 to the Loan Agreement is hereby deleted in its entirety and substituted with the following:

“Part A: Road Schemes

Construction, or upgrading and maintenance of Road Schemes including:
(1) reconstruction/upgrading of the route between Pocehova and Lendava;
(2) rehabilitation works on road sections as provided in Annex 1 to this Amendment subject to such modifications thereof as may be agreed between the Bank and the Government of the Borrower prior to conclusion of the relevant contracts;
(3) widening of the road between Crnuce to Domzale; and
(4) reconstruction of the major road M-3 crossing with the railway underpass at Ptuj.“
2. Paragraph 1(a) of Schedule 3 of the Loan Agreement is hereby amended to read in its entirety as:

“Goods, works and services (excluding consultants’ services which are covered under paragraph (2) of this Schedule) shall be procured through open tendering, expect that contracts for goods and services for the introduction of road monitoring equipment under Part B of the Project described in Schedule 1, in an aggregate amount not exceeding the equivalent of USD 700,000 and not exceeding the equivalent of USD 400,000 per contract may be procured through shopping.“

3. This Amendment is limited as specified herein and shall not constitute a modification, acceptance or waiver of any other provision of the Loan Agreement or any other document.
4. This Amendment shall be implemented provisionally from the date of its signature by the parties to it and shall enter into force on the date upon which the Bank notifies the Borrower on its acceptance of documentary evidence in form and substance satisfactory to the Bank that the execution of this Amendment by the Borrower has been duly authorised and ratified and that this Amendment is legally binding upon the Borrower in accordance with its terms.
5. This Amendment shall be executed in three (3) counterparts, each of which shall be deemed an original, and all of which together constitute one and the same document.
IN WITNESS WHEREOF, the parties hereto, acting through their duly authorized representatives, have caused this Amendment to be signed by correspondence as of the date first above written.

The table below sets forth the road sections and their lengths to be financed out of the proceeds of the Loan under paragraph (2) of Part A:

SPREMEMBA z dne 11. septembra 1998 (sprememba) KREDITNE POGODBE z dne 10. junija 1994 med EVROPSKO BANKO ZA OBNOVO IN RAZVOJ (banka) in Republiko Slovenijo (kreditojemalec)
GLEDE NA TO, da sta banka in kreditojemalec sklenila Kreditno pogodbo z dne 10. junija 1994 (Kreditna pogodba),
SE ZDAJ pogodbenici sporazumeta o spremembi Kreditne pogodbe, ki se glasi:
1. Del A Dodatka 1 Kreditne pogodbe se v celoti črta in nadomesti z naslednjim:
“Del A: Cestni projekti
Izgradnja ali posodobitev in vzdrževanje cest, ki obsegata:
(1) rekonstrukcijo/posodobitev trase med Počehovo in Lendavo;
(2) sanacijska dela na cestnih odsekih, kot je to določeno v Prilogi 1 k tej spremembi, ob upoštevanju sprememb, o katerih se lahko sporazumeta banka in vlada kreditojemalca pred sklenitvijo zadevnih pogodb;
(3) razširitev ceste med Črnučami in Domžalami in
(4) rekonstrukcijo križanja magistralne ceste M-3 z železniškim podvozom na Ptuju.“
2. Točka 1 (a) Dodatka 3 h Kreditni pogodbi se spremeni, tako da se v celoti glasi:
“Nabava blaga, del in storitev (razen storitev svetovalcev iz 2. točke tega dodatka) bo temeljila na javnih razpisih, kar pa ne velja za blago in storitve, potrebne pri uvedbi opreme za nadzor v okviru dela B projekta iz Dodatka 1, v skupni vrednosti, ki ne presega protivrednosti 700 000 USD in ki na pogodbo ne presega protivrednosti 400 000 USD, ki jih je mogoče nabaviti z nakupom.“
3. Ta sprememba je omejena, kot je v njej določeno, in se zaradi nje ne spremeni, sprejme ali odpove katera koli druga določba Kreditne pogodbe ali drugega dokumenta.
4. Ta sprememba se začasno izvaja od dne, ko jo pogodbenici podpišeta, in začne veljati na dan, ko banka uradno obvesti kreditojemalca, da je sprejela za banko po obliki in vsebini zadovoljiv dokumentarni dokaz, da je kreditojemalčev podpis te spremembe pravilno odobren in ratificiran ter da je ta sprememba pravno zavezujoča za kreditojemalca v skladu s svojimi določili.
5. Ta sprememba je sestavljena v treh (3) izvodih, od katerih se vsak šteje za izvirnik in vsi sestavljajo isti dokument.
V POTRDITEV NAVEDENEGA sta pogodbenici korespondenčno na dan, naveden na začetku, po svojih pravilno pooblaščenih predstavnikih podpisali to spremembo.

V spodnji tabeli so navedeni cestni odseki in njihove dolžine, ki se financirajo iz sredstev kredita po 2. točki dela A:

Za izvajanje spremembe kreditne pogodbe ter vseh pravic in obveznosti za Republiko Slovenijo, ki izhajajo iz spremembe, skrbi Ministrstvo za finance.

Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
