O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE (BTHGS)
Razglašam Zakon o ratifikaciji Sporazuma o trgovinskem in gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske (BTHGS), ki ga je sprejel Državni zbor Republike Slovenije na seji 15. februarja 2000.

O RATIFIKACIJI SPORAZUMA O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE (BTHGS)
1. člen
Ratificira se Sporazum o trgovinskem in gospodarskem sodelovanju med Vlado Republike Slovenije in Vlado Kraljevine Tajske, podpisan v Ljubljani 13. maja 1999.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
O TRGOVINSKEM IN GOSPODARSKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO KRALJEVINE TAJSKE
Vlada Republike Slovenije in Vlada Kraljevine Tajske (v nadaljevanju pogodbenici) sta se
v želji, da bi spodbudili in okrepili svoje trgovinsko in gospodarsko sodelovanje,
v prepričanju, da je potrebno trajno in učinkovito sodelovanje, ki bo vzajemno koristilo interesom obeh držav,
ob upoštevanju prakse in standardov mednarodnega trga
sporazumeli, kot sledi:
1. člen
Pogodbenici v okviru svojih zakonov in predpisov sprejmeta ustrezne ukrepe za okrepitev in spodbuditev trgovinskih odnosov in gospodarskega sodelovanja med državama.
2. člen
Pogodbenici v skladu z načeli Svetovne trgovinske organizacije (STO) priznavata druga drugi obravnavo po načelu največjih ugodnosti za carine in druge dajatve s podobnim učinkom kot tudi za carinske formalnosti v zvezi z uvozom in izvozom blaga in storitev s poreklom iz svojih držav.
3. člen
Določbe 2. člena tega sporazuma se ne uporabljajo za ugodnosti, oprostitve ali privilegije, ki jih pogodbenici priznavata ali jih bosta priznavali:
a) sosednjim državam, da bi olajšali obmejni promet in trgovino;
b) tretjim državam na podlagi sodelovanja v okviru carinske unije ali prostotrgovinskega območja ali regionalnega združenja za gospodarsko sodelovanje ali sporazumov o regionalnem povezovanju.
4. člen
Pogodbenici si v obsegu svojih pristojnosti prizadevata zagotoviti stabilne razmere za razvoj trgovine in drugih oblik gospodarskega sodelovanja med državama.
5. člen
Vsa plačila med pogodbenicama se opravljajo v prosto zamenljivi valuti po predpisih, ki se uporabljajo v državah pogodbenic, in v skladu s standardnimi pogoji in prakso mednarodnega trga. Prosto zamenljiva valuta pomeni katero koli valuto, kot jo občasno določi Mednarodni denarni sklad.
Računi v okviru tega sporazuma se lahko poravnajo na kateri koli mednarodno sprejemljiv način v skladu z bančno prakso na podlagi medsebojnega dogovora med udeleženimi gospodarskimi subjekti in v skladu z zakoni in predpisi pogodbenic.
6. člen
Medsebojna dobava blaga in opravljanje storitev temeljita na pogodbah, sklenjenih med gospodarskimi subjekti pogodbenic v skladu z zakoni in predpisi, ki veljajo v eni ali drugi državi.
7. člen
Glede na razvoj trgovinskega in gospodarskega sodelovanja pogodbenici spodbujata medsebojno izmenjavo informacij zlasti o svoji zakonodaji in gospodarskih programih kot tudi drugih informacij skupnega interesa.
8. člen
1. Pogodbenici ustanovita Skupno trgovinsko in gospodarsko komisijo za lažje posvetovanje in sodelovanje v okviru tega sporazuma med državama na področjih skupnega interesa.
2. Komisija:
– proučuje načine in sredstva za spodbujanje in razvijanje dvostranskih odnosov in sodelovanja v skladu z ustreznimi zakoni in predpisi pogodbenic;
– zagotavlja pravilno usklajevanje in izvajanje svojih odločitev in/ali priporočil;
– ocenjuje napredek pri izvajanju vseh sporazumov, dogovorov in drugih oblik pogodb med pogodbenicama in proučuje ter rešuje probleme, ki utegnejo nastati pri izvajanju takih sporazumov, dogovorov ali pogodb;
– zagotavlja izmenjavo informacij o spremembah predpisov pogodbenic;
– opredeljuje probleme, ki ovirajo dvostransko trgovinsko sodelovanje, in priporoča rešitve, ki lahko pomagajo širiti dostop do trga v njunih državah.
3. To komisijo sestavljajo predstavniki, ki jih imenujeta njuni vladi, in se sestaja ob vzajemno sprejemljivih datumih izmenično v Republiki Sloveniji in Kraljevini Tajski.
9. člen
Pogodbenici za namen tega sporazuma spodbujata in omogočata naslednje dejavnosti v svojih organizacijah in podjetjih:
a) organiziranje poslovnih srečanj, trgovinskih misij, trgovskih in industrijskih sejmov ter razstav, seminarjev in pogovorov;
b) izmenjavo izkušenj iz svoje zunanje trgovine;
c) sodelovanje pri proučevanju možnosti za razširitev dostopa do trgov tretjih držav.
10. člen
1. Pogodbenici si v skladu s tem sporazumom ter zakoni in predpisi, ki se uporabljajo v njunih državah, medsebojno pomagata pri organiziranju sejmov, specializiranih razstav in predstavitvenih dejavnosti.
2. Vsaka pogodbenica ob upoštevanju svojih veljavnih zakonov in predpisov oprosti drugo pogodbenico uvoznih carin za:
a) blago in materiale za začasne sejme in razstave, ki niso namenjeni prodaji;
b) vzorce blaga, ki se uporabljajo samo v ta namen in nimajo nobene tržne vrednosti.
3. Razpolaganje z blagom, materiali in vzorci, navedenimi v pododstavkih a) in b) tega člena, mora biti v skladu z veljavnimi zakoni in predpisi države, v katero so bili uvoženi.
11. člen
Kakršna koli razhajanja med pogodbenicama v zvezi z razlago in/ali izvajanjem tega sporazuma se rešijo nemudoma s prijateljskimi posvetovanji in pogajanji.
12. člen
1. Ta sporazum začne veljati trideset dni po datumu prejema zadnjega od uradnih obvestil, s katerima se pogodbenici medsebojno obvestita o izpolnitvi vseh notranjepravnih zahtev za začetek veljavnosti tega sporazuma.
2. Sporazum velja za obdobje enega leta in se samodejno podaljša za nadaljnje obdobje enega leta, razen če ga pogodbenici ne odpovesta po diplomatski poti s trimesečnim pisnim odpovednim rokom pred prenehanjem njegove veljavnosti.
13. člen
1. Pogodbenici lahko pisno ob vzajemnem soglasju spremenita katero koli določbo tega sporazuma. Za uveljavitev takšnih sprememb veljajo enaki postopki, kot so navedeni v prvem odstavku 12. člena.
2 Sprememba ali odpoved tega sporazuma na noben način ne ovira izpolnjevanja pogodb, sklenjenih med gospodarskimi subjekti obeh držav med veljavnostjo tega sporazuma.
V POTRDITEV NAVEDENEGA sta podpisana, ki sta ju pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v dveh izvodih v Ljubljani dne 13. maja 1999 v slovenskem, tajskem in angleškem jeziku kot enako verodostojnih besedilih. Ob razlikah pri razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
ON TRADE AND ECONOMIC COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE KINGDOM OF THAILAND
The Government of the Republic of Slovenia and the Government of the Kingdom of Thailand (hereinafter referred to as the Contracting Parties):
Desiring to promote and strengthen their trade and economic cooperation;
Convinced of the necessity of lasting and effective cooperation which will mutually benefit both countries’ interest;
Considering the practices and standards of the international market;
Have agreed as follows:
Article 1
The Contracting Parties shall, within the scope of their respective laws and regulations, take all appropriate measures in order to intensify and promote trade relations and economic cooperation between the two countries.
Article 2
The Contracting Parties shall, in accordance with the principles of the World Trade Organization (WTO), grant each other the most-favored-nation treatment with respect to customs duties and other charges with similar effect, as well as customs formalities, in connection with importation and exportation of goods and services originating from their countries.
Article 3
The provisions of Article 2 of this Agreement shall not apply to advantages, exemption or privileges which the Contracting Parties grant or shall grant:
(a) to its neighboring countries to facilitate frontier traffic and trade;
(b) to third countries based on cooperation within the framework of a customs union or a free trade area or a regional association for economic cooperation, or agreements on regional integration.
Article 4
The Contracting Parties shall endeavor, within the scope of their authority, to secure the stable conditions for the development of trade and other forms of economic cooperation between the two countries.
Article 5
All payments between the contracting Parties shall be effected in freely usable currency in compliance with regulations applicable in the countries of the Contracting Parties and in accordance with standard terms and practices of the international market. Freely usable currency shall mean any currency as determined from time to time by the International Monetary Fund.
Accounts within the framework of this Agreement may be settled in any internationally accepted way according to banking practice, based on mutual agreement among the economic entities involved and in accordance with the laws and regulations of the Contracting Parties.
Article 6
Mutual supply of goods and rendering of services shall be based on contracts concluded between economic entities of the Contracting Parties in accordance with the laws and regulations in force in either country.
Article 7
In view of the development of trade and economic cooperation, the Contracting Parties shall encourage mutual exchange of information, particularly concerning their respective legislation and economic programs, as well as other information of mutual interest.
Article 8
1. The Contracting Parties shall establish a Joint Trade and Economic Commission to facilitate consultation and cooperation within the framework of this Agreement between the two countries in the fields of mutual interest.
2. The Commission shall:
– consider ways and means to encourage and to develop bilateral relations and cooperation and in conformity with their respective laws and regulations;
– ensure the proper coordination and implementation of its decisions and/or recommendations;
– review the progress in implementation of all agreements, arrangements and other forms of contracts between the Contracting Parties and study and solve the problems that may arise from the implementation of such agreements, arrangements or contracts;
– ensuring the exchange of information concerning the changes of regulations of the Contracting Parties;
– identify problems that hamper bilateral trade cooperation and recommend solutions that may help widen the market access in their respective countries.
3. This Commission shall compose of the representatives appointed by their respective Governments and shall meet on mutually acceptable dates alternately in the Republic of Slovenia and the Kingdom of Thailand.
Article 9
For the purposes of this Agreement, the Contracting Parties shall encourage and facilitate the following activities of their respective organizations and enterprises:
(a) arrangements of business meetings, trade missions, trade and industrial fairs and exhibitions, seminars and talks;
(b) exchange of experience regarding their respective foreign trade;
(c) cooperation in studying the possibility of enlarging market access in third countries.
Article 10
1. The Contracting Parties shall, in accordance with this Agreement and the laws and regulations applicable in their respective countries, render each other assistance in organizing fairs, specialized exhibitions and promotion actions.
2. Each Contracting Party shall, subject to its laws and regulations in force, exempt the other Contracting Party from import duties for the following items:
(a) goods and materials for fairs and exhibitions which are not intended for sale;
(b) samples of merchandise fit only to be used as such and of no commercial value.
3. The disposal of such goods, materials and samples referred to in subparagraphs (a) and (b) of this Article shall be in accordance with the applicable laws and regulations of the country into which they were imported.
Article 11
Any differences between the Contracting Parties relating to the interpretation and/or implementation of this Agreement shall be resolved without delay by friendly consultations and negotiations.
Article 12
1. This Agreement shall enter into force thirty days after the date of receipt of the last of notes with which the Contracting Parties notify each other that all internal legal requirements for the entry into force of this Agreement have been fulfilled.
2. This Agreement shall be in force for the period of one year and shall be automatically renewed for successive period of one year unless one of the Contracting Parties terminates this Agreement through diplomatic channels by giving three months’ written notice before the expiry of its validity.
Article 13
1. The Contracting Parties shall be able to amend by mutual consent any provisions of this Agreement. For the entry into force of such amendments, the same procedures stipulated in Article 12, paragraph 1 shall be applied.
2. The modification or termination of the Agreement shall in no way interfere with the fulfillment of contracts concluded between the economic entities of both countries during the period of the validity hereof.
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.
Done in duplicate at Ljubljana on this 13th day of May 1999 in the Slovenian, Thai and English languages, all the three texts being equally authentic. In case of any divergence of interpretation of this Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za ekonomske odnose in razvoj.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
