Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Arabske republike Egipt o gospodarskem, industrijskem, tehnološkem in znanstvenem sodelovanju (BEGGIS), ki ga je sprejel Državni zbor Republike Slovenije na seji 29. februarja 2000.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO ARABSKE REPUBLIKE EGIPT O GOSPODARSKEM, INDUSTRIJSKEM, TEHNOLOŠKEM IN ZNANSTVENEM SODELOVANJU (BEGGIS)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Arabske republike Egipt o gospodarskem, industrijskem, tehnološkem in znanstvenem sodelovanju, podpisan v Ljubljani 28. oktobra 1998.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO ARABSKE REPUBLIKE EGIPT O GOSPODARSKEM, INDUSTRIJSKEM, TEHNOLOŠKEM IN ZNANSTVENEM SODELOVANJU
Vlada Republike Slovenije in Vlada Arabske republike Egipt (v nadaljevanju pogodbenici) sta se
ob upoštevanju pomena, ki ga ima gospodarsko sodelovanje za razvoj in raznolikost odnosov med državama,
z namenom, da bi razvili obstoječe gospodarske odnose na podlagi obojestranske koristi in vzajemnosti ob dopuščanju uporabe vseh možnosti, ki jih ustvarja tehnološki in znanstveni napredek,
v skladu z veljavnimi zakoni v obeh državah in z mednarodnimi sporazumi, ki sta jih sprejeli, ob upoštevanju določb Sporazuma o ustanovitvi Svetovne trgovinske organizacije
sporazumeli, kot sledi:
1. člen
Pogodbenici spodbujata razvoj gospodarskega sodelovanja med državama, da bi okrepili in razširili svoje odnose.
Pogodbenici z medsebojnim dogovorom določita področja delovanja, na katerih se zdi dvostransko sodelovanje ugodnejše, ob upoštevanju razvoja dvostranskih odnosov in prednostnih nalog gospodarske politike obeh držav.
2. člen
V skladu z zakoni in predpisi, ki veljajo v obeh državah, pogodbenici:
(a) spodbujata stike med pristojnimi ustanovami obeh držav, vključno z izmenjavo strokovnjakov;
(b) podpirata pobude, kot so sejmi, razstave, konference in druga srečanja, katerih namen je pospeševanje in razvoj sodelovanja med državama in zlasti med njunimi gospodarskimi predstavniki in pristojnimi institucijami;
(c) spodbujata razvoj novih načinov sodelovanja, vključno s sodelovanjem med srednje velikimi in majhnimi podjetji, kot so ustanovitev skupnih podjetij, medsebojne naložbe, oddaja del v podizvajanje, pogodbe o vodenju, raziskave, izmenjava tehnologij in skupna proizvodnja blaga;
(d) gospodarskim predstavnikom obeh držav zagotavljata informacije o dejanskih možnostih za sodelovanje in razvoj dvostranskih odnosov;
(e) podpirata sodelovanje med gospodarskimi organizacijami in podjetji obeh držav na podlagi dogovora o dolgoročnih programih, protokolov in pogodb;
(f) podpirata tečaje usposabljanja s posebnim interesom za gospodarsko dejavnost, katerih cilj je tehnološko usposabljanje poslovnežev in menedžerjev kot tudi srednje in visoko kvalificiranega osebja podjetij.
Pogodbenici omogočata odprtje in ustanovitev uradov v obeh državah ali kakršnega koli drugega predstavništva gospodarskih organizacij in podjetij druge države v skladu z zakoni, veljavnimi v obeh državah.
3. člen
Pogodbenici pospešujeta sodelovanje med podjetji obeh držav, vključno z ustanovitvijo skupnih podjetij, ki delujejo v obeh državah in tudi v tretjih državah.
4. člen
Ker se pogodbenici zavedata pomena znanosti in tehnologije za gospodarski in družbeni razvoj, bosta na podlagi vzajemne pravičnosti in koristi spodbujali razvoj znanstvenega in tehnološkega sodelovanja na področju, ki je posebej zanimivo za obe državi.
Za ta namen pogodbenici podpirata sklenitev vzajemnega sporazuma o znanstvenem in tehnološkem sodelovanju med ministrstvoma pogodbenic, pristojnima za znanost in tehnologijo.
5. člen
Pogodbenici se zavedata pomena, ki ga imajo majhna in srednje velika podjetja za gospodarstvo obeh držav, in bosta zato na tem področju pospeševali povezavo med nacionalnimi institucijami za podporo majhnim in srednje velikim podjetjem kakor tudi sodelovanje med njimi, skrbeli za izmenjavo in stike med njimi ter spodbujali sodelovanje med majhnimi in srednje velikimi podjetji v vseh oblikah, predvsem s pomočjo sistema izmenjave informacij.
6. člen
Pogodbenici si prizadevata za sklenitev sporazuma o spodbujanju in zaščiti naložb ter sporazuma o izogibanju dvojnemu obdavčevanju, zato da bi omogočali razvoj sodelovanja.
7. člen
Pogodbenici vsaka v okviru svojih pristojnosti zagotavljata in utrjujeta varstvo pravic intelektualne lastnine.
8. člen
Za zagotovitev uresničevanja tega sporazuma pogodbenici ustanovita medvladno mešano komisijo, ki ji predsedujeta ministrstvi obeh pogodbenic, pristojni za mednarodne ekonomske odnose.
Mešana komisija lahko vključuje predstavnike institucij, organizacij, podjetij in drugih strani obeh držav, ki se sestanejo enkrat letno oziroma po potrebi na željo ene ali druge pogodbenice izmenično v Republiki Sloveniji in Arabski republiki Egipt.
Mešana komisija spremlja in usklajuje gospodarsko sodelovanje med državama in predlaga eni oziroma drugi vladi ustrezne ukrepe za njegov razvoj, in sicer z opredelitvijo področij dejavnosti, na katerih se dvostransko sodelovanje zdi koristnejše.
Mešana komisija lahko sprejme posebna pravila, potrebna za svoje delovanje.
9. člen
Ta sporazum ne posega v druge mednarodne sporazume, ki zavezujejo pogodbenici.
10. člen
Pogodbenici lahko spremenita katero koli določbo tega sporazuma; te spremembe se odobrijo na podlagi prvega odstavka 11. člena.
11. člen
Sporazum začne veljati trideset dni po dnevu prejema drugega obvestila, s katerim pogodbenici druga drugo obvestita o odobritvi v skladu z ustavnimi postopki obeh držav.
Sporazum velja pet let in se samodejno podaljšuje za nadaljnja obdobja enega leta, razen če ga ena od pogodbenic ne odpove šest mesecev pred prenehanjem njegove veljavnosti.
Sestavljeno v Ljubljani dne 28. oktobra 1998 v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE ARAB REPUBLIC OF EGYPT ON ECONOMIC, INDUSTRIAL, TECHNOLOGICAL AND SCIENTIFIC COOPERATION
The Government of the Republic of Slovenia and the Government of the Arab Republic of Egypt, hereinafter referred to as the Contracting Parties,
aware of the importance of economic cooperation for the development and diversification of relations between both countries,
in order to develop existing economic relations on a basis of mutual benefit and reciprocity, allowing the use of all the opportunities created by technological and scientific progress,
in accordance with laws in force in both countries and international agreements accepted by them, by taking into account the provisions of the Agreement on establishment of the World Trade Organization,
have agreed as follows:
Article 1
The Contracting Parties shall promote the development of economic cooperation between both countries, in order to intensify and diversify their relations.
The Contracting Parties shall determine, by mutual agreement, the fields of activity in which bilateral cooperation seems more favourable, taking into account the development of bilateral relations and the priorities of the economic policy of both countries.
Article 2
In accordance with the laws and regulations in force in both countries, the Contracting Parties:
(a) shall promote contacts between competent institutions of both countries, including the exchange of experts;
(b) shall support initiatives such as fairs, exhibitions, conferences and other meetings, intended to promote and develop cooperation between both countries and mainly between their economic agents and competent institutions;
(c) shall facilitate the development of new means of cooperation, including cooperation between medium and small sized enterprises, such as the set up of joint companies, cross investments, subcontracting, management contracts, research, exchange of technologies and joint production of goods;
(d) shall provide information to economic agents of both countries on real opportunities for cooperation and development of bilateral relations;
(e) shall support cooperation between economic organizations and companies of both countries, on the basis of the agreement on long term programs, protocols and contracts;
(f) shall support training courses with particular interest in economic activity, aiming at the technological training of businessmen and managers, as well as of the medium- and highly qualified staff of companies.
The Contracting Parties shall facilitate the opening and establishment of offices in both countries, or of any other representation of economic organizations and companies of the other country in accordance with laws in force in both countries.
Article 3
The Contracting Parties shall promote cooperation between companies of both countries, including the set up of joint companies working in both countries and also in third party countries.
Article 4
Being aware of the importance of science and technology for economic and social development, the Contracting Parties shall promote, on the basis of mutual equity and benefit, the development of scientific and technological cooperation in the field of particular interest for both countries.
For this purpose both Contracting Parties support the conclusion of a mutual agreement on scientific and technological cooperation between the ministries of the Contracting Parties competent for science and technology.
Article 5
Both Contracting Parties are aware of the importance of small- and medium-sized enterprises for the economy of both countries and for this reason they shall promote the linkage of national institutions for support of SME’s, as well as the cooperation among SME units, provide for the exchange and contacts among them, and foster cooperation among SME’s in all forms mostly by means of the information-exchange system.
Article 6
The Contracting Parties shall endeavor to conclude an Agreement for Investments Promotion and Protection and Agreement to Avoid Double Taxation, in order to facilitate cooperation development.
Article 7
Within their respective competences, the Contracting Parties shall ensure and reinforce protection of intellectual property rights.
Article 8
To ensure the implementation of this Agreement, the Contracting Parties shall establish an Intergovernmental Joint Commission presided by the ministries of the two Contracting Parties competent for international economic relations.
The Joint Commission may include representatives of institutions, organizations, enterprises and other parties of the two countries, that shall meet once a year, or if need be, at the request of either Contracting Party in the Republic of Slovenia and the Arab republic of Egypt, alternatively.
The Joint Commission shall follow and coordinate economic cooperation between both countries and shall propose to the respective Governments the appropriate measures for its development, namely, defining the fields of activity in which bilateral cooperation seems more advantageous.
The Joint Commission may adopt specific rules necessary to its operation.
Article 9
This Agreement shall not prejudice other international agreements undertaken by the Contracting Parties.
Article 10
The Contracting Parties shall be able to amend any provision of this Agreement; such amendments shall be approved under paragraph 1 of Article 11.
Article 11
The Agreement shall come into force thirty days after the date of receipt of the second notice through which the Contracting Parties notified each other of their approval, in accordance with the Constitutional procedures of both countries.
The Agreement shall be in force for five years and shall be automatically renewed for consecutive periods of one year, unless one of the Contracting Parties denounces it six months before the end of its validity.
Done in Ljubljana on 28th October 1998 in two originals, in the Slovenian, Arabic and English languages, all texts being equally authentic. In case of differences in interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za ekonomske odnose in razvoj.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
