Razglašam Zakon o ratifikaciji Sporazuma med Ministrstvom za kmetijstvo, gozdarstvo in prehrano Republike Slovenije in Ministrstvom za kmetijstvo Slovaške republike o sodelovanju na področju kmetijstva, živilske industrije in gozdarstva (BSKKIG), ki ga je sprejel Državni zbor Republike Slovenije na seji 10. maja 2000.

O RATIFIKACIJI SPORAZUMA MED MINISTRSTVOM ZA KMETIJSTVO, GOZDARSTVO IN PREHRANO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA KMETIJSTVO SLOVAŠKE REPUBLIKE O SODELOVANJU NA PODROČJU KMETIJSTVA, ŽIVILSKE INDUSTRIJE IN GOZDARSTVA (BSKKIG)
1. člen
Ratificira se Sporazum med Ministrstvom za kmetijstvo, gozdarstvo in prehrano Republike Slovenije in Ministrstvom za kmetijstvo Slovaške republike o sodelovanju na področju kmetijstva, živilske industrije in gozdarstva, podpisan 9. januarja 1998 v Bratislavi.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:
S P O R A Z U M
MED MINISTRSTVOM ZA KMETIJSTVO, GOZDARSTVO IN PREHRANO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA KMETIJSTVO SLOVAŠKE REPUBLIKE O SODELOVANJU NA PODROČJU KMETIJSTVA, ŽIVILSKE INDUSTRIJE IN GOZDARSTVA
Ministrstvo za kmetijstvo, gozdarstvo in prehrano Republike Slovenije in Ministrstvo za kmetijstvo Slovaške republike (v nadaljnjem besedilu pogodbenici) sta se
v želji, da nadaljujeta razvoj sodelovanja v vzajemno korist na področju kmetijstva, živilske industrije in gozdarstva, in
z namenom, da podpreta uresničevanje neposrednih stikov med pravnimi osebami obeh držav,
dogovorili o naslednjem:
1. člen
Pogodbenici bosta v okviru svojih pristojnosti in v skladu z veljavnimi pravnimi predpisi ponujali svojo podporo in pomoč pravnim osebam vsake pogodbenice pri uresničevanju in razvijanju sodelovanja na področju kmetijstva, živilske industrije in gozdarstva.
2. člen
1. Sodelovanje med pogodbenicama na področju kmetijstva, živilske industrije in gozdarstva bo potekalo na naslednjih področjih:
a) pridelava rastlin: selekcija in žlahtnjenje rastlin, vključno z uporabo sodobnih tehnologij fitogenetike, semenarstvo, pridelava novih sort kmetijskih rastlin z uporabo okolju prijaznih tehnologij in sredstev za varstvo rastlin; sodelovanje na področju vinogradništva;
b) živinoreja: govedoreja, prašičereja, konjereja, ovčereja, kozjereja, kuncereja, perutninarstvo, ribogojstvo in čebelarstvo – preskrba s plemenskimi živalmi, reprodukcijskim materialom (seme, zarodki, oprema), strokovno delo na področju selekcije, rodovništva, nadzora proizvodnje in reprodukcije živali, nove tehnologije in reje živali in predelava krme;
c) mehanizacija kmetijstva: razvoj in uporaba novih tehnologij in tehnike na področju kmetijske proizvodnje in predelovalne industrije;
d) proizvodnja živil: prilagajanje tehnične zakonodaje pri proizvodnji živil, pri pripravi zakonov, v sistemu uvoznih in izvoznih certifikatov za kmetijske in živilske proizvode, pri zagotavljanju uradnega državnega nadzora kakovosti živil in varovanja potrošnika in pri označevanju živil, s tehnično zakonodajo Evropske unije, izmenjava informacij in strokovna pomoč pri skupnih vlaganjih v živilsko industrijo, izmenjava informacij o ponudbi tehnologij in know-howa za majhna podjetja (pridelava mleka in mesa, mlini in pekarne, predelava sadja in zelenjave, proizvodnja piva, slada in vina, odstranjevanje odpadnih vod iz majhnih obratov);
e) gozdarstvo: gozdarska politika in zakonodaja, trajnostno (sonaravno) gospodarjenje z gozdovi in njihova večnamenska raba, okolju prijazne tehnologije pridobivanja lesa in tehnike zanjo, varstvo gozdov (entomologija in fitopatologija), spremljanje stanja gozdov in daljinsko pridobivanje podatkov, trajnostno (sonaravno) upravljanje zavarovanih območij gozdov (parki), proces preoblikovanja gozdarstva (sodelovanje zlasti v smislu Resolucije H3 Ministrske konference o varovanju gozdov v Evropi, Helsinki, junij 1993);
f) lovstvo: zakonodaja, ki obravnava divjad in lovstvo, upravljanje divjadi (dela prosto živečih živali) kot sestavnim delom ekosistemov, načrtovanje upravljanja divjadi, varstvo in ohranjanje avtohtonih divjih živali, varstvo habitatov divjih živali, lovska kinologija in sokolarstvo.
2. Po posvetovanjih in s soglasjem pogodbenic se lahko ta sporazum pisno dopolni z drugimi področji sodelovanja.
3. člen
1. Sodelovanje med pogodbenicama bo potekalo v naslednjih oblikah:
a) izmenjava vzorcev semen, rastlin, biološkega materiala, kemičnih preparatov, veterinarskih preparatov, izmenjava plemenske živine in reprodukcijskega materiala, izmenjava novih strojev, opreme in instrumentov v preizkusne namene;
b) vzajemno preizkušanje, priznavanje in zamenjava sort in vrst;
c) izmenjava dosežkov raziskav, znanstvenikov in strokovnjakov ter informacij s seminarjev, simpozijev, razstav;
d) delo pri skupnih raziskovalnih nalogah;
e) posvetovanja, organizacija skupnih delavnic, simpozijev in razstav;
f) izmenjava informacij o pristopih in ukrepih kmetijske, živilske in gozdarske politike;
g) neposredni stiki med kmetijskimi in gozdarskimi združenji in organizacijami podjetnikov obeh držav;
h) splošna pomoč pri ustanavljanju skupnih vlaganj, podpora razvoju kooperacijske proizvodnje.
2. Po posvetovanjih in s soglasjem pogodbenic se lahko ta sporazum pisno dopolni z drugimi oblikami sodelovanja.
4. člen
Izmenjava vzorcev, materiala, strojev in informacij, omenjena v 3. členu tega sporazuma, bo potekala na podlagi vzajemnosti brezplačno ali pod pogoji, o katerih se dogovorita pogodbenici. Izmenjava znanstvenikov in sodelavcev bo potekala na podlagi programov za izvajanje tega sporazuma glede na potrebe, interese in možnosti pogodbenic.
5. člen
Pogodbenici se zavezujeta, da ne bosta objavljali informacij, ki jih dostavita druga drugi na podlagi tega sporazuma, niti rezultatov skupnih raziskav, razen tistih, o katerih se pisno dogovorita.
O lastninskih pravicah in uporabi rezultatov, pridobljenih s skupnim delom, se bosta pogodbenici ob spoštovanju Konvencije o ustanovitvi Svetovne organizacije za intelektualno lastnino (WIPO) dogovorili v skladu s posebnim protokolom, ki bo izdelan, preden se začne delo pri skupnem projektu.
6. člen
Pogodbenici bosta podpirali razvoj trgovinskih odnosov z namenom povečanja medsebojne izmenjave blaga in obsega storitev, opravljenih na podlagi splošno veljavnih mednarodnih tržnih načel (GAT 94/WTO) in ravni liberizacije in pod pogoji, kot jih določata Sporazum o prosti trgovini med Republiko Slovenijo in Slovaško republiko, podpisan v Bratislavi 22. decembra 1993 in Sporazum o pristopu Republike Slovenije k srednjeevropskemu sporazumu o prosti trgovini, podpisan v Ljubljani 25. novembra 1995.
7. člen
Pogodbenici bosta sodelovali na veterinarskem in fitosanitarnem področju na podlagi posebnih medvladnih sporazumov.
8. člen
Za usklajevanje dela pri uveljavljanju tega sporazuma je odgovorna mešana komisija. Mešana komisija bo pripravljala posamezne projekte sodelovanja in jih predlagala pogodbenicama. Mešana komisija se bo sestajala po potrebi, in sicer najmanj enkrat letno, izmenično v Republiki Sloveniji in Slovaški republiki, kot bo dogovorjeno. Dva meseca pred sestankom mešane komisije si bosta pogodbenici pisno izmenjali predloge za sodelovanje v naslednjem obdobju. Rezultati sestankov bodo zapisani v protokolu sestanka. Tehnično-administrativne stroške takšnih sestankov bo poravnala pogodbenica, ki je gostiteljica, druge stroške (potne, oskrbne in nastanitvene) pa vsaka pogodbenica sama.
9. člen
Ta sporazum nima nikakršnega vpliva na pravice in obveznosti pogodbenic, ki izhajajo iz mednarodnih sporazumov, ki sta jih pogodbenici že sklenili, ali iz njunega članstva v mednarodnih organizacijah.
10. člen
Ta sporazum mora biti odobren v skladu z notranjimi pravnimi predpisi pogodbenic in začne veljati trideseti dan po datumu izmenjave diplomatskih not o odobritvi sporazuma.
Sporazum se sklene za pet let in se samodejno podaljša za naslednje petletno obdobje, razen če ga katera od pogodbenic pisno odpove najkasneje šest mesecev pred iztekom tega obdobja.
Ta sporazum se lahko spremeni ali dopolni s pisnim soglasjem pogodbenic.
Sestavljeno v Bratislavi dne 9. januarja 1998 v dveh izvirnikih, vsak v slovenskem, slovaškem in angleškem jeziku, pri čemer so vsa besedila verodostojna. Ob morebitnem sporu se angleško besedilo šteje za odločilno.

A G R E E M E N T
BETWEEN THE MINISTRY OF AGRICULTURE, FORESTRY AND FOOD OF THE REPUBLIC OF SLOVENIA AND THE MINISTRY OF AGRICULTURE OF THE SLOVAK REPUBLIC ON COOPERATION IN THE FIELD OF AGRICULTURE, FOOD INDUSTRY AND FORESTRY
The Ministry of Agriculture, Forestry and Food of the Republic of Slovenia and the Ministry of Agriculture of the Slovak Republic (hereinafter the Contracting Parties),
wishing to continue the development of the mutually advantageous cooperation in the field of agriculture, food industry and forestry,
and with the intention to support the realization of direct contacts between legal persons of both countries,
have agreed as follows:
Article 1
Within their competences and in accordance with effective legal regulations, the Contracting Parties shall give their support and assistance to legal persons of each of the Contracting Parties in realization and development of cooperation in the field of agriculture, food industry and forestry.
Article 2
1. The cooperation between the Contracting Parties in the field of agriculture, food industry and forestry shall be carried out in the following areas:
a) plant production: plant selection and plant breeding, including the use of modern technologies in phytogenetics, seed production, production of new agricultural plant varieties using environment-friendly technologies, and means for plant protection; cooperation in the field of wine growing;
b) animal husbandry: cattle, pig, horse, sheep, goat, rabbit, poultry and fish farming, and bee-keeping - provision of purebred livestock and breeding material (semen, embryos, equipment), expert work in the fields of selection, purebreeding, control of animal production and reproduction, new technologies, rearing, and processing of fodder;
c) mechanisation of agriculture: development and application of new technologies and technics in the fields of agricultural production and processing industry;
d) production of foodstuffs: harmonisation of technical legislation in foodstuffs production, in the preparation of laws, in the system of import/export certificates for agricultural and food products, in ensuring official state supervision of foodstuffs quality and consumer safety, and in labelling of foodstuffs with the technical legislation of the European Union, exchange of information and expert assistance in joint ventures in the food industry, exchange of information on technologies available and know/how for small companies (dairy and meat production, mills and bakeries, processing of fruit and vegetables, production of beer, malt and wine, removal of effluent water from small production plants);
e) forestry: forestry policy and legislation, sustainable (close to nature) management of forests and their multipurpose use, environment-friendly technologies and techniques for obtaining wood, forest protection (entomology and phytopathology), monitoring the state of forests and remote data acquisition, sustainable (close to nature) management of protected forest areas (parks), forestry restructuring process (particularly cooperation in the sense of Resolution H3 of the Ministerial Conference on the Protection of Forests in Europe, Helsinki, June 1993);
f) hunting: legislation applying to hunting and game, management of game (certain wild animals) as a component of the ecosystem, planning game management, protection and preservation of indigenous wild animals, protection of the habitats of wild animals, breeding and training of hunting dogs, falconry.
2. After consultations and with the consent of the Contracting Parties, the Agreement may be amended in writing to include other areas of cooperation.
Article 3
1. The cooperation between the Contracting Parties shall be carried out in the following forms:
a) exchange of samples of seeds, plants, biological material, chemical preparations, veterinary preparations, exchange of purebred livestock and breeding material, exchange of new machines, equipment and instrumentation for testing purposes;
b) mutual testing, verification and substitution of varieties and species;
c) exchange of research results, of scientists and experts, as well as information on seminars, symposia and exhibitions;
d) working on joint research tasks;
e) consultation activities, organisation of joint workshops, symposia and exhibitions;
f) exchange of information on approaches and measures in the field of agrarian, food and forestry policy;
g) direct contacts between agricultural and forestry associations and entrepreneurial unions of both countries;
h) general assistance in establishing the joint ventures, support to the cooperative production development.
2. After consultations and with the consent of the Contracting Parties, the Agreement may be amended in writing to include other forms of cooperation.
Article 4
Exchange of samples, material, machinery and information referred to in Article 3 of the Agreement shall be carried out on the basis of reciprocity free of charge or under conditions the Contracting Parties have agreed upon. Exchange of scientists and fellowship participants shall be carried out on the basis of executive programs of this Agreement with regard to the needs, interests and possibilities of the Contracting Parties.
Article 5
The Contracting Parties undertake not to publish either the information they have provided to each other on the basis of this Agreement, or the results of their joint research except for those, which they have agreed upon in writing.
As far as the ownership rights and utilization of the results obtained during the joint work are concerned, the Contracting Parties shall, respecting the Convention Establishing the World Intellectual Property Organization (WIPO), agree thereon in accordance with a special Protocol elaborated before commencement of the work on the joint project.
Article 6
The Contracting Parties shall support the development of commercial relations aimed at increase of mutual exchange of goods and volume of services provided on the basis of generally valid international trade principles (GATT 94/WTO) and the level of liberalization and upon the conditions, as stipulated by the Free Trade Agreement between the Republic of Slovenia and the Slovak Republic signed in Bratislava on 22 December 1993 and the Agreement on Accession of the Republic of Slovenia to the Central European Free Trade Agreement signed in Ljubljana on 25 November 1995.
Article 7
The Contracting Parties shall cooperate in veterinary and phytosanitary fields on the basis of special intergovernmental agreements.
Article 8
The coordination of work in implementation of this Agreement shall be the responsibility of a Joint Committee.The Joint Committee shall prepare particular projects of cooperation and shall present them to the Contracting Parties. The Joint Committee shall have its sessions as required, at least once a year, alternately in the Republic of Slovenia and the Slovak Republic as agreed. Two months before the Joint Committee session, the Contracting Parties shall exchange in writing their proposals for cooperation for the forthcoming period. The results of the session shall be recorded in a Protocol of the meeting.The technical administrative costs of such meetings shall be borne by the Contracting Party hosting the meeting, and other costs (travelling, board and accommodation expenses) shall be borne by each Contracting Party itself.
Article 9
This Agreement shall not affect any rights and obligations of the Contracting Parties, arising from international agreements already concluded by both Contracting Parties or from their membership in international organisations.
Article 10
1. This Agreement is subject to approval in accordance with the national legislation of the Contracting Parties and shall enter into force on the 30th day after the date of exchange of diplomatic notes on its approval.
2. The Agreement is concluded for five years and it shall be automatically prolonged for the following five-year period, unless either of the Contracting Parties terminates it in writing within six months prior to the expiration of the forthcoming period, at the latest.
3. This Agreement can be modified or amended upon written consent of the Contracting Parties.
Done at Bratislava on January 9, 1998 in two original copies in the Slovene, Slovak and English languages, all texts being authentic. In case of controversy, the English text is considered to be decisive.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za kmetijstvo, gozdarstvo in prehrano.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
