3. Uredba o ratifikaciji Sporazuma o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Romunije, stran 16.

Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 45/2001) izdaja Vlada Republike Slovenije
U R E D B O
O RATIFIKACIJI SPORAZUMA O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO ROMUNIJE
1. člen
Ratificira se Sporazum o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Romunije, podpisan na Bledu 12. maja 2000.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO ROMUNIJE
Vlada Republike Slovenije in Vlada Romunije (v nadaljevanju pogodbenici) sta se
v želji, da bi spodbujali in pospeševali sodelovanje na področju znanosti in tehnologije na podlagi enakosti in vzajemnih koristi,
ker se zavedata prednosti, ki izhajajo iz povečanega znanstvenega in tehnološkega sodelovanja za naroda obeh držav in njegovega pomena za razvoj gospodarstev in blaginjo obeh držav,
v prepričanju, da bo mednarodno sodelovanje v znanosti in tehnologiji okrepilo prijateljske vezi in razumevanje med državama,
dogovorili o naslednjem:
1. člen
Pogodbenici razvijata in podpirata znanstveno in tehnološko sodelovanje na podlagi enakosti in koristi.
Organizacije, ki lahko sodelujejo, so znanstveni inštituti, znanstvena združenja, univerze, vladne ustanove in druge raziskovalne in razvojne organizacije.
2. člen
Po tem sporazumu se znanstveno in tehnološko sodelovanje spodbuja:
a/ z znanstvenimi in tehnološkimi raziskavami in razvojnimi projekti na skupaj dogovorjenih področjih;
b/ z izmenjavami znanstvenikov, strokovnjakov, raziskovalcev in izvedencev;
c/ z izmenjavo znanstvenih in tehnoloških informacij in dokumentacije v okviru sodelovanja;
d/ s skupnimi znanstvenimi konferencami, simpoziji, delavnicami in drugimi srečanji;
e/ z drugimi oblikami znanstvenega in tehnološkega sodelovanja, o katerih se lahko pogodbenici medsebojno dogovorita.
Poleg navedenega pogodbenici v največji možni meri spodbujata izmenjavo tehnologij med podjetji, vključno s tehničnim sodelovanjem.
3. člen
Pogodbenici spodbujata in podpirata sodelovanje in udeležbo pri večstranskih in regionalnih znanstvenih, tehnoloških in razvojnih programih in projektih.
Pogodbenici izmenjata informacije o svojih prednostnih nalogah pri znanstvenem in tehnološkem sodelovanju na evropski ravni in spodbujata sodelujoče organizacije, da začnejo in skupaj sodelujejo pri razvojno-raziskovalnih projektih v Okvirnih programih EU, EUREKA, COST itd.
4. člen
Za sodelovanje po tem sporazumu veljajo ustrezni zakoni in predpisi obeh držav ter predpisi mednarodnih organizacij, katerih članici sta pogodbenici.
5. člen
Obravnavo intelektualne lastnine, ki izhaja iz sodelovanja po tem sporazumu, urejajo dogovori o izvajanju med sodelujočimi organizacijami, v katerih je zagotovljeno ustrezno in učinkovito varstvo intelektualne lastnine. Sodelujoče organizacije postanejo solastnice intelektualne lastnine, ki izhaja iz sodelovanja po tem sporazumu.
Znanstvene in tehnološke informacije nelastninske narave, ki izhajajo iz sodelovanja po tem sporazumu, so last obeh strani in ne bodo razkrite tretji strani brez predhodnega pisnega pristanka obeh strani, razen če ni drugače pisno dogovorjeno med sodelujočimi organizacijami.
6. člen
Znanstveniki, izvedenci in ustanove drugih držav ali mednarodnih organizacij so lahko s soglasjem obeh sodelujočih organizacij povabljeni, da sodelujejo pri dejavnostih po tem sporazumu.
Stroške takega sodelovanja običajno krije tretja stran, razen če se strani pisno ne sporazumeta drugače.
7. člen
Določbe tega sporazuma se lahko spremenijo ali dopolnijo le s privolitvijo pogodbenic. Spremembe in dopolnitve morajo biti pisne. Veljale bodo v skladu z določbami 12. člena Sporazuma.
8. člen
Pristojni ustanovi za izvajanje določb tega sporazuma sta za Republiko Slovenijo Ministrstvo za znanost in tehnologijo in za Romunijo Državna agencija za znanost, tehnologijo in inovacije.
9. člen
Za izvajanje tega sporazuma pristojni ustanovi ustanovita skupni odbor za znanstveno in tehnološko sodelovanje (v nadaljevanju skupni odbor), sestavljen iz enakega števila predstavnikov in izvedencev, ki jih imenuje vsaka pristojna ustanova.
Skupni odbor načrtuje in usklajuje sodelovanje v znanosti in tehnologiji ter spremlja njegov razvoj. Sprejema dveletne programe sodelovanja, nadzoruje njihovo izvajanje in po potrebi predlaga konkretne ukrepe za uresničevanje rezultatov sodelovanja.
Skupni odbor se sestane vsaki dve leti ali na zahtevo ene od pogodbenic izmenično v Republiki Sloveniji in v Romuniji.
10. člen
Stroški izmenjave znanstvenikov, strokovnjakov, raziskovalcev in izvedencev, ki nastanejo po tem sporazumu, razen če ni posebej dogovorjeno, se krijejo, kot sledi:
a) pošiljateljica krije stroške mednarodnega prevoza med glavnima mestoma obeh držav;
b) gostiteljica krije stroške potovanj po svojem ozemlju ter stroške nastanitve in prehrane v skladu z veljavnimi predpisi vsake države;
c) gostiteljica krije stroške nujne medicinske pomoči v skladu s svojimi notranjimi predpisi.
11. člen
Spori pri razlagi ali izvajanju tega sporazuma se rešujejo s posvetovanjem v skupnem odboru ali med pristojnima ustanovama.
12. člen
Ta sporazum začne veljati, ko si pogodbenici izmenjata uradni obvestili, ki potrjujeta, da so končani njuni notranjepravni postopki, potrebni za začetek veljavnosti. Datum začetka veljavnosti je datum zadnjega od uradnih obvestil.
Ta sporazum velja pet let in se podaljšuje za nadaljnja petletna obdobja, razen če katera od pogodbenic šest mesecev prej pisno ne sporoči svoje namere, da odpoveduje sporazum.
Prenehanje veljavnosti tega sporazuma ne vpliva na projekte ali programe po tem sporazumu, ki ob njegovem prenehanju še niso v celoti končani.
13. člen
Po začetku veljavnosti tega sporazuma se v odnosih med Republiko Slovenijo in Romunijo preneha uporabljati naslednji dokument:
Sporazum o znanstveno-tehničnem sodelovanju med Ljudsko republiko Romunijo in Federativno ljudsko republiko Jugoslavijo, podpisan 27. oktobra 1956.
Sestavljeno na Bledu, dne 12.5. 2000 v dveh izvirnikih v slovenskem, romunskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF ROMANIA
The Government of the Republic of Slovenia and the Government of Romania (hereinafter referred to as the Contracting Parties)
Desiring to encourage and promote co-operation in the areas of science and technology on the basis of equality and mutual benefits,
Recognizing the advantages to be derived by the people of the two countries from the increased scientific and technological co-operation, as well as of its importance for the development of the national economies and prosperity of both countries,
Convinced that international co-operation in science and technology will strengthen the bonds of friendship and understanding between the two countries,
have agreed as follows:
Article 1
The Contracting Parties shall develop and support the co-operation in the field of science and technology on the basis of equality and benefit.
Co-operating organisations may include scientific institutes, scientific societies, universities, government agencies and other research and development organisations.
Article 2
According to this agreement, scientific and technological co-operation shall be promoted through:
a/ Scientific and technological research and development projects in areas jointly agreed upon;
b/ Exchanges of scientists, specialists, researchers and experts;
c/ Exchange of science and technology information and documentation in the context of activities;
d/ Joint scientific conferences, symposia, workshops and other meetings;
e/ Other forms of scientific and technological co-operation which can mutually be agreed upon by the Contracting Parties.
Besides, the Contracting Parties shall encourage, to the maximum possible extent, exchange of technologies between enterprises, including technical collaboration.
Article 3
The Contracting Parties shall encourage and support co-operation and participation in multilateral and regional scientific, technological and development programs and projects.
The Contracting Parties will exchange information on their priorities regarding the scientific and technical co-operation at European level and will encourage their co-operating organisations to initiate and jointly participate in R&D projects, within the EU Framework Programs, EUREKA, COST, etc.
Article 4
Co-operation under this Agreement shall be subject to the applicable national laws and regulations of both countries, as well as to the regulations of the international organisations Contracting Parties are members of.
Article 5
The treatment of intellectual property arising from the co-operation under this Agreement shall be regulated by the implementing arrangements between the co-operating organisations in which an adequate and efficient intellectual property protection shall be guaranteed. The co-operating organisations shall become joint owners of intellectual property resulting from co-operation under this Agreement.
Scientific and technological information of a non-proprietary nature deriving from the co-operation under this Agreement shall be possessed by both sides and shall not be disclosed to any third party without the prior written consent of both sides, unless otherwise agreed in writing by the co-operating organisations.
Article 6
Scientists, experts and institutions from other countries or international organisations may be invited, upon consent of both co-operating organisations, to participate in activities being carried out under this Agreement.
The costs of such participation shall normally be covered by third party, unless both sides otherwise agreed in writing.
Article 7
The provisions of this Agreement may be modified or amended only upon the consent of both Contracting Parties. Modifications and amendments should be done in writing. They will be enforced according to the stipulations of Article 12 of this Agreement.
Article 8
The responsible institutions for the implementation of the provisions of this Agreement are the Ministry of Science and Technology for the Republic of Slovenia and the National Agency for Science, Technology and Innovation for Romania.
Article 9
For the purpose of the implementation of this Agreement, the responsible institutions shall establish a Joint Committee for Scientific and Technological Co-operation (hereinafter referred to as “the Joint Committee“) consisting of equal number of representatives and experts designated by each responsible institution.
The Joint Committee shall plan and co-ordinate co-operation in science and technology and shall review the progress of such co-operation. It shall adopt biennial Programs of Co-operation, control the implementation of programs and propose, if necessary, concrete measures for implementation of the results of co-operation.
The Joint Committee shall meet every two years, or at the request of either party, alternately in the Republic of Slovenia and in Romania.
Article 10
The costs of the exchange of scientists, specialists, researchers and experts resulting from this Agreement, unless agreed upon separately, will be covered on the following bases:
a) The sending party shall cover the international transportation costs between the capitals of both countries.
b) The receiving party shall cover the travel expenses within its territory and the costs of accommodation and meals, according to the existing regulations of each country.
c) The receiving party shall cover the expenses related to the medical care in case of emergency, in accordance with internal regulations of receiving party.
Article 11
Any disputes related to the interpretation or implementation of this Agreement shall be settled through consultations within the Joint Committee or between the responsible institutions.
Article 12
This Agreement shall enter into force upon an exchange of notes confirming that the Contracting Parties have completed their legal internal procedures required for the entry into force. The date of the entry into force shall be the date of the last notification.
This Agreement shall remain in force for a period of five years and continue in force thereafter for successive periods of five years, unless either Contracting Party notifies in writing six months in advance of its intention to terminate this Agreement.
The termination of this Agreement shall not affect the projects or programs undertaken under this Agreement and not fully executed at the time of the termination of this Agreement.
Article 13
After this Agreement enters into force in the relations between the Republic of Slovenia and Romania the following document will cease to be applied:
Agreement for the scientific-technical co-operation between the Peoples Republic of Romania and the Yugoslav Federal Peoples Republic signed 27 October, 1956.
Done at Bled on 12.5. 2000 in two originals each, in Slovenian, Romanian and English languages, all texts being equally authentic. In case of different interpretation of the Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za šolstvo, znanost in šport.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
