Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Zvezno vlado Zvezne republike Jugoslavije o mednarodnem cestnem prevozu potnikov in blaga (BYUMCP), ki ga je sprejel Državni zbor Republike Slovenije na seji 14. maja 2002.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN ZVEZNO VLADO ZVEZNE REPUBLIKE JUGOSLAVIJE O MEDNARODNEM CESTNEM PREVOZU POTNIKOV IN BLAGA (BYUMCP)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Zvezno vlado Zvezne republike Jugoslavije o mednarodnem cestnem prevozu potnikov in blaga, podpisan 2. novembra 2001 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi: *
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN ZVEZNO VLADO ZVEZNE REPUBLIKE JUGOSLAVIJE O MEDNARODNEM CESTNEM PREVOZU POTNIKOV IN BLAGA
Vlada Republike Slovenije in Zvezna vlada Zvezne republike Jugoslavije, v nadaljnjem besedilu pogodbenici, sta se
v prizadevanju, da bi prispevali k razvoju trgovinskih in gospodarskih odnosov med državama,
odločeni, da v okviru tržnega gospodarstva spodbujata sodelovanje v mednarodnem prometu,
v skrbi za varstvo okolja in ljudi, racionalno uporabo energije, varnost na cesti in izboljšanje delovnih razmer voznikov,
v prizadevanju, da bi se razvili različni načini prevoza,
ob priznavanju skupnega interesa in prednosti, ki jih omogoča sporazum o mednarodnem cestnem prevozu,
sporazumeli in odločili, kot sledi:
SPLOŠNE DOLOČBE
1. člen
Področje uporabe
Ta sporazum ureja mednarodni cestni prevoz potnikov in blaga, ki ga opravljajo prevozniki, katerih sedež podjetja je na ozemlju države druge pogodbenice, z vozili, registriranimi na tem ozemlju, pri čemer sta odhodni in namembni kraj na omenjenem ozemlju, vključno s tranzitom čez to ozemlje ali čez ozemlje države druge pogodbenice.
Ta sporazum ne vpliva na pravice in obveznosti, ki izhajajo iz drugih mednarodnih obvez pogodbenic, niti ne na predpise Evropske unije ter na mednarodne sporazume med Evropsko unijo in državami nečlanicami.
2. člen
Pomen izrazov
V tem sporazumu:
1. “prevoznik“ pomeni katero koli fizično ali pravno osebo, ki ima sedež na ozemlju Republike Slovenije, ali katero koli pravno osebo, ki ima sedež na ozemlju Zvezne republike Jugoslavije in je v skladu z veljavnimi predpisi registrirana za opravljanje mednarodnega cestnega prevoza;
2. “vozilo“ pomeni vsako motorno vozilo, ki je registrirano na ozemlju države ene od pogodbenic in po svoji konstrukciji in opremi namenjeno mednarodnemu prevozu potnikov ali blaga;
3. “prevoz“ pomeni vožnjo s polnim ali praznim vozilom, tudi če se vozilo, priklopnik ali polpriklopnik na delu potovanja prevaža z vlakom ali ladjo;
4. “kabotaža“ pomeni prevoz potnikov ali blaga, ki ga prevoznik ene pogodbenice opravlja med posameznimi kraji na ozemlju države druge pogodbenice;
5. “ozemlje pogodbenice“ pomeni ozemlje Republike Slovenije in ozemlje Zvezne republike Jugoslavije;
6. “država, v kateri je sedež prevoznikovega podjetja“ pomeni ozemlje pogodbenice, na katerem ima prevoznik sedež svojega podjetja in na katerem je vozilo registrirano;
7. “država gostiteljica“ pomeni ozemlje pogodbenice, po katerem prevoznik opravlja prevoz, ne da bi imel na njem registrirano vozilo in sedež svojega podjetja;
8. “avtobus“ pomeni vozilo, ki je registrirano na ozemlju ene od pogodbenic in je po konstrukciji in opremi primerno in namenjeno za prevoz potnikov in ima poleg voznikovega več kot osem sedežev;
9. “linijski prevoz potnikov“ pomeni prevoz potnikov na določeni progi, ki se opravlja po vnaprej določenem in objavljenem voznem redu in ceniku. Linijski prevoz je namenjen vsakomur pod enakimi pogoji, potniki pa vstopajo in izstopajo na vnaprej določenih postajališčih;
10. “izmenični prevoz potnikov“ pomeni prevoz, pri katerem se vnaprej organizirane skupine potnikov prevažajo z več vožnjami tja in nazaj iz enega samega odhodnega kraja do enega samega namembnega kraja. Vsaka skupina je sestavljena iz potnikov, ki potujejo skupaj in se pozneje vrnejo v odhodni kraj. Odhodni in namembni kraj pomenita kraj, kjer se potovanje začne, in kraj, kjer se potovanje konča, pri čemer so v obeh primerih vključeni okoliški kraji v polmeru 50 km.
Izmenični prevoz potnikov lahko vključuje tudi nastanitev potnikov v namembnem kraju in po potrebi tudi med potovanjem.
V nizu izmeničnih voženj se prva povratna vožnja in zadnja vožnja ob odhodu opravita s praznim vozilom;
11. “občasni prevoz potnikov“ pomeni prevoz, ki ni opredeljen ne kot linijski prevoz potnikov ne kot izmenični prevoz. Pogostost ali število voženj ne vpliva na uvrstitev v občasni prevoz;
12. “kontrolni dokument“ pomeni spremnico, ki vsebuje podatke o vozilu, prevozniku, voznem osebju, vrsti prevoza, itinerarju in potnikih.
PREVOZ POTNIKOV
3. člen
Linijski prevoz potnikov
Za linijski prevoz potnikov, ki se opravlja z avtobusi, velja sistem dovoljenj, ki jih izda pristojni organ v državi odhoda, namembni državi in državi tranzita.
Vlogo za dovoljenje je treba predložiti pristojnemu organu države, v kateri je sedež prevoznikovega podjetja. Če pristojni organ države, v kateri je sedež prevoznikovega podjetja, to vlogo odobri, se vloga pošlje pristojnemu organu države gostiteljice.
Mešana komisija, ustanovljena na podlagi 14. člena tega sporazuma, odloča o obliki vloge za dovoljenje ter spremljajočih dokumentih kot tudi okoljevarstvenih, varnostnih in drugih pogojih za izdajo dovoljenja.
Dovoljenje iz prvega odstavka tega člena se izda na podlagi doseženega soglasja pristojnih organov pogodbenic.
Pristojna organa pogodbenic izdata dovoljenje iz prvega odstavka tega člena v treh mesecih od dneva, ko prejmeta vlogo pristojnega organa druge pogodbenice za dovoljenje. Navedeni rok se ob nepredvidenih okoliščinah lahko spremeni, o čemer se pristojna organa medsebojno obvestita.
Dovoljenje iz prvega odstavka tega člena velja največ pet let. V dovoljenju se določijo operativni pogoji za opravljanje linijskega prevoza potnikov.
O spremembi operativnih pogojev in odpovedi prevoza se odloča po postopku, določenem v drugem in tretjem odstavku tega člena.
4. člen
Občasni in izmenični prevoz potnikov
Za občasne in izmenične prevoze potnikov, ki se opravljajo z avtobusi, velja sistem dovoljenj ali dovolilnic, ki jih izda pristojni organ v državi odhoda, namembni državi in državi tranzita.
Kot izjema k določbi prvega odstavka tega člena so spodaj navedeni prevozi oproščeni sistema dovoljenj ali dovolilnic na ozemlju države gostiteljice:
1) krožne vožnje zaprtih vrat, pri katerih isti avtobus prevaža isto skupino potnikov ves čas potovanja in jo tudi pripelje nazaj v odhodni kraj v državi, v kateri je sedež prevoznikovega podjetja;
2) prevoz skupine potnikov iz odhodnega kraja na ozemlju države, kjer je sedež prevoznikovega podjetja, do namembnega kraja in vrnitev praznega avtobusa;
3) prevoz s praznim vozilom pri odhodu in s polnim vozilom pri vrnitvi pod pogojem, da je potnike predhodno isti prevoznik pripeljal na ozemlje države gostiteljice, kjer jih spet prevzame in odpelje na ozemlje države, kjer je sedež prevoznikovega podjetja.
Sprejemanje potnikov v vozilo med potovanjem pri prevozih iz drugega odstavka tega člena ni dovoljeno, razen če je za to izdano posebno dovoljenje pristojnega organa države gostiteljice.
Mešana komisija, ustanovljena na podlagi 14. člena tega sporazuma, lahko dopolni vrste občasnih in izmeničnih prevozov, za katere dovoljenja ali dovolilnice niso potrebne.
Vlogo za dovoljenje ali dovolilnico iz prvega odstavka tega člena prevoznik ene pogodbenice naslovi na pristojni organ v državi, v kateri je sedež prevoznikovega podjetja. Če pristojni organ države, v kateri je sedež prevoznikovega podjetja, vlogo odobri, se vloga pošlje pristojnemu organu države gostiteljice.
Mešana komisija, ustanovljena na podlagi 14. člena tega sporazuma, odloča o obliki vloge za dovoljenje ali dovolilnico in o drugih spremljajočih dokumentih.
Pristojna organa pogodbenic izdata dovoljenje iz prvega odstavka tega člena v enem mesecu od dneva, ko je vlogo predložil pristojni organ druge pogodbenice. Ta rok se lahko spremeni ob nepredvidenih okoliščinah, o čemer se pristojna organa medsebojno obvestita.
Za opravljanje prevozov iz drugega in četrtega odstavka tega člena mora imeti prevoznik v vozilu kontrolni dokument. Pogoje za uporabo kontrolnega dokumenta določi mešana komisija, navedena v 14. členu tega sporazuma.
5. člen
Skupne določbe za prevoz potnikov
Dovoljenja in dovolilnice za prevoz iz 3. in 4. člena tega sporazuma niso prenosljivi na druge prevoznike.
Opravljanje kabotaže je prepovedano. Lokalni izleti, organizirani izključno za skupino potnikov, ki jih v ta kraj pripelje isti prevoznik, se ne štejejo za kabotažo pod pogojem, da so vpisani na kontrolnem dokumentu.
PREVOZ BLAGA
6. člen
Sistem dovolilnic
Prevozniki, katerih sedež podjetja je na ozemlju pogodbenice, lahko na podlagi sistema dovolilnic na ozemlju druge pogodbenice opravljajo:
1) prevoz med ozemljema pogodbenic;
2) prevoz med določenim krajem na ozemlju druge pogodbenice in določenim krajem na ozemlju tretje države;
3) tranzitni prevoz čez ozemlji pogodbenic.
Kabotaža je dovoljena le s posebnim dovoljenjem države gostiteljice.
7. člen
Prevoz, za katerega dovolilnice niso potrebne
Ne glede na določbe 6. člena tega sporazuma za naslednje vrste prevoza niso potrebne dovolilnice:
1) prevoz z vozili, katerih skupna dovoljena masa, vključno s priklopniki, ne presega 6 ton ali pri katerih dovoljena nosilnost, vključno s priklopniki, ne presega 3,5 tone;
2) občasen prevoz na letališča ali z njih v primerih, ko je redni letalski prevoz preusmerjen;
3) prevoz poškodovanih ali pokvarjenih vozil in prevoz v popravilo;
4) vožnje praznega tovornega vozila, poslanega kot zamenjava za vozilo, ki se je pokvarilo v drugi državi, in po popravilu tudi povratna vožnja vozila, ki se je pokvarilo;
5) prevoz rezervnih delov in potrebščin za letala in čezoceanske ladje;
6) prevoz medicinskih potrebščin in opreme za nujne primere, še zlasti ob naravnih nesrečah in človekoljubnih potrebah;
7) prevoz umetniških del in predmetov za sejme in razstave ali prevoz za nekomercialne namene;
8) prevoz gledaliških rekvizitov, pripomočkov in živali na gledališke, glasbene, filmske, športne ali cirkuške predstave, sejme ali praznovanja ter z njih v nekomercialne namene in nujno potrebne opreme za snemanje radijskih programov, filmsko ali televizijsko produkcijo;
9) selitveni prevoz, ki se opravlja z ustrezno opremo in osebjem;
10) prevoz posmrtnih ostankov;
11) začetni in zadnji del poti – mednarodni ali na ozemlju države – kombiniranega prevoza po cesti pod pogojem, da se uporablja ustrezna nakladalna ali razkladalna postaja, ki je najbližje kraju nakladanja ali razkladanja tovora;
12) prevoz pošte.
Mešana komisija, navedena v 14. členu tega sporazuma, lahko sporazumno razširi seznam vrst prevoza iz prvega odstavka tega člena ali črta z njega tiste vrste, za katere dovolilnice niso potrebne.
8. člen
Skupne določbe za prevoz blaga
Pristojna organa pogodbenic si vsako leto izmenjata dogovorjeno število neizpolnjenih obrazcev dovolilnic.
Dovolilnice za prevoz blaga veljajo 13 mesecev od začetka vsakega koledarskega leta.
Dovolilnica iz prvega odstavka tega člena ni prenosljiva.
Dovolilnica se lahko hkrati uporablja le za eno vozilo. Če gre za kombinacijo vozil, je motorno vozilo odločilni dejavnik pri izdaji ali oprostitvi dovolilnice.
Mešana komisija, navedena v 14. členu tega sporazuma, določi kvoto, vrsto, pogoje izdajanja in uporabe neizpolnjenih obrazcev dovolilnic kot tudi pogoje, pod katerimi se lahko posamezne vrste prevozov oprostijo sistema dovolilnic.
Opravljanje kabotaže je prepovedano, razen če pristojni organ države gostiteljice za to izda posebno dovoljenje.
SKUPNE DOLOČBE
9. člen
Dajatve
Prevoz z vozili, registriranimi na ozemlju ene pogodbenice, ki se začasno opravlja na ozemlju druge pogodbenice, je po določbah tega sporazuma oproščen plačila vseh davkov v zvezi z lastništvom, registracijo in upravljanjem vozil.
Gorivo, ki je v serijsko vgrajenih, standardnih rezervoarjih vozila in je namenjeno pogonu vozila, ter maziva in rezervni deli so na ozemlju države gostiteljice oproščeni vseh uvoznih carin pod pogojem, da prevoznik upošteva ustrezne carinske predpise.
Za mednarodni cestni prevoz potnikov in blaga v skladu z določbami tega sporazuma se v državi gostiteljici plačujejo cestne pristojbine, cestnine in druge dajatve, ki jih plačujejo uporabniki cest v državi gostiteljici v skladu z veljavnimi predpisi.
Mešana komisija, navedena v 14. členu tega sporazuma, lahko prouči in predlaga pristojnim organom delno ali popolno vzajemno oprostitev dajatev prevoznika v zvezi z opravljanjem prevozov.
10. člen
Mase in dimenzije vozila
Največja dovoljena masa, osne obremenitve in dimenzije vozila ne smejo preseči tistih, ki so vpisane v registracijskem dokumentu vozila, in ne smejo preseči mejnih vrednosti, predpisanih v državi gostiteljici.
Pri prekoračitvah dovoljenih mas in dimenzij je v državi gostiteljici možno opraviti tak prevoz le s posebnim dovoljenjem, ki ga izda pristojni organ države gostiteljice in ga je treba pridobiti pred začetkom opravljanja prevoza.
11. člen
Oprema in druge značilnosti vozila
Vozila za prevoz nevarnega blaga ali hitro pokvarljivih živil morajo biti opremljena v skladu z mednarodnimi predpisi.
Oprema, ki je v vozilih nameščena za spremljanje časa vožnje in časa počitka posadke, mora biti v skladu z mednarodnimi predpisi.
Pogodbenici se zavezujeta, da bosta v okviru tega sporazuma spodbujali uporabo vozil, ki izpolnjujejo varnostne in okoljevarstvene standarde.
Mešana komisija, navedena v 14. členu tega sporazuma, lahko pri odločanju o kvotah in morebitni prihodnji liberalizaciji prevozov ugodneje obravnava vozila, ki izpolnjujejo najsodobnejše varnostne in okoljevarstvene standarde.
12. člen
Nadzor
Dovolilnice in vse druge dokumente, ki so predvideni na podlagi mnogostranskih ali dvostranskih sporazumov ali po notranjem pravu države, je treba imeti v vozilu in jih pokazati na zahtevo pristojnega organa države gostiteljice.
13. člen
Obveznosti prevoznikov in kršitve
Prevozniki ene pogodbenice in posadke njihovih vozil morajo, ko so na ozemlju druge pogodbenice, spoštovati veljavne zakone in predpise države gostiteljice.
Če prevoznik krši določbe tega sporazuma v državi gostiteljici, pristojni organ države gostiteljice o tem obvesti pristojni organ države, v kateri je sedež prevoznikovega podjetja, z namenom, da ta organ sprejme potrebne ukrepe, predvidene z notranjo zakonodajo.
Pristojna organa pogodbenic se obvestita o sprejetih ukrepih.
Določbe prvega in drugega odstavka tega člena ne izključujejo ukrepov, ki so jih sprejeli sodni ali drugi pristojni organi države gostiteljice.
14. člen
Sodelovanje in mešana komisija
Pristojna organa pogodbenic sta dolžna ukreniti vse potrebno za uporabo tega sporazuma in se obveščata o vseh koristnih informacijah ter o vsaki spremembi v notranji zakonodaji, ki bi vplivala na uporabo tega sporazuma.
Pristojna organa si medsebojno pomagata pri izvajanju tega sporazuma.
Za izvajanje tega sporazuma in obravnavanje vseh vprašanj v zvezi s tem sporazumom pogodbenici ustanovita mešano komisijo.
KONČNE DOLOČBE
15. člen
Začetek veljavnosti in trajanje sporazuma
Ta sporazum začne veljati, ko pogodbenici druga drugo po diplomatski poti obvestita, da so izpolnjeni vsi notranjepravni postopki, potrebni za začetek njegove veljavnosti.
Ta sporazum se začasno uporablja od dneva podpisa.
Ta sporazum je sklenjen za nedoločen čas. Vsaka pogodbenica ga lahko odpove po diplomatski poti. Sporazum preneha veljati tri mesece po dnevu, ko je druga pogodbenica prejela obvestilo o odpovedi.
V DOKAZ NAVEDENEGA sta podpisana, ki sta bila za to pravilno pooblaščena, podpisala ta sporazum.
SESTAVLJENO v Ljubljani dne 2. novembra 2001 v dveh izvirnikih v slovenskem, srbskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna.
Ob sporu ali razlikah v razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE FEDERAL GOVERNMENT OF THE FEDERAL REPUBLIC OF YUGOSLAVIA ON INTERNATIONAL TRANSPORT OF PASSENGERS AND GOODS BY ROAD
The Government of the Republic of Slovenia and the Federal Government of the Federal Republic of Yugoslavia, hereinafter referred to as the Contracting Parties;
Anxious to contribute to the development of trade and economic relations between their countries;
Determined to promote cooperation in international transport within the framework of the market economy;
Concerned about the protection of the environment and people, the rational use of energy, road safety and the improvement of drivers’ working conditions;
Aiming towards the development of transport intermodality;
Recognising the mutual interest and advantage of an agreement on international road transport;
Have agreed and decided as follows:
GENERAL PROVISIONS
Article 1
Scope of application
The present Agreement shall regulate the international transport of passengers and goods by road performed by transport operators established in the territory of the state of the other Contracting Party by means of vehicles registered in that territory, with the points of departure and destination in the said territory and involving transit through that territory or through the territory of the state of the other Contracting Party.
This Agreement does not affect the rights and obligations arising from the other international commitments of the two Contracting Parties, nor does it affect the regulations of the European Union and the international agreements between the European Union and non-member States.
Article 2
Definitions
In this Agreement:
1. “Transport operator“ means any natural person or legal person established in the territory of the Republic of Slovenia or any legal person established in the territory of the Federal Republic of Yugoslavia registered, in accordance with current regulations, to carry out international road transport operations.
2. “Vehicle“ means a motor vehicle registered in the territory of the state of one of the Contracting Parties and by virtue of its construction and equipment intended for the international transport of passengers or goods.
3. “Transport“ means the runs by a vehicle, either laden or unladen even if the vehicle, trailer or semi-trailer is carried by train or boat for part of the journey.
4. “Cabotage“ means the transport of passengers or goods carried out by a transport operator of one Contracting Party between individual places within the territory of the other Contracting Party.
5. “Territory of a Contracting Party“ means respectively the territory of the Republic of Slovenia and the territory of the Federal Republic of Yugoslavia.
6. “Country of establishment“ means the territory of the Contracting Party within which the transport operator is established and in which the vehicle is registered.
7. “Host country“ means the territory of a Contracting Party in which the transport operator is operating without its vehicle being registered there and without the transport operator being established there.
8. “Bus“ means a vehicle registered in the territory of one of the Contracting Parties and by virtue of construction and equipment suitable and intended for the transport of passengers and which has, in addition to the driver’s seat, more than eight sitting places.
9. “Regular passenger service“ means a service which carries passengers over a specified route, according to a timetable and price list set and published in advance. The regular passenger service is intended for everyone under the same conditions, with passengers picked up and set down at predetermined stopping points.
10. “Shuttle service“ means a service whereby, by means of repeated outward and return journeys, previously organised groups of passengers are carried from a single place of departure to a single destination. Each group consists of the passengers who travel together and return to the place of departure on a later journey. The place of departure and the place of destination respectively mean the place where the journey begins and the place where the journey ends, together with, in each case, the surrounding locality within a 50 km radius.
A shuttle service may include accommodation of passengers at its destination and, if need be, during the journey.
The first return journey and the last outward journey in a series of shuttle services are made unladen.
11. “Occasional service“ means a service falling neither within the definition of a regular passenger service nor within the definition of a shuttle service. The frequency or number of services does not affect their classification as an occasional service.
12. “Control document“ means the waybill which includes the data on the vehicle, transport operator, driving personnel, type of carriage, itinerary and passengers.
PASSENGER TRANSPORT
Article 3
Regular passenger services
Regular passenger services operated by bus shall be subject to a system of authorisations issued by the competent authority in the country of departure, destination and transit.
The authorisation application should be made to the competent authority in the country of establishment of the transport operator. If the competent authority of the country of establishment approves the application, the application is communicated to the competent authority of the host country.
The Joint Committee set up under Article 14 hereof decides on the form the application for authorisation takes and the accompanying documents required, as well as on environmental, safety and other conditions for the issue of an authorisation.
The authorisation referred to in the first paragraph of this Article is issued by joint agreement by the competent authorities of the Contracting Parties.
The competent authorities of the Contracting Parties issue the authorisation referred to in the first paragraph of this Article within a period of three months from the day of receipt of the application for authorisation from the competent authority of the other Contracting Party. This deadline may be changed in the event of unanticipated circumstances, of which the competent authorities keep each other informed.
The authorisation referred to in the first paragraph of this Article is valid for a maximum of five years. It sets out the operating conditions for the performance of regular passenger services.
Changes in operating conditions and the cancellation of the service are decided according to the procedure set out in the second and third paragraphs of this Article.
Article 4
Occasional and shuttle services
The occasional services and shuttle services operated by buses are subject to a system of authorisations or permits issued by the competent authority in the country of departure, destination and transit.
As an exception to the provision of the first paragraph of this Article, the services listed below are exempt from any authorisation or permit system in the territory of the host country:
1) closed-door tours whereby the same bus is used to carry the same group of passengers throughout the journey and to bring them back to the place of departure, in the country where the transport operator is established;
2) services carrying passengers from the place of departure in the country of establishment of the transport operator to the destination and making the return journey unladen;
3) services which make the outward journey unladen and the return journey laden, provided that the passengers have been previously brought by the same carrier into the territory of the host country where they are picked up again and carried into the territory of the country of establishment.
The picking up of passengers during the journey referred to in the second paragraph of this Article is not permitted unless special authorisation is granted by the competent authority of the host country.
The Joint Committee set up under Article 14 hereof may extend the authorisation or permit exemption to other categories of occasional services and shuttle services.
The authorisation or permit application referred to in the first paragraph of this Article should be made to the competent authority in the country of establishment of the transport operator. If the competent authority of the country of establishment approves the application, the application is communicated to the competent authority of the host country.
The Joint Committee set up under Article 14 hereof decides on the form that the authorisation or permit application takes and other accompanying documents required.
The competent authorities of the Contracting Parties issue the authorisation referred to in the first paragraph of this Article within a period of one month from the day of submission of the application by the competent authority of the other Contracting Party. This deadline may be changed in the event of unanticipated circumstances, of which the competent authorities keep each other informed.
While performing the services referred to in the second and fourth paragraphs of this Article the transport operator is required to keep a control document in the vehicle. The conditions of use of the control document are laid down by the Joint Committee referred to in Article 14 hereof.
Article 5
Provisions common to passenger services
The transport authorisations and permits referred to in Articles 3 and 4 hereof are not transferable to other transport operators.
The running of cabotage services is prohibited. Local trips organised solely for a group of passengers brought to that location by the same transport operator are not deemed to be cabotage services provided that they are entered on the control document.
GOODS TRANSPORT
Article 6
Permit system
Transport operators established in the territory of a Contracting Party may, under the system of permits, undertake in the territory of the other Contracting Party:
1) transport between the territories of the two Contracting Parties;
2) transport between a point in the territory of the other Contracting Party and a point in the territory of a third State;
3) transit transport through the territories of the Contracting Parties.
Cabotage is only permitted with the special authorisation of the host country.
Article 7
Transport exempted from permit requirements
As an exception to the provisions of Article 6 hereof, the following categories of transport are exempted from permit requirements:
1) Transport by vehicles whose Total Permissible Laden Weight, including trailers, does not exceed 6 tonnes, or when the permitted payload, including trailers, does not exceed 3.5 tonnes.
2) Occasional transport to or from airports in cases where regular air services are diverted.
3) Transport of vehicles which are damaged or have broken down and the transport of vehicles to be repaired.
4) Unladen runs by a goods vehicle sent to replace a goods vehicle which has broken down in another country, and also the return run, after repair, of the vehicle that has broken down.
5) Transport of spare parts and provisions for aircraft and ocean-going ships.
6) Transport of medical supplies and equipment needed for emergencies, especially in response to natural disasters and humanitarian needs.
7) Transport of works and objects of art for fairs and exhibitions or for non-commercial purposes.
8) Transport for non-commercial purposes of properties, accessories and animals to or from theatrical, musical, film, sports or circus performances, fairs or fetes, and the equipment urgently required for radio recordings, film or television production.
9) Removals carried out by appropriate equipment and staff.
10) Funeral transport.
11) First and final leg - international and national – by road of combined transport, providing, respectively, that the appropriate freight loading and unloading station closest to the point of loading or unloading of the freight is used.
12) Transport of mail.
The Joint Committee referred to in Article 14 hereof may, by mutual agreement, add to, or remove from, the list of transport categories referred to in the first paragraph of this Article exempted from the permit requirements.
Article 8
Common provisions for goods transport
The competent authorities of the two Contracting Parties exchange an agreed number of blank permit forms every year.
Permits for the transport of goods are valid for 13 months from the beginning of each calendar year.
The permit referred to in the first paragraph of this Article is not transferable.
The permit can only be used for one vehicle at a time. In the case of combinations of vehicles, the motor vehicle is the determining factor in permit issue or exemption.
The Joint Committee referred to in Article 14 hereof determines the quota, category, conditions of issue and use of blank permit forms as well as the conditions under which individual categories of transport may be exempted from the permit system.
The running of cabotage services is prohibited except where specially authorised by the competent authority of the host country.
COMMON PROVISIONS
Article 9
Levies
Transport by means of vehicles registered in the territory of one Contracting Party and operating temporarily in the territory of the other Contracting Party is, under the provisions of this Agreement, exempt from payment of all taxes related to ownership, registration and the running of the vehicle.
The fuel contained in the normal, by the manufacturer built-in fixed tanks of the vehicle intended to drive the vehicle, as well as lubricants and spares are exempt from all import duty in the territory of the host country provided that the transport operator complies with the relevant customs regulations.
The international transport of passengers and goods by road under the provisions of this Agreement is subject in the host country to road user charges, tolls and other duties levied for the use of the road in the host country in accordance with the regulations in force.
The Joint Committee referred to in Article 14 hereof may consider and propose to the competent authorities the partial or total exemption, on a reciprocal basis, from the payment of levies by a transport operator in connection with the performance of transport services.
Article 10
Weights and dimensions of vehicles
The permissible maximum weight, axle weight and dimensions of vehicles must not exceed those entered in the registration documents nor the upper limits in force in the host country.
The use in the host country of vehicles whose weight and dimensions exceed the permissible upper limits is permitted only with a special authorisation issued by the competent authority of the host country and applied for in advance.
Article 11
Equipment and other characteristics of vehicles
Vehicles carrying dangerous goods or perishable goods must be fitted out and equipped in accordance with international regulations.
Equipment used to monitor crew driving and rest time on vehicles must comply with the international regulations.
The Contracting Parties undertake to promote, within the framework of this Agreement, the use of vehicles meeting safety and environmental standards.
The Joint Committee referred to in Article 14 hereof may, when deciding on quotas and possible future liberalisation, give more favourable treatment to vehicles that meet the most modern safety and environmental standards.
Article 12
Control
The permits and all other documents foreseen under multilateral or bilateral agreements or under national law, must be kept in the vehicles and be produced at the request of the competent authorities of the host country.
Article 13
Obligations of transport operators and infringements
The transport operators of a Contracting Party and the crews of their vehicles must, when in the territory of the other Contracting Party, comply with the laws and regulations in force in the host country.
In the event of any infringement in the host country of the provisions of this Agreement by a transport operator, the competent authority of the host country shall notify the competent authority of the country of establishment with the intention that the latter authority takes the necessary steps against the transport operator, as provided for by its national legislation.
The Contracting Parties shall keep each other informed of the sanctions imposed.
The provisions of the first and the second paragraphs of this Article shall not exclude the measures taken by the judicial or other competent authorities of the host country.
Article 14
Cooperation and Joint Committee
The competent authorities of the Contracting Parties are obliged to take all the necessary steps for the application of this Agreement and shall keep each other informed on any useful information and on any change in national law affecting the application hereof.
The competent authorities shall offer each other mutual assistance for the purpose of implementing this Agreement.
A Joint Committee shall be set up by the Contracting Parties for the purpose of the implementation of this Agreement and to handle the issues related to this Agreement.
FINAL PROVISIONS
Article 15
Entry into force and period of validity of the Agreement
This Agreement shall enter into force when the Contracting Parties have notified each other through diplomatic channels that the procedures for its entry into force in accordance with national legislation have been completed.
The present Agreement shall apply provisionally as from the date of its signing.
The present Agreement is concluded for an indefinite period of time. Either Contracting Party may cancel it through diplomatic channels. It shall terminate three months after the date of receipt of notice by the other Contracting Party.
IN WITNESS WHEREOF the undersigned, being duly authorised thereto, have signed this Agreement.
DONE at Ljubljana on 2 November 2001 in two originals each in the Slovene, the Serbian and the English languages, all texts being equally authentic.
In the event of dispute or divergence in the interpretation of this Agreement, the English text shall prevail.
