Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Helenske republike o rednem zračnem prometu (BGRRZP), ki ga je sprejel Državni zbor Republike Slovenije na seji 12. junija 2002.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO HELENSKE REPUBLIKE O REDNEM ZRAČNEM PROMETU (BGRRZP)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Helenske republike o rednem zračnem prometu, podpisan 30. novembra 2001 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in v angleškem jeziku glasi:

Glede na to, da sta Republika Slovenija in
Helenska republika
(v nadaljevanju pogodbenici)
pogodbenici Konvencije o mednarodnem civilnem letalstvu, ki je bila na voljo za podpis v Chicagu 7. decembra 1944,
v želji, da razvijata sodelovanje na področju letalskega prevoza in da ustvarita potrebno podlago za opravljanje rednega zračnega prometa med svojima ozemljema in zunaj njiju,
sta Vlada Republike Slovenije in
Vlada Helenske republike
imenovali pooblaščenca, ki sta se dogovorila o:
1. člen
POMEN IZRAZOV
1. V tem sporazumu in v njegovi prilogi:
a) izraz „konvencija“ pomeni Konvencijo o mednarodnem civilnem letalstvu, ki je bila na voljo za podpis v Chicagu 7. decembra 1944, ter vključuje vsako prilogo, sprejeto na podlagi 90. člena konvencije, in vsako spremembo prilog ali konvencije v skladu z njenim 90. in 94. členom, če te priloge in spremembe veljajo za obe pogodbenici;
b) izraz „pristojni organ“ pomeni za Republiko Slovenijo Ministrstvo za promet in za Helensko republiko vodjo Uprave za civilno letalstvo ali v obeh primerih katero koli osebo ali organ, pristojen za naloge, ki jih zdaj opravljata omenjena organa;
c) izraz „določeni prevoznik“ pomeni prevoznika, ki ga je v skladu s 3. členom tega sporazuma določila pogodbenica za opravljanje dogovorjenega zračnega prometa;
d) izraz „tarifa“ pomeni cene, ki se zaračunavajo za prevoz potnikov, prtljage in tovora, ter pogoje, pod katerimi te cene veljajo, vključno s provizijo in drugimi dodatnimi plačili za agencije ali za prodajo prevoznih listin, izvzeti pa so plačila in pogoji za prevoz pošte;
e) izraz „ dogovorjeni promet“ pomeni redni zračni promet na progah, navedenih v prilogi k temu sporazumu, za prevoz potnikov, tovora in pošte, vsakega posebej ali v kombinaciji;
f) izraz „zmogljivost“ v zvezi z letalom pomeni koristni tovor letala, ki je na voljo na progi ali delu proge, izraz „zmogljivost“ v zvezi z „dogovorjenim prometom“ pa je zmogljivost letala, ki se uporablja za tak promet, pomnožena s pogostostjo letov takega letala v določenem obdobju na progi ali delu proge;
g) izraz „ozemlje“ v zvezi z državo ima pomen, kot je določeno v 2. členu konvencije;
h) izrazi „zračni promet“, „mednarodni zračni promet“, „prevoznik“ in „pristanek v nekomercialne namene“ imajo pomen, kot je določeno v 96. členu konvencije;
i) izraz „takse za uporabnike“ pomenijo takse, ki se prevoznikom naložijo za uporabo letališč in letaliških ali navigacijskih naprav in objektov ali naprav za varovanje v letalstvu.
2. Priloga je sestavni del tega sporazuma. Vsako sklicevanje na sporazum zajema prilogo, razen če ni izrecno drugače dogovorjeno.
2. člen
PODELITEV PRAVIC
1. Vsaka pogodbenica prizna drugi pogodbenici pravice, opredeljene v tem sporazumu, za opravljanje mednarodnega zračnega prometa na progah, navedenih v pregledu prog v prilogi. Tak promet in proge se v nadaljevanju imenujejo „dogovorjeni promet“ in „določene proge“.
2. V skladu z določbami tega sporazuma ima prevoznik, ki ga določi pogodbenica, pri opravljanju mednarodnega zračnega prometa:
a) pravico do preleta ozemlja druge pogodbenice brez pristanka;
b) pravico do pristanka na ozemlju druge pogodbenice v nekomercialne namene;
c) pravico, da na ozemlju druge pogodbenice v krajih, navedenih v prilogi tega sporazuma, vkrca in izkrca potnike, prtljago, tovor in pošto, namenjene v kraje na ozemlju druge pogodbenice ali ki prihajajo iz krajev druge pogodbenice;
d) pravico, da na ozemlju tretjih držav v krajih, navedenih v prilogi tega sporazuma, vkrca in izkrca potnike, prtljago, tovor in pošto, namenjene v kraje na ozemlju druge pogodbenice ali ki prihajajo iz krajev druge pogodbenice, navedenih v prilogi tega sporazuma.
3. Nobena določba tega člena ne daje določenemu prevozniku ene pogodbenice pravice, da za plačilo ali najemnino na ozemlju druge pogodbenice vkrca potnike, tovor in pošto, če so namenjeni v drug kraj na ozemlju te pogodbenice.
4. Podelitev prometnih pravic v skladu s prvim odstavkom zgoraj ne vključuje podelitve pravice do prevoza potnikov, prtljage, tovora in pošte med kraji na ozemlju pogodbenice, ki je podelila pravice, in kraji na ozemlju tretje države ali obratno (peta svoboda). Prometne pravice pete svobode se odobrijo samo na podlagi posebnih sporazumov med pristojnima organoma pogodbenic.
3. člen
DOLOČITEV PREVOZNIKOV IN IZDAJA DOVOLJENJ ZA OPRAVLJANJE PROMETA
1. Vsaka pogodbenica ima pravico, da za opravljanje dogovorjenega prometa določi enega prevoznika. Pristojni organ pogodbenice o tem pisno uradno obvesti pristojni organ druge pogodbenice.
2. Po prejemu obvestila o določitvi pristojni organ druge pogodbenice v skladu s tretjim in četrtim odstavkom tega člena določenemu prevozniku brez odlašanja izda potrebno dovoljenje za opravljanje prometa.
3. Pristojni organ pogodbenice lahko od prevoznika, ki ga je določila druga pogodbenica, zahteva, naj dokaže, da je sposoben izpolnjevati pogoje, določene v zakonih in predpisih, ki jih ta organ v skladu z določbami konvencije običajno uporablja pri opravljanju mednarodnega zračnega prometa.
4. Vsaka pogodbenica ima pravico, da zavrne izdajo dovoljenja za opravljanje prometa iz drugega odstavka tega člena ali da za uresničevanje pravic iz 2. člena določenemu prevozniku naloži take pogoje, kot se ji zdijo primerni, če nima dokaza, da so pogodbenica, ki je določila prevoznika, ali njeni državljani večinski lastnik prevoznika in imajo dejanski nadzor njim.
5. Ko določeni prevoznik dobi dovoljenje, predpisano v drugem odstavku tega člena, lahko kadar koli začne opravljati dogovorjeni promet, če veljajo tarife, določene v skladu z določbami 14. člena tega sporazuma.
6. Pogodbenica ima pravico, da skladno z določbami tega člena zamenja prevoznika, ki ga je določila, z drugim prevoznikom. Na novo določeni prevoznik uživa enake pravice in ima enake obveznosti kot prevoznik, katerega je nadomestil.
4. člen
PREKLIC IN ZAČASNI ODVZEM DOVOLJENJA ZA OPRAVLJANJE PROMETA
1. Vsaka pogodbenica ima pravico, da prekliče ali začasno odvzame določenemu prevozniku druge pogodbenice dovoljenje za opravljanje prometa v zvezi z uresničevanjem pravic iz 2. člena tega sporazuma ali da mu za uresničevanje teh pravic naloži pogoje, ki se ji zdijo potrebni, če:
a) nima zadovoljivih dokazov, da so pogodbenica, ki je določila prevoznika, ali njeni državljani večinski lastnik prevoznika in imajo dejanski nadzor nad njim;
b) prevoznik ne spoštuje zakonov ali predpisov pogodbenice, ki daje te pravice, ali jih grobo krši;
c) prevoznik ne opravlja dogovorjenega prometa v skladu s pogoji, določenimi v tem sporazumu.
2. Ta pravica se uporabi šele po posvetovanju z drugo pogodbenico, razen če je takojšen preklic, začasen odvzem dovoljenja za opravljanje prometa ali določitev pogojev iz prvega odstavka tega člena nujen, da bi se preprečile nadaljnje kršitve zakonov in predpisov.
5. člen
URESNIČEVANJE PRAVIC
1. Določeni prevoznik pogodbenice mora imeti pravične in enakopravne možnosti za opravljanje dogovorjenega prometa med ozemljema pogodbenic.
2. Določeni prevoznik ene pogodbenice upošteva interese določenega prevoznika druge pogodbenice, da ne bi neupravičeno vplival na dogovorjeni promet, ki ga ta prevoznik opravlja.
3. Glavni cilj dogovorjenega prometa je zagotavljanje zmogljivosti, ki ustrezajo potrebam po prevozu med ozemljem pogodbenice, ki je določila prevoznika, in kraji na določenih progah, kar poteka po načelu vzajemnosti.
4. Pravica določenih prevoznikov do opravljanja mednarodnega prometa med ozemljem ene pogodbenice in ozemlji tretjih držav se uresničuje v skladu s splošnimi načeli rednega razvoja trga, ki jih priznavata pogodbenici; ta pravica je vezana na pogoj, da se zmogljivost prilagaja:
a) potrebam po prevozu z ozemlja in na ozemlje pogodbenice, ki je določila prevoznika;
b) prometnim potrebam na območjih, skozi katera poteka dogovorjeni promet, ob upoštevanju domačega in regionalnega prometa;
c) zahtevam po ekonomičnem opravljanju dogovorjenega prometa.
5. Če pride do nesoglasja med določenima prevoznikoma pogodbenic o zmogljivosti, ki jo je treba zagotoviti, ter o pogostosti letov in tipu letal, ki jih uporabljata določena prevoznika pogodbenic pri dogovorjenem prometu, morata ta vprašanja rešiti pristojna organa pogodbenic. Dokler se organa o tem ne dogovorita, ostane v veljavi zmogljivost, ki jo zagotavljata določena prevoznika.
6. Nobena od pogodbenic ne sme enostransko omejiti opravljanja storitev določenega prevoznika druge pogodbenice, razen če je to v skladu s pogoji tega sporazuma ali z enotnimi pogoji, ki jih predvideva konvencija.
6. člen
OPROSTITEV PLAČILA CARIN IN DAJATEV
1. Letala, ki jih uporablja v mednarodnem zračnem prometu določeni prevoznik ene pogodbenice, njihova običajna oprema, zaloge goriva in maziv ter druge zaloge, vključno s hrano, pijačo in tobakom, ki so na njih, so ob prihodu na ozemlje druge pogodbenice oproščeni vseh carin, dajatev ali davščin, če ostanejo na letalu, dokler niso ponovno izvoženi.
2. Razen plačil stroškov za opravljene storitve so omenjenih dajatev in taks oproščeni tudi:
a) zaloge na letalih, natovorjene na ozemlju ene pogodbenice v količinah, ki jih določijo organi te pogodbenice, za uporabo na letalu določenega prevoznika druge pogodbenice, ki opravlja mednarodni zračni promet;
b) rezervni deli in običajna oprema na letalih, namenjeni za vzdrževanje ali popravilo letal, ki jih prevoznik uporablja v mednarodnem zračnem prometu;
c) gorivo in maziva za uporabo na letalih, ki jih v mednarodnem zračnem prometu uporablja določeni prevoznik druge pogodbenice, tudi kadar bodo te zaloge porabljene na delu poti nad ozemljem pogodbenice, na katerem so bile natovorjene.
3. Običajna letalska oprema ter material in zaloge na letalih, ki jih uporablja določeni prevoznik ene pogodbenice, smejo biti raztovorjeni na ozemlju druge pogodbenice le z odobritvijo njenih carinskih organov. V takem primeru so oprema, material in zaloge lahko pod njihovim nadzorom, dokler niso ponovno izvoženi ali drugače porabljeni v skladu s carinskimi predpisi.
4. Oprostitve iz tega člena se uporabljajo tudi, kadar določeni prevoznik ene pogodbenice sklene dogovor z nekim tretjim prevoznikom ali prevozniki o posojilu ali prevozu predmetov, ki so določeni v prvem in drugem odstavku tega člena, na ozemlje druge pogodbenice, če druga pogodbenica takemu tretjemu prevozniku daje podobne oprostitve.
7. člen
UPORABA ZAKONOV IN PREDPISOV
1. Zakoni in predpisi ene pogodbenice, ki urejajo vstop letal, ki opravljajo mednarodni zračni promet, na njeno ozemlje in izstop z njega ali polete teh letal nad njenim ozemljem, veljajo za določenega prevoznika druge pogodbenice.
2. Zakoni in predpisi ene pogodbenice, ki urejajo vstop potnikov, posadke, prtljage, tovora in pošte na njeno ozemlje, bivanje oziroma zadrževanje na njem in izstop z njega, kot so postopki v zvezi z vstopom, izstopom, izseljevanjem in priseljevanjem ter carinski in sanitarni postopki, veljajo za potnike, posadko, prtljago, tovor in pošto, ki jih prevažajo letala določenega prevoznika druge pogodbenice, dokler so na ozemlju prve pogodbenice.
3. Pogodbenica ne sme svojemu prevozniku v primerjavi z določenim prevoznikom druge pogodbenice dajati nobenih prednosti pri uporabi zakonov in predpisov, določenih v tem členu.
4. Za potnike, prtljago in tovor v neposrednem tranzitu čez ozemlje ene pogodbenice, ki ne zapuščajo za to namenjenega območja letališča, velja le enostaven nadzor. Prtljaga in tovor v neposrednem tranzitu sta oproščena carin in drugih podobnih dajatev.
8. člen
PRIZNAVANJE SPRIČEVAL IN LICENC
1. Spričevala o plovnosti, spričevala o sposobnosti ali licence, ki jih izda ali potrdi ena pogodbenica, mora v obdobju njihove veljavnosti druga pogodbenica priznati kot veljavna, če so zahteve, po katerih so bila spričevala ali licence izdana, vsaj enako stroge kot minimalni standardi, ki veljajo ali se lahko uvedejo skladno s konvencijo.
2. Pogodbenica ima pravico, da v zvezi z leti nad svojim ozemljem ne prizna za veljavne spričeval o sposobnosti in licenc, ki jih je njenim državljanom izdala ali potrdila druga pogodbenica ali tretja država.
3. Če bi privilegiji ali pogoji v licencah ali spričevalih iz prvega odstavka, ki jih je izdal pristojni organ ene pogodbenice osebi ali določenemu prevozniku ali za letalo, ki opravlja dogovorjeni promet na določenih progah, dovoljevali odstopanje od standardov, veljavnih po konvenciji, in če je o odstopanju pisno obveščena Mednarodna organizacija civilnega letalstva, sme pristojni organ druge pogodbenice po 17. členu tega sporazuma zahtevati posvetovanja s pristojnim organom prve pogodbenice, da bi dobil zadostne dokaze o tem, da je taka praksa zanj sprejemljiva. Če se organa ne moreta zadovoljivo dogovoriti, se uporabijo določbe 4. člena tega sporazuma.
9. člen
VARNOST V LETALSTVU
1. Pogodbenica lahko kadar koli zahteva posvetovanja o varnostnih standardih s katerega koli področja v zvezi s posadko letala, letalom ali njegovim upravljanjem, ki jih je sprejela druga pogodbenica. Posvetovanja se opravijo v 30 dneh od te zahteve.
2. Če po posvetovanjih ena pogodbenica ugotovi, da druga pogodbenica na katerem od teh področij dovolj učinkovito ne vzdržuje in ne uporablja varnostnih standardov, ki so vsaj enaki minimalnim standardom, takrat veljavnim po konvenciji, prva pogodbenica o teh ugotovitvah in ukrepih, potrebnih za uskladitev z minimalnimi standardi, obvesti drugo pogodbenico, ki mora sprejeti ustrezne korektivne ukrepe. Če druga pogodbenica v petnajstih (15) dneh ne sprejme ustreznih ukrepov, se uporabijo določbe 4. člena tega sporazuma.
3. Ne glede na obveznosti iz 33. člena konvencije velja, da lahko vsako letalo, ki ga določeni prevozniki uporabljajo za prevoz na ozemlje druge pogodbenice ali z njega, medtem ko je na ozemlju druge pogodbenice, znotraj in zunaj preiščejo pooblaščeni predstavniki druge pogodbenice, da bi preverili veljavnost dokumentov letala in osebja ter vidno stanje letala in njegove opreme (nadzor na ploščadi), če to ne povzroči prevelike zamude.
4. Če tak nadzor ali vrsta teh nadzorov na ploščadi vzbudi
a) resne skrbi, da letalo ali delovanje letala ni v skladu z minimalnimi standardi, ki so bili takrat sprejeti po konvenciji, ali
b) resne skrbi, da se varnostni standardi, ki so bili takrat sprejeti po konvenciji, premalo učinkovito vzdržujejo in izvajajo,
lahko pogodbenica, ki opravlja nadzor za namene 33. člena konvencije, neovirano sklepa, da zahteve, po katerih so bila izdana ali potrjena spričevala ali licence v zvezi z letalom ali posadko, ali da zahteve, po katerih to letalo deluje, niso enake minimalnim standardom, veljavnim po konvenciji, ali višje od njih.
5. Če predstavnik določenega prevoznika ene pogodbenice zavrne dostop do letala, ki ga upravlja ta prevoznik, zaradi nadzora na ploščadi v skladu s tretjim odstavkom, lahko druga pogodbenica neovirano sklepa, da obstajajo resni razlogi za zaskrbljenost, kakršni so omenjeni v četrtem odstavku, in sklepa tako, kot je to omenjeno v istem odstavku.
6. Pogodbenica si pridržuje pravico, da nemudoma začasno odvzame ali spremeni dovoljenje za opravljanje prometa prevozniku ali prevoznikom druge pogodbenice, če po nadzoru na ploščadi, vrsti nadzorov na ploščadi, zavrnitvi dostopa za izvedbo nadzora na ploščadi, po posvetovanju ali drugače ugotovi, da je takojšnje ukrepanje nujno za varno delovanje prevoznika.
7. Ukrepanje pogodbenice po drugem ali šestem odstavku preneha, ko ni več podlage za tako ukrepanje.
10. člen
VAROVANJE V LETALSTVU
1. Skladno s pravicami in obveznostmi po mednarodnem pravu pogodbenici ponovno potrjujeta, da je obveznost zagotavljati varnost civilnega letalstva pred dejanji nezakonitega vmešavanja sestavni del tega sporazuma. Ne da bi omejevali splošnost svojih pravic in obveznosti po mednarodnem pravu, morata pogodbenici še zlasti ravnati v skladu s Konvencijo o kaznivih dejanjih in nekaterih drugih dejanjih, storjenih na letalih, podpisano v Tokiu 14. septembra 1963, Konvencijo o zatiranju nezakonite ugrabitve zrakoplovov, podpisano v Haagu 16. decembra 1970, Konvencijo o zatiranju nezakonitih dejanj zoper varnost civilnega letalstva, podpisano v Montrealu 23. septembra 1971, in njenim dopolnilnim Protokolom o zatiranju nezakonitih nasilnih dejanj na letališčih za mednarodno civilno letalstvo, podpisanim v Montrealu 24. februarja 1988, Konvencijo o označevanju plastičnih razstreliv zaradi njihovega odkrivanja, podpisano v Montrealu 1. marca 1991, in vsemi drugimi mednarodnimi dokumenti s tega področja, ki jih lahko pogodbenici v prihodnosti ratificirata.
2. Pogodbenici na zahtevo druga drugi zagotovita vso potrebno pomoč, da bi preprečili nezakonite ugrabitve civilnih letal in druga nezakonita dejanja proti varnosti takih letal, njihovih potnikov in posadk, letališč in letalskih navigacijskih naprav ter vsako drugo grožnjo varnosti civilnega letalstva.
3. Pogodbenici v medsebojnih odnosih ravnata v skladu z določbami Mednarodne organizacije civilnega letalstva o varovanju v letalstvu, opredeljenimi v prilogah konvencije, v tisti meri, kot te določbe o varovanju veljajo za pogodbenici. Pogodbenici zahtevata od letalskih družb, ki so vpisane v njunih registrih ali imajo glavni sedež ali stalni naslov na njunih ozemljih, ter od letaliških podjetij na svojih ozemljih, da delujejo v skladu s takimi predpisi o varovanju letalstva.
4. Pogodbenici soglašata, da se lahko od njunih letalskih družb zahteva spoštovanje predpisov o varovanju letalstva, navedenih v tretjem odstavku tega člena, ki jih zahteva druga pogodbenica za vstop, izstop ali dokler so letala na ozemlju te druge pogodbenice. Vsaka pogodbenica zagotavlja, da se na njenem ozemlju učinkovito izvajajo primerni ukrepi za varovanje letal, za pregled potnikov, ročne prtljage, posadke, prtljage, tovora, pošte in zalog na letalu pred in med vkrcavanjem ali natovarjanjem. Vsaka pogodbenica z naklonjenostjo obravnava zahtevo druge pogodbenice za uvedbo posebnih, utemeljenih varnostnih ukrepov zaradi določene grožnje.
5. Ob nezakoniti ugrabitvi ali grožnji ugrabitve civilnega letala ali drugih nezakonitih dejanjih proti varnosti takega letala, njegovih potnikov in posadke, letališč ali letalskih navigacijskih naprav pogodbenici pomagata druga drugi, s tem da poskrbita za komuniciranje in druge ustrezne ukrepe, da bi se tak dogodek ali grožnja čim hitreje in varneje končal.
11. člen
TAKSE ZA UPORABNIKE
1. Pogodbenica določenemu prevozniku druge pogodbenice naloži ali dovoli, da se mu naložijo pravične in primerne takse za uporabnike. Takse temeljijo na zdravih ekonomskih načelih.
2. Takse, ki se odmerijo za uporabo letališč in letalskih navigacijskih naprav in storitev ene pogodbenice določenemu prevozniku druge pogodbenice, ne smejo biti višje od taks, odmerjenih letalom domačega prevoznika, ki opravlja redni mednarodni zračni promet.
12. člen
KOMERCIALNE DEJAVNOSTI
1. Pogodbenica dovoljuje določenemu prevozniku druge pogodbenice, da ima na njenem ozemlju svoja predstavništva. V predstavništvih so lahko pisarniško, upravno, komercialno in tehnično osebje, ki ga lahko pošlje druga pogodbenica, ali pa se tam zaposlijo lokalni prebivalci.
2. Pogodbenica daje določenemu prevozniku druge pogodbenice pravico, da na njenem ozemlju neposredno ali po pooblaščenih zastopnikih prodaja svoje prevozne storitve. Vsak prevoznik ima pravico, da prodaja, in vsaka oseba pravico, da kupuje take prevozne storitve v lokalni ali kateri koli prosto zamenljivi valuti skladno z veljavnimi predpisi o menjavi.
13. člen
ZAMENJAVA IN PRENOS PRIHODKA
Vsak določen prevoznik ima pravico, da v skladu z veljavnimi predpisi o menjavi zamenja in nakaže v svojo državo presežek prihodka (sorazmernega prevozu potnikov, prtljage, tovora in pošte) nad lokalnimi izdatki. Če so plačila med pogodbenicama urejena s posebnim sporazumom, se uporablja ta posebni sporazum.
14. člen
TARIFE
1. Tarife, ki jih lahko zaračuna določeni prevoznik za prevoz na ozemlje druge pogodbenice in z njega, so določene na primerni ravni, pri čemer so upoštevani vsi pomembni dejavniki, vključno s stroški obratovanja, primernim dobičkom, značilnostmi prometa in tarifami drugih prevoznikov.
2. Tarife iz prvega odstavka tega člena se, če je to mogoče, določijo s sporazumom med določenima prevoznikoma pogodbenic. Določena prevoznika po možnosti dosežeta tak sporazum s postopkom določanja tarif, ki ga je oblikovalo mednarodno telo, ki za to daje predloge.
3. Tako dogovorjene tarife se predložijo v odobritev pristojnima organoma pogodbenic vsaj šestdeset dni pred predlaganim dnevom njihove uvedbe. V posebnih primerih se ta čas lahko skrajša v skladu s sporazumom med omenjenima organoma. Če v tridesetih dneh po predložitvi tarif pristojni organ ene pogodbenice pisno ne sporoči pristojnemu organu druge pogodbenice, da se ne strinja s predloženo tarifo, se šteje tarifa za odobreno.
4. Če se določena prevoznika ne moreta dogovoriti ali če pristojni organ ene pogodbenice ne odobri tarife, skušata pristojna organa pogodbenic določiti tarifo v skupnem dogovoru. Pogajanja za to se začnejo v tridesetih dneh od dneva, ko postane očitno, da se določena prevoznika ne moreta sporazumeti o tarifi, ali od dneva, ko pristojni organ ene pogodbenice uradno pisno obvesti pristojni organ druge pogodbenice, da se ne strinja s tarifo.
5. Če se strani ne moreta sporazumeti, se spor predloži v postopek, predviden v 18. členu.
6. Že določena tarifa ostane veljavna, dokler se ne določi nova tarifa skladno z določbami tega člena ali 18. člena tega sporazuma, vendar največ dvanajst mesecev po dnevu, ko je pristojni organ ene pogodbenice sporočil, da se ne strinja s tarifo.
7. Pristojna organa pogodbenic si morata čim bolj prizadevati, da bi zagotovila, da določena prevoznika spoštujeta dogovorjene tarife, predložene pristojnima organoma pogodbenic, in da noben prevoznik nezakonito ne znižuje dela tarife, bodisi neposredno ali posredno.
15. člen
PREDLOŽITEV REDOV LETENJA
1. Določeni prevoznik vsaj trideset dni pred začetkom opravljanja dogovorjenega prometa predloži svoj red letenja v odobritev pristojnemu organu druge pogodbenice. Enak postopek se uporablja za spremembe reda letenja.
2. Če določeni prevoznik pogodbenice želi opravljati dodatne lete v dogovorjenem prometu zunaj odobrenega reda letenja, mora za to dobiti predhodno dovoljenje pristojnega organa druge pogodbenice. Tako zahtevo je običajno treba vložiti vsaj dva delovna dneva pred takimi leti.
16. člen
PREDLOŽITEV STATISTIČNIH PODATKOV
Pristojni organ pogodbenice pristojnemu organu druge pogodbenice na njegovo zahtevo pošilja redne in druge statistične podatke o prevozih v dogovorjenem zračnem prometu.
17. člen
POSVETOVANJA
Vsaka pogodbenica sme kadar koli zahtevati posvetovanje o izvajanju, razlagi, uporabi ali spremembi tega sporazuma. Takšno posvetovanje med pristojnima organoma se začne v šestdesetih dneh, potem ko pogodbenica prejme pisno zahtevo, razen če se pogodbenici dogovorita drugače.
18. člen
REŠEVANJE SPOROV
1. Spor v zvezi s tem sporazumom, ki ga pogodbenici ne moreta rešiti z neposrednimi pogajanji ali po diplomatski poti, se na zahtevo katere koli pogodbenice predloži arbitražnemu sodišču.
2. V takem primeru vsaka pogodbenica imenuje enega razsodnika, ta dva skupaj pa določita tretjega, ki je državljan tretje države. Če v dveh mesecih po tem, ko je ena pogodbenica imenovala svojega razsodnika, druga ne imenuje razsodnika ali če v enem mesecu po imenovanju drugega razsodnika oba razsodnika ne določita predsednika sodišča, lahko katera koli pogodbenica od predsednika sveta Mednarodne organizacije civilnega letalstva zahteva, da imenuje razsodnika. Če je predsednik sveta Mednarodne organizacije civilnega letalstva državljan ene od pogodbenic, imenuje razsodnika podpredsednik sveta, ki je državljan tretje države.
3. Arbitražno sodišče samo sprejme svoj poslovnik. Vsaka pogodbenica krije stroške razsodnika, ki ga je imenovala. Druge stroške arbitražnega sodišča si pogodbenici delita v enakih deležih.
4. Pogodbenici morata spoštovati vsako odločitev, sprejeto na podlagi tega člena.
19. člen
SPREMEMBE
1. Če pogodbenica meni, da bi bilo dobro spremeniti katero od določb tega sporazuma, ta sprememba, če se pogodbenici o njej dogovorita, začne veljati, ko se pogodbenici uradno obvestita, da so bili končani njuni notranjepravni postopki.
2. O spremembah priloge tega sporazuma se lahko neposredno dogovorita pristojna organa pogodbenic.
3. Ob sklenitvi splošne večstranske konvencije ali sporazuma o zračnem prometu, ki velja za obe pogodbenici, se šteje, da je ta sporazum spremenjen brez posebnih dogovorov, tako da ustreza določbam takega večstranskega sporazuma.
20. člen
ODPOVED
1. Vsaka pogodbenica lahko kadar koli pisno sporoči drugi pogodbenici svojo odločitev, da odpoveduje sporazum. Tako sporočilo mora biti hkrati poslano Mednarodni organizaciji civilnega letalstva.
2. V takem primeru sporazum preneha veljati dvanajst mesecev po prejemu obvestila, razen če ni pred potekom tega roka obvestilo sporazumno umaknjeno.
3. Če druga pogodbenica ne potrdi prejema obvestila o odpovedi, se šteje, da ga je prejela štirinajst dni po dnevu, ko ga je prejela Mednarodna organizacija civilnega letalstva.
21. člen
REGISTRACIJA PRI MEDNARODNI ORGANIZACIJI CIVILNEGA LETALSTVA
Ta sporazum, njegova priloga in vse poznejše spremembe se registrirajo pri Mednarodni organizaciji civilnega letalstva.
22. člen
ZAČETEK VELJAVNOSTI
Ta sporazum začne veljati na dan, ko pogodbenici druga drugo po diplomatski poti uradno obvestita, da so izpolnjene njune notranjepravne zahteve za začetek njegove veljavnosti.
Da bi to potrdila, sta podpisana pooblaščenca, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v Ljubljani v dveh izvodih dne 30. novembra 2001 v slovenskem, grškem in angleškem jeziku, pri čemer so vsa tri besedila enako verodostojna.

AND THE GOVERNMENT OF THE HELLENIC REPUBLIC
RELATING TO SCHEDULED AIR SERVICES
Considering that the Republic of Slovenia and
The Hellenic Republic
(hereinafter referred to as the Contracting Parties)
Being Parties to the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944,
Desiring to develop co-operation in the field of air transport, and desiring to establish the necessary basis for the operation of scheduled air services, between and beyond their respective territories;
The Government of the Republic of Slovenia, and
The Government of the Hellenic Republic
Have appointed plenipotentiaries who have agreed as follows:
Article 1
DEFINITIONS
1. For the purpose of the present Agreement and its Annex:
a) the term “the Convention” means the Convention on International Civil Aviation opened for signature at Chicago on the seventh day of December, 1944, and includes any annex adopted under article 90 of that Convention and any amendment of the annexes or Convention under articles 90 and 94 thereof, so far as those annexes and amendments are applicable for both Contracting Parties;
b) the term “aeronautical authorities” means in the case of the Republic of Slovenia, the Ministry of Transport and in the case of the Hellenic Republic, the Governor of the Civil Aviation Authority or, in both cases, any person or body authorised to exercise the functions presently assigned to the said authorities;
c) the term “designated airline” means an airline which one Contracting Party has designated in accordance with Article 3 of the present Agreement for the operation of the agreed air services;
d) the term “tariff” means the prices to be paid for the carriage of passengers, baggage and cargo and the conditions under which these prices apply, including commission charges and other additional remuneration for agency or sale of transportation documents but excluding remuneration and conditions for the carriage of mail.
e) the term “agreed services” means scheduled air services on the routes specified in the Annex to this Agreement for the transport of passengers, cargo and mail, separately or in combination.
f) the term “capacity” in relation to an aircraft means, the payload of that aircraft available on a route or section of a route and the term “capacity” in relation to “an agreed service” means, the capacity of the aircraft used on such service, multiplied by the frequency operated by such aircraft over given period on a route or section of a route.
g) the term “territory” in relation to a State has the meaning of the Article 2 of the Convention.
h) the terms “air service”, “international air service”, “airline” and “stop for non-traffic purposes” shall have the meanings respectively assigned to them in Article 96 of the Convention.
i) the term “user charge” means a charge made to airlines for the provision of airport, air navigation or aviation security facilities or property.
2. The Annex forms an integral part of the present Agreement. All references to the Agreement shall include the Annex unless explicitly agreed otherwise.
Article 2
GRANT OF RIGHTS
1. Each Contracting Party grants to the other Contracting Party the rights specified in the present Agreement for the purpose of operating international air services on the routes specified in the schedules of the Annex. Such services and routes are hereinafter called “the agreed services” and “the specified routes” respectively.
2. Subject to the provisions of the present Agreement the airline designated by each Contracting Party shall while operating international air services enjoy:
a) the right to fly across the territory of the other Contracting Party without landing;
b) the right to make stops in the territory of the other Contracting Party for non-traffic purposes;
c) the right to embark and disembark, in the said territory at the points specified in the Annex of the present Agreement, passengers, baggage, cargo and mail destined for or coming from points in the territory of the other Contracting Party;
d) the right to embark and disembark, in the territory of third countries at the points specified in the Annex of the present Agreement, passengers, baggage, cargo, and mail destined for or coming from points in the territory of the other Contracting Party, specified in the Annex of the present Agreement.
3. Nothing in this Article shall be deemed to confer on the designated airline of one Contracting Party the privilege of embarking, in the territory of the other Contracting Party, passengers, baggage, cargo and mail carried for remuneration or hire and destined for another point in the territory of that Contracting Party.
4. The grant of traffic rights pursuant to paragraph 1 above does not include the grant of the right to carry passengers, baggage, cargo and mail between points in the territory of the Contracting Party granting the rights and points in the territory of a third country or vice versa (fifth freedom). Fifth freedom traffic rights shall only be granted on the basis of special agreements between the aeronautical authorities of both Contracting Parties.
Article 3
DESIGNATION AND OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to designate one airline for the purpose of operating the agreed services. Such designation shall be effected by virtue of a written notification between the aeronautical authorities of both Contracting Parties.
2. The aeronautical authorities which have received the notification of designation shall, subject to the provisions of paragraph 3 and 4 of this Article, without delay grant to the designated airline of the other Contracting Party the necessary operating authorization.
3. The aeronautical authorities of one Contracting Party may require an airline designated by the other Contracting Party to prove that it is qualified to fulfil the conditions prescribed under the laws and regulations normally applied to the operation of international air services by the said authorities in conformity with the provisions of the Convention.
4. Each Contracting Party shall have the right to refuse to grant the operating authorization referred to in paragraph 2 of this Article, or to impose such conditions as it may deem necessary on the exercise of the rights specified in Article 2 of the present Agreement, whenever the said Contracting Party is not satisfied that the preponderant part of the ownership and effective control of that airline are vested in the Contracting Party designating the airline or in its nationals.
5. Having received the operating authorization, provided for under paragraph 2 of this Article, the designated airline may at any time begin to operate the agreed services, provided that tariffs established in accordance with the provisions of Article l4 of the present Agreement are in force.
6. Either Contracting Party shall have the right to replace, subject to the provisions of this Article, an airline it has designated by another airline. The newly designated airline shall have the same rights and be subject to the same obligations as the airline which it replaces.
Article 4
REVOCATION AND SUSPENSION OF OPERATING AUTHORIZATION
1. Each Contracting Party shall have the right to revoke or suspend an operating authorization for the exercise of the rights specified in Article 2 of the present Agreement by an airline designated by the other Contracting Party, or to impose such conditions as it may deem necessary on the exercise of such rights, if:
a) it is not satisfied that the preponderant part of that airline’s ownership and effective control are vested in the Contracting Party designating the airline or in its nationals; or
b) the said airline fails to comply with or has seriously infringed the laws or regulations of the Contracting Party granting those rights; or
c) the said airline fails to operate the agreed services in accordance with the conditions prescribed under the present Agreement.
2. Such right shall be exercised only after consultation with the other Contracting Party, unless immediate revocation, suspension or imposition of the conditions provided for under paragraph 1 of this Article is essential to prevent further infringements of laws and regulations.
Article 5
EXERCISE OF RIGHTS
1. The designated airline shall enjoy fair and equal opportunities to operate the agreed services between the territories of the Contracting Parties.
2. The designated airline of each Contracting Party shall take into consideration the interests of the designated airline of the other Contracting Party so as not to affect unduly the agreed services of the latter airline.
3. The main objective of the agreed services shall be to provide capacity corresponding to traffic demand between the territory of the Contracting Party which has designated the airline and the points served on the specified routes, based upon the principle of reciprocity.
4. The right of each of the designated airlines to carry international traffic between the territory of the other Contracting Party and the territories of third countries shall be exercised in conformity with the general principles of normal development of the market to which both Contracting Parties subscribe, and shall be subject to the condition that the capacity shall be adapted:
a) to traffic demand to and from the territory of the Contracting Party which has designated the airline;
b) to traffic demand of the areas through which the agreed service passes, local and regional services being taken into account;
c) to the requirements of an economical operation of the agreed services.
5. In case of disagreement between the designated airlines of the Contracting Parties on the capacity to be provided including the frequency of services and the type of aircraft to be used by the designated airlines of the Contracting Parties on the agreed services, these issues shall be resolved by agreement between the Aeronautical Authorities of the two Contracting Parties. Until such agreement has been reached, the capacity provided by the designated airlines shall remain unchanged.
6. Neither Contracting Party shall unilaterally restrict the operations of the designated airline of the other Contracting Party, except according to the terms of the present Agreement or by such uniform conditions as may be contemplated by the Convention.
Article 6
EXEMPTION FROM DUTIES AND TAXES
1. Aircraft operated in international air services by a designated airline of either Contracting Party, as well as their regular equipment, supplies of fuel and lubricants, aircraft stores including food, beverages and tobacco carried on board such aircraft, shall, on entering into the territory of the other Contracting Party, be exempt from all duties or taxes, provided such equipment, supplies and stores remain on board until they are re-exported.
2. Exempt from the same duties and taxes, with exception of charges corresponding to the services rendered, shall also be:
a) aircraft stores taken on board in the territory of one Contracting Party, within the limits fixed by the authorities of the said Contracting Party, and intended for use on board an aircraft operated in an international service by a designated airline of the other Contracting Party;
b) spare parts and regular airborne equipment imported into the territory of one Contracting Party for the maintenance or repair of aircraft operated in international services;
c) fuel and lubricants destined for a designated airline of one Contracting Party to supply aircraft operated in international services, even when these supplies are to be used on any part of a journey performed over the territory of the Contracting Party in which they have been taken on board.
3. The regular airborne equipment as well as the materials and supplies retained on board the aircraft operated by a designated airline of one Contracting Party may be unloaded in the territory of the other Contracting Party only with the approval of the customs authorities of that territory. In such case, they may be placed under supervision of the said authorities until they are re-exported or otherwise disposed of in accordance with customs regulations.
4. The exemptions provided for by this Article shall also be available in situations where a designated airline of either Contracting Party has entered into arrangements with another airline or airlines for the loan or transfer in the territory of the other Contracting Party of the items specified in paragraphs 1 and 2 of this Article, provided such other airline or airlines similarly enjoy such exemptions from the other Contracting Party.
Article 7
APPLICATION OF LAWS AND REGULATIONS
1. The laws and regulations of one Contracting Party governing entry into and departure from its territory of aircraft engaged in international air navigation or flights of such aircraft over that territory, shall apply to the designated airline of the other Contracting Party.
2. The laws and regulations of one Contracting Party governing entry into, sojourn in, and departure from its territory of passengers, crew, baggage, cargo or mail, such as formalities regarding entry, exit, emigration and immigration as well as customs and sanitary measures, shall apply to passengers, crew, baggage, cargo or mail carried by the aircraft of the designated airline of the other Contracting Party while they are within the said territory.
3. Neither Contracting Party may grant any preference to its own airline with regard to the designated airline of the other Contracting Party in the application of the laws and regulations provided for in this Article.
4. Passengers, baggage and cargo in direct transit across the territory of one Contracting Party and not leaving the area of the airport reserved for such purpose shall only be subject to a simplified control. Baggage and cargo in direct transit shall be exempt from customs duties and other similar taxes.
Article 8
RECOGNITION OF CERTIFICATES AND LICENCES
1. Certificates of airworthiness, certificates of competency and licences issued, or rendered valid, by one of the Contracting Parties shall, during the period of their validity, be recognized as valid by the other Contracting Party, provided that the requirements under which such certificates or licenses were issued or rendered valid are equal to or above the minimum standards which are or may be established pursuant to the Convention.
2. Each Contracting Party, however, reserves the right, to refuse to recognize as valid, for the purpose of flights over its own territory, certificates of competency and licences granted to, or rendered valid for, its own nationals by the other Contracting Party or by any other State.
3. If the privileges or conditions of the license or certificates referred to in paragraph (1) above, issued by the Aeronautical Authorities of one Contracting Party to any person or designated airline or in respect of an aircraft operating the agreed services on the specified routes would permit a difference from the standards established under the Convention, and which difference has been filed with the International Civil Aviation Organization, the Aeronautical Authorities of the other Contracting Party may request consultations in accordance with Article 17 of this Agreement with the Aeronautical Authorities of that Contracting Party with a view to satisfying themselves that the practice in question is acceptable to them. Failure to reach a satisfactory agreement will constitute grounds for the application of Article 4 of this Agreement.
Article 9
AVIATION SAFETY
1. Each Contracting Party may request consultations at any time concerning safety standards in any area relating to aircrew, aircraft or their operation adopted by the other Contracting Party. Such consultations shall take place within 30 days of that request.
2. If, following such consultations, one Contracting Party finds that the other Contracting Party does not effectively maintain and administer safety standards in any such area that are at least equal to the minimum standards established at that time pursuant to the Convention, the first Contracting Party shall notify the other Contracting Party of those findings and the steps considered necessary to conform with those minimum standards, and that other Contracting Party shall take appropriate corrective action. Failure by the other Contracting Party to take appropriate action within fifteen (15) days shall be cause for the application of Article 4 of this Agreement.
3. Notwithstanding the obligations mentioned in Article 33 of the Convention, it is agreed that any aircraft operated by the designated airlines on services to or from the territory of the other Contracting Party may, while within the territory of the other Contracting Party, be made the subject of an examination by the authorized representatives of the other Contracting Party, on board and around the aircraft to check both the validity of the aircraft documents and those of its crew and the apparent condition of the aircraft and its equipment (ramp inspection), provided this does not lead to unreasonable delay.
4. If any such ramp inspection or series of ramp inspections gives rise to
(a) serious concerns that an aircraft or the operation of an aircraft does not comply with the minimum standards established at that time pursuant to the Convention, or
(b) serious concerns that there is a lack of effective maintenance and administration of safety standards established at that time pursuant to the Convention,
the Contracting Party carrying out the inspection shall, for the purposes of Article 33 of the Convention, be free to conclude that the requirements under which the certificate or licences in respect of that aircraft or in respect of the crew of that aircraft had been issued or rendered valid, or that the requirements under which that aircraft is operated, are not equal to or above the minimum standards established pursuant to the Convention.
5. In the event that access for the purpose of undertaking a ramp inspection of an aircraft operated by the designated airline of one Contracting Party in accordance with paragraph 3 above is denied by the representative of the airline concerned, the other Contracting Party shall be free to infer that serious concerns of the type referred to in paragraph 4 above arise and draw the conclusions referred to in that paragraph.
6. Each Contracting Party reserves the right to suspend or vary the operating authorization of an airline or airlines of the other Contracting Party immediately in the event that the first Contracting Party concludes, whether as a result of a ramp inspection, a series of ramp inspections, a denial of access for ramp inspection, consultation or otherwise, that immediate action is essential to the safety of an airline operation.
7. Any action by one Contracting Party in accordance with paragraph 2 or 6 above shall be discontinued once the basis for the taking that action ceases to exist.
Article 10
AVIATION SECURITY
1. Consistent with their rights and obligations under international law, the Contracting Parties reaffirm that their obligation to each other to protect the security of civil aviation against acts of unlawful interference forms an integral part of the present Agreement. Without limiting the generality of their rights and obligations under international law, the Contracting Parties shall in particular act in conformity with the provisions of the Convention on Offences and Certain Other Acts Committed on Board Aircraft, signed at Tokyo on 14 September 1963, the Convention for the Suppression of Unlawful Seizure of Aircraft, signed at the Hague on 16 December 1970, the Convention for the Suppression of Unlawful Acts against the Safety of Civil Aviation, signed at Montreal on 23 September 1971 and its supplementary Protocol for the Suppression of Unlawful Acts of Violence at Airports Serving International Civil Aviation, signed at Montreal on 24 February 1988, the Convention on the Marking of Plastic Explosives for the Purpose of Detection, signed at Montreal on 1 March 1991 and all other international instruments in the same field which may be ratified in the future by the Contracting Parties.
2. The Contracting Parties shall provide upon request all necessary assistance to each other to prevent acts of unlawful seizure of civil aircraft and other unlawful acts against the safety of such aircraft, their passengers and crew, airports and air navigation facilities, and any other threat to the security of civil aviation.
3. The Contracting Parties shall, in their mutual relations, act in conformity with the aviation security provisions established by the International Civil Aviation Organisation and designated as Annexes to the Convention to the extent that such security provisions are applicable to the Contracting Parties. They shall require that operators of aircraft of their registry or operators of aircraft who have their principal place of business or permanent residence in their territory and the operators of airports in their territory act in conformity with such aviation security provisions.
4. Each Contracting Party agrees that such operators of aircraft may be required to observe the aviation security provisions referred to in paragraph 3 of this Article required by the other Contracting Party for entry into, departure from, or while within, the territory of that other Contracting Party. Each Contracting Party shall ensure that adequate measures are effectively applied within its territory to protect the aircraft and to screen passengers, and their carry-on items and to carry out appropriate checks on crew, baggage, cargo and aircraft stores prior to and during boarding or loading. Each Contracting Party shall also give positive consideration to any request from the other Contracting Party for reasonable special security measures to meet a particular threat.
5. When an incident or threat of an incident of unlawful seizure of civil aircraft or other unlawful acts against the safety of such aircraft, their passengers and crew, airports or air navigation facilities occurs, the Contracting Parties shall assist each other by facilitating communications and other appropriate measures intended to terminate rapidly and safely such incident or threat thereof.
Article 11
USER CHARGES
1. Each Contracting Party may impose or permit to be imposed on the designated airline of the other Contracting Party just and reasonable charges. These charges shall be based on sound economic principles.
2. Charges for the use of airport and air navigation facilities and services offered by one Contracting Party to the designated airline of the other Contracting Party shall not be higher than those which have to be paid by national aircraft operating on scheduled international services.
Article 12
COMMERCIAL ACTIVITIES
1. The designated airline of one Contracting Party shall be permitted to maintain adequate representations in the territory of the other Contracting Party. These representations may include commercial, operational and technical staff, which may consist of transferred or locally engaged personnel.
2. Each Contracting Party grants to the designated airline of the other Contracting Party the right to engage in the sale of air transportation in its territory directly and, at the airline’s discretion, through its agents. Each airline shall have the right to sell such transportation, and any person shall be free to purchase such transportation in the currency of that territory or in freely convertible currencies of other countries in accordance with the foreign exchange regulations in force.
Article 13
CONVERSION AND TRANSFER OF REVENUES
Each designated airline shall have the right to convert and remit to its country, in accordance with the foreign exchange regulations in force, receipts in excess of sums locally disbursed in due proportion to the carriage of passengers, baggage, cargo and mail. If payments between the Contracting Parties are regulated by a special agreement, this special agreement shall apply.
Article 14
TARIFFS
1. The tariffs to be applied by each designated airline in connection with any transportation to and from the territory of the other Contracting Party shall be established at reasonable levels, due regard being paid to all relevant factors, including cost of operation, reasonable profit, the characteristics of each service and the tariffs charged by other airlines.
2. The tariffs referred to in paragraph 1 of this Article shall, if possible, be established by mutual agreement by the designated airlines of both Contracting Parties. The designated airlines shall, whenever possible, reach such agreement through the rate fixing procedure established by the international body which formulates proposals in this matter.
3. The tariffs so agreed shall be submitted for approval to the aeronautical authorities of the Contracting Parties at least sixty days before the proposed date of their introduction. In special cases, this time limit may be reduced subject to the agreement of the said authorities. If within thirty days after the submission of the tariffs neither of the aeronautical authorities notifies to the other aeronautical authorities its disapproval, these tariffs shall be considered approved.
4. If the designated airlines cannot agree, or if a tariff is not approved by the aeronautical authorities of one Contracting Party, the aeronautical authorities of both Contracting Parties shall endeavour to determine the tariff by mutual agreement. Such negotiations shall begin within thirty days from the date when it becomes obvious that the designated airlines cannot agree upon a tariff or the aeronautical authorities of one Contracting Party have notified to the aeronautical authorities of the other Contracting Party their disapproval of a tariff.
5. In default of agreement the dispute shall be submitted to the procedure provided for in Article 18 hereinafter.
6. A tariff already established shall remain in force until a new tariff has been established in accordance with the provisions of this Article or Article 18 of the present Agreement but not longer than twelve months from the day of the disapproval of the aeronautical authorities of one of the Contracting Parties.
7. The aeronautical authorities of each Contracting Party shall exercise their best efforts to ensure that the designated airlines conform to the agreed tariffs filed with the aeronautical authorities of the Contracting Parties, and that no airline illegally rebates any portion of such tariffs by any means, directly or indirectly.
Article 15
TIME-TABLE SUBMISSION
1. Not later than thirty days prior to the begin of the operation of the agreed services the designated airline shall submit the envisaged time-table for approval to the aeronautical authorities of the other Contracting Party. The same procedure shall apply to any modification thereof.
2. For supplementary flights which a designated airline of one Contracting Party wishes to operate on the agreed services outside the approved time-table it has to request prior permission from the aeronautical authorities of the other Contracting Party. Such request shall usually be submitted at least two working-days before operating such flights.
Article 16
PROVISION OF STATISTICS
The aeronautical authorities of both Contracting Parties shall supply each other, on request, with periodic statistics or other similar information relating to the traffic carried on the agreed services.
Article 17
CONSULTATIONS
Either Contracting Party may at any time request consultations on the implementation, interpretation, application or amendment of the present Agreement. Such consultations between the aeronautical authorities shall begin within a period of sixty days from the date the other Contracting Party receives the written request, unless otherwise agreed by the Contracting Parties.
Article 18
SETTLEMENT OF DISPUTES
1. Any dispute arising under the present Agreement which cannot be settled by direct negotiations or through diplomatic channels, shall, at the request of either Contracting Party, be submitted to an arbitral tribunal.
2. In such case, each Contracting Party shall nominate an arbitrator and the two arbitrators shall appoint a president, national of a third State. If within two months after one of the Contracting Parties has nominated its arbitrator, the other Contracting Party has not nominated its own, or, if within the month following the nomination of the second arbitrator, both arbitrators have not agreed on the appointment of the President, each Contracting Party may request the President of the Council of the International Civil Aviation Organization to proceed with the necessary nominations. If the President of the Council of the ICAO is a national of either Contracting Party, the Vice-president of that Council, who is a national of a third state, may be requested to nominate the arbitrators.
3. The arbitral tribunal shall determine its own procedure. Each Contracting Party shall pay the expenses of its arbitrator. The remaining expenses of the arbitral tribunal shall be shared equally by the Contracting Parties.
4. The Contracting Parties shall comply with any decision delivered in the application of this Article.
Article 19
MODIFICATIONS
1. If either of the Contracting Parties considers it desirable to modify any provision of the present Agreement, such modification, if agreed between the Contracting Parties, shall enter into force when the Contracting Parties have notified to each other the fulfilment of their internal procedures.
2. Modifications to the Annex of the present Agreement may be agreed directly between the aeronautical authorities of the Contracting Parties.
3. If a general multilateral air transport convention or agreement, comes into force in respect of both Contracting Parties, this Agreement shall be deemed to be amended without further agreement as may be necessary to conform with the provisions of that multilateral agreement.
Article 20
TERMINATION
1. Each Contracting Party may at any time give notice in writing to the other Contracting Party of its decision to terminate the present Agreement. Such notice shall be simultaneously communicated to the International Civil Aviation Organization.
2. In such case the Agreement shall terminate twelve months after the date of receipt of the notice by the other Contracting Party, unless the notice to terminate is withdrawn by agreement before the expiry of this period.
3. In default of acknowledgement of receipt by the other Contracting Party, the notice shall be deemed to have been received fourteen days after the date on which the International Civil Aviation Organization has received communication thereof.
Article 21
REGISTRATION WITH INTERNATIONAL CIVIL AVIATION ORGANIZATION
The present Agreement and all amendments thereto shall be registered with the International Civil Aviation Organization.
Article 22
ENTRY INTO FORCE
This Agreement shall enter into force on the date when both Contracting Parties notify each other, through diplomatic channels, that they have completed their internal legal procedures necessary to this end.
In witness thereof, the undersigned plenipotentiaries being duly authorized by their respective Governments, have signed the present Agreement.
Done at Ljubljana in duplicate, this day 30 November 2001 in the Slovenian, Greek and English languages, all three texts being equally authentic.
In case of any divergence of interpretation the English text shall prevail.

Intermediate points and points beyond may be served by the designated airlines.
