O RATIFIKACIJI PROTOKOLA K EVROPSKEMU SPORAZUMU O PRIDRUŽITVI MED REPUBLIKO SLOVENIJO NA ENI STRANI IN EVROPSKIMI SKUPNOSTMI IN NJIHOVIMI DRŽAVAMI ČLANICAMI NA DRUGI STRANI O UGOTAVLJANJU SKLADNOSTI IN PREVZEMANJU INDUSTRIJSKIH IZDELKOV (PECA)
1. člen
Ratificira se Protokol k Evropskemu sporazumu o pridružitvi med Republiko Sloveniji na eni strani in Evropskimi skupnostmi in njihovimi državami članicami na drugi strani o ugotavljanju skladnosti in prevzemanju industrijskih izdelkov (PECA), podpisan v Bruslju dne 26. novembra 2002.

K EVROPSKEMU SPORAZUMU O PRIDRUŽITVI MED REPUBLIKO SLOVENIJO NA ENI STRANI IN EVROPSKIMI SKUPNOSTMI IN NJIHOVIMI DRŽAVAMI ČLANICAMI NA DRUGI STRANI O UGOTAVLJANJU SKLADNOSTI IN PREVZEMANJU INDUSTRIJSKIH IZDELKOV (PECA)
EVROPSKA SKUPNOST IN REPUBLIKA SLOVENIJA,
v nadaljevanju “pogodbenici“, sta,
KER je Republika Slovenija zaprosila za članstvo v Evropski uniji in ker tako članstvo pomeni učinkovito izvajanje pravnega reda Evropske skupnosti,
ZAVEDAJOČ SE, da se s postopnim sprejemanjem in izvajanjem prava Skupnosti že pred pristopom Republike Slovenije ponuja priložnost za razširitev nekaterih ugodnosti notranjega trga in zagotavljanje njegovega učinkovitega delovanja na nekaterih področjih,
GLEDE NA TO, da bo na področjih, ki jih zajema ta protokol, slovensko notranje pravo v veliki meri prevzelo pravo Skupnosti,
GLEDE NA privrženost pogodbenic načelom prostega pretoka blaga in pospeševanju kakovosti izdelkov, da bi zagotovili zdravje in varnost svojih državljanov in varovanje okolja, med drugim tudi s strokovno pomočjo in drugimi oblikami sodelovanja med njima,
V ŽELJI, da bi sklenili protokol k Evropskemu sporazumu o ugotavljanju skladnosti in prevzemanju industrijskih izdelkov (v nadaljevanju “ta protokol“), ki določa medsebojno prevzemanje industrijskih izdelkov, ki izpolnjujejo zahteve zakonitega dajanja na trg v eni od pogodbenic, in medsebojno priznavanje rezultatov ugotavljanja skladnosti industrijskih izdelkov, ki jih ureja pravo Skupnosti ali notranje pravo, s tem da 76. člen Evropskega sporazuma določa, da se po potrebi sklene sporazum o vzajemnem priznavanju,
S TEM da je zaradi tesnega povezovanja med Evropsko skupnostjo in Islandijo, Lihtenštajnom in Norveško na podlagi Sporazuma o evropskem gospodarskem prostoru primerno razmisliti o sklenitvi vzporednega evropskega sporazuma o ugotavljanju skladnosti med Republiko Slovenijo in temi državami, ki bi bil enakovreden temu protokolu,
OB UPOŠTEVANJU statusa pogodbenic v Sporazumu o ustanovitvi Svetovne trgovinske organizacije in zavedajoč se zlasti svojih obveznosti, ki izhajajo iz Sporazuma Svetovne trgovinske organizacije o tehničnih ovirah v trgovini,
SKLENILI:
1. ČLEN
Namen
Namen tega protokola je omogočiti pogodbenicama odpravo tehničnih ovir v trgovini z industrijskimi izdelki. Sredstvo za doseganje tega cilja je postopno sprejemanje in izvajanje notranjega prava Republike Slovenije, ki je enakovredno pravu Skupnosti.
Ta protokol določa:
(a) medsebojno prevzemanje industrijskih izdelkov, navedenih v prilogah o medsebojnem prevzemanju industrijskih izdelkov, ki izpolnjujejo zahteve za zakonito dajanje na trg v eni od pogodbenic;
(b) medsebojno priznavanje rezultatov ugotavljanja skladnosti industrijskih izdelkov, ki jih urejata pravo Skupnosti in enakovredno slovensko notranje pravo, kar je navedeno v prilogah o medsebojnem priznavanju rezultatov ugotavljanja skladnosti.
2. ČLEN
Pomen izrazov
V tem protokolu pomenijo izrazi:
(a) “industrijski izdelki“ izdelke, navedene v 9. členu in v Protokolu 2 Evropskega sporazuma,
(b) “pravo Skupnosti“ vsak pravni akt in ustaljene postopke Evropske skupnosti za izvajanje, ki se nanašajo na posamezno stanje, tveganje ali vrsto industrijskih izdelkov, kot ga razlaga Sodišče Evropskih skupnosti,
(c) “notranje pravo“ vsak pravni akt in ustaljene postopke za izvajanje, s katerimi Republika Slovenija prevzame pravo Skupnosti, ki se nanaša na posamezno stanje, tveganje ali vrsto industrijskih izdelkov.
Izrazi, uporabljeni v tem protokolu, imajo pomen, ki jim ga pripisujeta pravo Skupnosti in slovensko notranje pravo.
3. ČLEN
Usklajevanje zakonodaje
S tem protokolom Republika Slovenija soglaša, da bo po posvetu s Komisijo Evropskih skupnosti sprejela potrebne ukrepe za vzdrževanje prevzema ali dokončni prevzem prava Skupnosti, zlasti na področjih standardizacije, meroslovja, akreditacije, ugotavljanja skladnosti, nadzora na trgu, splošne varnosti izdelkov in odgovornosti proizvajalca.
4. ČLEN
Medsebojno prevzemanje industrijskih izdelkov
Pogodbenici soglašata, da se lahko za medsebojno prevzemanje industrijski izdelki, navedeni v prilogah o medsebojnem prevzemanju industrijskih izdelkov, ki izpolnjujejo zahteve za zakonito dajanje na trg v eni pogodbenici, dajejo na trg v drugi pogodbenici brez nadaljnjih omejitev. To ne vpliva na obveznosti iz 36. člena Evropskega sporazuma.
5. ČLEN
Medsebojno priznavanje rezultatov postopkov ugotavljanja skladnosti
Pogodbenici soglašata, da bosta priznavali rezultate postopkov ugotavljanja skladnosti, ki so usklajeni s pravom Skupnosti ali notranjim pravom in navedeni v prilogah o medsebojnem priznavanju rezultatov ugotavljanja skladnosti. Za priznavanje tako ugotovljene skladnosti pogodbenici ne bosta zahtevali ponovitve postopkov, niti ne bosta postavljali dodatnih zahtev.
6. ČLEN
Zaščitna klavzula
Če pogodbenica ugotovi, da bi industrijski izdelek, ki je bil na podlagi tega protokola dan na trg na njenem ozemlju in se uporablja v skladu s svojim namenom, lahko ogrozil varnost ali zdravje uporabnikov ali drugih oseb ali kateri koli drugi upravičeni interes, ki je zaščiten z zakonodajo, navedeno v prilogah, lahko sprejme primerne ukrepe za umik takega izdelka s trga, prepoved njegovega dajanja na trg, začetka obratovanja ali uporabe ali za omejitev njegovega prostega pretoka. Postopek, ki se uporabi v takih primerih, se določi v prilogah.
7. ČLEN
Razširitev obsega
Ko Republika Slovenija sprejme in nadalje izvaja notranje pravo, ki prevzema pravo Skupnosti, lahko pogodbenici spremenita priloge ali skleneta nove v skladu s postopkom, določenim v 14. členu.
8. ČLEN
Poreklo
Določbe tega protokola se nanašajo na vse industrijske izdelke ne glede na njihovo poreklo.
9. ČLEN
Obveznosti pogodbenic do njunih organov in organov za ugotavljanje skladnosti
Pogodbenici zagotavljata, da organi v njuni pristojnosti, ki so odgovorni za učinkovito izvajanje prava Skupnosti in notranjega prava, to stalno izvajajo. Nadalje, zagotavljata, da so ti organi po potrebi sposobni priglasiti, začasno preklicati, odpraviti začasni preklic in umakniti priglasitev organov za ugotavljanje skladnosti, zagotavljati skladnost industrijskih izdelkov s pravom Skupnosti ali notranjim pravom ali zahtevati njihov umik s trga.
Pogodbenici zagotavljata, da organi za ugotavljanje skladnosti, ki so v okviru njune pristojnosti priglašeni za ugotavljanje skladnosti z zahtevami prava Skupnosti ali notranjega prava, navedenimi v prilogah, stalno izpolnjujejo zahteve prava Skupnosti ali notranjega prava. Poleg tega pogodbenici ukreneta vse potrebno, da zagotovita, da bodo ti organi za ugotavljanje skladnosti ohranili potrebno usposobljenost za izvajanje nalog, za katere so bili priglašeni.
10. ČLEN
Priglašeni organi za ugotavljanje skladnosti
V začetku bodo za ta protokol priglašeni tisti organi za ugotavljanje skladnosti, ki bodo navedeni na seznamih, ki jih bosta Republika Slovenija in Skupnost izmenjali pred dokončanjem postopkov za njegovo uveljavitev.
Nato pa se bo za priglasitev organov za ugotavljanje skladnosti z zahtevami prava Skupnosti ali notranjega prava, navedenimi v prilogah, uporabljal ta postopek:
(a) pogodbenica v pisni obliki pošlje drugi pogodbenici svojo priglasitev;
(b) organ za ugotavljanje skladnosti se šteje za priglašenega in usposobljenega za ugotavljanje skladnosti z zahtevami, navedenimi v prilogah, od dne pisne potrditve druge pogodbenice.
Če se pogodbenica odloči, da bo umaknila priglasitev organa za ugotavljanje skladnosti, ki je v njeni pristojnosti, mora o tem pisno obvestiti drugo pogodbenico. Tak organ preneha ugotavljati skladnost z zahtevami, navedenimi v prilogah, najpozneje od dneva preklica, vendar pa ostane ugotavljanje skladnosti, ki ga je izvedlo pred tem datumom, veljavno, če Pridružitveni svet ne sklene drugače.
11. ČLEN
Preverjanje priglašenih organov za ugotavljanje skladnosti
Vsaka pogodbenica lahko zahteva, da druga pogodbenica preveri strokovno usposobljenost in primernost priglašenega organa za ugotavljanje skladnosti v njeni pristojnosti. Taka zahteva mora biti utemeljena, da lahko pogodbenica, odgovorna za priglasitev, izvede zahtevano preverjanje in nemudoma poroča drugi pogodbenici. Pogodbenici lahko tudi s sodelovanjem pristojnih organov skupaj preverita organ za ugotavljanje skladnosti. V ta namen zagotovita popolno sodelovanje organov za ugotavljanje skladnosti v svoji pristojnosti. Pogodbenici ukreneta vse potrebno in uporabita vsa razpoložljiva sredstva, ki so potrebna za reševanje ugotovljenih problemov.
Če problemov ni mogoče rešiti v zadovoljstvo obeh pogodbenic, lahko o tem obvestita predsedujočega Pridružitvenega sveta in navedeta razloge za nesoglasja. Pridružitveni svet lahko odloči o primernih ukrepih.
Če in dokler Pridružitveni svet ne sklene drugače, se priglasitev organa za ugotavljanje skladnosti in priznanje njegove usposobljenosti za ugotavljanje skladnosti z zahtevami prava Skupnosti ali notranjega prava, navedenimi v prilogah, na dan, ko pogodbenici obvestita predsedujočega Pridružitvenega sveta o nesoglasju, delno ali v celoti začasno prekliče.
12. ČLEN
Izmenjava informacij in sodelovanje
Da bi zagotovili pravilno in enotno uporabo in razlago tega protokola, pogodbenici, njuni organi in njuni priglašeni organi za ugotavljanje skladnosti:
(a) izmenjujejo vse potrebne informacije v zvezi z izvajanjem prava in ustaljenih postopkov, zlasti s postopkom za zagotavljanje primernosti priglašenih organov za ugotavljanje skladnosti;
(b) po potrebi sodelujejo pri ustreznih mehanizmih obveščanja, usklajevanja in drugih tovrstnih dejavnostih pogodbenic;
(c) spodbujajo svoje organe za ugotavljanje skladnosti k sodelovanju, da bi vzpostavili dogovore o medsebojnem priznavanju na prostovoljnem področju.
13. ČLEN
Zaupnost
Predstavniki, strokovnjaki in drugi zastopniki pogodbenic tudi po prenehanju svojih dolžnosti ne smejo razkriti informacij, pridobljenih po tem protokolu, za katere velja poklicna molčečnost. Te informacije se ne smejo uporabljati za druge namene, kot jih predvideva ta protokol.
14. ČLEN
Izvajanje protokola
Pridružitveni svet je odgovoren za učinkovito izvajanje tega protokola v skladu s 110. členom Evropskega sporazuma. Še zlasti je pooblaščen za sprejemanje odločitev o:
(a) spreminjanju prilog;
(b) dodajanju novih prilog;
(c) imenovanju skupine ali skupin strokovnjakov za preverjanje strokovne usposobljenosti priglašenega organa za ugotavljanje skladnosti in njegovega izpolnjevanja zahtev;
(d) izmenjavi informacij o predlaganih in veljavnih spremembah prava Skupnosti in notranjega prava, ki so navedene v prilogah;
(e) obravnavanju novih ali dodatnih postopkov ugotavljanja skladnosti za področje iz posamezne priloge;
(f) reševanju morebitnih vprašanj v zvezi z uporabo tega protokola.
Pridružitveni svet lahko v skladu z drugim odstavkom 114. člena Evropskega sporazuma prenese odgovornosti, ki so zajete v tem protokolu.
15. ČLEN
Strokovno sodelovanje in pomoč
Evropska skupnost lahko Republiki Sloveniji zagotovi strokovno sodelovanje in pomoč, če sta potrebna za zagotavljanje učinkovitega izvajanja in uporabo tega protokola.
16. ČLEN
Sporazumi z drugimi državami
Sporazumi o ugotavljanju skladnosti, ki jih pogodbenica sklene z državo, ki ni pogodbenica tega protokola, za drugo pogodbenico ne pomenijo obveznosti, da sprejme rezultate postopkov ugotavljanja skladnosti, ki se izvajajo v tej tretji državi, če ni v Pridružitvenem svetu dosežen izrecni dogovor med pogodbenicama.
17. ČLEN
Začetek veljavnosti
Ta protokol začne veljati prvi dan drugega meseca po dnevu, ko sta pogodbenici izmenjali diplomatski noti, s katerima potrjujeta, da so bili končani postopki za začetek veljavnosti tega protokola.
18. ČLEN
Status protokola
Ta protokol je sestavni del Evropskega sporazuma.
Protokol je sestavljen v dveh izvirnikih v slovenskem, angleškem, danskem, finskem, francoskem, grškem, italijanskem, nemškem, nizozemskem, portugalskem, španskem in švedskem jeziku, pri čemer so vsa besedila enako verodostojna.
Sestavljeno v Bruslju, šestindvajsetega novembra dvatisočdva.

P R O T O C O L
TO THE EUROPE AGREEMENT ESTABLISHING AN ASSOCIATION BETWEEN THE EUROPEAN COMMUNITIES AND THEIR MEMBER STATES, OF THE ONE PART, AND THE REPUBLIC OF SLOVENIA, OF THE OTHER PART, ON CONFORMITY ASSESSMENT AND ACCEPTANCE OF INDUSTRIAL PRODUCTS (PECA)
THE EUROPEAN COMMUNITY AND THE REPUBLIC OF SLOVENIA,
hereinafter referred to as “the Parties“,
WHEREAS the Republic of Slovenia has applied for membership of the European Union and such membership implies the effective implementation of the acquis of the European Community,
RECOGNISING that the progressive adoption and implementation of Community law by the Republic of Slovenia provides the opportunity to extend certain benefits of the internal market and to ensure its effective operation in certain sectors before accession,
CONSIDERING that, in the sectors covered by this Protocol, Slovenian national law substantially takes over Community law,
CONSIDERING their shared commitment to the principles of free movement of goods and to promoting product quality, so as to ensure the health and safety of their citizens and the protection of the environment, including through technical assistance and other forms of cooperation between them,
DESIRING to conclude a Protocol to the Europe Agreement on Conformity Assessment and Acceptance of Industrial Products (hereafter referred to as “this Protocol“) providing for the application of the mutual acceptance of industrial products which fulfil the requirements for being lawfully placed on the market in one of the Parties and of the mutual recognition of the results of conformity assessment of industrial products which are subject to Community or national law, noting that Article 76 of the Europe Agreement provides, where appropriate, for the conclusion of an agreement on mutual recognition,
NOTING the close relationship between the European Community and Iceland, Liechtenstein and Norway through the Agreement on the European Economic Area, which makes it appropriate to consider the conclusion of a parallel European Conformity Assessment Agreement between the Republic of Slovenia and these countries equivalent to this Protocol,
BEARING IN MIND the Parties’ status as Contracting Parties to the Agreement establishing the World Trade Organisation, and conscious in particular of their obligations under the World Trade Organisation Agreement on Technical Barriers to Trade,
HAVE AGREED AS FOLLOWS:
ARTICLE 1
Purpose
The purpose of this Protocol is to facilitate the elimination by the Parties of technical barriers to trade in respect of industrial products. The means to this end is the progressive adoption and implementation by the Republic of Slovenia of national law, which is equivalent to Community law.
This Protocol provides for:
(a) the mutual acceptance of industrial products, listed in the Annexes on mutual acceptance of industrial products, which fulfil the requirements for being lawfully placed on the market in one of the Parties;
(b) the mutual recognition of the results of conformity assessment of industrial products subject to Community law and to the equivalent Slovenian national law, both listed in the Annexes on mutual recognition of results of conformity assessment.
ARTICLE 2
Definitions
For the purpose of this Protocol,
(a) “industrial products“ means products, as specified in Article 9 of the Europe Agreement and in Protocol 2 thereto;
(b) “Community law“ means any legal act and implementing practice of the European Community applicable to a particular situation, risk or category of industrial products, as interpreted by the Court of Justice of the European Communities;
(c) “national law“ means any legal act and implementing practice by which the Republic of Slovenia takes over Community law applicable to a particular situation, risk or category of industrial products.
The terms used in this Protocol shall have the meaning given in Community law and Slovenian national law.
ARTICLE 3
Alignment of legislation
For the purpose of this Protocol, the Republic of Slovenia agrees to take appropriate measures, in consultation with the Commission of the European Communities, to maintain or complete the take-over of Community law, in particular in the fields of standardisation, metrology, accreditation, conformity assessment, market surveillance, general safety of products and producer liability.
ARTICLE 4
Mutual acceptance of industrial products
The Parties agree that, for the purpose of mutual acceptance, industrial products listed in the annexes on mutual acceptance of industrial products, which fulfil the requirements for being lawfully placed on the market of a Party, may be placed on the market of the other Party, without further restriction. This shall be without prejudice to Article 36 of the Europe Agreement.
ARTICLE 5
Mutual recognition of the results of conformity assessment procedures
The Parties agree to recognise the results of conformity assessment procedures carried out in accordance with the Community or national law listed in the Annexes on mutual recognition of the results of conformity assessment. The Parties shall not require procedures to be repeated, nor shall they impose additional requirements, for the purposes of accepting that conformity.
ARTICLE 6
Safeguard clause
Where a Party finds that an industrial product placed on the market on its territory by virtue of this Protocol, and used in accordance with its intended use, may compromise the safety or health of users or other persons, or any other legitimate concern protected by legislation identified in the Annexes, it may take appropriate measures to withdraw such a product from the market, to prohibit its placing on the market, putting into service or use or to restrict its free movement. The Annexes shall provide for the procedure to be applied in such cases.
ARTICLE 7
Extension of coverage
As the Republic of Slovenia adopts and implements further national law taking over Community law, the Parties may amend the Annexes or conclude new ones, in accordance with the procedure laid down in Article 14.
ARTICLE 8
Origin
The provisions of this Protocol shall apply to industrial products irrespective of their origin.
ARTICLE 9
Obligations of Parties as regards their authorities and bodies
The Parties shall ensure that authorities under their jurisdiction which are responsible for the effective implementation of Community and national law shall continuously apply it. Further, they shall ensure that these authorities are able, where appropriate, to notify, suspend, remove suspension and withdraw notification of bodies, to ensure the conformity of industrial products with Community or national law or to require their withdrawal from the market.
The Parties shall ensure that bodies, notified under their respective jurisdiction to assess conformity in relation to requirements of Community or national law specified in the Annexes, continuously comply with the requirements of Community or national law. Further, they shall take all necessary steps to ensure that these bodies maintain the necessary competence to carry out the tasks for which they are notified.
ARTICLE 10
Notified bodies
Initially, the bodies notified for the purpose of this Protocol shall be those included in the lists which the Republic of Slovenia and the Community have exchanged before the completion of the procedures for entry into force
Afterwards, the following procedure shall apply for the notification of bodies to assess conformity in relation to the requirements of Community or national law specified in the Annexes:
(a) a Party shall forward its notification to the other Party in writing;
(b) on the acknowledgement of the other Party, given in writing, the body shall be considered as notified and as competent to assess conformity in relation to the said requirements specified in the Annexes from that date;
If a Party decides to withdraw the notification of a body under its jurisdiction, it shall inform the other Party in writing. The body will cease to assess conformity in relation to the said requirements specified in the Annexes from the date of its withdrawal at the latest. Nevertheless, conformity assessment carried out before that date shall remain valid, unless otherwise decided by the Association Council.
ARTICLE 11
Verification of notified bodies
Each Party may request the other Party to verify the technical competence and compliance of a notified body under its jurisdiction. Such request shall be justified in order to allow the Party responsible for the notification to carry out the requested verification and report speedily to the other Party. The Parties may also jointly examine the body, with the participation of the relevant authorities. To this end, the Parties shall ensure the full cooperation of bodies under their jurisdiction. The Parties shall take all appropriate steps, and use whatever available means may be necessary, with a view to resolving any problems which are detected.
If the problems cannot be resolved to the satisfaction of both Parties, they may notify the Chairman of the Association Council of their disagreement, giving their reasons. The Association Council may decide on appropriate action.
Unless and until decided otherwise by the Association Council, the notification of the body and the recognition of its competence to assess conformity in relation to the requirements of Community or national law specified in the Annexes shall be suspended in part or totally from the date on which the disagreement of the Parties has been notified to the Chairman of the Association Council.
ARTICLE 12
Exchange of information and cooperation
In order to ensure a correct and uniform application and interpretation of this Protocol, the Parties, their authorities and their notified bodies shall:
(a) exchange all relevant information concerning implementation of law and practice including, in particular, on procedure to ensure compliance of notified bodies;
(b) take part, as appropriate, in the relevant mechanisms of information, coordination and other related activities of the Parties;
(c) encourage their bodies to cooperate with a view to establishing mutual recognition arrangements in the voluntary sphere.
ARTICLE 13
Confidentiality
Representatives, experts and other agents of the Parties shall be required, even after their duties have ceased, not to disclose information acquired under this Protocol which is of the kind covered by the obligation of professional secrecy. This information may not be used for purposes other than those envisaged by this Protocol.
ARTICLE 14
Management of the Protocol
Responsibility for the effective functioning of this Protocol shall be borne by the Association Council in accordance with Article 110 of the Europe Agreement. In particular, it shall have the power to take decisions regarding:
(a) amending the Annexes;
(b) adding new Annexes;
(c) appointing a joint team or teams of experts to verify the technical competence of a notified body and its compliance with the requirements;
(d) exchanging information on proposed and actual amendments to the Community and national law referred to in the Annexes;
(e) considering new or additional conformity assessment procedures affecting a sector covered by an Annex;
(f) resolving any questions relating to the application of this Protocol.
The Association Council may delegate the above responsibilities set out under this Protocol, in accordance with Article 114(2) of the Europe Agreement.
ARTICLE 15
Technical cooperation and assistance
The European Community may provide technical cooperation and assistance to the Republic of Slovenia where necessary in order to support the effective implementation and application of this Protocol.
ARTICLE 16
Agreements with other countries
Agreements on conformity assessment concluded by either Party with a country which is not a Party to this Protocol shall not entail an obligation upon the other Party to accept the results of conformity assessment procedures carried out in that third country, unless there is an explicit agreement between the Parties in the Association Council.
ARTICLE 17
Entry into force
This Protocol shall enter into force on the first day of the second month following the date on which the Parties have exchanged diplomatic notes confirming the completion of their respective procedures for entry into force of this Protocol.
ARTICLE 18
Status of the Protocol
This Protocol shall constitute an integral part of the Europe Agreement.
This Protocol is drawn up in two originals in the Danish, Dutch, English, Finnish, French, German, Greek, Italian, Portuguese, Spanish, Swedish and Slovenian languages, each text being equally authentic.
Done at Brussels on twenty-sixth day of November in the year two thousand and two.
