O RATIFIKACIJI SPORAZUMA O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO
1. člen
Ratificira se Sporazum o znanstvenem in tehnološkem sodelovanju med Republiko Slovenijo in Portugalsko republiko, podpisan dne 6. junija 2001 v Ljubljani.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED REPUBLIKO SLOVENIJO IN PORTUGALSKO REPUBLIKO
Republika Slovenija in Portugalska republika (v nadaljnjem besedilu pogodbenici), sta se v želji, da bi okrepili prijateljske odnose med državama in spodbudili razvoj sodelovanja na področju znanosti in tehnologije,
ob spoznanju pomena znanosti in tehnologije za državi
dogovorili, kot sledi:
1. člen
Pogodbenici v skladu s svojo zakonodajo in predpisi spodbujata sodelovanje na področju znanosti in tehnologije med državama po načelu enakosti in v medsebojno korist.
2. člen
Sodelovanje po tem sporazumu ima naslednje oblike:
1. izmenjava znanstvenikov, raziskovalcev, tehničnega osebja in strokovnjakov;
2. izmenjava dokumentov in informacij znanstvene in tehnološke narave;
3. skupna organizacija znanstvenih in tehnoloških seminarjev, simpozijev, konferenc in drugih srečanj;
4. skupno raziskovanje in razvoj področij, ki so v skupnem interesu, kot tudi izmenjava izsledkov raziskav in
5. druge oblike znanstvenega in tehnološkega sodelovanja, o katerih se pogodbenici lahko dogovorita.
3. člen
1. Z namenom, da bi olajšali znanstveno in tehnološko sodelovanje, pogodbenici, če je to potrebno, spodbujata sklepanje dodatnih dogovorov o izvajanju dejavnosti sodelovanja med svojimi vladnimi agencijami, raziskovalnimi inštituti, univerzami in drugimi ustreznimi ustanovami v okviru tega sporazuma. Taki dogovori se sklepajo v skladu z zakoni in predpisi, ki veljajo v eni in drugi državi.
2. Dogovori, navedeni v prvem odstavku tega člena, vključujejo določila, pogoje in postopke, ki se pri posameznih dejavnostih sodelovanja in drugih ustreznih zadevah morajo upoštevati.
4. člen
1. Da bi zagotovili kar najboljše pogoje za uporabo tega sporazuma, pogodbenici ustanovita skupni odbor za znanstveno in tehnološko sodelovanje, katere člani so predstavniki, ki jih imenujeta vladi.
2. Naloge skupnega odbora so:
A) pregled napredovanja dejavnosti sodelovanja po tem sporazumu;
B) opredelitev novih področij sodelovanja po tem sporazumu;
C) razprava o drugih zadevah, povezanih s tem sporazumom.
3. Skupni odbor se, če ni dogovorjeno drugače, sestaja vsaki 2 (dve) leti, in to ob vzajemno dogovorjenih datumih ter izmenično v Sloveniji in na Portugalskem.
5. člen
1. Pogodbenici krijeta stroške, nastale v zvezi z dejavnostmi sodelovanja po tem sporazumu, po načelu enakopravnosti in vzajemnosti ter v skladu z razpoložljivimi viri sredstev.
2. Stroški izmenjave znanstvenikov, raziskovalcev, tehničnega osebja, strokovnjakov in drugih izvedencev, izhajajoči iz tega sporazuma, se plačujejo takole:
a) pogodbenica pošiljateljica krije stroške potovanja med glavnima mestoma ene in druge države;
b) pogodbenica gostiteljica krije stroške prevozov po svojem ozemlju in stroške bivanja, t. j. hotelske nastanitve in dnevnic, v skladu s predpisi ene in druge države.
6. člen
1. Celotno dvostransko sodelovanje po tem sporazumu se podreja ustreznim zakonom in predpisom, ki veljajo v eni in drugi državi.
2. Pogodbenici zagotavljata ustrezno in učinkovito varstvo intelektualne lastnine, pridobljene na podlagi tega sporazuma.
7. člen
Organa, odgovorna za uresničevanje določb tega sporazuma, sta Ministrstvo za šolstvo, znanost in šport Republike Slovenije in Inštitut za mednarodno znanstveno in tehnološko sodelovanje (ICCTI) Portugalske republike.
8. člen
1. Ta sporazum začne veljati, ko si pogodbenici izmenjata noti o tem, da so izpolnjene zahteve, ki jih v eni in drugi državi narekuje notranji postopek za začetek veljavnosti tega sporazuma.
2. Ta sporazum velja za petletno obdobje in po poteku tega obdobja, če katera od pogodbenic vsaj šest mesecev prej pisno ne sporoči, da ga namerava odpovedati, velja za nadaljnja petletna obdobja.
3. Ta sporazum se lahko spremeni s skupnim soglasjem. Sprememba ali prenehanje tega sporazuma se začne izvajati brez vpliva na pravice ali obveznosti, ki iz tega sporazuma izhajajo ali so v zvezi z njim nastale pred datumom učinkovanja take spremembe ali prenehanja.
Sestavljeno v Ljubljani dne 6. junija 2001 v dveh izvodih v slovenskem, portugalskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob različni razlagi prevlada angleško besedilo.

A G R E E M E N T
ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE REPUBLIC OF SLOVENIA AND THE PORTUGUESE REPUBLIC
The Republic of Slovenia and the Portuguese Republic (hereinafter referred to as “The Parties“) desirous of strengthening friendly relationship between the two countries and promoting the development of co-operation in science and technology;
Recognizing the importance of science and technology in the national economies of both countries;
Have agreed as follows:
ARTICLE 1
The Parties shall promote, in accordance with their respective laws and regulations, the co-operation in the fields of science and technology between the two countries on the basis of equality and mutual benefit.
ARTICLE 2
The co-operation under this Agreement shall include the following forms:
1. exchange of scientists, researchers, technical personnel and experts;
2. exchange of documents and information of scientific and technological nature;
3. joint organisation of scientific and technological seminars, symposia, conferences and other meetings;
4. implementation of joint research and development on subjects of mutual interest, as well as exchange of its results; and
5. any other forms of scientific and technological co-operation as may be agreed upon by the Parties.
ARTICLE 3
1. With a view to facilitating scientific and technological co-operation, the Parties shall encourage, if necessary, the conclusion of supplementing arrangements to carry out co-operative activities between their government agencies, research institutes, universities and other relevant institutions which shall be within the framework of this Agreement. Such arrangements shall be concluded in accordance with the laws and regulations in force in their respective countries.
2. The arrangements mentioned in paragraph 1 of this Article shall include the terms, conditions and procedures to be followed in particular co-operative activities and other relevant matters.
ARTICLE 4
1. In order to ensure optimum conditions for the application of this Agreement, the Parties shall establish a Joint Committee on Scientific and Technological Co-operation which shall consist of representatives designated by the two Governments.
2. The tasks of the Joint Committee shall be:
(A) review the progress in co-operative activities under this Agreement;
(B) define new areas of co-operation under this Agreement; and
(C) discuss on other matters related to this Agreement.
3. The Joint Commission shall meet once every 2 (two) years, unless otherwise agreed, alternatively in Slovenia and in Portugal on mutually agreed dates.
ARTICLE 5
1. The Parties shall bear the expenses incurred in connection with the co-operative activities under this Agreement on the basis of the principle of equality and reciprocity and in accordance with the availability of resources.
2. The costs of the exchange of scientists, researchers, technical personnel, experts and other specialists, resulting from the present Agreement, unless agreed upon separately, will be covered on the following basis:
a) the sending Party will cover the round/trip transportation costs between the capitals of the two countries,
b) the receiving Party will cover the costs of trips within its territory and full accommodation, i.e. hotel and daily allowance, according to the regulations of each country.
ARTICLE 6
1. All bilateral co-operation developed under this Agreement shall be subject to the applicable laws and regulations in force in their respective countries.
2. The Parties shall ensure appropriate and efficient protection of intellectual property, obtained on the basis of this Agreement.
ARTICLE 7
The responsible bodies for the implementation of the provisions of the present Agreement are the Ministry of Education, Science and Sport of the Republic of Slovenia and the Institute for International Co-operation in S&T (ICCTI) of the Ministry of Science and Technology of the Portuguese Republic.
ARTICLE 8
1. This Agreement shall enter into force after the Parties have exchanged notes on completion of the requirements of their internal procedure for its entry into force.
2. This Agreement shall remain in force for a period of five years and shall continue to remain in force thereafter, for successive periods of five years, unless one of the Parties gives notice in writing, at least six month in advance, of its intentions to terminate this Agreement.
3. This Agreement may be revised by mutual consent. Any revision or termination of this Agreement shall be effected without prejudice to any right or obligation accruing or incurred under this Agreement prior to the effective date of such revision or termination.
Done in Ljubljana, on 6 June 2001 in the Slovene, Portuguese and English languages, in two copies each, all texts being equally authentic. In case of any divergence in interpretation the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za šolstvo, znanost in šport.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
