O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ESTONIJE O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI, PSIHOTROPNIMI SNOVMI IN PREDHODNIMI SESTAVINAMI IN TERORIZMU (BEEBOK)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Republike Estonije o sodelovanju v boju proti organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami in terorizmu (BEEBOK), ki ga je sprejel Državni zbor Republike Slovenije na seji 19. decembra 2003.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE ESTONIJE O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI, PSIHOTROPNIMI SNOVMI IN PREDHODNIMI SESTAVINAMI IN TERORIZMU (BEEBOK)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Estonije o sodelovanju v boju proti organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami in terorizmu, podpisan v Talinu 29. junija 2002.
2. člen
Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*

O SODELOVANJU V BOJU PROTI ORGANIZIRANEMU KRIMINALU, NEZAKONITI TRGOVINI S PREPOVEDANIMI DROGAMI, PSIHOTROPNIMI SNOVMI IN PREDHODNIMI SESTAVINAMI IN TERORIZMU
Vlada Republike Slovenije in Vlada Republike Estonije (v nadaljevanju pogodbenici)
sta se v želji, da prispevata k razvoju dvostranskih stikov,
sodelujeta v boju proti kriminalu, še posebno organiziranemu kriminalu, nezakoniti trgovini s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami in terorizmu,
okrepita skupna prizadevanja v boju proti terorizmu in zlorabi prepovedanih drog,
uskladita svoje ukrepe proti mednarodnemu organiziranemu kriminalu,
sporazumeli:
1. člen
(1) Pogodbenici v skladu s svojim notranjim pravom sodelujeta pri preprečevanju terorizma, nezakonite trgovine s prepovedanimi drogami, psihotropnimi snovmi in predhodnimi sestavinami in organiziranega kriminala, odkrivanju, zatiranju in kazensko-sodnem pregonu teh oblik kriminala kot tudi pri preprečevanju, odkrivanju, zatiranju in kazensko-sodnem pregonu drugih oblik kriminala.
(2) Pogodbenici sodelujeta posebej v primerih, ko so kazniva dejanja storjena ali potekajo priprave nanje na ozemlju ene od pogodbenic, podatki pa kažejo, da obstaja verjetnost, da potekajo priprave ali storitev kaznivih dejanj na ozemlju druge pogodbenice.
2. člen
Pogodbenici sodelujeta pri odkrivanju in zatiranju kriminala, zlasti organiziranega kriminala, in pri tem:
a) sporočata druga drugi podatke o osebah, vpletenih v organizirani kriminal, podatke o povezanosti storilcev, informacije o organizacijah in skupinah kriminalcev, značilnem vedenju storilcev in skupin, dejstva, posebej čas, kraj in način storitve kaznivih dejanj, informacije o objektih napada, posebnih okoliščinah, kazenskih predpisih, ki so bili kršeni, in ukrepih, ki so bili izvedeni;
b) na zaprosilo izvajata policijske ukrepe, ki so v skladu z notranjim pravom zaprošene pogodbenice;
c) v skladu s tem sporazumom in notranjim pravom pogodbenic sodelujeta v preiskavah z usklajenimi policijskimi ukrepi, vključno z vzajemno pomočjo v osebju, tehnični opremi in organizaciji;
d) izmenjavata podatke in izkušnje o metodah in novih oblikah, ki jih uporabljajo storilci kaznivih dejanj v mednarodnem kriminalu;
e) izmenjavata izsledke forenzičnih in kriminalističnih preiskav ter strokovno znanje, izsledke kriminalističnih in drugih študij na področju kriminalitete, se medsebojno obveščata o praksi preiskovanja dejanj in uporabi metod in sredstev dela;
f) na zaprosilo izmenjavata pisno gradivo, vzorce uradnih dokumentov in predmetov, ki so bili uporabljeni pri storitvi ali izvirajo iz kaznivega dejanja;
g) izmenjavata strokovnjake za skupno ali vzajemno izboljšanje kakovosti dela kot del boja proti organiziranemu kriminalu, zagotavljata študijske možnosti svojim strokovnjakom za pridobitev višje stopnje strokovnega znanja, za vzajemno spoznavanje sredstev in metod boja proti kriminalu in sodobnih dosežkov policijske tehnike;
h) po potrebi in pri določenih preiskavah organizirata delovna srečanja v zvezi s pripravami in izvajanjem usklajenih ukrepov.
3. člen
Za preprečevanje nezakonitega gojenja, proizvodnje, izvoza, uvoza in tranzita prepovedanih drog, psihotropnih snovi in predhodnih sestavin (v nadaljevanju prepovedanih drog) kakor tudi nezakonite trgovine s temi snovmi si pogodbenici v skladu s svojim notranjim pravom:
a) vzajemno sporočata vse informacije o osebah, vpletenih v proizvodnjo prepovedanih drog in trgovino z njimi, skrivališčih prepovedanih drog, načinih transporta in storitve kaznivih dejanj, krajih izvora prepovedanih drog in kam so namenjene, vključno z vsemi drugimi posebnostmi o teh kaznivih dejanjih;
b) izmenjavata informacije o običajnih in novih načinih nezakonite mednarodne trgovine s prepovedanimi drogami in vse druge informacije v zvezi s tem;
c) izmenjavata izsledke forenzičnih in kriminalističnih preiskav na področju nezakonite trgovine s prepovedanimi drogami in zlorabe prepovedanih drog;
d) izmenjavata vzorce novih prepovedanih drog;
e) izmenjavata izkušnje v zvezi z nadzorom nad zakonitim prometom z dovoljenimi drogami glede na možnosti nezakonite trgovine s temi snovmi;
f) uskladita policijske ukrepe v skladu z notranjim pravom pogodbenic.
4. člen
Zaradi preprečevanja terorizma in boja proti njemu si pogodbenici v skladu z notranjim pravom in s tem sporazumom:
a) izmenjavata spoznanja in podatke načrtovanih ali storjenih terorističnih dejanjih, vpletenih osebah in skupinah, načinih izvedbe in tehničnih sredstvih, uporabljenih za taka dejanja;
b) izmenjavata spoznanja in podatke o terorističnih skupinah, njihovih članih, ki načrtujejo, izvajajo oziroma so izvedli svoja dejanja na ozemlju ene od pogodbenic na njeno škodo, proti njenim interesom, če so potrebni za preprečevanje terorizma ali hudih kaznivih dejanj in boj proti njim, kot je opredeljeno v Evropski konvenciji o zatiranju terorizma (Strasbourg, 27. januar 1977).
5. člen
Sodelovanje med pogodbenicama zajema tudi:
a) izmenjavo informacij o pravni ureditvi v zvezi s kaznivimi dejanji, ki so predmet sodelovanja po tem sporazumu;
b) izmenjavo informacij o koristih, ki si jih je kdo pridobil s kriminalno dejavnostjo;
c) izmenjavo informacij, pomembnih za eno od pogodbenic v boju proti trgovini z ljudmi, kakor tudi izmenjavo predpisov, informacij in izkušenj v zvezi s tujci in migracijami.
6. člen
(1) Za izvajanje določb tega sporazuma pogodbenici določita svoje pristojne organe, ki bodo natančno opredeljeni po diplomatski poti, in jih pravilno pooblastita za neposredno in operativno sodelovanje v skladu z njihovimi pristojnostmi.
(2) Informacije med predstavniki pristojnih organov se izmenjavajo v angleškem jeziku, če ni drugače dogovorjeno.
7. člen
(1) Za varovanje osebnih podatkov, izmenjanih pri sodelovanju, pristojni organi pogodbenic uporabljajo svoje notranje pravo, Konvencijo o varstvu posameznikov glede na avtomatsko obdelavo podatkov (Strasbourg, 28. januar 1981) in Priporočilo št. 87-(15) Ministrskega sveta Sveta Evrope državam članicam, ki ureja varovanje osebnih podatkov v policiji (Strasbourg, 17. september 1987).
(2) Pogodbenici si izmenjata predpise o varovanju osebnih podatkov po diplomatski poti.
8. člen
(1) Pogodbenici jamčita za zaupnost vseh sporočenih podatkov, ki jih je ena od pogodbenic v skladu s svojim notranjim pravom določila kot zaupne.
(2) Gradivo, podatke in tehnično opremo, prejeto v skladu s tem sporazumom, je mogoče izročiti tretji državi le ob pisnem pristanku pristojnega organa pogodbenice, ki jih pošilja.
9. člen
(1) Za izvajanje in vrednotenje sodelovanja po tem sporazumu pogodbenici ustanovita mešano komisijo. O sestavi mešane komisije se pogodbenici vzajemno obvestita po diplomatski poti.
(2) Mešana komisija se sestane po potrebi in na predhodno določen datum izmenično v Republiki Sloveniji, Republiki Estoniji ali v tretji državi.
10. člen
Vsaka pogodbenica lahko v celoti ali delno odkloni svoje sodelovanje in podporo ali postavi določene pogoje zanju, če njeno notranje pravo to sodelovanje ali podporo omejuje ali če je s tem ogrožena njena varnost ali drugi temeljni interesi.
11. člen
Vsaka pogodbenica določi svojo osebo za zvezo, ki bo imela stike s pristojnimi organi druge pogodbenice.
12. člen
Določbe tega sporazuma ne vplivajo na druge dvostranske ali večstranske sporazume, ki zavezujejo pogodbenici.
13. člen
(1) Ta sporazum začne veljati na dan prejema zadnjega od uradnih obvestil, s katerima se pogodbenici obvestita, da so izpolnjene vse notranjepravne zahteve za začetek njegove veljavnosti.
(2) Sporazum je sklenjen za nedoločen čas. Vsaka pogodbenica ga lahko odpove po diplomatski poti. Odpoved začne veljati po šestih mesecih od dneva prejema uradnega obvestila o odpovedi.
Sestavljeno v Talinu dne 29. 6. 2002 v dveh izvirnikih v slovenskem, estonskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA
AND THE GOVERNMENT OF THE REPUBLIC OF ESTONIA
ON CO-OPERATION IN THE FIGHT AGAINST ORGANISED CRIME, ILLICIT DRUGS, PSYCHOTROPIC SUBSTANCES AND PRECURSORS TRAFFICKING AND TERRORISM
The Government of the Republic of Slovenia and the Government of the Republic of Estonia (hereinafter referred to as the Contracting Parties)
with the desire to contribute to the development of bilateral contacts,
to co-operate in the fight against crime, especially organised crime, against illicit drugs, psychotropic substances and percursors trafficking and against terrorism,
to increase their joint efforts in the fight against terrorism and drug abuse,
to harmonise their actions against international organised crime,
have agreed as follows:
Article 1
(1) The Contracting Parties shall, subject to their national law, co-operate in the prevention of terrorism, illicit drugs, psychotropic substances and precursors trafficking and organised crime in the detection, oppression and persecution of such forms of crime as well as in the prevention, detection, oppression and prosecution of other forms of crime.
(2) The Contracting Parties shall co-operate particularly in cases where criminal offences or preparations thereof are committed in the territory of one of the Contracting Parties and the information indicates a possibility of preparing or committing the same on the territory of the other Contracting Party.
Article 2
The Contracting Parties shall co-operate in the detection and suppression of crime, especially organised crime and shall:
a) notify each other about all the data on persons involved in organised crime, data on connections between criminals, information about organisations and groups of criminals, of typical behaviour of perpetrators and groups, of facts, with special attention to the time, place and modus operandi of criminal deeds, of objects of criminal attack, of special circumstances, of the provisions of the penal codes which were thus violated and of the measures taken;
b) perform certain police activities upon request and in accordance with the national law of the requested Contracting Party;
c) co-operate in investigations in accordance with the present Agreement and the national law of the Contracting Parties, with co-ordinated police measures, including mutual assistance in personnel, technical equipment and organisation;
d) exchange the information and experience concerning methods and new forms used by criminals in international crime;
e) exchange the results of forensic and criminalistic investigations and expertise, criminological and other studies of crime, inform each other of their own investigative practice, as well as of the methods and means of their work;
f) exchange, upon request, written materials, samples of official documents and objects used in the perpetration of or deriving from criminal offences;
g) exchange the experts for common or mutual improving of the quality of work as a part of the fight against organised crime, to enable the possibilities for further education of their experts in order to obtain a higher degree of professional knowledge, for a mutual comprehension of means and methods of the fight against crime and of modern results of the police techniques;
h) if necessary and in certain investigations, organise working meetings concerning the preparations and execution of already harmonised measures.
Article 3
For the prevention of the illicit cultivation, production, export, import and transit of drugs, psychotropic substances and precursors (hereinafter referred to as drugs), as well as illegal trafficking of such substances, the Contracting Parties, in accordance with their national law, shall:
a) communicate to each other any information relating to persons involved in drug production and trafficking, to drug hideouts, to transportation means and modus operandi, to places of origin and destination of drugs including any other particular details of such criminal offences;
b) exchange information concerning usual and new ways of illicit international drug trafficking and all other relevant information;
c) exchange the results of forensic and criminalistic investigations of illicit drug trafficking and drug abuse;
d) exchange samples of new drugs;
e) exchange their experience relating to the supervision of legal trading in drugs with regard to possibilities of illegal trafficking in such substances;
f) co-ordinate their police activities in accordance with their national law.
Article 4
In order to prevent and counter terrorism, the Contracting Parties shall in accordance with their national law and subject to the present Agreement:
a) exchange their knowledge and information relating to planned or committed terrorist actions, persons and groups involved, ways of performance and of technical means used in such acts;
b) exchange their knowledge and information about the terrorist groups, their members who plan, execute or have executed their deeds on the territory of one of the Contracting Parties to its detriment, against its interest, if such information is useful for preventing and countering of terrorism and violent criminal offences, as defined by the European Convention on the Suppression of Terrorism (Strasbourg, 27 January 1977).
Article 5
The co-operation between the Contracting Parties shall also include:
a) exchange of information regarding the legislation dealing with the fight against criminal offences, subject of co-operation under this Agreement;
b) exchange of information concerning benefits obtained by criminal activity;
c) exchange of any information important to one of the Contracting Parties in the fight against trade and trafficking in human beings, as well as exchange of legislation, information and experience relating to aliens or migration.
Article 6
(1) For the purpose of implementing the provisions of the present Agreement the Contracting Parties shall assign their competent authorities, that shall be specified through diplomatic channels, and duly authorise them to co-operate directly and operatively in accordance with their competencies.
(2) The exchange of information between the competent authorities shall be performed in English, unless otherwise agreed.
Article 7
(1) For the protection of personal data exchanged within their co-operation the competent authorities of the Contracting Parties shall apply their national law, the Convention for the Protection of Persons with regard to the Automatic Processing of Personal Data (Strasbourg, 28 January 1981) and the Recommendation No. 87- (15) of the Council of Ministers of the Council of Europe to the Member States regulating the protection of personal data in the police sector (Strasbourg, 17 September 1987).
(2) The Contracting Parties shall exchange their national laws on the protection of personal data through diplomatic channels.
Article 8
(1) The Contracting Parties shall guarantee the confidentiality of all delivered data determined as confidential by any of the Contracting Parties in accordance with their national law.
(2) The forwarding of materials, data and technical equipment delivered in accordance with the present Agreement to a Third State is possible only upon a written consent of the competent authority of the delivering Contracting Party.
Article 9
(1) The Contracting Parties shall form a Joint Commission for the implementation and evaluation of the co-operation under this Agreement. The Contracting Parties shall inform each other through diplomatic channels of the composition of Joint Commission.
(2) The Joint Commission shall meet when necessary and at predetermined date alternately in the Republic of Slovenia, the Republic of Estonia or in a Third State.
Article 10
Either Contracting Party may deny, in whole or in part, its co-operation and its support or may set certain conditions therefor, if this co-operation or support is restricted by its national law or endangers the security or other essential interests of the Contracting Party.
Article 11
Contracting Parties shall each appoint one person who will keep the contacts with the competent authorities of the other Contracting Party.
Article 12
The provisions of this Agreement shall not affect any bilateral or multilateral agreement binding the Contracting Parties.
Article 13
(1) This Agreement shall enter into force on the date of the receipt of the last notification by which Contracting Parties inform each other of the fulfilment of the internal legal requirements necessary for its entry into force.
(2) This Agreement is concluded for indefinite period of time. Either Contracting Party may terminate the Agreement through diplomatic channels. The termination shall become effective six months following the day the notification of termination was received.
Done in Tallinn on the 29th day of June 2002 in two originals in Slovenian, Estonian and English language, each text being equally authentic. In the case of any divergence of interpretation of the present Agreement, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za notranje zadeve Republike Slovenije.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
