O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN KABINETOM MINISTROV UKRAJINE O POMORSKEM PROMETU (BUKPM)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Kabinetom ministrov Ukrajine o pomorskem prometu (BUKPM), ki ga je sprejel Državni zbor Republike Slovenije na seji 27. februarja 2004.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN KABINETOM MINISTROV UKRAJINE O POMORSKEM PROMETU (BUKPM)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Kabinetom ministrov Ukrajine o pomorskem prometu, podpisan 10. novembra 2003 v Ljubljani.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi:*
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN KABINETOM MINISTROV UKRAJINE O POMORSKEM PROMETU
Vlada Republike Slovenije in Kabinet ministrov Ukrajine (v nadaljevanju pogodbenici)
sta se
– v želji, da bi spodbudila razvoj trgovskih in gospodarskih odnosov med državama,
– z namenom, da bi spodbudila odnose in dosegla tesnejše sodelovanje na področju pomorskega prometa med državama,
– v želji, da bi razvila pomorski promet med državama na podlagi enakosti in vzajemne koristi,
– v želji, da bi prispevala k razvoju mednarodne plovbe na podlagi načel svobodne plovbe,
– sporazumela, kot sledi:
1. člen
Namen tega sporazuma je:
– urediti in razviti odnose med državama na področju pomorskega prometa,
– zagotoviti tesno sodelovanje na področju pomorskega prometa,
– izogibati se dejanjem, ki bi bila škodljiva za normalen razvoj pomorskih dejavnosti.
2. člen
V tem sporazumu:
1. izraz "ladja pogodbenice" pomeni vsako ladjo, ki je registrirana na območju države te pogodbenice in plove pod njeno zastavo v skladu z njenim pravom. Ta izraz pa ne vključuje:
– vojnih ladij,
– javnih ladij, ki se uporabljajo v nekomercialne namene,
– ribiških ladij.
2. Izraz "član posadke" pomeni poveljnika ali katero koli osebo, ki je zaposlena na ladji in na njej opravlja dolžnosti in storitve in katere ime je vključeno na seznam posadke.
3. člen
1. Ta sporazum se uporablja na območju, ki vključuje teritorialno morje Republike Slovenije po eni strani, in na območju, ki vključuje teritorialno morje Ukrajine po drugi strani.
2. Pogodbenica zagotavlja ladjam druge pogodbenice enako obravnavo kot svojim lastnim ladjam glede prostega dostopa do pristanišč, uporabe pristanišč za nakladanje in razkladanje tovora ter vkrcavanje in izkrcavanje potnikov, za opravljanje trgovskih dejavnosti, uporabo vseh navigacijskih storitev kot tudi glede plačila pristaniških pristojbin in pristaniških dajatev.
3. Določbe drugega odstavka tega člena:
a) se ne uporabljajo za pristanišča, ki niso odprta za vstop tujih ladij,
b) se ne uporabljajo za dejavnosti, ki jih vsaka pogodbenica pridrži za svoje organizacije in podjetja, vključno še zlasti z notranjo kabotažo in morskim ribištvom,
c) ne obvezujejo pogodbenice, da priznava ladjam druge pogodbenice oprostitve od zahtev obvezne pilotaže, ki jo priznava svojim lastnim ladjam,
d) se ne uporabljajo za predpise v zvezi z vstopom in bivanjem tujcev.
4. člen
Pogodbenici v skladu s svojo zakonodajo sprejmeta vse možne ukrepe za skrajšanje postanka ladij v svojih pristaniščih in za poenostavitev upravnih, carinskih in sanitarnih postopkov, ki veljajo v teh pristaniščih.
5. člen
1. Listine, ki potrjujejo državno pripadnost ladij, izmeritvena spričevala in druge ladijske listine, ki jih izda ali prizna ena od pogodbenic, prizna tudi druga pogodbenica.
2. Za ladje pogodbenice, ki imajo izmeritvena spričevala, izdana v skladu z Mednarodno konvencijo o izmeritvi ladij iz leta 1969, ni potrebna ponovna izmeritev v pristaniščih druge pogodbenice.
6. člen
1. Pogodbenici priznata osebne dokumente pomorščakov, ki jih izdata pristojna organa druge pogodbenice, in jamčita imetnikom takih dokumentov pravice, ki jih določata Konvencija o olajšavah v mednarodnem pomorskem prometu iz leta 1965 in Konvencija MOD št. 108 o osebnih dokumentih pomorščakov iz leta 1958.
Ta osebna dokumenta sta:
– za slovenske pomorščake – slovenska pomorska knjižica,
– za ukrajinske pomorščake – osebna izkaznica pomorščaka.
Pogodbenici se ob kakršnih koli spremembah pri zgoraj omenjenih osebnih dokumentih medsebojno obvestita po diplomatski poti.
2. Pogodbenici pa si pridržujeta pravico, da zavrneta vstop katere koli osebe z zgoraj navedenima dokumentoma pomorščakov, ki jo štejeta za nezaželeno, na svoje območje.
7. člen
1. Katera koli oseba, ki je imetnica osebnega dokumenta iz 6. člena tega sporazuma, lahko brez vizuma odide na kopno in biva v mejah mesta, v sklopu katerega leži pristanišče postanka, medtem ko se ladja zadržuje v tem pristanišču, če je vključena na seznam ladijske posadke in seznam osebja, ki ju poveljnik ladje izroči pristaniškemu organu. Pri odhodu na kopno in vrnitvi na ladjo se taka oseba ravna po veljavnih predpisih.
2. Katera koli oseba, ki je imetnica osebnega dokumenta, ki ga izda ena od pogodbenic in je omenjen v 6. členu tega sporazuma, ima ne glede na uporabljeno prevozno sredstvo pravico vstopiti na območje druge pogodbenice, zato da se vkrca na svojo ladjo, da je premeščena na drugo ladjo ali da se vrne v svojo državo.
3. V vseh primerih iz drugega odstavka tega člena morajo osebni dokumenti vsebovati vizum druge pogodbenice. Vizum se izda, kakor hitro je mogoče.
4. Kadar se član posadke, ki ima osebni dokument iz 6. člena tega sporazuma, izkrca v pristanišču pogodbenice iz zdravstvenih razlogov ali drugih razlogov, ki jih pristojna organa priznata za veljavne, slednja dasta potrebno dovoljenje, da ta oseba ostane na njenem območju in da se ob morebitnemu zdravljenju v bolnišnici vrne v svojo državo porekla ali odide v drugo pristanišče vkrcanja s katerim koli prevoznim sredstvom.
5. Brez vpliva na določbe 6. in 7. člena tega sporazuma se še naprej uporabljajo določbe, ki na območjih pogodbenic veljajo v zvezi z vstopom, bivanjem in odstranitvijo tujcev.
8. člen
1.Pristojni sodni organi pogodbenic ne smejo sprejeti zahtevkov, ki izhajajo iz pogodbe o opravljanju storitev člana posadke ladje druge pogodbenice, brez soglasja pristojnega diplomatskega ali konzularnega uradnika druge pogodbenice.
2.Če član posadke ladje ene od pogodbenic stori kaznivo dejanje na ladji, medtem ko je ladja v teritorialnih vodah druge pogodbenice, ga pristojni sodni organi druge pogodbenice ne smejo kazensko preganjati brez soglasja pristojnega diplomatskega ali konzularnega uradnika države, pod katere zastavo plove ladja, razen:
a) če posledice kaznivega dejanja segajo na območje druge pogodbenice,
b) če kaznivo dejanje ogroža javni red v tej državi ali njeno varnost,
c) če je po zakonu te pogodbenice kaznivo dejanje hudo kaznivo dejanje,
d) če je kaznivo dejanje storjeno zoper katero koli osebo, ki ni član posadke ladje, in
e) če je kaznivo dejanje povezano z nedovoljeno trgovino z drogami in psihotropnimi snovmi.
3. Določbe drugega odstavka tega člena ne vplivajo na pravico pristojnih sodnih organov vsake pogodbenice do nadzora in preiskave, ki jo imajo v skladu s svojo zakonodajo.
9. člen
1. Če ladja ene od pogodbenic doživi brodolom, nasede, jo vrže na obalo ali se ji zgodi kakšna druga nezgoda ob obali druge pogodbenice, sta ladja in tovor na območju te druge pogodbenice deležna enake obravnave, kot je zagotovljena njenim lastnim ladjam in tovoru.
2. Posadki in potnikom kot tudi ladji sami in njenemu tovoru sta ob vsakem času zagotovljeni zaščita in pomoč v enakem obsegu kot njenim lastnim ladjam.
3. Določbe tega člena ne vplivajo na pravice ene od pogodbenic ali tistih, ki jih ta pogodbenica pooblasti, do ustrezne odškodnine za kakršne koli ukrepe, sprejete za reševanje ladje ali pomoč ladji, posadki, potnikom in tovoru.
4. Če je bila ladja poškodovana, njen tovor in predmeti, ki so bili raztovorjeni ali rešeni s te ladje v primerih, določenih v prvem odstavku tega člena, niso zavezani plačilu carin pod pogojem, da niso dostavljeni za uporabo ali potrošnjo na območju druge pogodbenice.
10. člen
Za izvajanje določb tega sporazuma sta pristojna organa pogodbenic:
za Vlado Republike Slovenije – Ministrstvo za promet,
za Kabinet ministrov Ukrajine – Ministrstvo za promet.
11. člen
Pogodbenici se sporazumeta:
a) da bosta spodbujali udeležbo ladij pogodbenic v dvostranskem pomorskem prometu v skladu s trgovinskimi pogodbami. V ta namen še zlasti spodbujata ustanovitev skupnih pomorskih linij po načelih enakosti in vzajemne koristi;
b) da ne bosta ovirali ladij pogodbenic pri udeležbi pri pomorskem prometu med pristanišči druge pogodbenice in pristanišči tretjih držav.
Določbe tega člena ne omejujejo pravice ladij tretjih držav, da sodelujejo v pomorskem prometu med pristanišči pogodbenic.
12. člen
Pogodbenici si v skladu s svojo notranjo zakonodajo še naprej prizadevata podpirati in razvijati učinkovito sodelovanje med organi in trgovskimi organizacijami, ki delujejo na področju pomorskega prometa v njunih državah. Še zlasti se pogodbenici sporazumeta, da bosta podpirali medsebojna posvetovanja in izmenjavo informacij med ustreznimi ladjarskimi organizacijami in podjetji.
13. člen
Za izvajanje tega sporazuma pristojna organa pogodbenic ustanovita skupno komisijo.
Skupna komisija se sestane na zahtevo katere koli pogodbenice.
Kakršen koli spor, ki izhaja iz razlage uporabe tega sporazuma, rešuje skupna komisija.
Če skupna komisija ne doseže rešitve, se spor rešuje po diplomatski poti.
14. člen
1. Pogodbenici druga drugo po diplomatski poti obvestita o dokončanju postopkov, potrebnih za začetek veljavnosti tega sporazuma.
2. Ta sporazum začne veljati na datum zadnjega od uradnih obvestil, kot je določeno v prejšnjem odstavku, in velja za nedoločen čas.
3. Vsaka pogodbenica lahko odpove ta sporazum z uradnim obvestilom drugi pogodbenici po diplomatski poti.
4. Odpoved začne veljati na dan izteka šestmesečnega obdobja po datumu, na katerega je ena od pogodbenic prejela to uradno obvestilo.
V dokaz tega sta podpisana, ki sta ju za to pravilno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v Ljubljani dne 10. novembra leta 2003 v dveh izvirnikih v slovenskem, ukrajinskem in angleškem jeziku kot enako verodostojnih besedilih. Ob razlikah v razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF
THE REPUBLIC OF SLOVENIA AND
THE CABINET OF MINISTERS OF UKRAINE
ON MERCHANT SHIPPING
The Government of the Republic of Slovenia and the Cabinet of Ministers of Ukraine (hereinafter – the contracting parties)
– Desirous of promoting the development of commercial and economic relations between the two countries,
– Having the intention to promote relations and achieve closer co-operation in the field of maritime transport between the two countries;
– Wishing to develop merchant shipping between the two countries on the basis of equality and mutual benefit,
– Wishing to contribute to the development of international shipping on the basis of the principles of freedom of navigation,
Have agreed as follows:
ARTICLE 1
The purpose of this Agreement is:
– regulation and development of the relations between the two countries in the field of merchant shipping,
– ensuring close co-operation in the field of merchant shipping,
– avoiding actions that would be injurious to the normal development of maritime activities.
ARTICLE 2
In the present Agreement
1. The term "vessel of a Contracting Party" shall mean any vessel registered in the territory of the state of this Contracting Party and carrying its flag in accordance with its law. The term shall not, however, include:
– warships;
– public ships used for non-commercial purposes;
– fishing vessels
2. The term "member of the crew" shall mean the master or any person employed for duties and services on board the vessel and whose name is included into the crew list.
ARTICLE 3
1. The present Agreement applies on the territory, including territorial sea of Ukraine, on the one part, and on the territory including territorial sea of the Republic of Slovenia, on the other part.
2. Either of the Contracting Parties shall ensure for the vessels of the other Contracting Party the same treatment as for its own vessels in respect of free access to ports, use of ports for loading and unloading of cargoes and embarking and disembarking of passengers, performing commercial operations, using all the navigation services as well as in respect of payment of port dues and port taxes.
3.The provisions of Paragraph 2 of this Article:
a) shall not apply to the ports not open for the entry of foreign vessels;
b) shall not apply to the activities reserved by each of the Contracting Parties for their organizations and enterprises including, in particular, national cabotage and sea fishing;
c) shall not oblige a Contracting Party to extend for the vessels of the other Contracting Party exemptions from compulsory pilotage requirements granted to its own vessels;
d) shall not apply to the regulations concerning entry and stay of foreigners.
ARTICLE 4
Contracting Parties shall take in accordance with their legislation all possible steps to reduce the time of stay for ships in their ports and simplify administrative, customs and sanitary formalities in force in those ports.
ARTICLE 5
1. The documents certifying the nationality of vessels, certificates of tonnage and other ship's documents issued or recognized by one of the Contracting Parties shall be recognized by the other Contracting Party.
2. The vessels of each of the Contracting Parties supplied with tonnage certificates issued in accordance with the international Convention on Tonnage Measurement of Ships, 1969, shall not be subject to re-measurement in the ports of the other Contracting Party.
ARTICLE 6
1. The Contracting Parties shall recognize the seafarers' identity documents issued by the competent authorities of the other Contracting Party and shall guarantee for the owners of such documents the rights provided by the Convention on Facilitation of International Maritime Traffic (1965) and the ILO Convention No 108 (1958), concerning seafarers' national identity documents.
These identity documents are;
– for the Slovenian seafarers – Slovenian Seaman's Book.
– for the Ukrainian seafarers – Seaman's identification Card;
Both Contracting Parties shall notify each other through the diplomatic channels in the case of any changes in the above mentioned identity documents.
2. The Contracting Parties shall reserve, however, their right to refuse entry into their territories for any person possessing the seafarers' identity documents mentioned above whom they consider undesirable.
ARTICLE 7
1) Any person holding identity documents referred to in Article 6 of this Agreement may, without a visa, go ashore and stay within the limits of a city in which the port of call is situated while the vessel remains in the said port, provided that they are included into the vessel's crew list and on the list of personnel handed by the master of the vessel to the port authority. Both on going ashore and on returning aboard the vessel, such person shall comply with the regulatory controls.
2) Any person holding the identity documents issued by one of the Contracting Parties and referred to in Article 6 of this Agreement shall be entitled irrespective of the means of transport used, to enter the territory of the other Contracting Party to join their vessel, to be transferred to another vessel or to return to their own country.
3) In all the cases referred to in Paragraph 2 of this Article, identity documents must bear the visa of the other Contracting Party. This visa shall be granted as quickly as possible.
4) Where a crew member holding the identity document referred to in the Article 6 of this Agreement is disembarked at a port of the Contracting Party for health reasons or for other reasons recognized as valid by the Competent Authorities, the latter shall give the necessary authorization, for the person concerned to remain in its territory and in the event of hospitalization, to return to his country of origin or proceed to another port of embarkation by any means of transport.
5) Without prejudice to the provisions of Articles 6 and 7 of this Agreement, the provisions in force in the territories of the Contracting Parties, relating to entry, abode and removal of foreigners, shall remain applicable.
ARTICLE 8
1. The Competent judicial authorities of the Contracting Parties shall not accept claims arising out of a hire service contract as a member of the crew of a vessel of the other Contracting Party, without the consent of the competent diplomatic or consular official of the other Contracting Party.
2. If a member of the crew of a vessel of one of the Contracting Parties commits an offence aboard the vessel while the vessel is in the territorial waters of the other Contracting Party, the competent judicial authorities of the other Contracting Party shall not prosecute him without the consent of the competent diplomatic or consular official of the country whose flag the vessel flies, unless:
a) the consequences of the offence extend to the territory of the other Contracting Party;
b) the offence jeopardizes the public order in that state or its security;
c) the offence under the law of this Contracting Party constitutes a grave crime;
d) the offence is committed against any person other than a member of the crew of the vessel; and
e) the offence is connected with illicit traffic of drugs and psychotropic substances.
3. The provisions of paragraph 2 of this Article do not affect the right of control and inquiry the competent judicial authorities of each of the Contracting Parties have according to their legislation.
ARTICLE 9
1. If a vessel of one of the Contracting Parties suffers ship-wreck, runs aground, is cast ashore or suffers any other accident off the coast of the other Contracting Party, the vessel and the cargo shall enjoy, in the territory of the latter Contracting Party, the same treatment which is secured to its own vessels and cargoes.
2. The crew and passengers as well as the vessel itself and its cargo shall be granted, at any time, protection and assistance to the same extent as in the case with its own vessels.
3. The provisions of this Article do not affect the rights of one of the Contracting Parties or those authorized by such Contracting Party for the corresponding compensation for any actions taken for the salvage of the vessel or any assistance provided to the vessel, the crew, the passengers and the cargo.
4. If a vessel has been damaged, its cargo and items unloaded or saved from this vessel in cases specified in paragraph 1 of the present Article shall not be liable to any custom duties provided that they are not delivered for use or consumption in the territory of the other Contracting Party.
ARTICLE 10
For realizing the terms of the present Agreement, the Competent Authorities of the Contracting Parties are:
– for the Government of the Republic of Slovenia – the Ministry of Transport.
– for the Cabinet of Ministers of Ukraine – the Ministry of Transport;
ARTICLE 11
The Contracting Parties have agreed on the following:
a) to promote participation of the vessels of the both Contracting Parties in the bilateral merchant shipping in accordance with trade contracts. For this purpose they, in particular, shall promote establishing of joint sea lines according to the principles of equality and mutual benefit.
b) not to hinder the vessels of either Contracting Party to participate in the merchant shipping between the ports of the other Contracting Party and the ports of third countries.
The terms, of this Article shall not restrict the right of the vessels of third countries to participate in merchant shipping between the ports of the Contracting Parties.
ARTICLE 12
The Contracting Parties shall continue within their national legislation the efforts supporting and developing efficient co-operation between authorities and commercial organizations operating in the field of merchant shipping in their countries. In particular, the Contracting Parties agree to support mutual consultations and exchange of information between their corresponding shipping organizations and enterprises.
ARTICLE 13
For the purposes of realization of this Agreement the Competent Authorities of the Contracting Parties shall establish a Joint Commission.
Joint Commission shall meet upon request of any Contracting Party.
Any dispute arising from the interpretation of application of this Agreement shall be settled by the Joint Commission.
If the Joint Commission cannot reach any solution, the disagreement shall be settled through the diplomatic channels.
ARTICLE 14
1. The Contracting Parties shall notify one another through the diplomatic channels of the completion of the procedures necessary for this Agreement to enter into force.
2. This Agreement shall enter into force on the date of the last of the two notifications, as set fourth in the previous paragraph, and shall remain in force for an indefinite period.
3. Each Contracting Party can denounce this Agreement by means of official notification to the other Contracting Party through the diplomatic channels
4. The denunciation becomes valid on the date of expiration of a 6 month period after the date such notification was received by one of the Contracting Party.
In witness thereof the undersigned duly empowered by their corresponding Governments, have signed this Agreement.
Done in Ljubljana, on this 10th November in the year 2003 in two originals, both in Slovenian, Ukrainian and English languages, each version being equally authentic. In case of any misinterpretation of this Agreement, the English text shall prevail.

3. člen
Za izvajanje tega sporazuma skrbi Ministrstvo za promet.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
