Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – prečiščeno besedilo) izdaja Vlada Republike Slovenije

Ratificira se Sporazum v obliki izmenjave pisem med Evropsko skupnostjo in Republiko Slovenijo o prehodnem sistemu točk, ki se dodelijo težkim tovornim vozilom, ki vozijo čez Avstrijo v obdobju od 1. januarja 2004 do 30. aprila 2004, sklenjen 18. februarja 2004 v Bruslju.

Besedilo sporazuma se v izvirniku v angleškem jeziku ter v prevodu v slovenskem jeziku glasi:

Sir,
 
I have the honour to inform you that, following negotiations between the delegation of the Republic of Slovenia and the delegation of the European Community, the following has been agreed:
 
1. The transitional points system is applicable to the heavy goods vehicles registered in Slovenia, with a maximum authorised weight of over 7,5 tons, using 6, 7 or 8 points, when these vehicles transit Austria, regardless of whether they are laden or not.
Heavy goods vehicles using more than 8 points are not allowed to transit Austria.
Heavy goods vehicles that require 5 points or less are exempt from this system.
 
2. The number of points allocated to the heavy goods vehicles registered in Slovenia and transiting Austria, from 1 January 2004 until 30 April 2004, is 118.816 points.
 
3. The application modalities and procedures for the management and control of the points are identical to the ones laid down in the agreement in the form of an exchange of letters between the European Community and the Republic of Slovenia concerning the system of ecopoints to be applied to Slovenian transit traffic through Austria as from 1 January 1997.(*1)
The joint committee established by the Agreement between the European Community and the Republic of Slovenia in the field of transport shall adopt, if necessary, further measures concerning the procedures relating to the transitional points system, the distribution of points and the technical issues concerning the application of the present exchange of letters.
 
4. This agreement shall enter into force on the day following the notification of both parties that the internal procedure leading to the conclusion of this Agreement is finished.
It shall be applied on a provisional basis from 1 January 2004.
The Agreement shall expire on 30 April 2004.
I should be obliged if you would confirm the agreement of your Government to the contents of this letter.

V čast mi je, da vas obvestim, da je bilo po pogajanjih med delegacijo Republike Slovenije in delegacijo Evropske skupnosti dogovorjeno naslednje:
 
1. Prehodni sistem točk se uporablja za težka tovorna vozila, registrirana v Sloveniji, z največjo dovoljeno maso več kot 7,5 tone, ki potrebujejo 6, 7 ali 8 točk za tranzit čez Avstrijo ne glede na to, ali so prazna ali natovorjena.
Težkim tovornim vozilom, ki potrebujejo več kot 8 točk, tranzit čez Avstrijo ni dovoljen.
Težka tovorna vozila, ki potrebujejo 5 točk ali manj, so izvzeta iz tega sistema.
2. Število točk, ki so dodeljene težkim tovornim vozilom, ki so registrirana v Sloveniji in tranzitirajo čez Avstrijo, je od 1. januarja 2004 do 30. aprila 2004 118.816 točk.
3. Načini uporabe in postopki za upravljanje točk in nadzor nad njimi so enaki tistim, ki so določeni v Sporazumu v obliki izmenjave pisem med Evropsko skupnostjo in Republiko Slovenijo o sistemu ekotočk, ki se uporablja za slovenski tranzitni promet čez Avstrijo od 1. januarja 1997.(*1)
Skupni odbor, ustanovljen po Sporazumu med Evropsko skupnostjo in Republiko Slovenijo na področju prometa, po potrebi sprejme dodatne ukrepe glede postopkov v zvezi s prehodnim sistemom točk, razdelitve točk in tehničnih vprašanj uporabe te izmenjave pisem.
 
4. Ta sporazum začne veljati na dan, ki sledi uradnemu obvestilu obeh strani, da je končan notranji postopek za sklenitev tega sporazuma.
Uporablja se začasno od 1. januarja 2004.
 
Ta sporazum preneha veljati 30. aprila 2004.
Prosim vas, da potrdite, da se vaša vlada strinja z vsebino tega pisma.

4. Ta sporazum začne veljati na dan, ki sledi uradnemu obvestilu obeh strani, da je končan notranji postopek za sklenitev tega sporazuma.
Uporablja se začasno od 1. januarja 2004.
 
Ta sporazum preneha veljati 30. aprila 2004.
