O RAZGLASITVI ZAKONA O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO ROMUNIJE O SODELOVANJU V ZDRAVSTVU IN MEDICINI (BROZM)
Razglašam Zakon o ratifikaciji Sporazuma med Vlado Republike Slovenije in Vlado Romunije o sodelovanju v zdravstvu in medicini (BROZM), ki ga je sprejel Državni zbor Republike Slovenije na seji 20. aprila 2005.

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO ROMUNIJE O SODELOVANJU V ZDRAVSTVU IN MEDICINI (BROZM)
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Romunije o sodelovanju v zdravstvu in medicini, podpisan v Ljubljani 6. julija 2004.
2. člen
Sporazum se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:

BETWEEN THE GOVERNMENT OF
THE REPUBLIC OF SLOVENIA AND
THE GOVERNMENT OF ROMANIA ON
CO-OPERATION IN THE FIELDS OF HEALTH AND MEDICINE
THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF ROMANIA (hereinafter referred to as the "Contracting Parties"),
HAVING in view the friendly relations between the two countries,
DESIROUS to develop on this basis the co-operation in the fields of health and medicine with a view to promoting and protecting the health of their people,
REAFFIRMING the importance of the principles of equality, reciprocity and mutual benefit for the development of fruitful co-operation,
HAVE AGREED as follows:
ARTICLE 1
The Contracting Parties shall take measures to encourage the development of their co-operation in the fields of health and medicine. The specific areas of mutual interest shall be agreed upon under the Programmes of Co-operation referred to under Article 5 of the present Agreement.
ARTICLE 2
In order to achieve this objective, the Contracting Parties shall facilitate:
– exchange of information in health fields of mutual interest;
– exchange of specialists for the purpose of study and consultations, as specified in the Programme of Co-operation referred to in Article 5 of this Agreement;
– direct contacts between institutions and organisations in their respective countries;
– exchange of information on new equipment and technological developments related to medicine and health;
and
– such other forms of co-operation in the fields of medicine and health as may be mutually agreed upon.
ARTICLE 3
The Contracting Parties shall inform each other about the conventions, symposia, round tables and any other similar events with international participation dealing with topics from the fields of health and medicine organised in their countries. Upon request, the other Contracting Party shall supply materials related to such events.
ARTICLE 4
The respective bodies of the Contracting Parties shall exchange upon request lists of medical literature and films on health care as well as any other written, visual or audio-visual informative materials in the fields of health and medicine.
ARTICLE 5
The implementation of the Agreement will be monitored on behalf of the Government of the Republic of Slovenia by the Ministry of Health of the Republic of Slovenia, and on behalf of the Government of Romania by the Ministry of Health of Romania.
The two ministries shall every two years conclude Programmes of Co-operation, which shall specify the areas of co-operation, the terms and conditions of the bilateral co-operation, including the financial provisions necessary to carry out such co-operative activities.
ARTICLE 6
Any dispute which may arise in connection with the interpretation or the implementation of this Agreement shall be settled through consultations between the Contracting Parties.
This Agreement may be amended by written consent of the Contracting Parties. The amendments shall enter into force in accordance with the procedure provided for under Article 7 of the present Agreement.
ARTICLE 7
This Agreement shall enter into force on the date of receipt of the last of the notes by which the Contracting Parties notify each other that all internal legal requirements for entry into force of this Agreement have been fulfilled.
This Agreement shall be valid for a period of five years. Upon the expiration of this period its validity shall be automatically prolonged each time for five years, unless either Contracting Party denounces it in writing through diplomatic channels at least 6 months prior to its expiration.

S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE
IN VLADO ROMUNIJE O SODELOVANJU
V ZDRAVSTVU IN MEDICINI
VLADA REPUBLIKE SLOVENIJE IN VLADA ROMUNIJE (v nadaljnjem besedilu pogodbenici) sta se
GLEDE NA prijateljske odnose med državama,
V ŽELJI, da bi na tej podlagi razvijali sodelovanje v zdravstvu in medicini ter tako spodbujali in varovali zdravje svojih ljudi,
KER PONOVNO POTRJUJETA, da so načela enakosti, vzajemnosti in medsebojne koristi pomembna za razvoj plodnega sodelovanja,
SPORAZUMELI, kot sledi:
1. ČLEN
Pogodbenici sprejmeta ukrepe za spodbujanje razvoja sodelovanja v zdravstvu in medicini. O posebnih področjih skupnega pomena se bosta dogovorili v okviru programov sodelovanja iz 5. člena tega sporazuma.
2. ČLEN
Da bi uresničili ta cilj, pogodbenici omogočata:
– izmenjavo informacij na področju zdravstva, ki zanimajo obe državi;
– izmenjavo strokovnjakov za študijske namene in zaradi posvetovanja, kot je to določeno v programu sodelovanja iz 5. člena tega sporazuma;
– neposredne stike med ustanovami in organizacijami v eni in drugi državi;
– izmenjavo informacij o novi opremi in tehnološkem razvoju v medicini in zdravstvu;
in
– druge oblike sodelovanja na področju medicine in zdravstva, o katerih se pogodbenici dogovorita sporazumno.
3. ČLEN
Pogodbenici druga drugo obveščata o konvencijah, simpozijih, okroglih mizah in drugih podobnih dogodkih z mednarodno udeležbo, ki obravnavajo teme s področja zdravstva in medicine, organiziranih v njunih državah. Na zahtevo ene pogodbenice druga pogodbenica pošlje gradivo, povezano s takimi dogodki.
4. ČLEN
Pristojni organi pogodbenic si na zahtevo izmenjavajo sezname medicinske literature in filmov o zdravstveni oskrbi, pa tudi drugo pisno, vizualno ali avdiovizualno informativno gradivo s področja zdravstva in medicine.
5. ČLEN
Izvajanje tega sporazuma bo v imenu Vlade Republike Slovenije spremljalo in nadzorovalo Ministrstvo za zdravje Republike Slovenije, v imenu Vlade Romunije pa Ministrstvo za zdravje Romunije.
Ministrstvi vsako drugo leto skleneta programe sodelovanja, ki opredeljujejo področja sodelovanja, načine in pogoje dvostranskega sodelovanja ter finančne določbe za opravljanje skupnih dejavnosti.
6. ČLEN
Morebitni spori, nastali zaradi razlage ali izvajanja tega sporazuma, se rešujejo s posvetovanjem med pogodbenicama.
Ta sporazum se lahko spremeni s pisnim soglasjem pogodbenic. Spremembe začnejo veljati v skladu s postopkom, določenim v 7. členu tega sporazuma.
7. ČLEN
Ta sporazum začne veljati na dan prejema zadnje note, s katero pogodbenici druga drugo uradno obvestita, da so bili izpolnjeni vsi notranjepravni pogoji za začetek veljavnosti tega sporazuma.
Ta sporazum velja pet (5) let. Po poteku tega obdobja se njegova veljavnost vsakokrat samodejno podaljša za nadaljnjih pet (5) let, če ga ena od pogodbenic pisno ne odpove po diplomatski poti vsaj 6 mesecev pred potekom njegove veljavnosti.
Sestavljeno v Ljubljani dne 6. julija 2004 v dveh izvirnikih v angleškem jeziku.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zdravje Republike Slovenije.
4. člen
Ta zakon začne veljati petnajsti dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
