Na podlagi prve in tretje alinee petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo in 20/06 – ZNOMCMO) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED MINISTRSTVOM ZA OBRAMBO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA OBRAMBO UKRAJINE O SODELOVANJU NA VOJAŠKEM PODROČJU
1. člen
Ratificira se Sporazum med Ministrstvom za obrambo Republike Slovenije in Ministrstvom za obrambo Ukrajine o sodelovanju na vojaškem področju, podpisan v Kijevu 27. junija 2007.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in v angleškem jeziku glasi(*):
S P O R A Z U M
MED MINISTRSTVOM ZA OBRAMBO REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA OBRAMBO UKRAJINE O SODELOVANJU NA VOJAŠKEM PODROČJU
Ministrstvo za obrambo Republike Slovenije in Ministrstvo za obrambo Ukrajine, v nadaljnjem besedilu pogodbenici, sta se
na podlagi ciljev in načel Ustanovne listine Združenih narodov, Pariške listine, Dunajskega dokumenta 1999 in drugih dokumentov OVSE,
ob priznavanju pozitivne vloge sodelovanja na obrambnem področju kot pomembnega dejavnika v razvoju odnosov med državama,
v želji pospešiti razvoj dvostranskega sodelovanja v interesu oboroženih sil pogodbenic na temelju zaupanja in medsebojnega spoštovanja,
v prepričanju, da bo sodelovanje na vojaškem področju prispevalo k nadaljnji krepitvi medsebojnih odnosov med Republiko Slovenijo in Ukrajino,
dogovorili o naslednjem:
1. člen
Namen sodelovanja
Namen tega sporazuma je opredeliti temeljna načela in postopke za izvajanje sodelovanja na obrambnem in vojaškem področju v interesu pogodbenic na osnovi enakopravnosti in medsebojnih koristi.
2. člen
Področja sodelovanja
Sodelovanje med pogodbenicama poteka na naslednjih področjih:
obrambna politika,
reforma in razvoj oboroženih sil držav pogodbenic, izvajanje raziskovalnih dejavnosti na vojaškem področju,
vojaško izobraževanje,
sodelovanje na področju topografije in geodezije,
okoljska vprašanja in nadzor nad onesnaževanjem v vojaških objektih,
obrambna in vojaška zakonodaja na področju obrambe.
O drugih področjih vojaškega sodelovanja se pogodbenici lahko dogovorita s sklenitvijo posebnih dokumentov.
3. člen
Oblike sodelovanja
Sodelovanje med pogodbenicama poteka v naslednjih oblikah:
uradni in delovni obiski vodstev in drugih predstavnikov pogodbenic,
posvetovanja na ravni strokovnjakov pogodbenic,
izmenjava izkušenj, informacij, dokumentov, izobraževalnega gradiva, podatkovnih zbirk v skupnem interesu pogodbenic,
usposabljanje vojaških in civilnih strokovnjakov v vojaških izobraževalnih ustanovah, na tečajih in z izmenjavo programov,
udeležba na tečajih, vajah, seminarjih, kolokvijih in simpozijih,
sodelovanje vojaških opazovalcev na vojaških vajah na temelju vzajemnosti.
Vse dejavnosti v zvezi s sodelovanjem morajo biti skladne z nacionalno zakonodajo države prejemnice.
4. člen
Izvajanje sporazuma
V skladu z določbami tega sporazuma pogodbenici pripravita letne načrte o sodelovanju.
Pooblaščeni zastopniki pogodbenic izmenjajo predloge za pripravo dvostranskih načrtov sodelovanja za naslednje koledarsko leto in ocenijo rezultate sodelovanja, predvidene s predhodnim načrtom, do 15. oktobra tekočega leta. Izmenjava predlogov za načrtovanje in pisno komuniciranje med pooblaščenimi zastopniki pogodbenic poteka prek uradov vojaških atašejev obeh držav.
Načrt dvostranskega sodelovanja zajema vsebino dogodkov, kraj, čas in rok izvajanja dejavnosti, število udeležencev, oblike izvajanja dejavnosti, pooblastila in druge potrebne informacije.
Pooblaščeni zastopniki pogodbenic v ta namen oblikujejo delovne skupine za potrditev predlogov in pripravijo končni načrt sodelovanja za naslednje leto do 30. novembra.
Spremembe in dopolnitve sprejetih načrtov dvostranskega sodelovanja so mogoče na podlagi medsebojnega pisnega soglasja pogodbenic.
5. člen
Finančni vidiki
Finančni stroški, ki so povezani z izvajanjem dejavnosti, predvidenih v načrtih o sodelovanju, bremenijo pogodbenici na temelju vzajemnosti.
Pogodbenica pošiljateljica krije prevozne stroške članov delegacije v državo prejemnico in iz nje ter stroške dnevnic.
Pogodbenica prejemnica nosi stroške oskrbe in nastanitve članov delegacije v vojaških in civilnih ustanovah ter stroške, povezane z izvajanjem dogovorjenih načrtov dvostranskega sodelovanja.
Če delegacija šteje več kakor deset članov, stroški njihove oskrbe in nastanitve bremenijo pogodbenico pošiljateljico ali pa velja poseben dogovor.
Za vse nenačrtovane dogodke in druge zadeve, ki jih ne ureja ta sporazum, veljajo določbe posebnih dogovorov med pogodbenicama.
Pogodbenica prejemnica po potrebi zagotovi brezplačno nujno medicinsko zdravljenje v ustreznih zdravstvenih ustanovah. Zobozdravstvene storitve so omejene na zagotavljanje nujne zobozdravstvene oskrbe.
Če zastopnik pogodbenice pošiljateljice zaprosi za zdravljenje v civilnih zdravstvenih ustanovah pogodbenice prejemnice, vse stroške krije pogodbenica pošiljateljica.
Pogodbenica pošiljateljica krije stroške prevoza bolnikov v svojo državo.
6. člen
Varovanje tajnih podatkov
Pogodbenici jamčita za varovanje tajnih podatkov, ki sta jih prejeli ali so jima bili dani na voljo med pripravami in izvajanjem dejavnosti dvostranskega sodelovanja, ki se zagotavljajo po tem sporazumu, v skladu z veljavno zakonodajo in predpisi vsake od držav pogodbenic.
Podatki, izmenjani v času dvostranskega sodelovanja, se ne smejo uporabiti v škodo interesov pogodbenic.
Pogodbenici jamčita, da ne bosta posredovali podatkov, izmenjanih z dejavnostmi dvostranskega sodelovanja, tretjim osebam, posameznikom ali organizacijam brez predhodnega pisnega soglasja pogodbenice, ki je odstopila tajne podatke.
7. člen
Končne določbe
Ta sporazum začne veljati na dan prejema zadnjega uradnega obvestila, s katerim pogodbenici druga drugo obvestita, da so izpolnjeni vsi notranjepravni postopki, potrebni za začetek veljavnosti tega sporazuma.
Vsaka pogodbenica lahko kadar koli zahteva spremembo tega sporazuma in začne postopek posvetovanja zaradi dogovora o predlaganih dopolnitvah ali spremembah.
Vse spore v zvezi z razlago ali uporabo tega sporazuma bosta pogodbenici reševali s pogajanji in posvetovanji ter jih ne bosta predložili kateremu koli mednarodnemu sodišču ali tretji osebi.
Vsaka pogodbenica lahko odpove ta sporazum po diplomatski poti šest mesecev vnaprej s pisnim obvestilom o odpovedi.
Ob odpovedi tega sporazuma ostanejo določbe 6. člena še naprej v veljavi.
Sklenjeno v Kijevu 27. junija 2007 v dveh izvirnikih v slovenskem, ukrajinskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna.
Ob različni razlagi tega sporazuma prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE MINISTRY OF DEFENCE OF THE REPUBLIC OF SLOVENIA AND THE MINISTRY OF DEFENCE OF UKRAINE ON CO-OPERATION IN MILITARY SPHERE
The Ministry of Defence of the Republic of Slovenia and the Ministry of Defence of Ukraine, hereinafter referred as the Parties,
guided by purposes and principles of the United Nations Charter, the Paris Charter, the 1999 Vienna Document as well as other OSCE documents,
recognizing the positive role of cooperation in the defence field as an important factor in the development of relations between states,
wishing to develop long-term bilateral cooperation in the interests of the armed forces of Parties on the basis of confidence and mutual respect,
being convinced that the co-operation in the military sphere will contribute to further strengthening of the mutual relations between Republic of Slovenia and Ukraine,
have agreed as follows:
Article 1
Purpose of cooperation
The purpose of the present Agreement is to determine general principles and procedures for realization of cooperation in the defence and military sphere in the interests of Parties on the basis of equal rights and mutual benefits.
Article 2
Spheres of cooperation
The cooperation between Parties shall be carried out in the following spheres:
defence policy;
reform and development of the armed forces of Parties states, conducting research activities in the military field;
military education;
cooperation in the field of topography and geodesy;
environmental issues and pollution control within military installations;
defence and military legislation in the field of defence.
Other spheres of military cooperation may be subject to separate arrangements between the Parties.
Article 3
Forms of cooperation
The cooperation between the Parties shall be implemented through the following forms:
official and working visits of the leadership and other representatives of the Parties,
consultations at the level of experts of the Parties,
exchange of experience, information, documents, training materials, database in the mutual interests of the Parties,
training of military and civilian experts in the military educational establishments, on the courses and by means of exchange programs,
participation in the courses, exercises, seminars, colloquiums and symposiums,
participation of military observers in the military exercises on the basis of reciprocity.
All activities related to cooperation shall be in accordance with the national law of the receiving State.
Article 4
Implementation
In accordance with provisions of the present Agreement, the Parties shall draw up annual plans of cooperation.
The authorized representatives of Parties shall exchange proposals for the drawing up of bilateral cooperation plans for the subsequent calendar year and review cooperation results, envisaged in the previous plan by 15 October of the current year. The exchange of proposals for planning and correspondence between the authorized representatives of the Parties shall be exchanged through the offices of military attaches of both states.
The plan of bilateral cooperation shall include the contents of events, venue, time and term of activities, number of participants, forms of activities, implementation, authorities and other necessary information.
For this purpose the authorized representatives of Parties shall set up working groups for approval of proposals and draw up the final plan of cooperation for subsequent year until 30 November.
Amendments and supplements to the approved plans ob bilateral cooperation shall be made by the mutual written consent of the Parties.
Article 5
Financial aspects
Financial costs related to the implementation of the activities envisaged by the cooperation plans shall be borne by the Parties on a reciprocal basis.
The sending Party shall bear costs related to the transportation of the members of delegation to and from the receiving Party as well as the daily allowances.
The receiving Party shall bear costs related to board and accommodation of the members of delegation in military and civilian institutions and cover expenses related to implementation of agreed plans of bilateral cooperation.
If number of the members of delegation exceeds 10 persons, costs related to accommodation and board of the members of delegation shall be borne by the sending Party or separate arrangements shall apply.
All unplanned events and other matters that are not governed by this Agreement shall be subject to separate arrangements between the Parties.
The receiving Party, if necessary, shall provide free of charge emergency urgent medical treatment in the relevant medical institutions. Dental services shall be limited to providing an emergency medical care.
If the representative of the sending Party shall ask for treatment in civilian medical institutions of the receiving Party, all costs shall be borne by the sending Party.
Costs related to the transportation of patients to sending Party's state shall be borne by the sending Party.
Article 6
Protection of classified information
The Parties shall guarantee the protection of the classified information, received or made available during preparation and fulfillment of activities of bilateral co-operation which are provided within the framework of this Agreement, in accordance with the laws and regulations in force in each of the states of the Parties.
The information exchanged during bilateral co-operation shall not be used to harm interests of the Parties.
The Parties guarantee not to transfer the information exchanged under bilateral co-operation activities to the third Parties, persons or organizations without prior written consent of the originating Party.
Article 7
Final provisions
This Agreement shall enter into force on the date of receipt by the Parties of the last notice of compliance with internal legal procedures required for the entry into force of this Agreement.
Each Party may at any time request the revision of this Agreement and will begin a process of consultation in order to agree upon the suggested amendments or changes.
Any disputes concerning the interpretation or application of present Agreement shall be settled through negotiations and consultations between the Parties and shall not be submitted to any international court or third party.
Any Party may terminate this Agreement by giving the other Party through diplomatic channels, six months in advance, written notice of its intention to terminate this Agreement.
In case of termination of this Agreement, the provisions set forth in Article 6 shall remain in force.
Done at Kyiv on 27 June 2007 in two copies, each in the Slovenian, Ukrainian and English languages, all texts being equally authentic.
In case of divergence in interpretation of this Agreement the English text shall prevail.

3. člen
Za izvajanje tega sporazuma skrbi Ministrstvo za obrambo Republike Slovenije.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
