O RATIFIKACIJI SPORAZUMA MED MINISTRSTVOM ZA ZUNANJE ZADEVE REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA ZUNANJE ZADEVE REPUBLIKE MADŽARSKE O SODELOVANJU PRI SPREJEMANJU IN POŠILJANJU SLOVENSKIH VIZUMSKIH VLOG NA URADU ZA TRGOVINO REPUBLIKE MADŽARSKE V TAJPEJU
1. člen
Ratificira se Sporazum med Ministrstvom za zunanje zadeve Republike Slovenije in Ministrstvom za zunanje zadeve Republike Madžarske o sodelovanju pri sprejemanju in pošiljanju slovenskih vizumskih vlog na Uradu za trgovino Republike Madžarske v Tajpeju, podpisan v Lendavi 17. oktobra 2007.

Besedilo sporazuma se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:

BETWEEN THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF SLOVENIA AND THE MINISTRY OF FOREIGN AFFAIRS OF THE REPUBLIC OF HUNGARY ON COOPERATION IN COLLECTION AND FORWARDING OF SLOVENE VISA APPLICATIONS BY THE TRADE OFFICE OF THE REPUBLIC OF HUNGARY IN TAIPEI
The Ministry of Foreign Affairs of the Republic of Slovenia (hereinafter referred to as the Slovene Party) and the Ministry of Foreign Affairs of the Republic of Hungary (hereinafter referred to as the Hungarian Party, together: Parties)
recalling the trustful cooperation between the Slovene and Hungarian consular services;
with reference to the Agreement between the Republic of Slovenia and the Republic of Hungary on the Mutual Representation by their Diplomatic and Consular Missions in Processing Visas and Residence Permits of 4 April 2007;
acknowledging the fact that simplification of visa issuance is in the common interest of both countries;
in view of community achievements and drafts concerning cooperation in the field of visa issuance;
considering the fact that both the Republic of Slovenia and the Republic of Hungary will begin to fully apply the Schengen aquis in the near future;
have agreed as follows.
Article 1
Organizational framework of the activity
1. The Trade Office of the Republic of Hungary in Taipei (hereinafter referred to as the Hungarian Trade Office) undertakes the task of collecting and forwarding applications for A, B and C visas which are to be decided on by the Republic of Slovenia.
2. The Hungarian Party shall notify the local Ministry of Foreign Affairs of this activity of the Hungarian Trade Office.
Article 2
Tasks of the Hungarian Trade Office
1. The activity of the Hungarian Trade Office as defined in paragraph 1 of Article 1 comprises the provision of information to visa applicants, reception of visa applications, their registration, assistance in collection of visa fees, forwarding documents and data to the Embassy of the Republic of Slovenia in Tokyo (hereinafter referred to as the Slovene Embassy), returning travel documents to visa applicants, organising and conducting interviews with the applicants when necessary, providing summaries of interviews with the applications to be forwarded to the Slovene Embassy with a remark concerning possible security risks.
2. During the performance of its duties set out in paragraph 1 of this Article the Hungarian Trade Office shall take due care and caution, as if it handled visa applications for applicants travelling to Hungary.
Article 3
Coordination and control of daily work
1. The tasks of the Hungarian Trade Office as stated in paragraph 1 of Article 1 are managed by a member of the staff of the Trade Office, performing consular functions.
2. The Slovene Embassy and the Hungarian Trade Office shall be in continuous and close contact with each other for the purpose of facilitating the activities of the Hungarian Trade Office as stated in the present Agreement. In case of disputes that can not be solved directly by the member of the staff of the Trade Office performing consular functions and the Slovene Embassy, they shall seek the advice of their respective ministries without delay.
3. The Slovene Embassy and the Hungarian Trade Office shall maintain separate mailboxes in order to make correspondence related to the work of the Hungarian Trade Office – as stated in the present Agreement – transparent.
Article 4
Staff
For the fulfilment of its duties as defined in paragraph 1 of Article 1 of the present Agreement the Hungarian Party shall employ a visa administrator who is a resident of Taiwan.
Article 5
Specific rules concerning visa applications managed by the Hungarian Trade Office
1. The Hungarian Trade Office shall not receive visa fees. Applicants pay the visa fee determined by the Republic of Slovenia to a bank account opened by the Hungarian Trade Office for this purpose. The Hungarian Trade Office shall transfer the collected fees to the Slovenian Party within thirty (30) days. Details on the transfer conditions shall be agreed upon via diplomatic channels.
2. Detailed rules concerning the receipt and forwarding of applications by the Hungarian Trade Office, return of travel documents and communication of visa refusal are contained in the Annex.
3. Receipt of visa applications may only be rejected if – according to the provisions of the Annex – the applicant is not exempted from the payment of visa fee and has not provided a proof of payment with the application. Before rejection, the applicant shall be requested to provide a proof of payment.
4. In case of lack of supporting documents listed in the Annex the application may be accepted and the applicant shall be requested in writing, using a form (“Form for the request of additional subsidiary Information”) attached in the Annex, to provide the missing documents within a set period of time and shall be notified that the non-performance may result in the refusal of the application. After the expiration of the deadline the application shall be forwarded to the Slovene Embassy with a copy of this form.
5. Visa applications and enclosed supporting documents shall be forwarded by the Hungarian Trade Office through express postal service designated by the Slovene Party in the Annex. Frequency of transmission of applications shall be determined by the Slovene Party considering the number of applications. Cost of the transfer of applications and passports shall be paid by the sending party directly to the express postal service.
6. The member of the staff of the Trade Office performing consular functions shall be responsible for ensuring that the visa administrator is aware of the rules contained in the Annex and their amendments.
Article 6
Closing Provisions
1. This Agreement is concluded for an indefinite period and either Contracting Party may terminate it at any time in writing, communicated through diplomatic channels. In case of termination, the Agreement remains in force for thirty (30) days following the receipt of the notice of termination by the other Contracting Party.
2. The Contracting Parties may suspend the application of this Agreement wholly or partly at any time. The starting and closing date of the suspension shall be communicated through diplomatic channels and shall become effective thirty (30) days after the notification, unless agreed otherwise by the Contracting Parties.
3. As of the full implementation of the Schengen Agreement Hungary will fully represent Slovenia in the field of issuance of harmonised Schengen visa.
4. Issues related to the interpretation or the implementation of this Agreement shall be resolved by the Contracting Parties through negotiations.
5. The Annex does not constitute part of this Agreement. The Annex shall be prepared and maintained by the Slovene Party who notifies the Hungarian Trade Office in case of any modification.
6. The Contracting Parties may modify this Agreement in writing at any time especially for the purpose of further deepening the cooperation in the field of visa issuance, or based on the experience gained during the cooperation. This Agreement shall be modified by the exchange of notes between the Contracting Parties.
7. In case of termination of this Agreement the Contracting Parties shall, if necessary, settle all outstanding expenses with each other, resulting from the implementation of this Agreement.
8. This Agreement shall enter into force on the day of the receipt of the last notification by which Contracting Parties officially notify each other through diplomatic channels that their constitutional requirements for the entry into force have been fulfilled. The Agreement, however, enters into force temporarily as of the date of its signature.

MED MINISTRSTVOM ZA ZUNANJE ZADEVE REPUBLIKE SLOVENIJE IN MINISTRSTVOM ZA ZUNANJE ZADEVE REPUBLIKE MADŽARSKE O SODELOVANJU PRI SPREJEMANJU IN POŠILJANJU SLOVENSKIH VIZUMSKIH VLOG NA URADU ZA TRGOVINO REPUBLIKE MADŽARSKE V TAJPEJU
Ministrstvo za zunanje zadeve Republike Slovenije (v nadaljevanju: slovenski pogodbenik) in Ministrstvo za zunanje zadeve Republike Madžarske (v nadaljevanju: madžarski pogodbenik, skupaj: pogodbenika) sta se
ob sklicevanju na zaupanja vredno sodelovanje med slovensko in madžarsko konzularno službo,
glede na Sporazum med Republiko Slovenijo in Republiko Madžarsko o vzajemnem zastopanju diplomatsko-konzularnih predstavništev pri obdelavi vizumov in dovoljenj za prebivanje z dne 4. aprila 2007,
ob priznavanju, da je poenostavitev postopka izdaje vizumov v skupnem interesu obeh držav,
glede na skupnostne dosežke in predloge v zvezi s sodelovanjem pri izdajanju vizumov,
glede na to, da bosta Republika Slovenija in Republika Madžarska kmalu začeli v celoti izvajati schengenski pravni red,
dogovorili:
1. člen
Organizacijski okvir dejavnosti
1. Urad za trgovino Republike Madžarske v Tajpeju (v nadaljevanju: madžarski urad za trgovino) prevzema nalogo sprejemanja in pošiljanja vlog za vizume A, B in C, o katerih odloča Republika Slovenija.
2. Madžarski pogodbenik o tej dejavnosti madžarskega urada za trgovino obvesti lokalno ministrstvo za zunanje zadeve.
2. člen
Naloge madžarskega urada za trgovino
1. Dejavnosti madžarskega urada za trgovino, opredeljene v prvem odstavku 1. člena, vključujejo zagotavljanje informacij prosilcem za vizum, sprejem in vpis vizumskih vlog, pomoč pri pobiranju vizumskih taks, pošiljanje dokumentov in podatkov Veleposlaništvu Republike Slovenije v Tokiu (v nadaljevanju: slovensko veleposlaništvo), vračanje potnih listin prosilcem za vizum, po potrebi organiziranje in opravljanje pogovorov s prosilci ter pošiljanje povzetkov pogovorov in vlog prosilcev slovenskemu veleposlaništvu z opozorilom o mogočih varnostnih tveganjih.
2. Naloge iz prvega odstavka tega člena madžarski urad za trgovino opravlja skrbno in pazljivo, kakor bi obravnaval prošnje za vizum prosilcev, ki potujejo na Madžarsko.
3. člen
Usklajevanje vsakodnevnega dela in nadzor nad njim
1. Naloge madžarskega urada za trgovino iz prvega odstavka 1. člena opravlja član osebja urada, ki opravlja konzularne naloge.
2. Slovensko veleposlaništvo in madžarski urad za trgovino sta v stalnih in tesnih stikih, da se madžarskemu uradu za trgovino omogoča opravljanje dejavnosti, navedenih v tem sporazumu. Ob sporih, ki jih član osebja urada za trgovino, ki opravlja konzularne naloge, in slovensko veleposlaništvo ne moreta rešiti neposredno, se nemudoma posvetujeta s svojima ministrstvoma.
3. Slovensko veleposlaništvo in madžarski urad za trgovino imata ločena poštna predala, tako da je korespondenca, povezana z delom madžarskega urada za trgovino, določenim v tem sporazumu, pregledna.
4. člen
Osebje
Za opravljanje dolžnosti, ki so opredeljene v prvem odstavku 1. člena tega sporazuma, madžarski pogodbenik zaposli vizumskega uradnika, ki je tajvanski rezident.
5. člen
Posebna pravila za vizumske vloge, ki jih obravnava madžarski urad za trgovino
1. Madžarski urad za trgovino ne sprejema vizumskih taks. Prosilci plačajo vizumsko takso, ki jo določi Republika Slovenija, na bančni račun, ki ga za ta namen odpre madžarski urad za trgovino. Madžarski urad za trgovino prenakaže zbrane takse slovenskemu pogodbeniku v tridesetih (30) dneh. O podrobnostih glede prenakazila bo dogovorjeno po diplomatski poti.
2. Podrobna pravila o tem, kako madžarski urad za trgovino sprejema in pošilja vloge, vrača potne listine in obvešča o zavrnitvi vizuma, so v prilogi.
3. Sprejem vizumske vloge se lahko zavrne samo, če – skladno z določbami priloge – prosilec za vizum ni oproščen plačila vizumske takse in vlogi ne priloži dokazila o plačilu. Pred zavrnitvijo je od prosilca treba zahtevati, da predloži dokazilo o plačilu.
4. Če je spremna dokumentacija, navedena v prilogi, pomanjkljiva, se vloga lahko sprejme, od prosilca pa je z obrazcem iz priloge (Obrazec za zahtevo dodatnih informacij) pisno zahtevano, da v določenem času predloži manjkajoče dokumente, in je obveščen, da se sicer vloga lahko zavrne. Po poteku roka se vloga skupaj s kopijo omenjenega obrazca pošlje slovenskemu veleposlaništvu.
5. Madžarski urad za trgovino pošlje vizumske vloge in priloženo spremno dokumentacijo slovenskemu veleposlaništvu prek ponudnika hitre pošte, ki ga določi slovenski pogodbenik v prilogi. Pogostost pošiljanja vlog določi slovenski pogodbenik glede na njihovo število. Pogodbenik, ki dokumente pošilja, plača stroške pošiljanja vlog in potnih listov neposredno ponudniku hitre pošte.
6. Član osebja urada za trgovino, ki opravlja konzularne naloge, mora zagotoviti, da je vizumski uradnik seznanjen s pravili iz priloge in njihovimi spremembami.
6. člen
Končne določbe
1. Sporazum se sklene za nedoločen čas; pogodbenika ga lahko kadar koli odpovesta in to pisno sporočita po diplomatski poti. Ob odpovedi sporazum velja še trideset (30) dni po tem, ko drugi pogodbenik prejme obvestilo o odpovedi.
2. Pogodbenika lahko kadar koli delno ali v celoti prekineta izvajanje tega sporazuma. Začetni in končni datum prekinitve izvajanja sporazuma se sporočita po diplomatski poti, prekinitev pa začne veljati trideset (30) dni po prejemu uradnega obvestila, razen če se pogodbenika ne dogovorita drugače.
3. Po polni uveljavitvi schengenskega sporazuma bo Madžarska v celoti zastopala Slovenijo pri izdajanju enotnih schengenskih vizumov.
4. Vprašanja glede razlage ali izvajanja tega sporazuma pogodbenika rešujeta s pogajanji.
5. Priloga ni sestavni del sporazuma. Pripravi in vzdržuje jo slovenski pogodbenik, ki madžarski urad za trgovino obvesti o morebitnih spremembah.
6. Pogodbenika lahko kadar koli pisno spremenita sporazum predvsem zaradi nadaljnjega poglabljanja sodelovanja pri izdaji vizumov ali glede na izkušnje, pridobljene med sodelovanjem. Sporazum se spremeni z izmenjavo not med pogodbenikoma.
7. Če sporazum preneha veljati, pogodbenika po potrebi drug drugemu plačata neporavnane stroške, ki so nastali z izvajanjem tega sporazuma.
8. Sporazum začne veljati z dnem prejema zadnjega od uradnih obvestil, s katerima se pogodbenika uradno po diplomatski poti obvestita, da so izpolnjeni njuni notranjepravni pogoji, potrebni za začetek veljavnosti sporazuma. Sporazum pa se začne začasno uporabljati z dnem podpisa.
Sestavljeno v Lendavi dne 17. oktobra 2007 v dveh izvodih v angleškem jeziku.

4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
