Na podlagi tretje in sedme alinee petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo in 20/06 – ZNOMCMO) izdaja Vlada Republike Slovenije

O RATIFIKACIJI PROTOKOLA O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO ARABSKE REPUBLIKE EGIPT
1. člen
Ratificira se Protokol o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Arabske republike Egipt, sestavljen v Ljubljani, 23. aprila 2007.
2. člen
Protokol se v izvirniku v slovenskem in angleškem jeziku glasi(*):

O ZNANSTVENEM IN TEHNOLOŠKEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO ARABSKE REPUBLIKE EGIPT
Vlada Republike Slovenije, ki jo zastopa Ministrstvo za visoko šolstvo, znanost in tehnologijo, in Vlada Arabske republike Egipt, ki jo zastopa Državno ministrstvo za znanstvene raziskave, v nadaljevanju pogodbenici, sta se,
ker se zavedata pomena razvijanja obstoječih gospodarskih odnosov na podlagi obojestranske koristi in vzajemnosti ter ob dopuščanju uporabe vseh možnosti, ki jih ustvarja tehnološki in znanstveni napredek,
ker sta zavezani krepitvi svojih notranjih zmožnosti z mednarodnim tehničnim in znanstvenim sodelovanjem ter
skladno s Sporazumom med Vlado Republike Slovenije in Vlado Arabske republike Egipt o gospodarskem, industrijskem, tehnološkem in znanstvenem sodelovanju, podpisanim v Ljubljani 28. oktobra 1998,
sporazumeli:
1. člen
Pogodbenici spodbujata ter podpirata sodelovanje v znanosti in tehnologiji med svojimi raziskovalnimi subjekti skladno s tem protokolom in veljavno zakonodajo vsake države.
2. člen
Sodelovanje poteka zlasti v teh oblikah:
1. skupni raziskovalni in razvojni projekti, vključno z izmenjavo raziskovalnih izsledkov in znanstvenikov, strokovnjakov in raziskovalcev;
2. organizacija skupnih znanstvenih srečanj, konferenc, simpozijev, tečajev, delavnic in razstav ter sodelovanje na njih;
3. izmenjava znanstvenih in tehnoloških informacij ter dokumentov;
4. skupna uporaba in razvoj naprav in znanstvene opreme;
5. druge oblike znanstvenega in tehnološkega sodelovanja, o katerih se lahko dogovorita.
3. člen
Znanstveni in tehnološki izsledki ter vse druge informacije, pridobljene s sodelovanjem po tem protokolu, se objavijo, natisnejo ali ekonomsko izkoriščajo s soglasjem obeh sodelujočih partneric in skladno s pogodbami o varstvu intelektualne lastnine, ki zavezujejo pogodbenici.
4. člen
Pogodbenici zagotovita ustrezno zdravstveno zavarovanje za svoje znanstvenike, strokovnjake, raziskovalce in izvedence med njihovim obiskom v državi sprejemnici pred njihovim prihodom v državo sprejemnico.
5. člen
Financiranje raznih načinov sodelovanja se določi s posebnim programom za uresničevanje.
6. člen
Za izvajanje tega protokola se ustanovi skupni odbor za znanstveno in tehnološko sodelovanje.
Naloge skupnega odbora so:
1. dogovori o področjih sodelovanja;
2. ustvarjanje ugodnih razmer za izvajanje tega protokola;
3. olajševanje in podpiranje izvajanja skupnih programov in projektov;
4. izmenjava mnenj o vseh možnostih za dvostransko znanstveno in tehnološko sodelovanje ter preučitev novih predlogov za razvoj sodelovanja.
Skupni odbor se običajno sestaja vsaki dve leti izmenično v Sloveniji in Egiptu ter sklene programe za uresničevanje, ki vsebujejo sklepe in predloge skupnih zasedanj. Sestane se vsakokrat, ko je potrebno.
7. člen
Pogodbenici povabita k sodelovanju pri zasnovi in razvoju projektov druge znanstvene akademske institucije in podjetja; način financiranja, potrebnega za te izmenjave obiskov, poteka skladno s 5. členom tega protokola.
8. člen
Pogodbenici se dogovorita, da bosta vse medsebojne spore reševali s pogajanji.
9. člen
Protokol začne veljati z dnem, ko slovenska pogodbenica uradno obvesti egiptovsko pogodbenico, da je bil protokol sprejet skladno z notranjepravnimi postopki.
Protokol velja nedoločen čas, razen če ga ena ali druga pogodbenica ne odpove z uradnim obvestilom po diplomatski poti. Odpoved začne veljati v enem letu po datumu omenjenega uradnega obvestila.
Prenehanje veljavnosti tega protokola ne vpliva na dokončanje projektov, začetih po tem protokolu, ki ob prenehanju njegove veljavnosti še niso dokončani.
Sestavljeno v Ljubljani dne 23. aprila 2007 v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri različni razlagi prevlada angleško besedilo.

ON SCIENTIFIC AND TECHNOLOGICAL COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE ARAB REPUBLIC OF EGYPT
The Government of the Republic of Slovenia, represented by the Ministry of Higher Education, Science and Technology and the Government of the Arab Republic of Egypt, represented by the Ministry of State for Scientific Research, hereinafter referred to as "the Contracting Parties"
Recognizing the importance of developing the existing economic relations on a basis of mutual benefit and reciprocity, allowing the use of all opportunities created by technological and scientific progress
Commited to the strengthening of their respective national capacities through technical and scientific international co-operation and
According to the Agreement between the Government of the Republic of Slovenia and the Government of the Arab Republic of Egypt on Economic, Industrial, Technological and Scientific Co-operation signed in Ljubljana on 28th October, 1998,
Have agreed as follows:
Article 1
The Contracting Parties shall encourage and support cooperation in the field of science and technology between their affiliated research entities according to the provisions of this Protocol and the existing legislation and regulations of each country.
Article 2
The cooperation will have the following forms, in particular:
1. Joint research and development projects including exchange of research results and exchange of scientists, specialists and researchers;
2. Organizing and participating in joint scientific meetings, conferences, symposia, courses, workshops, exhibitions;
3. Exchange of scientific and technological information and documents;
4. Joint use of research and development facilities and scientific equipment;
5. Other forms of scientific and technological cooperation which may be mutually agreed upon.
Article 3
Scientific and technological results and any other information derived from the cooperation activities under this Protocol, will be announced, published or commercially exploited with the consent of both cooperation partners and according to the treaties concerning protection of intellectual property binding the Contracting Parties.
Article 4
The Contracting Parties shall provide adequate medical insurance for their own scientists, specialists, researchers and experts for the time of their visits to the receiving country, prior to their arrival to the receiving country.
Article 5
The financing of the different modalities of cooperation shall be set up by a specific executive programme.
Article 6
For the purpose of the implementation of this Protocol a Joint Commission on scientific and technological cooperation will be established.
The tasks of the Joint Commission are as follows:
1. To agree on the fields of co-operation;
2. To create favourable conditions for implementation of this Protocol;
3. To facilitate and support the implementation of joint programmes and projects;
4. To exchange opinions on the overall perspectives of bilateral scientific and technological cooperation and to examine new proposals for the development of cooperation.
The Joint Commission shall meet usually every two years, alternatively in Slovenia and Egypt, and will conclude Executive Programmes which will contain conclusions and proposals of the joint sessions. It shall meet every time the Joint Commission considers necessary.
Article 7
The Contracting Parties shall invite other scientific academic institutions and enterprises to participate in the design and development of the projects; financial modalities arising from such exchange of visits will refer to the Article 5 of this Protocol.
Article 8
The Contracting Parties shall agree to solve any controversy arising between them, through negotiations.
Article 9
This Protocol shall enter into force on the date when the Slovenian Party notify the Egyptian Party that the Protocol has been approved in accordance with the legal procedures.
This Protocol shall remain in force for an unlimited period unless either Contracting Party terminates this Protocol by notification through diplomatic channels. The termination shall come into effect in one year from the date of the said notification.
The termination of this Protocol shall not affect the finalization of projects undertaken under this Protocol and not fully executed at the time of the termination of this Protocol.
Done in Ljubljana on 23 of April 2007 in two originals in the Slovene, Arabic, and English languages, all texts being equally authentic. In case of differences in interpretation, the English text shall prevail.

3. člen
Za izvajanje protokola je pristojno Ministrstvo za visoko šolstvo, znanost in tehnologijo.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
