Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08 in 108/09) izdaja Vlada Republike Slovenije
U R E D B O
O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE AZERBAJDŽAN O ODPRAVI VIZUMSKE OBVEZNOSTI ZA IMETNIKE DIPLOMATSKIH POTNIH LISTOV
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Republike Azerbajdžan o odpravi vizumske obveznosti za imetnike diplomatskih potnih listov, podpisan 9. novembra 2009 v Bakuju.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi:(1)
S p o r a z u m
med Vlado Republike Slovenije in Vlado Republike Azerbajdžan o odpravi vizumske obveznosti za imetnike diplomatskih potnih listov
Vlada Republike Slovenije in Vlada Republike Azerbajdžan (v nadaljnjem besedilu: pogodbenici) sta se
v želji za okrepitev prijateljskih odnosov in olajšanje potovanj med Republiko Slovenijo in Republiko Azerbajdžan
dogovorili:
1. ČLEN
V tem sporazumu:
Diplomatski potni list pomeni diplomatski potni list Republike Slovenije in diplomatski potni list Republike Azerbajdžan.
2. ČLEN
Državljani pogodbenic, ki so imetniki veljavnih diplomatskih potnih listov, in mladoletni družinski člani, ki so vpisani v njihove potne liste, lahko vstopijo na ozemlje druge pogodbenice in tam bivajo brez vizuma največ devetdeset (90) dni v obdobju šestih (6) mesecev od dneva prvega vstopa.
3. ČLEN
Ne glede na določbo 2. člena tega sporazuma lahko državljani pogodbenic, ki so imetniki diplomatskih potnih listov in so člani diplomatskega predstavništva ali konzulata ene pogodbenice na ozemlju druge pogodbenice, ter njihovi družinski člani, ki živijo z njimi v skupnem gospodinjstvu in so vpisani v njihove potne liste ali so imetniki diplomatskih potnih listov, neovirano in brez obveznosti pridobitve vizuma bivajo na ozemlju do izteka napotitve, če pri pristojnih organih na ozemlju druge pogodbenice izpolnijo formalnosti, povezane z bivanjem.
4. ČLEN
Imetniki veljavnih diplomatskih potnih listov ene pogodbenice lahko vstopijo na ozemlje druge pogodbenice na vseh mejnih prehodih za mednarodni potniški promet, če so izpolnjene potrebne formalnosti v skladu z veljavnimi predpisi pristojnih organov druge pogodbenice.
5. ČLEN
Ta sporazum ne odvezuje državljanov pogodbenic od spoštovanja zakonov in predpisov druge pogodbenice pri vstopu na njeno ozemlje in med bivanjem na tem ozemlju.
6. ČLEN
Pogodbenici si pridržujeta pravico, da zavrneta vstop ali odrečeta bivanje na svojem ozemlju državljanu druge pogodbenice, ki je imetnik veljavnega diplomatskega potnega lista in velja za nezaželeno osebo.
7. ČLEN
1. Ta sporazum ne vpliva na veljavne zakone in/ali predpise obeh držav s področja notranje varnosti ter vstopa, bivanja ali gibanja tujcev.
2. Pogodbenici lahko zaradi državne varnosti, javnega reda in miru ter javnega zdravja v celoti ali delno začasno ustavita izvajanje tega sporazuma. Pogodbenica po diplomatski poti takoj, vendar najpozneje v oseminštiridesetih (48) urah, obvesti drugo pogodbenico o uvedbi in umiku takih ukrepov. Ukrepi začnejo in prenehajo veljati na dan prejema uradnega obvestila.
8. ČLEN
1. Pogodbenici si po diplomatski poti izmenjata vzorce diplomatskih potnih listov v tridesetih (30) dneh pred začetkom veljavnosti tega sporazuma.
2. Ob uvedbi novih diplomatskih potnih listov pogodbenica po diplomatski poti drugi pogodbenici predloži nove vzorce in vse potrebne informacije, če je le mogoče v tridesetih (30) dneh pred uvedbo.
9. ČLEN
Dopolnitve in spremembe sporazuma se lahko sklenejo s soglasjem pogodbenic.
Dopolnitve in spremembe, ki so sestavni del tega sporazuma, se sklenejo kot posebni protokoli in začnejo veljati v skladu z določbami 10. člena tega sporazuma.
10. ČLEN
1. Ta sporazum začne veljati trideseti dan (30) od dneva prejema zadnjega pisnega uradnega obvestila, s katerima se pogodbenici obvestita, da so izpolnjene notranje pravne zahteve za začetek njegove veljavnosti.
2. Sporazum se sklene za nedoločen čas. Vsaka pogodbenica ga lahko kadar koli odpove s pisnim uradnim obvestilom drugi pogodbenici po diplomatski poti. Ob odpovedi sporazum velja še trideset (30) dni potem, ko druga pogodbenica prejme uradno obvestilo.
SESTAVLJENO v Bakuju dne 9. novembra 2009 v dveh izvirnikih, vsak v slovenskem, azerbajdžanskem in angleškem jeziku. Ob razlikah v razlagi in uporabi določb tega sporazuma prevlada angleško besedilo.

A g r e e m e n t
between the Government of the Republic of Slovenia and the Government of the Republic of Azerbaijan on the Abolition of Visa Requirements for Holders of Diplomatic Passports
The Government of the Republic of Slovenia and the Government of the Republic of Azerbaijan, hereinafter referred to as »the Contracting Parties«;
Desiring to strengthen their friendly relations and facilitate travel between the Republic of Slovenia and the Republic of Azerbaijan;
Have agreed as follows:
ARTICLE 1
For the purpose of this agreement:
“Diplomatic passport” refers to the diplomatic passport of the Republic of Slovenia and to the diplomatic passport of the Republic of Azerbaijan.
ARTICLE 2
Nationals of the Contracting Parties holding valid Diplomatic passports and under-age family members whose names reflected in their passports may enter the territory of the other Contracting Party and stay in it without a visa not more than ninety (90) days within six (6) months from the date of their first entry.
ARTICLE 3
Irrespective of the provision of Article 2 of this Agreement, nationals of the Contracting Parties holding Diplomatic passports and forming part of diplomatic missions and consulates of one of the Contracting Party based in the territory of the other Contracting Party, and their family members forming part of their household whose names reflected in their passports or holding Diplomatic passports may freely and without the obligation to acquire a visa stay in the territory until the end of their assignment subject to the completion of residence formalities at the competent authorities in the territory of the relevant Contracting Party.
ARTICLE 4
Holders of valid Diplomatic passports of the Contracting Parties may enter the territory of the other Contracting Party at all points of entry open to international passenger traffic provided that required formalities are met in accordance with applicable regulations of relevant authorities of the other Contracting Party.
ARTICLE 5
This Agreement does not exempt nationals of the Contracting Parties from their obligation to abide by the laws and regulations of the other Contracting Party when entering its territory and staying in it.
ARTICLE 6
Either Contracting Party shall reserve the right to deny the entry or to terminate the stay of any national of the other Contracting Party, holding valid diplomatic passports, considered as persona non grata.
ARTICLE 7
1. This Agreement does not affect the applicable laws and/or regulations of the two countries relating to internal security and the entry, stay or movement of foreigners.
2. Either Contracting Party may temporarily suspend the application of this Agreement wholly or partially for reasons of public order, national security or public health. Each Contracting Party shall immediately, but no later than forty eight (48) hours inform the other Contracting Party through diplomatic channels of the introduction and withdrawal of such measures. These measures shall enter into force or cease to apply on the date of receipt of a notification to that effect.
ARTICLE 8
1. The Contracting Parties shall exchange, through diplomatic channels, specimens of their diplomatic passports within thirty (30) days prior to the entry into force of this Agreement.
2. In the event of the introduction of new diplomatic passports, the Contracting Party concerned shall provide the other Contracting Party with the new specimens and necessary information through diplomatic channels thirty (30) days prior to the introduction, if possible.
ARTICLE 9
Any additions and amendments may be made to this Agreement by mutual consent of the Contracting Parties. Such additions and amendments being an integral part of this Agreement shall be made in the form of separate Protocols and shall enter into force in accordance with the provisions of Article 10 of this Agreement.
ARTICLE 10
1. This Agreement shall enter into force on the thirtieth (30(na th)) day from the date of receipt of the last written notification by which the Contracting Parties inform each other that the internal legal requirements for its entry into force have been fulfilled.
2. This Agreement shall remain in force for an indefinite period of time. Either Contracting Party may terminate it at any time by giving written notification to the other Contracting Party to that effect through diplomatic channels. The Agreement shall remain in force thirty (30) days after the receipt of the notification by the other Contracting Party.
DONE at Baku on 9 November 2009 in two originals, each in the Slovenian, Azerbaijani and English languages. In case of divergences in interpretation and application of the provisions of this Agreement, English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
