Razglašam Zakon o ratifikaciji Sporazuma o spremembi Sporazuma med Republiko Slovenijo in Češko republiko o podpori in zaščiti investicij in o njegovem prenehanju (BCZPZIA), ki ga je sprejel Državni zbor Republike Slovenije na seji 18. junija 2010.

O RATIFIKACIJI SPORAZUMA O SPREMEMBI SPORAZUMA MED REPUBLIKO SLOVENIJO IN ČEŠKO REPUBLIKO O PODPORI IN ZAŠČITI INVESTICIJ IN O NJEGOVEM PRENEHANJU (BCZPZIA)
1. člen
Ratificira se Sporazum o spremembi Sporazuma med Republiko Slovenijo in Češko republiko o podpori in zaščiti investicij in o njegovem prenehanju, sklenjen z izmenjavo not 8. julija 2009.

Sporazum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:

The Embassy of the Czech Republic in Ljubljana presents its compliments to the Ministry of Foreign Affairs of the Republic of Slovenia and, referring to the recommendations contained in the 2006 Annual Report to the ECOFIN Council and desiring to ensure that all investors from all Member States of the European Union are accorded equal treatment based on ED legislation, has the honour to convey to the esteemed Ministry the following:
The Czech side proposes that the Agreement between the Czech Republic and the Republic of Slovenia on the Promotion and Protection of Investments (Sporazum med Češko Republiko in Republiko Slovenijo 0 podpori in zaščiti investicij), signed on 4(na th) May 1993 in Prague, is hereby terminated. Moreover, the Czech side proposes that the provision of Article 13 paragraph 3 of the said Agreement shall not further apply.
On the understanding that the Slovenian side agrees with this proposal, the Czech side proposes that this Note and the reply Note of the Slovenian side constitute the Agreement between the Czech Republic and the Republic of Slovenia on the Amendments to the Agreement between the Czech Republic and the Republic of Slovenia on the Promotion and Protection of Investments, signed on 4(na th) May 1993 in Prague, and on Termination thereof.
This Agreement is subject to internal procedures on either side and the Czech Republic and the Republic of Slovenia shall notify each other about the completion of their respective internal legal procedures for the entry into force of this Agreement. This Agreement will enter into force on the 30th day following the date of the later of the two notifications.
The Embassy of the Czech Republic in Ljubljana avails itself of this opportunity to renew to the Ministry of Foreign Affairs of the Republic of Slovenia the assurances of its highest consideration.

The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Embassy of the Czech Republic and has the honour to confirm the receipt of the Embassy’s Note No. 4/2009 of 7 January 2009 stating the following:

The Slovenian side has the honour to confirm its full consent with the above mentioned so that the Czech note and this Note in reply constitute the Agreement between the Republic of Slovenia and the Czech Republic amending the Agreement between the Republic of Slovenia and the Czech Republic on the Promotion and Protection of Investments and on its Termination, which shall enter into force on the thirtieth day after the date of receipt of the later of the two notifications, with which the Parties inform each other of the completion of all internal legal requirements necessary for the entry into force of this Agreement.
The Ministry of Foreign Affairs of the Republic of Slovenia avails itself of this opportunity to renew to the Embassy of the Czech Republic the assurances of its highest consideration.

Veleposlaništvo Češke republike v Ljubljani izraža svoje spoštovanje Ministrstvu za zunanje zadeve Republike Slovenije in ima čast, sklicujoč se na priporočila, vsebovana v poročilu Sveta ECOFIN za leto 2006 ter v želji zagotoviti vlagateljem vseh držav članic Evropske unije enako obravnavo, temelječo na zakonodaji EU, sporočiti cenjenemu ministrstvu sledeče:
Češka stran predlaga, da Sporazum med Češko republiko in Republiko Slovenijo o podpori in zaščiti investicij, podpisan 4. maja 1993 v Pragi, s tem preneha veljati. Razen tega češka stran predlaga, da se določba tretjega odstavka 13. člena tega sporazuma ne uporablja več.
Če se slovenska stran strinja s tem predlogom, češka stran predlaga, da ta nota in nota – odgovor slovenske strani tvorita Sporazum med Češko republiko in Republiko Slovenijo o spremembi sporazuma med Češko republiko in Republiko Slovenijo o podpori in zaščiti investicij, podpisanega 4. maja 1993 v Pragi, in o njegovem prenehanju.
Ta sporazum je podvržen notranjim postopkom na obeh straneh ter se bosta Češka republika in Republika Slovenija obvestili o končanju njunih potrebnih notranjih pravnih postopkov za začetek veljavnosti tega sporazuma. Sporazum bo začel veljati 30. dan po datumu kasnejšega od uradnih obvestil.
Veleposlaništvo Češke republike v Ljubljani izkorišča tudi to priložnost, da Ministrstvu za zunanje zadeve Republike Slovenije ponovno izrazi svoje najgloblje spoštovanje.

Ministrstvo za zunanje zadeve Republike Slovenije izraža spoštovanje Veleposlaništvu Češke republike ter ima čast potrditi prejem note cenjenega veleposlaništva št. 4/2009 z dne 7. januarja 2009, ki se glasi kot sledi:

Slovenska stran ima čast potrditi svoje polno soglasje z zgoraj omenjenim, tako da češka nota in ta nota – odgovor tvorita Sporazum med Republiko Slovenijo in Češko republiko o spremembi sporazuma med Republiko Slovenijo in Češko republiko o podpori in zaščiti investicij in o njegovem prenehanju, ki začne veljati trideseti dan po datumu kasnejšega od uradnih obvestil, s katerima se pogodbenici obvestita o končanju njunih potrebnih notranjih pravnih postopkov za začetek veljavnosti tega sporazuma.
Ministrstvo za zunanje zadeve izkorišča tudi to priložnost, da Veleposlaništvu Češke republike ponovno izrazi svoje najgloblje spoštovanje.

Za izvajanje sporazuma skrbi Ministrstvo za gospodarstvo.
4. člen
Ta zakon začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
