Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08 in 108/09) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO DRŽAVE KUVAJT O GOSPODARSKEM IN TEHNIČNEM SODELOVANJU
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Države Kuvajt o gospodarskem in tehničnem sodelovanju, podpisan v Kuvajtu 11. januarja 2010.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi(1):
3. člen
Za izvajanje sporazuma skrbi ministrstvo, pristojno za zunanje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.

(1) Besedilo sporazuma v arabskem jeziku je na vpogled v Sektorju za mednarodno pravo Ministrstva za zunanje zadeve.
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VLADO DRŽAVE KUVAJT O GOSPODARSKEM IN TEHNIČNEM SODELOVANJU
Vlada Republike Slovenije in Vlada Države Kuvajt (v nadaljnjem besedilu "pogodbenici") sta se
ob priznavanju, da je gospodarsko in tehnično sodelovanje bistvenega pomena in nujno za razvoj trdnih in dolgotrajnih dvostranskih odnosov ter v obojestranskem interesu obeh pogodbenic in njunih narodov,
v prizadevanju za dosego stabilne gospodarske rasti, izboljšanja življenjskega standarda njunih državljanov ter učinkovite rabe njunih naravnih in človeških virov, in
v želji spodbujati in okrepiti dvostransko gospodarsko in tehnično sodelovanje v interesu njunih narodov,
ob upoštevanju njunih obveznosti, ki izhajajo iz članstva v Svetovni trgovinski organizaciji,
dogovorili:
1. člen
Pogodbenici z ustreznimi ukrepi spodbujata nadaljnji razvoj medsebojnega gospodarskega in tehničnega sodelovanja.
V tem sporazumu tehnično sodelovanje pomeni vzajemne programe izobraževanja ali usposabljanja ter izmenjavo svetovalcev ali uslužbencev s podobnimi nalogami z namenom krepitve gospodarskega sodelovanja med pogodbenicama.
Obe strani si prizadevata ustvarjati ugodne razmere za naložbe.
2. člen
Področja gospodarskega in tehničnega sodelovanja, ki jih zajema sporazum, vključujejo zlasti spodbujanje:
1. oblikovanja projektov med pogodbenicama na naslednjih področjih: gospodarstvu, financah, trgovini, bančništvu, industriji, kmetijstvu, infrastrukturi, storitvah, prometu, telekomunikacijah, varstvu okolja in turizmu,
2. izmenjave poslovnih in gospodarskih informacij, povezanih s tehničnim sodelovanjem,
3. izmenjave in usposabljanja strokovnjakov za konkretne programe tehničnega sodelovanja,
4. medsebojne pomoči pri organizaciji sejmov, razstav, simpozijev in podobnih prireditev v skladu z veljavno zakonodajo.
3. člen
Pogodbenici spodbujata izmenjavo obiskov svojih gospodarskih in tehničnih predstavnikov in delegacij ter organizacijo razstav za krepitev dvostranskega gospodarskega in tehničnega sodelovanja.
4. člen
Pogodbenici po potrebi skleneta posebne sporazume na področjih sodelovanja iz 2. člena in izvajata druge posebne projekte, o katerih se dogovorita.
5. člen
1. Ustanovi se skupni odbor za izvajanje tega sporazuma, ki ga sestavljajo predstavniki obeh pogodbenic.
2. Skupni odbor se sestane enkrat na leto ali pa na zahtevo ene od pogodbenic izmenično v prestolnicah obeh pogodbenic.
3. Skupnemu odboru na kuvajtski strani predseduje minister za finance Države Kuvajt, na slovenski pa minister, ki ga imenuje Vlada Republike Slovenije.
4. Skupni odbor je med drugim pristojen za obravnavo:
a) spodbujanja in usklajevanja gospodarskega in tehničnega sodelovanja med pogodbenicama,
b) predlogov za izvajanje tega sporazuma in sporazumov, ki iz njega izhajajo, in
c) priporočil za odpravo ovir, ki bi se lahko pojavile med izvajanjem katerega koli sporazuma in projekta, zasnovanega v skladu s tem sporazumom.
6. člen
Vsi spori med pogodbenicama, povezani z razlago ali izvajanjem tega sporazuma, se rešujejo prijateljsko s posvetovanji ali pogajanji.
7. člen
Ta sporazum ne vpliva na pravice in obveznosti pogodbenic iz drugih mednarodnih sporazumov, še zlasti članstva v Evropski uniji (EU), katere članica je Republika Slovenija, in članstva v Svetu za sodelovanje v Zalivu (SSZ), katerega članica je Država Kuvajt, in/ali njunega članstva v drugih mednarodnih organizacijah.
8. člen
1. Ta sporazum začne veljati na dan prejema zadnjega pisnega obvestila, s katerima se pogodbenici po diplomatski poti obvestita, da so izpolnjene njune ustavne zahteve za začetek veljavnosti tega sporazuma.
2. Ta sporazum se lahko spremeni ali dopolni s soglasjem obeh pogodbenic z izmenjavo diplomatskih not. Spremembe začnejo veljati v skladu s prvim odstavkom 8. člena.
3. Ta sporazum velja za obdobje petih (5) let in se samodejno podaljšuje za nadaljnja obdobja petih (5) let, razen če ena od pogodbenic najmanj šest (6) mesecev pred potekom pisno po diplomatski poti ne obvesti druge pogodbenice, da ga namerava odpovedati.
9. člen
Odpoved tega sporazuma ne vpliva na veljavnost ali trajanje posebnih dogovorov, projektov in dejavnosti sklenjenih po tem sporazumu, do izpolnitve takšnih posebnih sporazumov, projektov in dejavnosti.
V POTRDITEV TEGA sta podpisana, ki sta ju ustrezno pooblastili njuni vladi, podpisala ta sporazum.
Sestavljeno v Kuvajtu dne 11. januarja 2010, kar ustreza 25. muharamu 1431H, v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah v razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE STATE OF KUWAIT ON ECONOMIC AND TECHNICAL CO-OPERATION
The Government of the Republic of Slovenia and the Government of the State of Kuwait (hereinafter jointly referred to as the "Contracting Parties")
Recognizing that economic and technical co-operation is an essential and indispensable component for the development of bilateral relations on a firm, long-term basis, and of mutual interest to the two Contracting Parties and their respective people;
Being guided by the goals of ensuring a steady economic growth, improvement of standards of living of their citizens and effective utilization of their respective available natural and manpower resources; and
Desiring to promote and further strengthen their bilateral economic and technical co-operation in the interest of their people;
Taking into account their commitments by virtue of their membership in the World Trade Organization,
Have agreed on the following:
Article 1
The Contracting Parties shall promote, by taking proper measures, further development of economic and technical cooperation between them.
For the purpose of this Agreement technical cooperation means mutual education or training programs and exchange of consultants, advisers or similar personnel with a view to strengthen all spheres of economic cooperation between the Contracting Parties.
Both sides shall strive to create favourable investment conditions.
Article 2
The fields of economic and technical co-operation contemplated in this Agreement include in particular, but are not limited to, the encouragement of:
1. Establishment of projects in the following fields: economic, financial, commercial, banking, industrial, agricultural, infrastructure, services, transportation, telecommunication, environment protection and tourism between the Contracting Parties;
2. Exchange of business and economic information related to technical cooperation;
3. Exchange and training of specialists required for specific technical co-operation programmes;
4. Assisting each other in organizing fairs, exhibitions, symposiums and similar events according to applicable laws.
Article 3
The Contracting Parties shall encourage the exchange of visits by economic and technical representatives and delegations between them and the setting up of exhibitions for enhancing bilateral economic and technical co-operation.
Article 4
If deemed necessary, the Contracting Parties shall conclude specific Agreements concerning the fields of co-operation referred to in Article (2) and shall undertake other special projects that may be agreed upon between them.
Article 5
1. With a view to ensuring the implementation of this Agreement, a Joint Committee shall be established, composed of representatives from both Contracting Parties.
2. The Joint Committee shall meet annually or at the request of either Contracting Party alternately in the capitals of the Contracting Parties.
3. The Joint Committee shall be chaired for the Kuwaiti side by the Minister of Finance of the State of Kuwait, and for the Slovenian side by the Minister nominated by the Government of the Republic of Slovenia.
4. The Joint Committee shall have the authority, inter alia, to consider:
(a) Promoting and coordinating the economic and technical co-operation between the Contracting Parties;
(b) Proposals aimed at the implementation of this Agreement and those Agreements resulting therefrom; and
(c) Recommendations for the purposes of removing obstacles that may arise during the execution of any agreement and project that may be established in accordance with this Agreement.
Article 6
Any dispute between the Contracting Parties arising out of the interpretation or the implementation of this Agreement shall be settled amicably through consultations or negotiations.
Article 7
This Agreement shall not prejudice the rights and obligations of the Contracting Parties stemming from other international agreements, in particular membership in the European Union (EU) to which the Republic of Slovenia is a party, and membership in the Gulf Cooperation Council (GCC) to which the State of Kuwait is a party and/or out of their membership in other international organizations.
Article 8
1. This Agreement shall enter into force on the date of receipt of the last notification in which the Contracting Parties inform each other in writing through the diplomatic channels of the completion of the constitutional requirements necessary for the entry into force of this Agreement.
2. This Agreement may be amended or revised by mutual consent of the Contracting Parties through an exchange of Notes between the Contracting Parties through diplomatic channels. The amendments shall enter into force according to paragraph 1 Article 8.
3. This Agreement shall remain in force for a period of five (5) years and shall be automatically renewed for successive five (5) years periods, unless either Contracting Party notifies the other in writing through the diplomatic channels of its intention to terminate this Agreement at least six (6) months prior to its termination.
Article 9
The termination of this Agreement shall not affect the validity or the duration of any specific agreements, projects and activities made under this Agreement until the completion of such specific agreements, projects and activities.
IN WITNESS WHEREOF the undersigned, being duly authorized thereto by their respective Governments, have signed this Agreement.
Done in Kuwait on the 11(th) of January 2010 corresponding to the 25(th) of Moharram 1431H, in two original copies, in the Slovenian, Arabic and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.
