Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08 in 108/09) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VELIKO SOCIALISTIČNO LJUDSKO LIBIJSKO ARABSKO DŽAMAHIRIJO O ODPRAVI VIZUMSKE OBVEZNOSTI ZA IMETNIKE DIPLOMATSKIH IN SLUŽBENIH POTNIH LISTOV
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Veliko socialistično ljudsko libijsko arabsko džamahirijo o odpravi vizumske obveznosti za imetnike diplomatskih in službenih potnih listov, podpisan 5. julija 2010 na Brdu pri Kranju.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi:(1)
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VELIKO SOCIALISTIČNO LJUDSKO LIBIJSKO ARABSKO DŽAMAHIRIJO O ODPRAVI VIZUMSKE OBVEZNOSTI ZA IMETNIKE DIPLOMATSKIH IN SLUŽBENIH POTNIH LISTOV
Vlada Republike Slovenije in Velika socialistična ljudska libijska arabska džamahirija, v nadaljnjem besedilu: pogodbenici, sta se
– v želji po spodbujanju dvostranskih odnosov,
– ob zavzemanju za krepitev prijateljskih odnosov, tako da se poenostavi potovanje državljanov ene pogodbenice v drugo pogodbenico,
dogovorili:
1. člen
Državljani ene od pogodbenic, imetniki veljavnih diplomatskih in službenih potnih listov, ki niso akreditirani na ozemlju druge pogodbenice, so oproščeni vizumske obveznosti za vstop na ozemlje, tranzit in bivanje na ozemlju ter izstop z ozemlja druge pogodbenice do treh (3) mesecev v šestih (6) mesecih pri enem ali več obiskih od dneva prvega vstopa na ozemlje Velike socialistične ljudske libijske arabske džamahirije ali na schengensko območje.
2. člen
Po tem sporazumu člani diplomatskih predstavništev in konzulatov ter mednarodnih organizacij na ozemlju druge pogodbenice in njihovi družinski člani, imetniki diplomatskih in službenih potnih listov, niso oproščeni vizumske obveznosti za akreditacijo pri državi gostiteljici.
Te osebe lahko po akreditaciji v času svojega mandata brez vizuma vstopajo v državo gostiteljico, potujejo čez njeno ozemlje v tranzitu, v njej bivajo ali iz nje izstopajo.
3. člen
Državljani ene od pogodbenic, imetniki diplomatskih ali službenih potnih listov, navedeni v 1. členu in v drugem odstavku 2. člena tega sporazuma, lahko vstopijo na ozemlje druge pogodbenice ali ga zapustijo na katerem koli mednarodnem mejnem prehodu.
4. člen
Po tem sporazumu državljani katere koli od pogodbenic, imetniki diplomatskih ali službenih potnih listov iz 1. člena in drugega odstavka 2. člena, niso oproščeni obveznosti, da spoštujejo zakonodajo pogodbenice sprejemnice.
5. člen
Ta sporazum ne vpliva na pravico pristojnih organov obeh pogodbenic, da zavrnejo vstop ali bivanje na ozemlju pogodbenice sprejemnice osebam, ki veljajo za nezaželene.
Pogodbenici se obvezujeta, da bosta brez formalnosti nemudoma prevzeli svoje državljane, ki ne izpolnjujejo ali več ne izpolnjujejo pogojev za vstop in bivanje na ozemlju druge pogodbenice.
6. člen
Vsaka pogodbenica si pridržuje pravico, da zaradi nacionalne varnosti ali javnega reda v celoti ali delno začasno prekine izvajanje tega sporazuma.
O začasni prekinitvi izvajanja tega sporazuma se druga pogodbenica uradno obvesti po diplomatski poti najmanj 72 ur pred začetkom izvajanja takega ukrepa.
Začasna prekinitev izvajanja tega sporazuma ne vpliva na pravice državljanov, navedenih v 1. členu in v drugem odstavku 2. člena tega sporazuma, ki so že na ozemlju pogodbenice gostiteljice.
7. člen
Pogodbenici si po diplomatski poti izmenjata vzorce diplomatskih in službenih potnih listov vsaj trideset (30) dni pred začetkom veljavnosti tega sporazuma.
Ob uvedbi novih diplomatskih ali službenih potnih listov ali spremembi obstoječih si pogodbenici izmenjata vzorce takih potnih listov najmanj trideset (30) dni pred uvedbo novih potnih listov ali sprememb.
8. člen
Ta sporazum se lahko s soglasjem obeh pogodbenic spremeni s protokoli ali izmenjavo diplomatskih not, ki so sestavni del tega sporazuma.
9. člen
Morebitne razlike ali nesoglasja pri razlagi določb tega sporazuma pogodbenici v prijateljskem duhu rešujeta po diplomatski poti s posvetovanji ali pogajanji.
10. člen
Ta sporazum začne veljati trideseti dan po prejemu zadnjega od obeh pisnih uradnih obvestil po diplomatski poti, s katerima se pogodbenici obvestita, da so končani notranjepravni postopki, potrebni za začetek njegove veljavnosti.
Sporazum se sklene za nedoločen čas in velja še tri (3) mesece od prejema pisnega uradnega obvestila druge pogodbenice po diplomatski poti, da odpoveduje sporazum.
Sestavljeno na Brdu pri Kranju 5. julija 2010 v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Pri različni razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GREAT SOCIALIST PEOPLE’S LIBYAN ARAB JAMAHIRIYA ON THE ABOLITION OF VISA REQUIREMENTS FOR HOLDERS OF DIPLOMATIC AND SERVICE PASSPORTS
The Government of the Republic of Slovenia and the Great Socialist People's Libyan Arab Jamahiriya, hereinafter referred to as “the Parties”,
– Desirous of promoting bilateral relations;
– Considering the efforts to strengthen friendly relations by facilitating travel of nationals of one Party to the other;
have agreed as follows:
Article 1
Nationals of one Party who are holders of valid diplomatic and service passports and are not accredited to the territory of the other Party shall be exempt from visa requirement for entry into, exit from, transit through and stay on the territory of the other Party for a period not exceeding three (3) months (in a single or more periods) within six (6) months of the date of first entry on the territory of the Great Socialist People's Libyan Arab Jamahiriya and in the Schengen Area, respectively.
Article 2
Under the present Agreement, members of diplomatic missions, consular posts and international organisations based on the territory of the other Party and their family members, holders of diplomatic and service passports, are not exempt from visa requirement for accreditation to the host country.
Following the accreditation, the persons referred to above shall be able to enter into, exit from and transit through the territory of the host country or stay in it without a visa during their term of office.
Article 3
Nationals of either Party, holders of diplomatic or service passports, referred to in Article 1 and Article 2, Paragraph 2 of the present Agreement may enter or depart from the territory of the other Party at any international border crossing point.
Article 4
The present Agreement shall not exempt nationals of either Party, holders of diplomatic or service passports, referred to in Article 1 and Article 2, Paragraph 2, from their obligations to abide by the laws of the receiving Party.
Article 5
The present Agreement shall not affect the right of the competent authorities of either Party to deny entry or stay in the territory of the receiving Party to persons considered as persona non grata.
The Parties engage to readmit, forthwith and without any formalities, their respective nationals who do not, or no longer meet, the requirements for entry and stay on the territory of the other Party.
Article 6
Either Party shall reserve the right to temporarily, in whole or in part, suspend the implementation of the present Agreement for reasons of national security or public order.
The other Party shall be notified of temporary suspension of the present Agreement through diplomatic channels at least 72 hours prior to the introduction of such a measure.
Temporary suspension of the present Agreement does not affect the rights of nationals referred to in Article 1 and Article 2, Paragraph 2 of the present Agreement who are already on the territory of the host Party.
Article 7
The Parties shall exchange specimens of diplomatic or service passports through diplomatic channels at least thirty (30) days prior to the entry into force of the present Agreement.
Upon the introduction of new diplomatic or service passports or modification of the existing passports, the Parties shall exchange specimens of such passports at least thirty (30) days prior to the introduction of new passports or modifications.
Article 8
The present Agreement shall be amended by consent of both Parties by protocols or an exchange of diplomatic notes that are considered integral parts of the present Agreement.
Article 9
Any difference or disagreement in the interpretation of the provisions of the present Agreement shall be settled through diplomatic channels by consultation or negotiation between the Parties in a friendly spirit.
Article 10
The present Agreement shall enter into force on the thirtieth day following the date of receipt of the second written notification through diplomatic channels by which the Parties inform each other that all internal legal procedures required for the entry into force of the present Agreement have been fulfilled.
This Agreement is concluded for an indefinite period of time and shall remain in force for three (3) months after the date of receipt of a written notification of one Party through diplomatic channels informing the other Party of its intention to terminate this Agreement.
Done at Brdo pri Kranju on 5 July 2010 in two originals, each in the Slovenian, Arabic and English languages, all texts being equally authentic. In case of any divergence of interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi Ministrstvo za zunanje zadeve.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
