Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08 in 108/09) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VELIKO SOCIALISTIČNO LJUDSKO LIBIJSKO ARABSKO DŽAMAHIRIJO O GOSPODARSKEM SODELOVANJU
1. člen
Ratificira se Sporazum med Vlado Republike Slovenije in Veliko Socialistično ljudsko libijsko arabsko džamahirijo o gospodarskem sodelovanju, podpisan v Ljubljani 6. maja 2010.
2. člen
Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi(*):
S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN VELIKO SOCIALISTIČNO LJUDSKO LIBIJSKO ARABSKO DŽAMAHIRIJO O GOSPODARSKEM SODELOVANJU
Vlada Republike Slovenije in Velika socialistična ljudska libijska arabska džamahirija (v nadaljevanju pogodbenici),
– potrjujeta prijateljske odnose med svojima državama in njunimi prebivalci;
– želita pospešiti razvoj medsebojnega gospodarskega sodelovanja na področjih obojestranskega interesa na podlagi enakopravnosti, obojestranske koristi in vzajemnosti;
– upoštevata vzajemno korist, ki izhaja iz povečanega trgovanja in želje po nadaljnji krepitvi teh odnosov, zlasti s pospeševanjem dvostranske trgovine, gospodarskih vezi in tesnejšega sodelovanja; in
– upoštevata zaveze svojih držav, ki izhajajo iz mednarodnih sporazumov,
sta se dogovorili o naslednjem:
1. člen
Pogodbenici si v okviru svojih zakonov in predpisov in ob upoštevanju svojih mednarodnih obveznosti ter sporazumov kar najbolj prizadevata za razvoj in krepitev gospodarskega sodelovanja na čim širši podlagi in na vseh področjih, za katere menita, da so v njunem obojestranskem interesu in v njuno obojestransko korist.
2. člen
Pogodbenici si prizadevata za ustvarjanje ugodnih razmer za krepitev gospodarskega sodelovanja, zlasti s tem da:
– olajšujeta in podpirata izmenjavo in stike med svojimi gospodarskimi subjekti,
– ustvarjata ugodno ozračje za naložbe,
– olajšujeta izmenjavo poslovnih in gospodarskih informacij,
– si pomagata pri organizaciji sejmov, razstav, simpozijev in podobno,
– olajšujeta izmenjavo informacij o zakonodaji o gospodarski dejavnosti v obeh državah,
– razširjata njuno sodelovanje na področju malih in srednje velikih podjetij, investicij itd.,
– spodbujata medsebojno menjavo blaga in storitev in dolgoročno sodelovanje na področjih kot so industrija, infrastruktura, telekomunikacije, prevoz, varstvo okolja in turizem.
3. člen
S tem namenom pogodbenici ustanovita Slovensko-libijsko skupno komisijo, ki obravnava področja v okviru tega sporazuma ter:
– opredeli področja za razširitev sodelovanja med pogodbenicama, predlaga ukrepe in daje priporočila za njihovo uresničevanje;
– pripravlja predloge za izboljšanje sodelovanja med gospodarskimi subjekti obeh držav;
– izmenjuje informacije o gospodarski situaciji obeh držav, predpisih, gospodarskih programih ter druge informacije vzajemnega interesa;
– ugotavlja težave, ki ovirajo dvostransko trgovinsko in gospodarsko sodelovanje ter priporoča ukrepe za njihovo rešitev.
4. člen
1. Komisijo sestavljajo predstavniki pogodbenic, po potrebi pa se k sodelovanju lahko povabi tudi predstavnike drugih ustanov zasebnega ali javnega sektorja.
2. Pogodbenici se dogovorita o poslovniku skupne komisije na njenem prvem zasedanju.
5. člen
1. Komisija se sestaja praviloma enkrat letno oziroma po potrebi, na zahtevo ene ali druge pogodbenice.
2. Pogodbenici uskladita datum zasedanja in dnevni red skupne komisije medsebojno.
3. O zasedanju komisije pogodbenica gostiteljica vodi zapisnik, ki ga ob koncu zasedanja podpišeta vodji obeh delegacij.
6. člen
Ta sporazum ne vpliva na obveznosti, ki izhajajo iz članstva Republike Slovenije v Evropski uniji ali sporazumov med Veliko socialistično ljudsko libijsko arabsko džamahirijo in Evropsko unijo.
7. člen
1. Ta sporazum začne veljati trideseti dan po dnevu prejema zadnjega uradnega obvestila, s katerima se pogodbenici obvestita o dokončanju notranjepravnih postopkov, potrebnih za uveljavitev sporazuma.
2. Ta sporazum se sklene za tri leta, nato se samodejno podaljšuje za nadaljnja enoletna obdobja, razen če katerakoli pogodbenica šest mesecev pred njegovim potekom druge pisno uradno ne obvesti o svoji nameri, da ga odpoveduje.
3. Sporazum lahko pogodbenici soglasno pisno spremenita.
Sestavljeno v Ljubljani 6. maja 2010, kar ustreza 6. maju 1378, v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob različni razlagi prevlada angleško besedilo.

A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GREAT SOCIALIST PEOPLE'S LIBYAN ARAB JAMAHIRIYA ON ECONOMIC COOPERATION
The Government of the Republic of Slovenia and the Great Socialist People’s Libyan Arab Jamahiriya (hereinafter referred to as "the Contracting Parties"),
– Confirming friendly relations between their states and their inhabitants,
– Desiring to promote the development of economic cooperation in the fields of mutual interest on the basis of equality, mutual benefit and reciprocity,
– Considering the mutual benefit arising from increased trade and the desire to further strengthen these relations, especially through the promotion of bilateral trade, economic ties and closer cooperation, and
– Considering the obligations of their states under international agreements,
Have agreed as follows:
Article 1
The Contracting Parties, within the framework of their laws and regulations and considering their international obligations and agreements, shall make their best efforts to develop and strengthen economic cooperation on the widest possible scale and in all fields deemed to be of their mutual interest and benefit.
Article 2
The Contracting Parties shall strive to create favourable conditions to strengthen economic cooperation, especially by:
– facilitating and supporting exchange and contacts between their economic operators,
– creating favourable investment conditions,
– facilitating the exchange of business and economic information,
– assisting each other with the organisation of fairs, exhibitions, symposiums and similar,
– facilitating the exchange of information on laws and regulations on the economic activities in both countries,
– expanding their co-operation in the field of small and medium size enterprises, investments, etc.,
– promoting trade in goods and services, and long-term cooperation in the fields of industry, infrastructure, telecommunications, transport, environment protection and tourism.
Article 3
To this end, the Contracting Parties hereby establish a Slovenian-Libyan Joint Commission which shall deal with the fields covered by this Agreement and
– identify fields to which cooperation between the Contracting Parties may be extended, propose measures and make recommendations for their implementation,
– prepare proposals for improving the co-operation between economic operators of the two countries,
– exchange information on the economic situation in the two states, on regulations, economic programmes and other information of mutual interest,
– identify problems which hinder bilateral trade and economic cooperation, and propose measures for resolving these problems.
Article 4
1. The Joint Commission shall be composed of representatives of the Contracting Parties and, where necessary, representatives of other public or private sector institutions may also be invited to participate.
2. The Contracting Parties shall agree upon the Rules of Procedure of the Joint Commission at its first meeting.
Article 5
1. The Joint Commission shall meet once a year or when necessary at the request of either of the Contracting Parties.
2. The dates of meetings and the agenda of the Joint Commission shall be agreed by both Contracting Parties.
3. The host Contracting Party shall take minutes of the meeting of the Joint Commission, which shall be signed by the heads of both delegations at the end of the meeting.
Article 6
This Agreement shall apply without prejudice to the obligations arising from the membership of the Republic of Slovenia of the European Union or the agreements between the Great Socialist People’s Libyan Arab Jamahiriya and the European Union.
Article 7
1. This Agreement shall enter into force on the thirtieth day after the date of receipt of the last notification that all internal legal procedures for the entry into force of the Agreement have been concluded.
2. This Agreement shall be concluded for a period of three years and shall be automatically extended for successive one-year periods unless either Contracting Party submits a written notification to the other of its intention to terminate the Agreement six months prior to its expiry.
3. The Agreement may be amended by mutual written consent of the Contracting Parties.
Done in Ljubljana on 6 May 2010, corresponding to 6 May 1378, in two original copies, in the Slovenian, Arabic and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.

3. člen
Za izvajanje sporazuma skrbi ministrstvo, pristojno za gospodarsko diplomacijo.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
