Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO, 76/08, 108/09 in 80/10 – ZUTD) izdaja Vlada Republike Slovenije

O RATIFIKACIJI MEMORANDUMA O SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN MEDNARODNIM CENTROM ZA PROMOCIJO PODJETIJ
1. člen
Ratificira se Memorandum o sodelovanju med Vlado Republike Slovenije in Mednarodnim centrom za promocijo podjetij, podpisan 7. septembra 2011 v Ljubljani.
2. člen
Besedilo memoranduma se v izvirniku v slovenskem in angleškem jeziku glasi:
MEMORANDUM O SODELOVANJU
med Vlado Republike Slovenije in Mednarodnim centrom za promocijo podjetij
Vlada Republike Slovenije in Mednarodni center za promocijo podjetij (v nadaljevanju podpisnici) sta se:
v želji po okrepitvi sodelovanja med Republiko Slovenijo in Mednarodnim centrom za promocijo podjetij (v nadaljevanju ICPE),
upoštevajoč, da je Republika Slovenija država gostiteljica in država članica ICPE ter interes ICPE za sodelovanje in povečanje svojih aktivnosti in prispevek k napredku javnega podjetništva in razvoju držav članic ICPE kot tudi k internacionalizaciji in diverzifikaciji slovenskega gospodarstva in visokošolskega izobraževanja ter turističnih potencialov,

1. ČLEN
NAMEN
Zaradi povečanja sodelovanja med Republiko Slovenijo in ICPE sta se podpisnici dogovorili, da skleneta Memorandum o sodelovanju med Republiko Slovenijo in Mednarodnim centrom za promocijo podjetij (v nadaljevanju Memorandum), s katerim opredeljujeta temeljna področja sodelovanja, kjer obstaja obojestranski interes pri izvajanju posameznih programov in projektov (Skupni akcijski načrti, v nadaljevanju SANi). Pri delovanju se upošteva strateški načrt Sveta ICPE.
ICPE sodeluje s posameznimi zainteresiranimi vladnimi resorji in službami, še zlasti pristojnimi za visoko šolstvo, znanost in tehnologijo, gospodarstvo, finance, javno upravo, zunanje zadeve, okolje in prostor, kmetijstvo, gozdarstvo in prehrano, zdravje ter razvoj in evropske zadeve.
2. ČLEN
IZVAJANJE SKUPNIH AKCIJSKIH NAČRTOV PROGRAMOV IN PROJEKTOV
Podpisnici sodelujeta pri izvajanju skupnih akcijskih načrtov posameznih programov in projektov na naslednjih področjih:
– mednarodni podiplomski izobraževalni programi,
– predstavitev in izmenjava dobrih praks in dosežkov na področjih dela ministrstva, pristojnega za javno upravo za državne uslužbence držav članic ICPE,
– pomoč strokovnjakov slovenskih vladnih institucij državam članicam ICPE,
– seminarji o gospodarski diplomaciji za države članice ICPE,
– upravljanje zelene industrije v regiji in Evropi,
– upravljanje znanja o podjetništvu z namenom promocije slovenskih tehnoloških in znanstvenih dosežkov za države članice ICPE,
– mednarodna razvojna pomoč in razvojno sodelovanje v državah članicah ICPE,
– mednarodna razvojna pomoč v sodelovanju z UNIDO,
– sodelovanje z mednarodnimi in medvladnimi organizacijami,
– sodelovanje v projektih in dogodkih OECD,
– sodelovanje na področju zadev EU,
– pomoč slovenskim podjetjem in kasneje podjetjem iz drugih držav članic ICPE pri prijavljanju na razpise za izvedbo razvojnih projektov, dobavo blaga ali storitev mednarodnih finančnih institucij (projekt Procurement Assistance Center),
– priprava predlogov projektov v sodelovanju s Slovensko izvozno in razvojno banko (SID banko), ki bi bili financirani v okviru »Western Balkans Investment Framework«,
– internacionalizacija slovenskega gospodarstva, s poudarkom na povečanju gospodarskega sodelovanja z državami članicami ICPE in krepitvi sodelovanja podjetij na področju razvoja,
– spodbujanje vhodnih in izhodnih neposrednih tujih investicij v države članice ICPE in iz njih, s poudarkom na investicijah v projekte z razvojno dimenzijo,
– promocija in razvoj slovenskega vhodnega turizma iz držav članic ICPE, s poudarkom na trajnostnem turizmu,
– sodelovanje pri reševanju mednarodnih okoljskih vprašanj,
– druga področja sodelovanja, ki so v skladu z interesi in potrebami podpisnic.
3. ČLEN
IZVAJANJE MEMORANDUMA
Podpisnici se dogovorita, da se po začetku veljavnosti Memoranduma sklenejo akcijski načrti izvedbenih ukrepov oziroma projektov, o katerih se bodo dogovorili posamezni vladni resorji in službe. Skupni akcijski načrti se ustrezno finančno in kadrovsko ovrednotijo ter pripravijo v skladu z metodologijo EU.
Izvajanje skupnih akcijskih načrtov je odvisno od finančnih zmožnosti posameznih vladnih resorjev in služb ter razpoložljivih človeških virov. Pri tem se upošteva tudi strateški načrt Sveta ICPE.
Skupni akcijski načrti so ustrezna podlaga za to, da bi dejavnosti morebiti sofinancirali posamezni vladni resorji in službe.
Za spremljanje izvajanja Memoranduma Vlada Republike Slovenije ustanovi Medresorsko delovno skupino, v kateri se usklajujejo tudi skupni akcijski načrti iz prvega odstavka tega člena. Na sestanke Medresorske delovne skupine se lahko povabi tudi predstavnik ICPE.
4. ČLEN
FINANČNE DOLOČBE
O morebitnih kadrovskih in finančnih obveznostih se podpisnici dogovorita ob vsakokratni sklenitvi posameznih akcijskih načrtov. V okviru sklenjenih akcijskih načrtov si podpisnici prizadevata za učinkovito izvedbo skupnih projektov.
5. ČLEN
ZAČETEK IN PRENEHANJE VELJAVNOSTI
Memorandum začne veljati na dan prejema pisnega uradnega obvestila, s katerim Republika Slovenija uradno obvesti ICPE, da so na slovenski strani izpolnjene vse notranje pravne zahteve za začetek njegove veljavnosti.
Memorandum je sklenjen za nedoločen čas. Vsaka podpisnica ga lahko odpove s pisnim uradnim obvestilom drugi podpisnici. Odpoved začne veljati šest mesecev po prejemu takega uradnega obvestila.
Memorandum se lahko spremeni s pisnim soglasjem obeh podpisnic. Take spremembe začnejo veljati v skladu z določbo prvega odstavka tega člena in so sestavni del tega Memoranduma.
Prenehanje veljavnosti tega Memoranduma ne spremeni pravic, ki sta jih podpisnici pridobili pred dnevom prenehanja veljavnosti. Določbe Memoranduma se uporabljajo še po prenehanju njegove veljavnosti za vse skupne dejavnosti sodelovanja, ki še potekajo.
Sestavljeno v Ljubljani, 7. septembra 2011 v dveh izvirnikih v slovenskem in angleškem jeziku, pri čemer sta besedili enako verodostojni.

MEMORANDUM OF COOPERATION
between the Government of the Republic of Slovenia and the International Center for Promotion of Enterprises
The Government of the Republic of Slovenia and the International Center for Promotion of Enterprises (hereinafter referred to as the “Signatories”),
Wishing to strengthen cooperation between the Republic of Slovenia and the International Center for Promotion of Enterprises (hereinafter referred to as the “ICPE”),
Considering that the Republic of Slovenia is the host country and a Member State of the ICPE, and taking account of the ICPE’s interest in cooperation, expanding its activities and contributing to the advancement of public sector entrepreneurship and to the development in ICPE Member States, as well as to the internationalisation and diversification of Slovenia’s economy, higher education and tourism opportunities,
Have agreed as follows:
ARTICLE 1
PURPOSE
To enhance cooperation between the Republic of Slovenia and the ICPE, the Signatories have agreed to conclude this Memorandum of Cooperation between the Government of the Republic of Slovenia and the International Center for Promotion of Enterprises (hereinafter referred to as the “Memorandum”) which identifies the key areas of cooperation in which the implementation of programmes and projects (Joint Action Plans) is of interest to both sides. All activities are undertaken by taking account of the Strategic Plan of the ICPE Council.
The ICPE cooperates with relevant ministries, agencies and government offices, particularly those responsible for higher education, science and technology; the economy; finance; public administration; foreign affairs; the environment and spatial planning; agriculture, forestry and food; health; and development and European affairs.
ARTICLE 2
IMPLEMENTATION OF JOINT ACTION PLANS FOR PROGRAMMES AND PROJECTS
The Signatories cooperate in implementing Joint Action Plans for the programmes and projects covering the following areas:
– International post-graduate courses;
– Presentation and exchange of good practices and achievements in the fields covered by the ministry responsible for public administration for civil servants of ICPE Member States;
– Assistance to ICPE Member States by the experts of Slovenian government institutions;
– Economic diplomacy seminars for ICPE Member States;
– Management of green industry in the region and Europe;
– Management of entrepreneurial knowledge with a view to enabling the promotion of Slovenia’s technological and scientific achievements aimed at ICPE Member States;
– International development assistance and development cooperation in ICPE Member States;
– International development assistance in cooperation with UNIDO;
– Cooperation with international and intergovernmental organisations;
– Participation in OECD projects and events;
– Cooperation in EU affairs;
– Assistance to Slovenian companies and, subsequently, to companies from other ICPE Member States in participating in calls for proposals for the implementation of development projects and tenders for the supply of goods or services of international financial institutions (Procurement Assistance Center Project);
– In cooperation with the SID bank (Slovenian export and development bank), the preparation of proposals for projects which would be financed within the Western Balkans Investment Framework;
– Internationalisation of the Slovenian economy, particularly enhancement of economic cooperation with ICPE Member States;
– Promotion of inward and outward foreign direct investment in or by ICPE Member States, with an emphasis on investment in projects with a development dimension;
– Promotion and enhancement of Slovenia’s inbound tourism from ICPE Member States with focus on sustainable tourism;
– Participation in resolving global environmental issues; and
– Other areas of cooperation which are relevant to the interests and needs of the Signatories.
ARTICLE 3
IMPLEMENTATION OF THE MEMORANDUM
The Signatories agree that after the Memorandum becomes effective, action plans agreed at the level of ministries, agencies and government offices will be concluded for implementing measures or projects. Joint Action Plans are evaluated in terms of the necessary funds and human resources, and drafted in accordance with EU methodology.
The implementation of Joint Action Plans depends on the availability of funds of ministries, agencies and government offices and their human resources. The activities defined in the Joint Action Plans take account of the Strategic Plan of the ICPE Council.
Joint Action Plans provide a suitable basis for any potential co-funding of activities by ministries, agencies and government offices.
The Government of the Republic of Slovenia establishes an Inter-ministerial Working Group tasked with monitoring the implementation of the Memorandum, as well as harmonising Joint Action Plans under paragraph 1 of this Article. An ICPE representative may also be invited to attend the meetings of the Inter-ministerial Working Group.
ARTICLE 4
FINANCIAL PROVISIONS
Any obligations relating to human resources and finances are agreed by the Signatories upon every conclusion of a Joint Action Plan. The Signatories strive for the effective implementation of joint projects in the framework of the concluded Joint Action Plans.
ARTICLE 5
EFFECTIVE DATE AND TERMINATION
The Memorandum becomes effective on the date of receipt by the ICPE of a written notification of the Republic of Slovenia informing that all internal legal requirements have been fulfilled by the Slovenian side for its entry into force.
The Memorandum is in effect until any of the Signatories withdraw from the Memorandum by giving written notice of termination of the Memorandum to the other Signatory. The termination becomes effective six months after receipt of such notification.
The Memorandum may be amended with the written consent of both Signatories. Such amendments become effective in accordance with the provision of paragraph 1 of this Article, and constitute an integral part of the Memorandum.
The termination of the Memorandum does not affect the rights of the Signatories acquired prior to the date of termination. For the purpose of completing all forms of cooperation that are still underway, the provisions of the Memorandum remain effective even after the termination of the Memorandum.

Za izvajanje sporazuma skrbi Ministrstvo za visoko šolstvo, znanost in tehnologijo Republike Slovenije.
4. člen
Ta uredba začne veljati naslednji dan po objavi v Uradnem listu Republike Slovenije – Mednarodne pogodbe.
